    THE CONSTITUTION AND BY-LAWS OF THE

    COLLEGIATE STUDENT BODY ORGANIZATION

    Preamble

    We, the legitimate members of the Collegiate

    Student Body Organization of Central Luzon StateUniversity, imploring the aid of Almighty God toform and establish a just and benevolent studentorganization that shall embody our ideas andgenuine interest, promote general welfare andcommon good with utmost responsibility, integrity,truth, loyalty, justice, peace, and equality, do herebyordain and promulgate this constitution.

    Article INAME AND ADDRESS

    SECTION 1. This organization shall be known asthe Central Luzon State University CollegiateStudent Body Organization herein referred to as theCSBO.

    Section 2. The CLSU-CSBO shall have its office atCentral Luzon State University, Muoz, NuevaEcija.

    Article IIMEMBERSHIP

    Section 1. All bona fide CLSU Collegiate Studentsincluding those who are taking up special coursesof at least one year are ipso facto members of the

    CSBO of CLSU.

    Section 2. Membership to the organization shallcease upon the students completion of hiscollegiate studies, or upon failure to enroll in theuniversity, or for any valid reasons to be determinedby the University Supreme Student Council.

    Section 3. Every member shall individual and incooperation with his fellow members discharge hisduties and responsibilities in connection with theduly adopted decisions, projects and activities ofthe CSBO.

    Article IIIOBJECTIVES

    The following are the objectives of the CSBO.

    Section 1. To promote the rights, general welfareand interest of the CLSU studentry.

    Section 2. To develop social and moral awareness,responsibility, intellectual and political developmentof students, and undertake activities towards this

    cause.

    Section 3. To provide representation andparticipation in the policy-making bodies in theuniversity which directly or indirectly affect theinterests of the students.

    Section 4. To develop a closer relationshipbetween the CLSU constituents and the UniversitySupreme Student Council (USSC) officers.

    Article IVRIGHTS AND PRIVILEGES

    Section 1. Rights. Every member shall have thefollowing rights:

    a. To vote and be voted upon, provided thatthe qualities stated on Article VII, Section10, paragraphs a to e are complied with;

    b. To be informed of the activities of theUSSC, its financial status, budgetary plansof each activity and detailed outcome of thesame;

    c. To give his suggestion/comments/ideas/opinions concerning the affairs of USSCand the organization;

    d. To seek assistance from the USSC and the

    CSBO;e. To call for or participate in any assembly

    called for a purpose;f. To defend himself from any accusations;

    andg. To initiate disciplinary measures against

    any USSC officer in accordance with theprovisions of Article XII of this Constitution.

    Section 2. No member shall be twice put injeopardy of punishment for the same offense (Art.III, Sec. 21, 1987 Constitution of the Philippines)

    Section 3. Every authorized member shall have thechance to represent the CLSU studentry in anyoccasion whenever representation is needed.

    Article VDUTIES AND RESPONSIBILITIES

    Section 1. Every member of the CSBO shall havethe following duties and responsibilities:

    a. To uphold the Constitution and By-Laws ofthe CSBO;

    b. To be aware and responsible for thecontent of the CLSU Student Code ofDiscipline and CLSU-CSBO Constitutionand By-Laws;

    c. To avoid and/or prevent any violations ofthe CLSU Student Code of Discipline;

    d. To participate in the USSC activitieswhenever participation is necessary;

    e. To send and support their respectivedelegate to the Congress of the CampusLeaders (CCL); and

    f. To pay the semestral CSBO fee.

    Article VITHE CONGRESS OF CAMPUS LEADERS

    Section 1. The Congress of Campus Leaders(CCL) shall be the highest policy-making body ofthe CSBO.

    Section 2. The CLSU-CCL shall be composed of allelected Class Presidents (All CFY and other yearlevel sections), College Council Presidents, and allOSA recognized SOs. These Presidents shallenjoy the right to exercise the functions of everyCCL member for the duration of their term. Thisposition is transferably only in cases of disability(which will inhibit his or her from exercising his/herfunction), resignation, removal from office, droppingof course or failure to re-enroll. However, anyreplacement for the said position must bedetermined through ascendancy of officialsuccessors (e.g. Vice Presidents) or through anelection called upon by the class or the StudentOrganization to fill the said position.

    Section 3. The CCL shall convene regularly at leasttwice a year. The first regular session shall becalled by the USSC Chairperson within thirty (30)days after taking their oath of office. The secondregular session will be called for thirty days beforethe final examination of the second semester.Special sessions may be called by the USSCChairperson or by at least one-third of therecognized members of the CCL to decide uponmatters, which are of immediate concern to the

    members.Section 4. The CCL shall be deemed in quorumonce all members are in attendance are recognizedby the presiding officer. A vote of 50% of allmembers in attendance plus one (1) shall constitutea majority decision.

