INTRODUCTION

The intent of the contents of this guide, as well as the existence of the Architectural Review Committee (ARC), is to provide the guidelines required for maintaining an aesthetically pleasing community. Adhering to these guidelines is beneficial for all involved in that they are meant to protect the investment of the homeowners, as well as portray a quality community of well-planned homes constructed with long lasting materials maintaining high constructions standards. In conjunction with the Declaration of Covenants, Conditions and Restrictions (DCCR's) for Covington Estates at Cross Creek Association (CECCA), the design standards are binding on all parties having interest in any portion of CECCA, and each homeowner is required to comply with the requirements as set forth. Any failure to comply with these requirements will be subject to remedies provided for in the documents.

Terms such as "good taste" and "sound design" are difficult to define and even more difficult to

legislate. It is the intent of these Guidelines to encourage "good design" by showing examples of the desired result. Elements such as deed restrictions, appropriate attention to scale, proportion to the community should be considered with all requests.

Nothing contained in these Guidelines shall obligate any agency, governmental or otherwise, to approve plans submitted, nor shall the approval of the ARC be construed as meeting the requirements of neither Hillsborough County nor any governmental agency required for approval.

The ARC has the sole and exclusive right to modify, revise, add, delete or make any changes to this manual without notification or approval of any party.

A. REVIEW PROCESS

A. GENERAL

The design and construction review process is a 4-step procedure: Initial Review, Submission of Plans, Construction Commencement and Inspection. Thorough and timely submission of information as well as adherence to the guidelines set forth in the process will prevent delays and minimize frustration of all parties involved. Questions concerning interpretation of any matter set forth in the Guide should be directed to the ARC.

STEP 1 - Initial Review

It is required that a homeowner submits to the ARC an Alteration Application Form

(AAF) for the modification that is being requested, along with a set of plans (2 sets of plans, will be required for additions to existing homes). Any and all modification requests and submissions of supporting documentation should be made by mail, email or in person to Pilawski Property Management Company and a receipt requested. Facsimile with verification of transmittal will also be acceptable. The information required for the review is as follows:

a) Exterior Alteration Application with a detailed description of the planned modifications.

b) Site Plans/Lot Surveys, showing the approximate location and dimensions of all modifications, including driveway, irrigation, and swimming pools.

c) Floor plans if applicable. d) Exterior elevations (all sides) if applicable. e) Concept Landscape Plan if modification involved changes to the current

landscape. f) Any other information, data, and drawings as may be reasonably requested by

the ARC.

The ARC shall review the information and indicate its approval, disapproval or recommendations for change to the plan. The ARC will review the accompanying documents within thirty (30) days and return one set of plans to the Owner with the appropriate response. NO MODIFICATION shall be made on any property until the

Alteration Application Form (AAF) has received final approval by the ARC. All applications expire 6 months from date of application

STEP 2 - Submission of Plans to the Building Department

Following the approval of Step 1, the Owner may submit their plans to the Building Department or the required agencies that have jurisdiction for the required permits that may be needed for the modification project. Changes required by the said agencies must be reapproved by the ARC.

STEP 3 - Construction Commencement

Upon completion of Step 2, a copy of any and all permits must be available to the ARC for review prior to the Owner beginning construction. If the request does not require a permit, all materials utilized in the modification, must be approved by the ARC before Commencement. Any modification to the original application for any reason must also be reapproved.

STEP 4 - Final Inspection

The ARC shall have the right to enter upon and inspect any property (however, the member will call before visiting a property) at any time of the process before, during or after the completion of work for which approval has been granted. Upon completion of the modification the Homeowner shall give notice to the ARC. At this time it will be reviewed for "Sound Design". Any damage to streets, curbs, drainage inlets, sidewalks, street signs, walls, community signage, landscaping, irrigation, etc., must be repaired or the damage will be repaired by the Association and such costs will be charged to the Owner. Acceptable completion time frames for projects will be as follows:

- Pool Installation -4 months

- Fence Installation - 2 month - Home Additions - 8 months

If projects will require additional time, the Owner should contact the ARC with the anticipated completion date.

