COUNCIL MEETINGS

Explanatory Notes for Members of the Public Attending Meetings

1. Council meetings comprise the full membership of the Council with a quorum of six Councillors. Ordinary Council meetings consider reports from all Divisions of Council. 2. The Chairperson shall be the Mayor or, in her absence, the Deputy Mayor. 3. A recorded message listing all items on the agenda is placed on the Agenda Information Line (9936 8188) after midday on the Thursday before a Council meeting. Reports are published on Council’s website (www.northsydney.nsw.gov.au) by close of business on the Thursday before the meeting or printed copies may be viewed at Stanton Library or the Council Chambers. 4. Members of the public wishing to address Council or have an item brought forward may register by telephoning the Council (9936 8115) by 5.00pm on the day of the meeting or by speaking to the officer who is present in the foyer outside the Council Chamber from 6.40pm to 6.55pm. 5. As the Chairperson calls the brought forward items on the agenda, speakers are invited to take their place at the foot of the Councillors’ table between Wollstonecraft and Cremorne Ward Councillors. When you are called to speak, you must identify yourself by name and address or professional status. When you have made your address, the Council may wish to ask questions of you, after which you should resume your seat in the Gallery. 6. The following points should be noted by members of the public wishing to address Council:

Addresses must relate to an item on the agenda. Addresses should be limited to three (3) minutes. Addresses should be made to "Mayor and Councillors". If you have previously addressed the Council on the subject then any further address

must be made to present new information ONLY. Groups, or persons wishing to present similar points of view, should nominate a

spokesperson and not address the Council individually. All questions and comments are to be addressed through the Chairperson. Having made your address and answered any questions put to you by the Councillors,

you may take no further part in the debate. No written submissions or documentation may be presented to the meeting without a

General Manager’s Office GMO01: Matters Outstanding

Report of Warwick Winn, General Manager A report on the current status of matters arising from Council resolutions up to the meeting of 20 April 2015 is presented. Recommending: 1. THAT the report be received.

1. GMO02: Compliance with Performance Improvement Order

Report of Warwick Winn, General Manager The Minister for Local Government, the Hon Paul Toole, on 9 December 2014 issued the Council with a Performance Improvement Order (PIO) under section 438A of the Local Government Act 1993. This report advises Council’s compliance with the PIO. Expenditure on compliance with the PIO to date is $23,652.68. This figure does not include final expenditure on the training and conflict resolution components of the Order. Recommending: 1. THAT Council advise the Minister for Local Government of its actions in complying with the PIO. 2. THAT Council determine whether it wishes to participate in follow up Conflict Resolution sessions, as proposed by the consultant.

2. GMO03: Workers Compensation Insurance - Tender 38/2015

Report of Jon Paul Agnew, Risk Manager Tenders were called and were received until 4pm, 10 March 2015 for the submission of tenders to provide workers compensation insurance. Council resolved at its meeting of 20 April 2015 to defer the matter to the Councillor Finance Workshop of 05 May 2015. Having been discussed at the Workshop, the tender report is again presented for Council’s consideration. In order for Councillors to discuss the content of this Commercial in Confidence report it will be necessary to close the Council meeting to the public. Recommending: 1. THAT Council accept the tender of the highest ranked Tenderer for Tender 38/2015 for workers compensation insurance. 2. THAT Council hereby authorises its Official Seal to be affixed to Contract 38/2015 under the signature of the Mayor and the General Manager. 3. THAT, once Council has executed the Contract, information relating to the successful tender be published in Council’s Register of Contracts as required by

Government Information (Public Access) Act 2009 - Part 3 Division 5 - Government Contracts With Private Sector.