    Section 5. The CCL shall elect a speaker by amajority vote of all its members in attendance who

    shall preside over all proceedings and shall ceaseto the same following the end of that particularsession of the congress.

    Section 6. The CCL shall determine its rule ofproceedings punish its members for disorderlybehavior and with the concurrence of all it smembers in attendance, suspend, or expel a

    member.

    Section 7. The congress shall keep a journal of itsproceedings, and from time to time, may publish thesame.

    Section 8. The Congress, being the highest policymaking body of the CSBO shall among others:

    a. Approve or amend the General Program ofAction of the newly elected USSC includingrules, regulations, budgetaryappropriations, and guidelines formulatedfor the CSBO;

    b. Serve as the avenue for the exercising ofthe rights and privileges as well as dutiesand responsibilities of the CSBO membersas embodied in this constitution; and

    c. As a body, propose and approve actions onany relevant matters that affect the rightsand welfare of the CSBO members.

    Section 9. All decisions of the CCL shall bedeemed final and binding to all members of theCSBO Constitution, vetoed by the Chairperson, oris overturned by another session of the CCL calledfor a purpose.

    Section 10. Special Working Committees may beformed by the CCL provided:

    a. That such shall have a specific function andtime frame for its existence;

    b. That the said committee shall be composedof legitimate CCL members; and

    c. That said committee shall not serve parallelfunctions, nor shall duplicate any functionthat is being served by the USSC or any ofits Constitutional Committees.

    Article VIITHE UNIVERSITY SUPREME STUDENT

    COUNCIL

    Section 1. The government of the CLSU-CSBOshall be vested to the University Supreme StudentCouncil herein after referred to as the USSC. Itshall be composed of the Chairperson, ViceChairperson, Secretary, Treasurer, Auditor, andCouncilors (one from each college).

    Section 2. The USSC shall be the highestexecutive body of the CLSU-CSBO. It shallconduct business during the regular or specialsession attended by a majority of the members.Towards this end, it shall:

    a. Formulate rules and regulations, guidelinesc0oncerning the provisions in the conductof affairs of the USSC consistent with this

    constitution and by-laws, university rulesand regulations, including the UniversityCode of Conduct and Discipline, DECSOrders, CHED rulings, Letters ofInstructions, Presidential Decrees, Lawsand other legal orders and decisions of theCCL;

    b. Make decisions, plans, programs, andprojects including budgetary appropriationof the CSBO;

    c. Appoint any replacements to vacantposition(s) in the USSC;

    d. Decide disciplinary measures against any

    erring officers of the USSC;e. Act on any relevant matter brought to itsattention including resolutions fromwhatever source, office or institutions andrecommendations from CCL; and

    f. Have transitory policy-making power inbetween sessions of the CCL.

    Section 3. The members of the USSC in exercisingand discharging their collective responsibilities asthe highest executive body of the CLSU-CSBOshall be jointly and severely liable for theconsequences of their acts.

    Section 4. The USSC officers shall hold office forthe period of one school year including thesucceeding summer until their successors shallhave been elected and induced into office. TheUniversity Supreme Student Council shall holdoffice only for the unserved.

    Section 5. Members appointed as replacements toany vacant position of the term and/or of his serviceis still necessary.

    Section 6. Duties of officers.1. The Chairperson shall be a chief executive

    of the USSC and shall among others;a. Convene and preside over all

    meetings of the USSC.b. Convene the CCL;c. Sign all resolutions,

    communications and papers of theUSSC and CCL, veto any decree,proposal, resolution, etc. by theCCL when necessary;

    d. Represent the CLSU-CSBO on alloccasions where the CSBO needsrepresentation in general theuniversity academic andadministrative council and in theBoard of Regents;

    e. Present a report of the status of theUSSC to the CCL when necessary;

    f. Sign all requisitions anddisbursement of the CSBO fund;

    g. Create and/or dissolve committeeswhenever necessary except theconstitutional committees inconsultation with the members ofthe council;

    h. Certify the correctness of theminutes of the meetings and otherrecords in his custody;

    i. Do and perform any lawful act topromote/ uphold the best interest ofthe CSBO; and

    j. To appoint a property custodianamong elected officers.