NOTE:

All Homeowners shall be held responsible for the acts of their employees, subcontractors, and any other persons or parties involved in construction or alteration of the home site. The responsibilities include but are not limited to the following:

a) Ensuring that the construction site, community properties and roadways are kept clean and free of all debris and waste materials, and that stockpiles of unused materials are kept in a neat and orderly fashion.

b) Material shall be stored and disposed of in a lawful manner. No material or debris shall be dumped in conservation or common areas.

c) Prohibiting the consumption of alcoholic beverages, illegal drugs or other intoxicants that could hamper the safety or well being of other personnel on the site.

d) Noise pollution shall be kept to a minimum. e) Work shall take place between the hours of 7:00 AM and 6:00 PM Monday-

Saturday and 10 AM – 3 PM on Sunday

B. EXEMPTIONS

The following modifications do not require prior approval by the ARC:

- Re-surface existing driveways in the identical color/material previously approved by the ARC.

- Replace existing screening with identical screening materials previously approved by the ARC.

- Replace existing exterior doors with identical exterior doors previously approved by the ARC.

- Replace existing mailbox with identical mailbox or previously approved by the ARC.

- Replace existing roof with identical roof material.

All references in the paragraph to "identical" shall mean that such items shall be replaced with an item that is identical in all respects to the existing item (i.e., identical style, texture, size, color, type, etc.).

C. RECONSTRUCTION

In the event that a residential structure or any part thereof destroyed by fire, casualty or natural disaster, the Owner must correct the damage within nine (9) months. The ARC will make every effort to accommodate the Owner in the application process in order to repair or rebuild in a timely manner.

D.ADMINISTRATIVE FEES

As a means of defraying its expense, the ARC may charge a fee to the homeowner for the submission of preliminary plans and specifications in the event that professional opinion is

needed for the review of plans. In such case, the cost of this service will be a direct charge back to the owner/resident.

E.APPEALSPROCESS

In the event that the ARC disapproved any plans and specifications:

The applicant may request a rehearing by the ARC for additional review of the disapproved plans and specifications. The meeting shall take place no later than thirty (30) days after written request for such meeting is received by the ARC, unless applicant waives this time requirement in writing.

The ARC shall make a final written decision no later than thirty (30) days after such meeting. In the event the ARC fails to provide such written decision within thirty (30) days, the plan and specifications shall be deemed Approved.

If the final decision of the ARC is disapproval, the applicant may appeal the decision of the ARC to the CECCA Board of Directors within thirty (30) days of the ARC's written review and disapproval.

Review by the Board shall take place no later than thirty (30) days after receipt of the applicant's request therefore. If the Board fails to hold such a meeting within thirty (30) days after request for such meeting, then the plans and specifications shall be deemed APPROVED.

The Board shall make a final decision no later than thirty (30) days after such meeting. In the event the Board fails to provide such written decision within thirty (30) days after such meeting, such plans and specifications shall be deemed APPROVED.

The decision of the ARC or the Board shall be final and binding.

A. Fences, Walls, and Hedges

No fences, walls or hedges of any nature may be erected, constructed or maintained upon any lots unless approved by the ARC in writing in advance of construction.

Fences shall be installed according to the CECCA. Fence Specifications will be returned with all approved applications. They may also be downloaded from the internet at Covington-estates.com.

Homeowners are encouraged to collaborate with their neighbors when planning fence projects. On conservation Lots, the ARC may require written permission from your neighbors.

No fence may be constructed in a utility easement. Fences may be six feet in height for the entire length. Any fence located along a drainage easement adjacent to a retention pond may be six feet

in height beginning at the front line of the home with a minimum 10 foot setback then step down to four feet in height in the last eight foot section of the fence on either side and continue at four feet across the rear of the lot. Fences may not be installed in drainage easements or wetland conservation easements.

Irrigation systems must be re-configured, if necessary, to provide 100% coverage of property.

Fence will be erected so that posts will face to the interior of the property. All fence materials will be white polyvinyl chloride (PVC) Wood fences replacement

shall be of PVC material.

Acceptable types of fence are listed in Appendix A.

Fences should be kept in a neat, clean and attractive condition

No fences are permitted on conservation area

B. Vehicles

Motor vehicles shall only be parked on the driveway or in a garage and not on the street. Recreational vehicles and belonging to guest of Owners shall park on a non-recurring

basis and for a single period not to exceed seventy- two (72) hours in duration. Commercial vehicles and trailers used in connection with the furnishing of services and

the routine pick-up and delivery from and to dwelling units may park on the street for a period not to exceed twelve (12) hours in duration.

No motor vehicles which are owned by a Resident and primarily used for commercial purposes, other than those present on business, nor any trailers, may be parked on the Properties unless inside a garage and concealed from public view.

Inoperable and/or unregistered or unlicensed automobiles shall be parked inside of garages and concealed from public view.

