The Group policy is underwritten by SterlingInsurance Company Limited (except whereotherwise stated).

With Group, you choose the cover yourequire to match the insurance needs of yourgroup. This document summarises the coverprovided by the Group policy and should beread carefully before you make your selectionand complete the proposal form.

The Policy Summary does not contain the fullterms and conditions, which can be found inthe policy document. A full policy documentis available free of charge from MortonMichel.

Public Liability

If you or your group is held legally responsiblefor an injury to a child or third party, or fordamage to a third party’s property then youwill be required to pay damages. PublicLiability covers these damages and anyresulting legal expenses up to the limit ofindemnity.

Limit of Indemnity

£1,000,000 any one cause (higher limitsavailable on request).

Automatically Included

• accidental damage to the regular meetingplace for which you are legally liable

• organised and supervised group outingsand trips away for a maximum of 3 days(extensions can be arranged)

• fund raising events of a non-sportingnature involving group officials, membersand their families. Other events andcircumstances should be advised toMorton Michel for consideration

Employers’ Liability

If you are an employer, you are required bylaw to have Employers’ Liability insurance.This covers you in case an employee suffersan accident at work for which you are heldlegally responsible. Employees include paid orunpaid supervisors, students, work experiencestudents, trainees and volunteers.

Limit of Indemnity

£10,000,000 any one cause. (£5,000,000 if arising out of terrorism.)

• legal costs incurred in the defence ofcriminal proceedings in respect of a breachof the Health and Safety at Work etc Act1974 – limit £10,000 in any one period ofinsurance

Equipment – Standard Cover

This provides cover for equipment belongingto you/the group, or for which you are legallyresponsible, against loss/damage resultingfrom the perils of fire, lightning, explosion,aircraft, theft involving violent and forcibleentry or exit, riot or civil commotion,malicious damage, earthquake, impact byvehicles, storm, flood or water damage.

Minimum sum insured: £2,000.

• damage to the premises caused by theftinvolving forcible and violent entryprovided you are responsible for the repairof such damage

NB: Please keep receipts when you buy anyequipment for your group because theinsurers need to see these as proof ofpurchase should you have to make a claim.Claims can be settled much quicker if thereceipts can be produced.

Equipment – All Risks

If you regularly use items of equipment awayfrom your group premises, you may wish toinsure them against accidental loss or damageanywhere in the UK.

Sum Insured

Full replacement cost of the property.

Main Exclusions

• the first £100 of each claim

• wear and tear

• theft from unattended vehicles

• storm or flood unless the property iscontained in an enclosed vehicle or in abuilding

• electrical or mechanical breakdown

• breakage of brittle articles (unless part ofphotographic equipment)

Loss of Revenue

Provides protection against financial loss duringthe period taken for the business to return tonormal following loss or damage by any of theevents covered under the Equipment section.Reasonable costs incurred to maintain thebusiness following loss or damage are included.

The sum to be insured should be based onyour estimate of the gross revenue to beearned in the next twelve months (or anylonger period that you choose) with allowancesfor anticipated growth and inflationary factors.

• unrecoverable outstanding debit balances

• prevention of access due to damage tonearby premises

• loss caused by damage at land basedpremises of public utilities ortelecommunication undertakings

• accidental failure of electricity, gas orwater supplies at the terminal ends of thepublic supply undertaking’s feed to thepremises (unless such failure is for a periodof less than sixty minutes)

• the occurrence at the premises ofpoisoning, murder or suicide

• closure due to defective sanitation, verminor pests

• outbreak of human infectious or contagiousdisease at the premises

• wages for replacement staff followingsuspension by OFSTED, or otherregistering authority, of employees accusedof child abuse, up to £2,500.

Trustees’ and Officers’ Financial Liability

If your group is forced to close withinsufficient assets to cover outstanding debts,the trustees or officers of your group mayfind themselves held responsible for suchshortfall.

Three levels of sum insured are available forall claims by all trustees and officers of yourgroup.

£5,000/£7,500/£10,000

The closure of the group must be outside thecontrol of the trustees or officers.

Main Exclusions

• the first £25 or 5% of each claim,whichever is the greater

• fraud, embezzlement, misappropriation orother criminal act of any trustee or officer

• shortfall resulting from dishonouredcheques, use of counterfeit money,clerical/accounting errors or shortages dueto error or omission

• losses arising from the closure of thegroup within the first six months frominception date.

