It’s the end of another year! This year has been quite the year for our industry. I would like the thank all of the SDRCA Board Members and particularly James Robyn, for all the efforts put forward this year to maintain the mission of the SDRCA.

Thanks are also in store for all the contractors, manu-facturers, and distributors that not only participate in our association, but find the time and resources to help with the SDRCA’s Build-A-Roof program. These projects would not be possible without your contributions and hard efforts.

I do not know what it is like in other industries, but the roofing industry in San Diego is a pleasure to work in, especially with the contractor members of the SDRCA. The contractors have a healthy competitive spirit and are striving to provide the best quality of work and products. The San Diego Roofing Contractors' Association (SDRCA) has been serving the Roofing Industry for over forty years.

Times, techniques and technology has changed, but the SDRCA Core Values, Code of Ethics, Mission and Vision Statement has not. The 2014 Board of Di-rector Team is committed and dedicated to serving our members and this associa-tion with new education, resources, training and savings for the purpose of helping our members continue a tradition of profitability and professionalism in our industry. It is the intent of this Association to establish and maintain professional standards and prac-tices in the Roofing Industry through education and public awareness. Our members are com-mitted to excellence and they use the benefits offered by the Association to help obtain this goal. The SDRCA encourages you to become fully aware of the potential problems of dealing with an unli-censed, uninsured roofer.

The SDRCA was formed in 1957 to preserve and promote the art of roofing application. SDRCA members recognize that after 52 years of innovation in roofing technology and Application, the fol-lowing goals are as meaningful and relevant today as they were yesterday and will be tomorrow.

The SDRCA remains a strong supporter of open competition and the free enterprise system; indeed, this competitive environment led to the success of its members. SDRCA members recognize that the perpetuation of such a healthy business environment is greatly influenced by their own professional conduct. Annual Dinner Meeting Recap

The Annual Dinner Meeting held on Wednesday, November 11th at the Lomas Santa Fe Country Club consisted of 25 members of the SDRCA. The turnout was a bit less than last year and perhaps we picked the wrong date as the 11th was Veteran’s Day.

Along with an update on the Association, Director elections were held. We had four can-didates running for the Board of Directors, Dennis Parra II, Randy Swank, Gary Gilmore, and JP McEvenue. All candidates were elected and below is the listing of the 2016 Board of Directors. Our thanks to Dave Britton (APOC) who sat on the Board from 2013-2015.

Requirements For Home Improvement Salespersons By Kenneth S. Grossbart: Abdulaziz, Grossbart & Rudman

 As many of you know, salespersons are required to be registered with the Contractors' State License Board. If you are a contractor that uses salespersons to assist in obtaining customers, your salespersons must be registered with the CSLB. Failure to register puts the salesperson in the position of being charged with a misdemeanor. It also puts the con-tractor in a position of being in violation of the Licensing Law, which could subject the con-tractor to Citation and perhaps even Accusation.

Until recently, the law was such that any salesperson that sells for any company, must reg-ister themselves each time that they act as a salesperson for each separate com-pany. This became problematic, particularly with the fact that it could sometimes take weeks if not months for a salesperson to be properly registered to act as a salesperson for any given construction company.

Business and Professions Code section 7153 currently states in part that anyone who solic-its, sells, negotiates, executes home improvement contracts for a licensed contractor, out-side of the contractors normal place of business must be registered with the CSLB as a Home Improvement Salesperson (HIS).

Governor Brown recently signed SB 561 (Monning) into law, which simplifies the proc-ess. The new law, which takes effect January 1, 2016, eliminates the requirements that a salesperson register with each particular contractor that he/she is acting as a salesperson for. The salesperson will register once (every two years) and the contractor can then elec-tronically notify the CSLB the salesperson is working for it.

The new law is a terrific win for contractors and salespersons. Effective January 1, 2016, all that is required is a single registration. In addition to the single registration provision, SB 561 will:

1. The CSLB will require the HIS to have a current and valid registration filed with the CSLB before making sales calls on behalf of contractors;

2. Require a contractor to notify the CSLB when they hire a registered HIS and also when that employment ceases;

3. The CSLB will accept applications electronically (including signatures) from the HIS ap-plicant;

Registration will be valid for two years from the month of issue.

As mentioned, the passage of SB 561 is good for not only sales representatives, but the contractors themselves.

FALL PROTECTION Tops OSHA’s Annual Most-Cited Violations List: OSHA’s Fall Protection Standard (1926.501) is once again the agency’s most frequently cited for violations. 2015 marks the fifth year in a row that the Fall Protection Standard tops the annual list. Patrick Kapust, Deputy Director of OSHA’s Enforcement Programs, stated that “Fall protection systems are out there and are moderately priced, so there’s no reason that your employees shouldn’t be in them.” The preliminary list covering the fiscal year 2015 include at least 3 of the top 10 hazards that are common to the construction and roofing trades as follows: 1. Fall Protection (1926.501) 2. Hazard Communication (1910.1200) 3. Scaffolding (1926.451) 4. Respiratory Protection (1910.134) 5. Lockout/Tagout (1910.147) 6. Powered Industrial Trucks (1910.178) 7. Ladders (1926.1053) 8. Electrical – Wiring Methods (1910.305) 9. Machine Guarding (1910.212) 10. Electrical – General Requirements (1910.303)

OSHA Under Obama: What We Can Expect During The Final Year: One year from now a new U.S. president will be preparing to take office. A new leader in the Oval Office could mean a different direction for OSHA. Before that happens, however, OSHA under President Obamas’ administration has many items left on its agenda, including rules on silica dust, record keeping and combustible dust – probably too many for the agency to address in just over 13 months. Although a new administration could continue OSHA’s current agenda, it’s not guaranteed, especially if we see the election of a Republican. So with limited time and resources, here is what we might expect in the remaining months of the Obama presidency:

SILICA – A final rule on silica most likely will be issued before Obama leaves office, as it is clearly

now the agency’s top rule making priority. This is rule making that OSHA feels could make the greatest impact in the time they have left. OSHA has been publicly working on updating its silica rule for more than a decade and issued a proposed regulation two years ago. Despite strong opposition from some industry and employer groups, as well as many members of Congress, the rule is expected within the next year or so, with room for debate as to whether it is released before, during or after the 2016 presidential election.

RECORDKEEPING – An updated rule from OSHA now requires employers to report on the job

and work-related deaths in a timelier manner, as well as report more hospitalizations and all amputations. Two other rules could be issued in the next 12-15 months; one would require many employers to regularly submit their injury and illness records, which would then be made available to the public; the other rule clarifies that recording an injury is an “ongoing obligation,” and would provide the agency an avenue to work around a court ruling barring OSHA from citing an employer past a six-month statute of limitations.

WALKING / WORKING SURFACES – OSHA’s rule to address slip, trip and fall hazards is one of

the furthest along in the rulemaking process – it has been in the works for the past 25 years. Although a final rule was expected in August, it was still under the OMB agency review at this time. Regardless, many in both the construction industry and safety community regard the rule as one that OSHA could easily issue, possibly before the end of 2015.