Watercraft, watercraft trailers, campers, motor homes, travel trailers, aircraft gliders, trailers, and buses shall be parked inside of garages and concealed from public view.

Motorcycles, motorbikes, motor scooters, mopeds, ATV's, or go-carts are not permitted parked or stored on any lot street or any other part of Covington. Furthermore, no such vehicles may be operated inside Covington except for entering or leaving and must be licensed and registered.

No repair work on motor vehicles shall be performed in public view. All vehicles must be currently registered and operable. No vehicle shall be permitted to block the sidewalks.

C. Storage

No Lot shall be used for the storage of rubbish and/or equipment. No items may be stored in the driveway, front porch or on the sides of homes within the community.

Trash, garbage or other waste shall be kept in sanitary containers properly concealed from public view in the garage of the home except between the hours of 6pm the day preceding trash collection and 6pm on the day of trash collection.

D. Clothes Hanging and Drying

All outdoor clothes hanging and drying activities should not be visible from any Front Street or Side Street.

All clothes poles and racks shall be capable of being lifted and removed by one (1) person in one (1) minute time.

Clothes poles and racks shall be stored out of sight when not in use for clothes drying purposes.

E. Antennas, Aerials, and Satellite Dishes.

No television, radio or other electronic towers, or aerials will be permitted without prior approval of the ARC.

Satellite dishes must be 24 inches in diameter or smaller. Installation of satellite dishes must be as unobtrusive as possible from the

fronting street or neighboring units. Exposed wiring and junction boxes painted to match the existing color

scheme of the house. A picture or brochure of the actual dish to be installed must accompany each

application. A site plan of the home must be included in the application depicting the actual

proposed location of the dish. Antennae shall be installed in compliance with all state and local laws and

regulations, including zoning, land use and building regulations. Nothing in

these guidelines shall be construed to be in conflict with the FCC guidelines regarding Over-The-Air-Reception-Devices (OTARD).

F. Mailboxes

Mailboxes shall be the exact same style as originally conveyed by the builder.

House numbers must be clearly displayed. Style shall be exactly the same as conveyed by the builder.

House numbers and/or decorative scroll attachments may be obtained from Mailbox Impressions, 17300 US. 41 North. Lutz, FL 33549, (813) 949-4039.

Newspaper or other tubes will not be allowed. Holiday lighting is accepted during the winter holiday season (defined as

November 15th' to January 15th of the following year). Holiday decorations must be removed within two weeks after the holiday.

Mailboxes shall be kept clean of mold/mildew/dirt and cleaned of rust stains and be maintained in like new condition

G. Lot and Dwelling upkeep

Lots shall have the grass, shrubs and trees regularly cut, trimmed and fertilized at least three (3) times a year and Weed & Feed treatments applied. The association may exercise its option of having the landscape maintenance performed upon prior notice to the owner as required by the DCCR’s, and assess the owner accordingly for the costs incurred.

Lots shall be maintained in good repair, including, but not limited to the exterior paint (every 7 years) and appearance of the Dwelling. Homes shall be cleaned free of mold/mildew/dirt on the exterior surface of the home, oil & rust stains cleaned from driveways, etc.

Each Owner shall, as necessary from time to time, repair, replace and maintain the roofs. Gutters, downspouts, walks, fencing, exterior building surfaces, windows, doors, trim

members, driveways, coach lights and other exterior improvements in order to maintain the Dwelling in a safe, sanitary and reasonably attractive condition.

Exterior lighting, such as "Malibu" lights, will be permitted with ARC approval. A light plan or "layout" should be submitted with the Exterior Alteration Application.

The landscaping shall include shrubbery plantings of a value of not less than One Thousand ($1000.00) dollars.

When coverings are used on shrubs as "frost protection" they shall be removed in a timely manner, as the frost threat has subsided.

H. Window Treatments

No newspaper, aluminum foil, reflective film, mirrored tint, sales signs, bed sheets,

towel, nor any other material, other than usual and customary window treatments, shall be placed over the windows of any Dwelling.

A window treatment placed on windows in the front of the Dwelling should be in harmony with the color scheme of the house.

Window tint materials require the approval of the Architectural Control Committee. A color sample of the window tint proposed must be submitted to the ARC with the application.