• fraud or dishonesty of any group officialunless discovered within seven working days

• shortages due to error or omission

• dishonoured cheques or use of counterfeitmoney.

Automatically Included

• Personal Assault – Group officials agedbetween 16 and 70 are provided withcompensation if they sustain bodily injuryor death following an assault whilsthandling money in connection with yourbusiness.

Compensation Levels

• temporary total disablement (up to 104weeks): £50 per week.

Personal Accident for Group Members,Staff and Children

The majority of accidents are dealt with underPublic or Employers’ Liability insurance.However, some accidents are not anyone’sfault and the group cannot be heldresponsible. In these circumstances, thePersonal Accident insurance will givecompensation provided that the accidentoccurred: a) whilst the victim was engaged inorganised and supervised group activities; andb) the victim suffered one of the injuriesspecified in the chart set out below.

Deterioration of Refrigerated/FrozenFood

Loss by deterioration of stock in any freezeror refrigerated cabinet following breakdownor accidental damage, or failure of publicelectricity supply.

Sum insured £500 (more if required).

• equipment more than ten years old.

Legal Expenses

This section is automatically included in yourpolicy. Cover, which is provided by DAS LegalExpenses Insurance Company Limited (DAS),will pay your legal costs including solicitors’and barristers’ fees, court costs, expenses forexpert witnesses, attendance expenses andaccountants’ fees.

• employment disputes and compensationawards that might arise with youremployees (such as unfair dismissal)

• legal defence in the event of a criminalprosecution arising from your businessactivity (such as alleged child abuse of thechildren attending your group)

• a legal representative to support you if youare asked to go to the police station for amatter relating to your business

• taxation disputes with HM Revenue andCustoms

• contract disputes of over £250, if a clientbreaks with your contract terms

• recovery of a debt of over £250, if a clientfails to pay for your services

• legal action to obtain compensation or aninjunction following damage to, or trespasson, your property

• legal action to obtain compensation fordeath or bodily injury

• loss of registration.

Main Exclusions

• costs and expenses incurred before thewritten acceptance of a claim by DAS

• any civil claim which does not offer areasonable prospect of success.

Helplines

Helplines, provided by DAS, that giveprofessional advice and support areautomatically included with your policy. Theyare available 24 hours a day, 365 days of theyear.

Advice is given on:

Tax: including VAT, self-assessment income taxand Inland Revenue audits.

Legal matters: including employment andcontract disputes.

Health and medical information: includingfood allergies, medication, childhood illnesses,vaccinations, nutrition and exercise.

Help is provided through:

Emergency repair support: giving access toapproved contractors for plumbing, electrical,gas and roofing repairs (you will beresponsible for the cost of the repair).

Confidential counselling: a valuable supportservice to help you through those difficulttimes whether because of stress, anxiety,depression, relationships, bereavement orhealth related. It includes onwards referral torelevant voluntary and/or professionalservices, where appropriate.

To obtain the full benefit from yourinsurance it is important that thesums insured are adequate at alltimes. If they are inadequate then, inthe event of a claim, the amountpayable will be reduced in proportionto the degree of underinsurance.

What is Public Liability insurance andwhy is it so important?

Public Liability insurance covers you ifsomeone in your care, or a member of thepublic, suffers an injury that is held by law tobe your fault. Recent examples have includeda visitor to a hall who slipped on a wet floor,which had not been properly cleaned; and achild who was injured when an incorrectlyerected trestle table fell on her foot. In thecurrent climate of litigation, such incidentsnow frequently lead to claims being madeagainst groups and you need Public Liabilityinsurance to protect your interests againstsuch lawsuits.

What is Employers’ Liability insurance?

If you employ anyone, you are required bylaw to take out Employers’ Liability cover. It issimilar to Public Liability insurance, but relatesspecifically to injuries suffered by youremployees. Again, this area has witnessed amassive increase in claims in recent years.

What is the difference between Liabilityinsurance and Personal Accident?

Liability insurance covers you for damages andcosts that may be awarded against you in aCourt of Law, when you have been found tobe at fault. The Personal Accident sectionprovides an agreed amount of compensationin the event of an injury, such as loss of a limbor an eye, suffered by a group official orgroup child in an accident, irrespective of whomay have been at fault. A full list of injuriesfor which compensation would be payable isstated on page 6 of this summary.