3. GMO04: Fit for the Future - Assessment Process of Council Proposals

Report of Peter Coulton, Project Planning Officer IPART have been appointed by the State Government as the Expert Advisory Panel to review Council Fit for the Future (FFF) proposals. IPART have released a Consultation Paper which outlines the methodology they propose to use to assess proposals which are due 30 June 2015. This paper outlines IPART’s methodology and provides recommendations for North Sydney as a way forward. Ryde Council considered their Fit for the Future progress at their meeting of 12 May 2015. A brief update of their plans is provided, as is an extract from an Executive Summary provided to Ryde by Brian Dollery which indicates that North Sydney Council would suffer a significant decrease in efficiency if amalgamated according to the Independent Local Government Review Panel’s recommendation. A budget allocation of $30,000 has been made in accordance with Council’s resolution of 13 October 2014 to fund the public meeting and subsequent actions. Recommending: 1. THAT Council hold a second Community Meeting to provide an update on Fit for the Future preparations on Monday 1 June commencing at 7pm at Rydges, North Sydney. 2. THAT Council invite the Minister for Local Government, The Opposition Shadow Minister for Local Government, The Greens Spokesperson for Local Government and the President of LGNSW to attend the Public Meeting. 3. THAT Council commission a survey/representative phone poll of North Sydney residents to determine their views on North Sydney’s position. 4. THAT Council establish a North Sydney - FFF Facebook Page. 5. THAT North Sydney’s FFF Campaign be rebranded to “I [heart] North Sydney”. 6. THAT Campaign brochures, leaflets, banners etc be distributed as required. 7. THAT Council endorse the submission to IPART regarding their proposed methodology.

4. GMO05: Code of Conduct matter

Report of Adrian Panuccio, Chief Operating Officer/Complaints Coordinator To provide information in response to the Council resolution on of 16 February 2015 where it resolved: 1. THAT Councillor Bevan be formally censured for the breach under section 440G of the Local Government Act 1993 and, 2. THAT the matter be referred to the Director General of the Office of Local Government for further action under the misconduct provisions of the Act. Recommending: 1. THAT Council close the meeting to the public pursuant to sections 10A(1) and 10A(2)(i) of the Local Government Act 1993 to consider information concerning a code of conduct matter.

City Strategy Division 5. CiS01: Adoption of Amended Delivery Program 2013/14-

2016/17, Revenue Policy 2015/16, Fees and Charges 2015/16 and Amended Resourcing Strategy 2013-2023

Report of Katrina Furjanic, Acting Manager Integrated Planning and Special Projects The purpose of this report is to adopt the proposed Amended Delivery Program 2013/14-2016/17, Revenue Policy 2015/16, Fees and Charges 2015/16 and Amended Resourcing Strategy 2013-2023 following their public exhibition. Council adopted the Draft Amended Delivery Program 2013/14-2016/17; Draft Amended Resourcing Strategy 2013-2023; Draft Revenue Policy 2015/16 and Draft Fees and Charges 2015/16 at the Council Meeting on 16 March 2015 and invited submissions from the public. Council received one late submission on the Draft Amended Delivery Program 2013/14-2016/17; Draft Amended Resourcing Strategy 2013-2023; Draft Revenue Policy 2015/16 and Draft Fees and Charges 2015/16. A number of amendments are proposed to the Draft Amended Delivery Program 2013/14-2016/17 and Draft Revenue Policy 2015/16 based on internal submissions which are outlined in this report. Council is required to adopt the Amended Delivery Program 2013/14-2016/17, Revenue Policy 2015/16 and Fees and Charges 2015/16 by 30 June 2015. Printing and promotion associated with the Amended Delivery Program 2013/14-2016/17; Revenue Policy 2015/16; Fees and Charges 2015/16 and Amended Resourcing Strategy 2013-2023 can be met from existing administrative budgets. Recommending: 1. THAT having considered the submission and amendments detailed, Council adopts the Amended Delivery Program 2013/14-2016/17 as attached to this report. 2. THAT having considered the amendments detailed, Council adopts the Revenue Policy 2015/16 as attached to this report. 3. THAT having considered the amendments detailed, Council adopts the Fees and Charges 2015/16 as attached to this report. 4. THAT having the amendments detailed, Council adopts the Amended Resourcing Strategy 2013-2023 as attached to this report.