I. Signs

No sign billboard, or advertising of any kind shall be displayed without the prior written approval of the Architectural Review Committee. Exceptions:

o One (1) security alarm sign, not to exceed one (1) foot square. o For Sale or Rent: One (1) discreet professionally prepared sign not to exceed

twenty-four (24) inches in width and eighteen (18) inches in height, to be attached to a 4 x 4 no higher than three (3) feet from the ground. Such sign shall contain no other wording than "For Sale" or "For Rent", the name, address and telephone number of one (1) registered real estate broker or a telephone number of an Owner or his agent. In no event shall more than one (1) sign ever be placed on any Lot. The sign shall be that of the approved style for Covington Estates at Cross Creek.

No advertising will be allowed for contractors. One permit board will be allowed. No public display on any lot of items or materials used in a homeowners business, trade

or profession. No personal information sign shall be posted or displayed on CECC property unless it

is on a ARC approved display board

J. Trees

Normal and customary trimming and pruning, which do not substantially alter the shape, configuration, or health of any tree, will be allowed.

Trees existing on the Properties should be preserved and maintained as best as possible.

Trees along the sidewalk must be trimmed, by the homeowner, to maintain an eight (8) foot canopy to enable pedestrians' safe clearance.

Replacement of an existing tree with the exact same species does not require prior approval. If replacing with a different species, tree must be native and non-invasive, and requires written approval from the ARC.

Only American elm, Winged Elm, Crepe Myrtle. Dwarf Magnolia, or Queen Palms will be allowed in the utility easement and requires the written approval of the ARC.

No additional plantings such as flowerbeds or shrubs will be allowed in the utility easement without the written approval of the ARC.

K. Wells

No wells will be allowed.

L. Swimming Pools

Any swimming pool to be constructed upon any home site shall be subject to review by the ARC.

All pool equipment must have fencing or shrubs placed around it so as to screen it from public view.

All irrigation systems must be re-installed to insure 100% coverage of sod and landscaped property.

No above ground pools will be allowed. Pool must be fenced or enclosed to comply with local laws and these guidelines. Hot

tubs/spas must be located on a screened lanai or behind a fence

M. Patios, Screen Doors, and Screen Enclosures

Patios and Screen Enclosures must be located on the areas shown as Patio" or "Lanai" on the plans/site survey. If a patio extension is requested on the rear of the home, plans must be submitted with the Exterior Alteration Application, including a plot plan showing where the proposed extension will be placed. Patios or screen enclosures may not exceed the height or width of the home. No alterations or improvements shall be constructed in wetlands or drainage easements.

Irrigation systems must be modified to ensure 100% coverage of the property. All screening and screened enclosures shall be constructed utilizing white or black/dark

brown aluminum.

Screening shall be charcoal in color. No decorative grills or bars will be permitted on screen doors with the exception of those

that do not face the front or side street.

A kick plate will be permitted up to 24" of the door Front doors, entrances and garages may not be screened. Retractable screen doors may be

permitted provided they receive prior approval from the ARC. Framing/casing is painted to match the exterior of the home and screening must be retracted when the door is closed.

No aluminum roofing will be permitted on any of the screen enclosures

N. Hose Reels, Garbage Cans, Tanks, etc.

Hose reels, rolled hoses, above ground tanks and water softeners must be screened from view of the neighboring properties and from the streets with landscaping or other method acceptable to the ARC.

Garbage cans may be placed at the front of the home after 6:00pm on the day before the scheduled day of collection and must be removed from the front of the home by 6:00pm on the scheduled day of collection.

At all other times, garbage containers must be stored and screened from view from the street within an enclosed garage.

Garbage containers must have securely closed lids and may not be placed on the street or sidewalk.

Garbage containers must be kept in a clean and sanitary condition to prevent noxious and offensive odors

O. Lawn Furnishings and Ornaments

Unless located out of view from the front or side of the street or inside a fenced yard, birdbaths, lawn sculpture, artificial plants, birdhouses, rock garden or similar types of accessories and lawn furnishings are not permitted on any home site without prior approval of the ARC with the proper application. Statues, fountains or birdbaths may be permitted. A maximum of four lawn ornaments may be allowed per home site, two in the front and two in the rear. If the rear yard is fenced, this restriction will not apply. The statues will not be greater than 4 feet in height, must be in landscape beds and must blend in color with the home. With birdbath/fountain requests, height and dimensions must be submitted with the application and preferably a picture of the desired statue, birdbath or fountain.

P. Landscaping and Patios

Basic landscaping plans for each home or the modifications to any existing landscaping plan must be submitted to and approved by the ARC.