    2. The Vice Chairpersons shall assumepowers and functions of the President inthe absence or incapacity of the latter andshall among others:

    a. Supervise and monitor directly theactivities of the constitutionalcommittees.

    b. Present the performance report ofthe USSC officers upon request;and

    c. Perform other duties/ functions asChairperson may assign.

    3. The Secretary shall keep all the records ofthe University Supreme Student Council.He/ She shall:

    a. Keep all the minutes of meetingsand proceedings of the USSC.

    b. Receive and file all papers/correspondence of the USSC;

    c. Prepare ad furnish the USSCofficers with the agenda of themeetings at least one day prior tothe schedule meetings.

    d. Make the performance report of theUSSC officers; and

    e. Perform other duties/ functions asmaybe assigned by the President.

    4. The Treasurer shall be the chief financeand budget officer of the USSC. He/Sheshall:

    a. Collect and disburse the funds ofthe USSC in accordance with theduty approved procedures;

    b. Keep all the financial records of theUSSC;

    c. Prepare and present to the CCL theBudgetary Plan of the USSC thirty(30) days after its assumption to

    the office and its financial status 30days before the final term exam onthe second semester; and

    d. Issue receipts for the collectionsand sign all vouchers/checks forthe disbursement of USSC funds.

    5. The Auditor shall:a. Check and certify the correctness

    of all financial statements andassess the progress of the financialactivities of each College Counciland USSC;

    b. Certify the availability of funds;c. Recommend to the USSC thenecessary measures that willensure the sufficient allocation,procurement and utilization offunds/ resources including those forthe prevention of irregular,unnecessary, excessive orextravagant uses of the CSBOfunds and properties.

    6. The Councilors shall:a. Assist in formulation and

    implementation of program, plansand activities of the USSC;

    b. Compose the constitutional ad hoccommittees; and

    c. Perform other functions and dutiesthat may be assigned by theChairperson.

    Section 7. In case of disability (which will inhibit aperson from performing his/her duties), resignation,removal of the office, of the Chairperson and ViceChairperson, the councilors shall elect areplacement among themselves shall then act asthe Chairperson, until a new Chairperson/Vice

    Chairperson shall be elected.

    Section 8. In case of disability, resignation, removalof the Secretary, Treasurer and Auditor, theincumbent councilors shall elect among themselvesthe successors of the aforementioned officer/s.

    Section 9. In case of vacancy among thecouncilors, the USSC shall require the concernedcollege council to fill the said positions.

    Section 10. Qualifications of the elective officers:The candidates for the CSBO Officers shall

    have the following qualifications:a. A bona fide college student of CLSU;

    b. Not in the warning list, and does nothave a grade of 5.0 or more than oneincomplete grade during theimmediately preceding semester ascertified by the University Registrar.Summer classes will be considered asthe immediately preceding semester ifthe candidate was enrolled during theimmediately preceding summer;

    c. Not enrolled and shall not enroll inpractice of teaching or apprenticeshipduring the school year;

    d. Not holding any major position in the

    USSC, any organization (includingcollege councils) or any editorial staffposition in the CLSU Collegian; and

    e. Should present a certificate of goodmoral character signed by the Dean ofStudents, head of the Security Force,and respective College Dean.

    Section 11. Meetings.a. The USSC shall meet in regular session at

    least once a week.b. Special meetings shall be called by the

    USSC Chairperson if he deems necessaryand two-thirds (2/3) of the officers may callfor a meeting even if the USSCChairperson opposes.

    c. A simple majority (50%+1) of the membersof the USSC shall constitute a quorum.

    Article VIIICONSTITUTIONAL COMMITTEES

    Section 1. The Committee on StudentOrganization, Domiciliary and Education shallperform the following:

    a. Initiate and implement a university-wideprogram or activity in line with the general

    program of the USSC;b. Work under the SOU officer regarding SO

    matters; andc. Undertake the liaison task of the USSC

    Chairperson to the Office of the StudentAffairs, of the Office f the Vice President forthe Academic Affairs and related services.

    Section 2. The Committee on Evaluation ofComplaints and Grievances shall perform judicialfunction as:

    a. Have direct communications with the VicePresident for Administration;

    b. Evaluate student problems, complaints, andgrievances; have direct access to a legalcounsel; and

    c. Recommend appropriate legal action in thesolution of student problems to the USSCafter due investigation and observance ofdue process.

    Section 3. The Committee in Education, Culture,and Sports.

    a. Education - shall promote the improvementof the system of education by lawful means;

    b. Culture - shall promote cultural awarenessinside and outside the university;

    c. Sports - shall promote the physicalawareness and develop sportsmanship.