6. CiS02: St Leonards / Crows Nest Planning Study - Precincts

2 and 3 Post Exhibition Report

Report of Emma Booth, Strategic Planning Team Leader - Design The St Leonards / Crows Nest Planning Study – Precincts 2and3 (the ‘study’) provides a strategic planning framework for St Leonards / Crows Nest that aims to: Establish a liveable, high amenity mixed use centre; Support creative/innovative industries to establish and grow;

Improve urban design and street level amenity; Improve building design and residential amenity; and Increase investment in St Leonards. Recent development interest in St Leonards across the three local government areas, and the current subregional planning process being undertaken by State and local government, suggests a pressing need to re-evaluate the existing statutory planning framework, particularly Council’s height and non-residential floor space ratio controls. The study is an opportunity to positively manage change in St Leonards and ensure the agreed, exhibited public benefits for precincts 2 and 3 are delivered in a timely fashion to transform the precinct into an exemplar of a modern, mixed use centre. The study has received considerable support from the community, local businesses and landowners, particularly for the proposed public domain upgrades and initiatives to provide more activity, retail, entertainment and services in St Leonards. Key issues raised during the exhibition period relate to landowners’ expectations for height and density, the long term employment function of the centre and concerns relating to traffic, overshadowing, privacy and view loss. This report makes a number of recommendations to amend the exhibited study that address these and other matters. Formal adoption of the amended study (Attachment 1) will enable landowner-initiated planning proposals to be received to implement the scheme. The study identifies public domain and community projects that are to be delivered through any voluntary planning agreements prepared in of support proposed amendments to North Sydney Local Environmental Plan 2013. These projects will be the subject of separate reports to Council as the details of the draft agreements become available. Recommending: 1. THAT the St Leonards / Crows Nest Planning Study – Precincts 2 and 3 be adopted.

7. CiS03: Supporting DCP amendments to the St Leonards

Crows Nest Planning Study – Precincts 2/3

Report of Nigel Turner, Strategic Transport Planner The St Leonards/Crows Nest Planning Study - Precinct 2/3 seeks to facilitate the growth and revitalisaiton of the centre whilst achieving improvements that will provide greater levels of public amenity and a stronger sense of identity. An important factor in achieving this, is to build on the centre’s excellent access to public transport and reduce the impact of car based travel and congestion as the centre grows. Background work undertaken during the preparation of the Study identified that without intervention, increasing traffic generation would become a significant detracting influence on the successful development of the centre. Submissions received from local residents and the Roads and Maritime Services (RMS) during the public exhibition of the Study, raised concern about traffic generation and its impact on the local road network.

This report identifies a number of planning options to determine whether their implementation would satisfactorily resolve this issue and other amenity related matters. The likely success of these options was assessed against a range of performance criteria. As a result of this analysis, this report recommends that the growth of traffic generation in the precinct be restrained and managed by amending the North Sydney DCP 2013 as follows:

Introducing new parking rates for the precinct which are significantly lower than in other precincts Strengthening travel planning requirements Removing existing impediments to the provision of innovative parking schemes. These proposed changes respond to one of the Study’s objectives of creating a place that is welcoming, interesting and safe and that prioritises walking, cycling and public transport over private vehicles. Recommending: 1. THAT Council endorse the proposed amendments to DCP 2013 (Attachment 1) for the purposes of public exhibition.

8. CiS04: Planning Proposal - 75-89 Chandos St, 58-62

Atchison St and 23-35 Atchison St, St Leonards – Auswin TWT Development

Report of Marcelo Occhiuzzi, Manager Strategic Planning At its meeting on 20 April 2015, Council resolved to defer the consideration of the Planning Proposal for this site pending a further Councillor Briefing. Council staff have attempted to arrange such briefing with the applicant for the evening of 5 May 2015, however, have been advised by the applicant team that it is unable to attend and therefore requested that such briefing be convened at a later date. An alternative date of 19 May 2015 is available which has been communicated to the applicant. This report discusses the process undertaken by the Department of Planning and Environment in assessing the proponent’s request for a “gateway review” and timing implications. Recommending: 1. THAT Planning Proposal - 75-89 Chandos St, 58-62 Atchison St and 23-35 Atchison St, St Leonards – Auswin TWT Development this report be noted.

