Honorable Members of the Erie County LegislatureDepartment of Public Works, Office of the CommissionerErie County Department of Public Works - Division of HighwaysResponse to New York State Department of Transportation Bridge Inspectionswith Yellow & Red Flagged Conditions of County Bridges and CulvertsApril 29, 2011

SUMMARYIt is recommended that the County Executive be authorized to execute a contract for emergency bridgeand culvert construction management, technical services, and construction inspection to Clough,Harbour & Associates to address the numerous yellow and red flagged conditions received from theNew York State Department of Transportation on Erie County bridges during the 2011 constructionseason.

FISCAL IMPLICATIONSThe Clough, Harbour & Associates contract will not exceed $29,853.79 allocated from B.00059 - 2003Culvert Design in the amount of $9,769.70 and B.00040 - 2002 Culvert Inspection, Load Rating andDesign in the amount of $20,084.09.

REASONS FOR RECOMMENDATIONErie County received notice ofNYSDOT inspection reports citing Erie County bridge and culvertdeficiencies as "yellow" and "red" flags which limit or restrict public access. DPW-Division ofHighways is required to provide immediate response to sufficiently improve bridge conditions in orderfor the NYSDOT to remove those flags.

BACKGROUND INFORMATIONThe County has 294 bridges and 461 culverts averaging approximately 50 years in age. The lack ofcapital investment in the maintenance, repair, and reconstruction of County bridges has precipitated theerosion of many County bridges thereby, accounting for the numerous citations of yellow and red flagsby the NYSDOT.

CONSEQUENCES OF NEGATIVE ACTIONIf these flagged conditions are not responded to in a reasonable time frame, access by the travelingpublic on the County's bridges will be limited through load postings or closed based on the severity ofthe condition. Non-action will affect the health and safety of the traveling public, deter commercetravel, and alter traffic flow for emergency vehicles, school buses, deliveries, trash pick-up and generalmotorists.

STEPS FOLLOWING APPROVALThe County Executive will execute a contract with Clough, Harbour & Associates. Information fromthe engineering consultant will determine award and execution of emergency bridge constructionpurchase orders through the Department of Purchase and/or through a public bid opening by theCommissioner of Public Works.

RE: Erie County Department of Public Works­Division of HighwaysResponse to New York State Departmentof Transportation Bridge Inspectionswith Yellow & Red Flagged Conditionsof County Bridges and Culverts

WHEREAS, the New York State Department of Transportation (NYSDOT) is currentlyperforming annual and biannual inspections of County-owned bridges and culverts; and

WHEREAS, as a result of these inspections Erie County was cited with numerous yellow andred flags which restricts access to the traveling public and requires the County to respond to NYSDOTwith a plan of action as soon as practicable; and

WHEREAS, the Department of Public Works - Division of Highways determined that Clough,Harbour & Associates, a legislatively approved Term Agreement consultant via Comm. 14E-19 adoptedJuly 17, 2008, has the appropriate experience in construction management, technical services, andconstruction inspection of bridges and culverts; and

WHEREAS, in order for the Department of Public Works - Division of Highways to urgentlyrespond to these cited County bridge and culvert deficiencies with repairs and construction during the2011 construction season, it requires authorization to award construction contracts.

NOW, THEREFORE, BE IT

RESOLVED, that the County Executive be allowed to execute a contract to Clough, Harbour &Associates for an amount not to exceed $29,853.79, from B.00059 - 2003 Culvert Design in the amountof $9,769.70 and B.00040 - 2002 Culvert Inspection, Load Rating and Design in the amount of$20,084.09; and be it further

RESOLVED, that the Commissioner of the Department of Public Works - Division ofHighways is authorized to requisition for purchase orders for bridge and culvert repair and constructionthrough the Department of Purchase approved Highways Material Bid or through an open competitivebidding process; and be it further

RESOLVED, that the Erie County Legislature be provided with an informational item uponreturn from recess that includes a report of progress, vendors awarded, and contract amounts from theDepartment of Public Works - Division of Highways; and be it further

RESOLVED, that five (5) certified copies of this resolution be sent to the Department of PublicWorks, Office of the Commissioner, and one copy each to the New York State Department ofTransportation, the Office of the County Executive, the Division of Budget and Management, the Officeof the Comptroller, and the Department of Purchase.