    Article IXADVISER

    Section 1. There shall be an adviser of theCLSU_CSBO who shall be elected by the USSCmembers among the qualifying full time faculty andstaff members of CLSU. The name of the electedadviser shall be submitted to the Office of the VicePresident for Academic Affairs or related offices forreference purpose.

    Section 2. The Adviser shall:a. Represent the interest of the USC in any

    forum or body within and outside theUniversity in accordance with the officers ofthe USSC.

    b. Countersign all disbursement, checks, andpapers of the USSC.

    Section 3. The tenure o f the Adviser of the USC isone school year (two semester) including until suchtime that the student government elect one fromthose recommended advisers.

    Section 4. In case of resignation, incapability,incompetence or leave of absence, the USSC shallappoint a new Adviser for the unserved period.

    Section 5. Outgoing USSC officers who are stillmembers of the CLSU-CSBO are entitled to be the

    junior adviser for the first semester. They shall actas consultant and help the transition period.

    Article XELECTIONS

    Section 1. The annual election of the officers of theUSSC should not be later than the last day of thefifth week after the opening of classes during thefirst semester of the school year. The campaignperiod should start one week before the scheduled

    election and shall cease at twelve midnight of theday immediately preceding the election.

    Section 2. All bona fide college students and thosewho are taking up special courses at least one yearin CLSU shall constitute the electorate.

    Section 3. The election for the major positions(Chairperson, Vice-Chairperson, Secretary,Treasurer, and Auditor) shall be conducted on aUniversity-wide basis.

    Section 4. The Councilor shall be elected by their

    respective colleges simultaneously with the electionin the major position.

    Section 5. The vice President for Academic Affairsor related office shall create the University ElectoralBoard (UEB) which shall be composed of tenmembers- one faculty member who will be thechairman, eight non-partisan students representingeach college with recommendation of the dean andone Collegian staffer without voting power in thedecision making.

    Section 6. Functions of the UEB:A. The functions of the UEB are the following:

    A1. Receive and investigate the legality andapprove the candidacy of eachaspirant;

    A2. Enforce and administer all rules andguidelines concerning the conduct ofthe annual election of the USSCconsistent with the Constitution and By-laws and as mandated by the CCL;

    A3. The Board should set a limit on theamount to be used during thecampaign, each party should submit aprojected schedule of the expenses;

    A4. Supervise and monitor the election of

    the members of the USSC;A5. Canvass election returns from the

    Colleges; andA6. Announce the result of the election

    within three (3) days after the day ofelection unless there are some mattersto be resolved in connection therewith.

    B. Specific duties.

    B1. Chairmana. The chief executive of the board;

    andb. In case of a tie of votes in decision-

    making, he will be the tie breaker.

    B2. Eight (8) Student Representativesa. Responsible of the gathering of all

    facts related to the elections; andb. Decide among themselves any

    possible problems that will ariseduring the duration of the electionand come up with precautionarymeasures.

    B3. Collegian Staffera. Responsible for the information

    dissemination and press release.

    Section 7. A plurality of votes of the members ofthe CSBO shall elect officers. In case of tie, aspecial election for the position in question shall be

    called within three (3) days after the declaration of atie.

    Section 8. All problems/ complaints that arisebefore the election should be resolved prior to theelection. Election protests may be filed to theChairman of the UEB within two (2) daysimmediately after the election with witnesses andsupporting documents indicating the grounds for theprotest.

    Section 9. The UEB shall decide whether theprotest shall be given due course. Otherwise, thereason shall be furnished to the protester.

    Article XIFUNDS

    Section 1. The CSBO funds shall come from thestudent organizations fee paid by the members,fund raising campaigns and solicitations conductedby the USSC.

    Section 2. All funds collected within the consent andauthority of the USSC shall be considered part ofthe general fund of the CSBO.

    Section 3. The student Organization fee shall becollected by the USSC Officers and shall be turnedover to the Treasurer of the USSC (amount shall bechecked from the official receipt and the totalenrollees.

    Section 4. All money collected shall be deposited inthe Land Bank of the Philippines at CLSU, In

    circumstance of closure, the USSC can transfer itsdeposit to any bank as agreed upon by the body.

    Section 5. Funds can be withdrawn from the bankthrough resolution approved by the body. Thesignatories of which are the Chairperson,Treasurer, auditor and the USS C Adviser.

    Section 6. The CLSU-CSBO funds shall be auditedby the Auditor of the University or any CertifiedPublic Accountant at the end of the every semester.

    Section 7. All appropriations/ disbursement of theCSBO funds shall be approved by the USSC.