What activities are included?

Only those activities that have been advisedto and agreed in writing by Morton Michel.There is a question on the proposal formasking what activities you offer – you mustprovide full details, as this will be the basis ofthe contract.

We are a Community Association/VillageHall/Residents’ & Tenants’ Association(or similar). Does the insurance cover allactivities that take place at thepremises?

No. The insurance will only cover thoseactivities which are organised and supervisedby the association and which have beenaccepted in writing by Morton Michel. Allother groups using the premises – such asscouts, Rotary clubs, drama groups, etc – orindividuals – such as keep fit and judoinstructors – must have their own insurance.

Frequently Asked Questions

Are we covered for giving medication?

The administration of non-prescribed drugs ormedicines, prescribed oral medication orasthma inhalers and the administration ofother medication is covered strictly inaccordance with conditions stated in thepolicy. (See also the FAQ relating to childrenwith special needs.)

Does the policy cover children withspecial needs?

Yes, the Group policy covers your legalliability to the child in respect of the activitiesof your group and in respect of the premises(for which you are responsible). It also coversyour legal liability for theadministration/provision of first aidtreatment, drugs/medicines, oxygen, gastrofeeding, naso-gastric tube feeding, cleaningand changing of feeding andtracheostomy/tracheotomy tubes andemptying/changing stoma bags, strictly inaccordance with conditions stated in thepolicy. You must ensure that you arecomplying with all OFSTED or otherregistering authority requirements and thatappropriate supervision ratios apply.

Are we covered for using a bouncycastle?

Your legal liability is covered in respect ofbouncy castles used by you for the childrenattending your group (or other children intheir family), providing you adhere to theconditions stated in the policy. (You may alsowish to read the explanatory guidelinesavailable from Morton Michel.) You are notcovered for any damage you do to the bouncycastle or if you hire out the bouncy castle toanyone else. You are not automaticallycovered if the bouncy castle is to be used at afete or “fun day” open to the public; in suchcircumstances, you should contact MortonMichel for a quotation. (Please note that thepolicy defines a bouncy castle as: “playequipment with a horizontal, inflatable baseand inflatable sides designed and intendedsolely for children to bounce in or on and forno other recreational activity”. An inflatableslide, for example, would NOT be covered.)

Do we have to register under theChildren Act 1989 to take out the policy?

If your group is required to be registeredunder the terms of the Act, then you mustobtain registration and adhere to its terms inorder for the insurance to be valid. If yourgroup is exempt from the Children Act, thenyou do not require registration to obtain theinsurance cover. Please contact OFSTED, orother registering authority, to find out if youneed to be registered.

Are voluntary workers covered underPublic Liability or Employers’ Liability?

Regular voluntary workers are regarded asemployees for the purposes of the PublicLiability and Employers’ Liability insurances.Your legal liability for bodily injury to regularvoluntary helpers is covered under theEmployers’ Liability Section. Therefore, if youhave regular voluntary helpers, you shouldtake out Employers’ Liability insurance.

Can we take on young people to help atthe premises for work experience?

Yes, provided that they are on a Governmentor otherwise authorised work experience,training, study, exchange or similar scheme.They must always work under the supervisionof experienced group officials and be of anappropriate age for the duties beingperformed. If in any doubt, please contactMorton Michel. If you are asked to sign adocument from an authority concerning youngpeople doing work experience, please let ussee this document.

Is the group covered if it moves to newpremises?

Provided that the consent of OFSTED orother registering authority has been obtained,both temporary or permanent changes ofaddress will be covered automatically by thepolicy. Please advise Morton Michel in writingof all changes of address. However, if weinsure your buildings, we will requirecompletion of a new proposal form beforeyou move and cover is subject to acceptanceof this proposal by Morton Michel.

We are taking out cover for ourequipment. Does it include sheds andcontents of sheds?

Yes, within certain limits, providing it is eithera timber or metal shed. Please refer to theGroup Equipment – Standard Cover on page5 for details of the cover. If the limits areinsufficient for your needs or if you have ashed that is not timber or metal, please ringMorton Michel.

6. Duration of contract

The first period of insurance under yourGroup policy will be 12 months unlessotherwise requested by you and agreed by theCompany.