9. CiS05: Integrated Traffic and Parking Strategy (ITPS)

Review

Report of Nigel Turner, Strategic Transport Planner On 15 September, 2014 Council resolved (Min. No 375): 4. THAT prior to the commencement of any trial period the Integrated Traffic and Parking Strategy be referred to Council’s City Strategy Division to ensure that the following issues are adequately addressed:

1. The criticism in the peer review of the Integrated Traffic and Parking Strategy relating to the mixed-function nature of the streets in the North Sydney local government area; 2. The submissions of residents and Precinct Committees relating to issues of resident commuter parking within the proposed enlarged new TAPAS areas, particularly around activity generators such as transport hubs, theatres, schools, including creation of hub zones and number of resident parking permits; 3. Consistency with Council’s ESD Best Practice Transport recommendations. An assessment of the four key recommendations of the ITPS has been made against criteria identified in the peer review, community consultation, and ESD Best Practice Project. This assessment has shown that: The traffic and parking prioritisation processes proposed by the ITPS are generally consistent with Council’s objectives for the effective management of transport in North Sydney and, subject to minor changes to the traffic plan process, should be initiated as soon as possible; The amalgamation of resident parking scheme permit areas in to TAPAS precincts and the standardisation of parking permit entitlements both warrant further consideration. Possible improvements to the resident parking scheme will be considered as part of the Integrated On-street and Off-street Parking Strategy, including potential changes to resident parking scheme permit allocation areas and changes to permit entitlements. Recommending: 1. THAT Council endorse the development of prioritised transport minor works programs (Traffic and Parking Plans) for TAPAS precincts using amended Traffic Plan assessment processes that address a broader range of transport related Community Strategic Plan indicators. 2. THAT Council not endorse the proposed amalgamation of resident parking scheme areas until a full review of the North Sydney Resident Parking Scheme is completed as part of the Integrated On-street and Off-street Parking Strategy. 3. THAT Council not endorse changes to resident parking permit entitlements until a full review of the North Sydney Resident Parking Scheme is completed as part of the Integrated On-street and Off-street Parking Strategy.

10. CiS06: Hume Street Park expansion - Concept and feasibility

planning

Report of Alex Williams, Strategic Planning Team Leader - Policy On 22 October 2012, Council formally adopted the St Leonards/Crows Nest Planning Study - Precinct 1 (“the Study”) which sought to manage the growth of that precinct. A key outcome of the Study was the proposal to expand Hume Street Park and provide a pedestrian link to Willoughby Road. In August 2014, consultancy team Tonkin Zulaikha Greer & JMD Design (TZG+JMD) was engaged to undertake concept design and feasibility planning for the expansion of Hume Street Park. In collaboration with an internal working team, the consultant team has prepared three concept design options for the expansion of the park. Options 1 and 2 are generally consistent with the open

space gains envisaged by the Study of Precinct 1. Option 3 takes into consideration the limited life span of the existing Hume Street car park and indoor sports centre structure and represents a whole-of-block outcome with significant open space gains beyond that envisaged by the Study. The next stage of the process is to consult with the community, including key stakeholders, regarding the three options and their component parts. This will assist in the ongoing refinement of the concept designs. It should be noted that this remains at concept stage and there is enough flexibility in the options to enable component parts of the designs to be amended or massaged following consultation. TZG+JMD have prepared a staging plan for each concept design option. Notably, stages 1 and 2 are similar for each option. An opportunity therefore exists to implement stages 1 and 2 with funds available in the short-term, while deferring implementation of a final outcome until design refinements are made, and cost implications and funding options become clearer. A transformational project such as that represented by concept design option 3, may well attract State Government funding should the mooted Crows Nest Rapid Transit railway station, and associated requirements for increased density, come to fruition. This report recommends that the consultant outputs, including the three concept designs and funding options, be placed on public exhibition for community input. Following the consideration of submissions and further deliberation with the consultant team and Councillors, it is anticipated that a preferred option can be identified and pursued to detailed design. Identification of a preferred option will also allow for a detailed long term funding plan to be prepared for implementation beyond Stages 1 and 2. Recommending: 1. THAT the concept planning and feasibility work prepared by consultants TZG+JMD (Attachments 1-4) be placed on public exhibition for 28 days. 2. THAT key stakeholders, including the Holtermann Precinct Committee, North Sydney Indoor Sports Centre, Kelly’s Place Children’s Centre and property owners within Precinct 1, be notified of the exhibition period and offers be made for Council staff to present the three concept design options.