    Section 8. The financial statement, together with thenecessary supporting documents shall be open toall of the students and the administration forinspection anytime during office hours.

    Article XIIDISCIPLINARY MEASURES

    Section 1. Any USSC Officer may be removed fromoffice based on grounds stated in this article,Section 3, paragraph a to e upon two-third votesthrough a secret balloting of the USSC officerspresent provided there is a quorum.

    Section 2. Any USSC officer may be suspended forany violation in the House Rules with theconcurrence of two-thirds (2/3) vote, through secretballoting of all officers present in the meeting calledfor a purpose, provided there is a quorum.However, the penalty of suspension when imposedwill not exceed thirty (30) days.

    The Chairperson may be sanctioned under thissame provision if he/ she fails to convene anyregular session of the CCL without any validreason.

    Section 3. Any USSC officer may be removed/impeached for any of the following grounds:

    a. Willful violation of the CSBO Constitutionand By-Laws;

    b. Neglect of duty;c. Inefficiency and inconsistency in

    performance of his duties;d. Violation of existing Code of Conduct and

    Discipline;e. Juggling and malversation funds;

    Section 4. Any officer violating any provision of thepreceding shall be subjected to investigation andobservance of due process.

    Section 5. The Chairperson o f the USSC with theapproval of the body shall create a specialcommittee that will investigate any violation of theConstitution and By-laws by the officer of theUSSC.

    Section 6. The result of the investigation shall bepresented to the body within the presence of the

    officer concerned to be heard and to defend himselfif so decided.

    After he had been found guilty, the decision forremoval from office will take effect immediately afterpromulgation thereof in a meeting called for apurpose.

    Section 7. The decision of the USSC shall be finaland a copy of the decision will be furnished to theoffice of the Vice President for Academic Affairs orrelated office and the unit concerned a week afterthe promulgation of the decision.

    Article XIIISEPARABILITY CLAUSE

    Section 1. Any part of the Constitution and By-Laws inconsistent with the provision of theFundamental Law of the Land, PresidentialDecrees, Executive Orders, Letters of Instruction,DECS Orders, CHED Memos, and other Laws ofthe Land, shall be inoperative, however, theremaining part which is not affected thereby shallbe in full force and effect.

    Article XIVTRANSITORY PROVISION

    Section 1. All incumbent officer of the CLSU-CSBOshall continue in office until they finish the tem orbecome incapacitated to discharge the duties oftheir offices or are removed for a cause.

    Section 2. All incumbent officers of the CSBO shallcontinue to perform their duties and responsibilitiesas provided for by the Article VII, Section 6, andparagraph 1 to 7.

    Section 3. All properties, records, supplies,facilities, equipment and other assets of the USSCunder custody of the incumbent officers shall betransferred to the succeeding officers.

    Article XVBY-LAWS

    Section 1. These By-laws shall be officiallypromulgated in English and shall be translated inFilipino. However, in case of misinterpretation and/or misconception English translation shall prevail.

    Section 2. The members of the USSC shall supportany massive action to the best of the students.

    Section 3. The CLSU-CSBO shall have its ownseal and its official emblem.

    Section 4. The members of the USSC shall havedirect participation in any decision-making or anypolicy making body of the University in mattersaffecting the studentry.Section 5. The members of the USSC shall havethe right to call for dialogue with the:

    a. CLSU Administration and/ or related officesand constituents;

    b. Student Organization and College Councils;and

    c. CLSU College Students and other concerned parties.

    Article XVIAMENDMENTS

    Section 1. Any amendments to, or revision of thisConstitution and BY Laws may be proposed by:

    a. CCL or USSC, Upon majority voters of allits members; or

    b. A constitutional convention.

    Section 2. Amendments to this Constitution andBy-Laws may likewise be directly proposed by thestudentry through the initiative upon petition of atleast ten percent (10%) of the total number of theCLSU-CSBO.

    Section 3. No amendments under this section shallbe authorized within four years following itsratification of this Constitution nor earlier than fouryears thereafter.

    Section 4. The USSC may call by a vote of tw0-thirds (2/3) of all of it s members, a constitutionalc9onvention, or by majority of votes of all its

    member, submit to the electorate the question ofcalling such a convention.

    Section 5. Any amendment to, or revision to thisConstitution and By-laws shall be valid upon itsratification by a majority of CSBO votes cast inplebiscite called for a purpose and shall take effectupon approval of such amendments.

    Article XVIIEFFECTIVITY

    Section 1. This Constitution and By-Laws shall takeeffect immediately upon its ratification by a majorityof the votes cast in a plebiscite held for a purposeand shall supersede all previous constitutions.
