CHAPTER 343 - ENVIRONMENTAL ASSESSMENT:

In accordance with Hawaii Administrative Rule Section 11-200-8 and the Exemption Listfor the Department of Land and Natural Resources concurred with by the EnvironmentalCouncil and dated June 5, 2015, the subject request is exempt from the preparation of anenvironmental assessment pursuant to Exemption Class No. 1, Item 51. See Exhibit D.

REMARKS:

Hawaii Beach Volleyball Association (HBVA) is requesting a right-of-entry permit for aDinosaur Beach Volleyball Tournament. The tournament is scheduled for March 17-19,2017 from 8:00 am to 5:00 pm. Set-up will be at 7:00 am and break down by 6:00 pm.

At its meeting of January 27, 2017, Item D-l, a request for the same event but by adifferent applicant, Keauhou Volleyball Association (KVA), was deferred as BoardMember Keith “Keoni” Downing had the following unanswered questions relating to therequest:

1. Is the applicant (KVA) confirmed as a qualified 501(c )(3) non-profit organization?2. What is the breakdown of the $120 fee collected from each participating team?

KVA is not a qualified 501(c )(3) non-profit organization. However, HBVA as the newapplicant for the event is confirmed as a 501(c)(3), non-profit. (Exhibit B)

The breakdown of the fees collected is indicated on Exhibit C.

The event is open to the public, with no admission being charged. Although a $120 entryfee per team is being charged as Board Member Downing noted, HBVA explains the feeis being used to defray the cost of holding the event. Since the expenses to run this eventwill exceed the anticipated entry fees collected, there will be no profits realized for thistournament. HBVA states that no tents or spectator seating will be placed on thebeach/State land by events coordinators. The tents and chairs will be placed on theMarriott Hotel grounds.

Applicant has not had a lease, permit, easement or other disposition of State landsterminated within the past five years due to non-compliance with such terms andconditions.

The proposed activity is of a similar type and scope of beach activities that routinely hasoccurred and continues be held on this and other beaches across the State. Such activitieshave resulted in no known significant impacts, whether immediate or cumulative, to thenatural, environment andlor cultural resources in the area. As such staff believes that theproposed event would involve negligible or no expansion or change in use of the subjectarea beyond that previously existing.

On November 30, 2016 various government agencies and interest groups were solicitedfor comments.

RECOMMENDATION: That the Board

1. Declare that, after considering the potential effects of the proposed disposition asprovided by Chapter 343, HRS, and Chapter 11-200, HAR, this project willprobably have minimal or no significant effect on the environment and istherefore exempt from the preparation of an environmental assessment.

2. Authorize the issuance of a right-of-entry permit to Hawaii Beach Volleyball
