Definitions1(1) In this regulation,

"Act" means The Oil and Gas Act; (« Loi »)

"drainage unit" means an area, determined bythe director in accordance with this regulation,that

(a) is allocated to a horizontal well for thepurpose of producing oil and gas, and

(b) consists of all spacing units locatedwithin 100 m of the completed interval of thehorizontal well; (« surface de drainage »)

"holiday oil" means oil production that is exemptfrom any royalty payable under this regulation orany tax payable under the Oil and GasProduction Tax Regulation, ManitobaRegulation 28/97; (« pétrole exempté »)

"holiday oil volume" and "HV" mean

(a) the volume of holiday oil, in cubic metres,produced from a new oil well or third tier oilwell, as that volume

(i) was determined under The MinesAct, R.S.M. 1987, c. M160, or

(ii) is determined under section 4 ofthis regulation, or

(b) the volume of holiday oil, in cubic metres,produced from a marginal well after that wellhas undergone a major workover, as thatvolume is determined under section 4 of thisregulation; (« volume de pétrole exempté » ou« VPE »)

"horizontal well" means a horizontal well asdefined in the Drilling and ProductionRegulation; (« puits horizontal »)

"inactive well" means a well that has beendesignated by the director as an inactive wellunder section 54 of the Drilling and ProductionRegulation, Manitoba Regulation 111/94 and forwhich any applicable levy has been paid or is notyet overdue; (« puits inactif »)

"licensee" means the holder of a well licenseissued under Part 8 of the Act; (« titulaire depermis »)

"major workover" means

(a) the re-entry of an abandoned well,

(b) the deepening of a well into a newgeological formation,

(c) the recompletion of a well from one poolto another,

(d) the repair of casing in a well involving theinstallation of a new string of casing or byother means that are approved by thedirector in advance, or

(e) a workover designated by the directorunder Schedule G; (« reconditionnementimportant »)

"marginal oil well" means a well that

(a) is abandoned,

(b) has not operated in the previous 12months,

(c) over the previous 12 months, producedoil at an average rate, as determined by thedirector, of less than one cubic metre foreach day the well was operated, or

(d) had a major workover performed on it onor after January 1, 2005

(i) in which the casing of the well is repairedby the installation of a new string of casing orby other means that are approved by thedirector in advance, and

(b) an old oil well that, in the opinion of thedirector, can reasonably be attributed to anincrease in reserves as a result of a project ofenhanced recovery implemented afterApril 1, 1974 and before April 1, 1999 underthe Act or The Mines Act R.S.M. 1987,chapter M160; (« pétrole nouveau »)

"new oil well" means

(a) a well that was drilled and completed onor after April 1, 1974 and beforeApril 1, 1999 in a spacing unit that, at thetime the well was drilled, contained no otherproducing well or any well capable ofproducing,

(b) an abandoned well that is re-enteredon or after April 1, 1974 and beforeApril 1, 1999, or

"producing month" means, in respect of aspacing unit or unit tract, a month in which oiland gas is produced from the spacing unit or unittract; (« mois de production »)

"third tier oil" means oil that is produced from

(a) a third tier oil well,

(b) an inactive well that is activated afterApril 1, 1999, or

(c) an old oil well or new oil well that, in theopinion of the director, can reasonably beattributed to an increase in reserves as aresult of a project of enhanced recoveryimplemented under the Act afterApril 1, 1999; (« pétrole de troisièmeniveau »)

Crown royalty on oil and gas to be paid by holder3(1) Every holder shall pay a royalty to theCrown on oil and gas produced from a lease area asfollows:

(a) on oil, the volume calculated for eachproducing month in accordance with Schedule A;

(b) on gas, 12½ percent of the volume sold,calculated for each producing month to thenearest 0.001 thousand cubic metres.

ASSIGNMENT OF AHOLIDAY OIL VOLUME ACCOUNT

Conditions applicable to assignments1 The assignment of a holiday oil volumeto or from a holiday oil volume account for a welldrilled on or after January 1, 2009 and beforeJanuary 1, 2014 is subject to the following:

(a) each eligible producing well must retain aholiday oil volume of not less than 500 cubicmetres;

(b) subject to clause (a), the licensee may, withinone year of the finished drilling date of a well,assign holiday oil volume earned by the well to aholiday oil volume account;

(c) subject to clauses (c.1) and (d), where a wellhas earned a holiday oil volume underSchedule B of less than 3 000 cubic metres, thelicensee may make a one-time assignment ofholiday oil volume from a holiday oil volumeaccount to bring the well's holiday oil volume toa maximum of 3 000 cubic metres,

(i) prior to the well producing the holiday oilvolume earned under Schedule B, or

(ii) within one year of the finished drillingdate of the well,

whichever comes first;

(c.1) where, in the opinion of the director, a wellis completed for production from a formationdeeper than the Devonian Three ForksFormation, the licensee's one-time assignment ofholiday oil volume under clause (c) may bring thewell's holiday oil volume to a maximumof 10 000 cubic metres;

(e) the holiday oil volume that is earned by a dryhole shall be assigned to the licensee's account orthe account of such other person as the licenseemay designate;

(f) where a well has been drilled to a deeperformation but is completed in a shallowformation before being put on production and thedirector is satisfied that the licensee is diligentlyevaluating the potential of the deeper formation,the well is allocated the holiday oil volume that isthe lesser of

(i) the amount it would have earned if thedeeper portion of the well had not beendrilled, and

(ii) the holiday oil volume the well has earnedunder Schedule B,

and any remainder of the holiday oil volume thatis earned by the well shall be assigned to theholiday oil volume account of the licensee or suchother person as the licensee may designate;

(g) repealed, M.R. 50/99;

Allocation in a unit area3(2) Where the producing area of ahorizontal well lies

(a) entirely within a unit area, production fromthe well is allocated to unit tracts in the unit areain accordance with the unit order or agreement;and

(b) partially within a unit area and partiallyoutside a unit area, production from the well isallocated to

(i) spacing units outside the unit area inaccordance with the formula insubsection (1), and

(ii) to unit tracts in the unit area inaccordance with the unit order or agreement.