The landscaping plan must detail the location of beds and planting materials. No invasive or non-native (e.g .melaleuca, Brazilian pepper) plants are permitted. Landscaping replacement in the existing beds on the home site shall not require approval

of the ARC. However, should additional landscape beds or tree plantings be desired prior approval of the ARC is required.

Decorative borders around landscaping beds require the prior approval of the ARC. However, if the limits of the existing landscaping are not going to be changed, a border

selected from the pre-approved list does not require approval. The pre-approved list of decorative borders is listed in Appendix B.

Flowers, grasses, and shrubbery within the limits of the existing landscaping may be replaced on a regular basis without approval of the ARC excluding trees. All landscape beds and tree rings shall be mulched once per year

Q. Barbeques/Smokers

Barbeque grills and smokers may be located or permitted upon the back patio or yard of Home.

If not screened from view of the neighboring property by a fence, they must remain covered when not in use.

R. Garage

No garages shall be enclosed or converted into a living area (heated and/or air conditioned) and must at all times be used as a garage for car storage purposes.

No screening is allowed temporarily or permanently on garage door openings. See item M above.

Garage doors shall be maintained in good repair and good working order.

S. Play Equipment and Accessory Structures

All exterior recreation and play equipment, swing sets, jungle gyms, soccer goals, trampolines, or skate board ramps must be located within the rear yard of the property and must be screened from public view.

No basketball goals will be allowed. All play equipment must be maintained on a regular basis 1i the Owner to preserve

standards, and when needed, should be painted entirely "earth toned"- tan olive or brown.

All portable recreation equipment and toys must be removed from public view when not in use.

Play structures must not exceed 12 feet total in height.

Play structures should be maintained by the owner

Shade or shelter tents may be placed in the rear yardbut must be removed after 48 hours.

T. Exterior Painting

Each Owner must submit to the ARC a color plan, including samples of the actual colors to be utilized.

The ARC shall determine whether the color plan and materials are consistent with the Homes in the surrounding areas and that they conform to the color scheme of the community.

The color plan must be submitted prior to construction or repainting. Color pallets should be muted earth tones with coordinating trim colors. No primary or bright colors will be approved. No more than three (3) different colors

will be allowed per home. Homeowners are encouraged to observe the five (5) homes nearest them and select

colors that are not too similar in order to maintain good taste" in their general area.

U. Gutters and Downspouts

All gutters must match the exterior house color, trim color and/or window metal color.

Gutter down spouts must not concentrate water flow onto neighboring properties.

V. Solar Collectors |

Solar Collectors must not be installed so as to be visible from the street. Exposed pipes, wiring and junction boxes must be painted to match the existing color scheme of the house.

W. Additions

Rainwater from a new addition roof or new grade of Home terrain must not run on neighboring property as to create a nuisance.

The location of all windows in a new addition must not adversely affect the privacy of adjoining neighbors.

The architecture of the addition must match the existing home.

The application must include the following: plan view, elevation view, an~ irrigation plan, electrical plan, mechanical plan, structural plan, engineer's certification, county approval and permit.

X. Awning and Shutters

Awning and shutters (except for hurricane) will not be approved.

Hurricane shutters may be allowed with approval of the ARC, under the following conditions Housing of shutter and tracking is painted the same color as the house.

Shutter may not be closed at any time other than during a tropical storm or hurricane watch or warning.

Y. Driveway Construction

Driveway and sidewalk: extensions/modifications require ARC approval and must conform to the standards for Covington Estates Subdivision,

No gravel or asphalt driveways will be permitted. Driveways may not be stained, painted, altered or changed in any way prior to

receiving approval from the ARC.

z. Decorative Lighting

Decorative holiday and festival lighting does not require approval during the winter holiday season (defined as November 1 5" to January 15th of the following year). Other holiday lighting may be installed ten days prior to the holiday and removed within ten days after the holiday.

Festive lighting during other times of the year requires approval from the ARC. Lighting display must not create a nuisance to neighbors or traffic.

AA. Flags and Flagpoles

No flagpole in front or either side of the property will be allowed. One flagpole at the rear of the house will be permitted upon approval by the ARC. Applications must include the following: height of the pole, size of the flag, elevation view of house, and plan view-showing location and landscaping.

Shrubbery or buffering landscaping must be installed directly around the base of the structure to soften the effect and alleviate the starkness of the pole.

Proper flag etiquette must be observed at all times when flying the National or State flags. One wall mount flag assembly may be installed on the front of a home without approval of the ARC, to a maximum flag size of 24" x 36".
