Current Connections A Newsletter For Members

December 2017

Business Manager’s Repor t

Dear Brothers and Sisters:

I want to wish everyone the best for the up-

coming Christmas holiday and the new year. I

would like to remind everyone that throughout

the shopping season, please support local

businesses and buy American and union-

made.

We had the annual Old Newsboys paper drive

on December 1 which the Building Trades

participates in and supports every year. If you

didn’t have a chance to throw money in the

bucket, please consider making a donation.

Local 8 has always been a huge supporter of

the Old Newsboys.

The election is over and we feel very good

about the outcome. Some notable races are:

Toledo Mayor Wade Kapszukiewicz. We

are excited about working with Wade on

the future of Toledo.

Toledo City Council - Gary Johnson and

Nick Komives are new to the city council

and we look forward to working with

them.

Toledo Municipal Court Judges - Joe

Howe and Nichole Khoury.

Thank you to everyone who took the time to

exercise their right to vote and who volun-

teered their time to help our candidates.

Area high schools are starting to show an

interest in having the building trades address

their students on the skilled trades and the

fact that college isn't for everyone. Students

need to know the benefits that the building

trades has to offer with our apprenticeship

programs and a great career. This includes

one on one with the students, no student loan

debt, health care, pension and good wages.

In the past, we had this big push for students

to go to college and now, due to the high

number of members retiring, we are experi-

encing a shortage of skilled tradesmen.

It was agreed, with lots of discussion, to move

forward with revamping foremanship training

classes at the JATC. Due to retirement and

the upcoming work picture in the next few

years, foremen will be needed. I encourage

all journeymen to attend these classes. Clas-

ses will also be offered to apprentices on a

voluntary basis; fourth and fifth year Inside

apprentices, 3rd and 4th year Residential

apprentices, and 3rd year VDV apprentices.

Health & Welfare

At the last Trustees’ meeting, we agreed to

change our dental provider from Dentemax to

Delta Dental, effective January 2018. This will

create a savings for all our members and our

plan. With Delta Dental, they will take over the

claims processing as we currently do that in-

house. We have been assured that we will

have access to the Delta Dental claim system

to assist in any customer service inquires.

Delta Dental will be the primary point of cus-

tomer service and we will have the ability to

assist if there are any issues.

Work Picture

It was announced recently that Leipsic

Steel will build a 4th steel plant and the

electrical work was awarded to Lake Erie

and MJ Electric. This will be a Code of

Excellence job. Most of our members

have the training but we will have clas-

ses gearing up for those of you who will

need the training.

The Cleveland Cliffs steel project in Tole-

do was approved to be worked under the

National Maintenance Agreement.

Motor City Electric was awarded site

lighting at the Monroe Power Plant.

Brint Electric was awarded power and

lighting at Guardian Glass.

McDonald’s in Swanton was awarded to

Northwest Electric

NW Windfarm in Paulding County -

White Construction is the General with

MJ Electric awarded the electrical (42

wind turbines).

Toledo Refinery will have their shutdown

beginning February 28, 2018.

I would like to remind everyone to renew their

Toledo electrical license, Ohio fire alarm li-

cense and Michigan State electrical license.

The requirements for the Ohio fire alarm have

changed. Now you need to renew by the expi-

ration date or you will have to re-test.

At this time, you can renew the City of Toledo

license in person or online. We understand

the frustration with the City of Toledo’s renew-

al process and we will work with the city and

our members to remedy the problem. Up-

dates will be posted on our website at

PPO VS NPPO

In-network (PPO = Preferred Provider Organiza-tion) Health insurers negotiate fees and sign agreements with health care providers and facilities that are then considered in network for members. Generally speaking, members pay less at these in-network facilities in the form of lower copayments and de-ductibles. Out-of-network (NPPO = Non Preferred Provider Organization) If providers do not have an agreement with an insur-

er, then they are considered out of network. Mem-

bers who wish to visit an out-of-network provider or

facility do not have the advantage of a negotiated

lower rate. Because of this, services may be more

expensive.

Hello. I am nervous, because there are … let’s call them rumblings of a potential strike. I am struggling right now with my personal financ-es, and so I am just writing to ask whether I can get unemployment benefits during a strike. I am the longest-term employee at our plant and have no discipline in the last six years. Will that make a differ-ence? -Not The Best Time

Dear Not The Best Time,

I am sorry to hear of your struggles. We have all been there! Keep calm, and do not give up. As to your ques-tion, unfortunately, your excellent his-tory with the company is not going to influence whether you would receive unemployment benefits during a strike. Ohio law is pretty clear that laborers on strike have “caused” their own unemployment under the law, and therefore they are not entitled to unemployment compensation, even though workers like yourself may be ready and willing to work. Part of the reasoning is that the granting of unem-ployment benefits would prolong the negotiation process between your union and the company, and would do so at great expense to the unemploy-ment funds. Potentially, I could give you a different answer if the situation were that of a lockout or if you were merely terminated. Also, if the em-ployer “Severed” the labor dispute by legitimately replacing you with perma-nent workers during the strike and notified you of such, my answer might change. Barring any of the above, though, you may be out of luck as far as unemployment goes for the days you are not working if your union votes to strike at your facility. Hopefully, however, the strike would provide you with better pay or benefits if the union can use the strike as leverage towards a better deal, which may help with your situation.

I was fired a few weeks ago, and just found out today that I was de-nied unemployment. I did not file a grievance or anything about the termination or the disciplines lead-ing up to it, but, without getting into any of the details, I would like to appeal the unemployment decision. What are my chances? -Determined J.

Dear Determined J.,

More information would be appreciat-ed in order to better answer your question. When you refer to the deci-sion, are you referring to Director’s Determination from your first claim for unemployment benefits, or one from a later stage? Assuming you would like to appeal the initial determination, you are free and entitled to do so. Typical-ly, this involves submitting to the ODJFS a brief statement of your intent to appeal (instructions on how to do so should have been included with the initial determination). If you have any documents that may help your case, be sure to include them with your ap-peal. Keep in mind that the ODJFS is QUITE strict about deadlines. You will have 21 days to appeal (not even a minute more) – it would be wise to mark the specific deadline listed in the Notice of Determination on your calen-dar, for this reason. The same goes for the second appeal. Upon a sec-ond appeal, you will then be entitled to a telephonic hearing on the matter. Think of this as a mini-trial conducted over the phone! You will even be in-structed in your notice of the telephon-ic conference on how to subpoena witnesses or evidence (such as per-haps previous evaluations or disci-plines, etc.). Obtaining a lawyer may be helpful here. However, be fore-warned that unemployment determina-tions are not overturned terribly often. Because you did not provide many facts as to your employment history or termination, feel free to call us if you need assistance with your appeal/s.

The rules and regulations regarding rights in the workplace can be complex and con-fusing. Each situation is different and re-quires a fact intensive review to determine whether an employee’s rights are being violated.