Community & Library Services Division 11. CLS01: RSL ANZAC Day events: North Sydney and

Kirribilli Sub- Branches

Report of Martin Ellis, Director, Community and Library Services The RSL North Sydney Sub-Branch events marking “100 years of the ANAZC tradition” were successfully staged at 10am on 19 April 2015 and on Saturday at 6am on ANZAC Day itself, 25 April 2015, at the War Memorial, Ridge Street, North Sydney. Some fifty persons attended ANZAC Sunday, and approximately 1,000 attended the dawn service, the latter being double the number expected. Although the order of the events, including invitations and the master ceremonies role, is determined solely by the Sub-Branch, Council was a major contributor to the successful staging: contributing a refurbishment of the Cenotaph itself (re-pointing, refurbishment of the ground lights, installation of a power point; and provision of Public Address System, lectern and lectern-light. Numerous compliments were received by Council staff about the presentation of the grounds (new turf, bark chips and general tidiness). Also supporting the event were The North’s Group and The Greens who provided chairs and a shotgun breakfast for the public and special guests at the conclusion of the ceremony. The Mayor also attended the Kirribilli Sub-Branch’s ANZAC Sunday. At both Sunday events the Mayor was asked to speak and her address is provided with this report. While grant funds were received from the ANZAC Memorial Committee for Council’s refurbishment of the HMAS Sydney Bow; no funds have been received for the Cenotaph. Some Council funds for this project remain and options for making final improvements (to the above ground lights) are being costed. Recommending: 1. THAT the report be received. 2. THAT improvements suggested in the report be introduced for ANZAC Day 2016.

12. CLS02: The North Sydney Art Prize 2015

Report of Alison Clark, Arts and Culture Coordinator This report details the successful delivery of The North Sydney Art Prize held at The Coal Loader Centre for Sustainability from 7 to 22 March 2015. It presents an overview of the project and the positive response from artists, community and visitors across the region. Funding for these projects was included in the adopted 2014/15 budget. Recommending: 1. THAT the report be received.

This report presents the estimates for Shorelink 2015/16. North Sydney’s contribution is provided for in the estimates that have recently completed public exhibition. Recommending: 1. THAT the Shorelink estimates for 2015/16 be adopted.

14. CLS04: Termination and Re-establishment of Lease - 215

Chandos Street, Crows Nest

Report of Martin Ellis, Director, Community and Library Services Council jointly owns the above property (Council’s share: 41.33%) jointly with FACS (NSW Land and Housing Corporation). Along with Taldumande it provides the only transitional youth housing in North Sydney and has been managed by Phoenix House on Council’s behalf since 1996. The current lease is to June 2016 with a 5 year option. Responding to the Staying Home Going Home Reforms (previously reported to Council), Phoenix House has written to Council asking for its lease to be terminated and re-established with Link Housing for the same purpose. The purpose of the request is to secure the property and its service to vulnerable young people into the future. Phoenix House itself has funding certainty for only another 2 years. There will be no impact on the existing tenants. FACS officers have advised the author of this report that they will agree to the proposal if Link Housing agrees to take on the lease. Link has advised the author of this report that Link will agree to do that. Council is currently liable for maintenance of the property although there is no specific cost centre for it. The model for long term maintenance that Council has resolved to enter into for its development at 23 Nicholson Street can also be applied to the Chandos Street property: namely a 50 year fully repairing and insuring lease which requires Link Housing to meet all cyclical and capital maintenance costs. FACS officers have also given support for this. The proposal secures the financial management of the property, costs to be met by Link. Recommending: 1. THAT Council advises The NSW Department of Family and Community Services (LAHC) that it supports the termination of the existing lease to Phoenix House for 2015 Chandos Street, Crows Nest on the understanding that the property will continue to be used for transitional youth housing. 2. THAT Council enters in to 50 year fully repairing and insuring lease with Link Housing and FACS (LAHC) for the property at 215 Chandos Street Crows Nest.

15. CLS05: Construction of 23 Nicholson Street, Wollstonecraft

THAT Council accept the tender of the highest ranked Tenderer for Tender 34/2015 for Construction of 23 Nicholson Street Boarding House. 2. THAT Council hereby authorises its Official Seal to be affixed to Contract 34/2015 under the signature of the Mayor and the General Manager. 3. THAT, once Council has executed the Contract, information relating to the successful tender be published in Council’s Register of Contracts as required by Government Information (Public Access) Act 2009 - Part 3 Division 5 - Government Contracts With Private Sector.

16. CLS06: Proposed lease over North Sydney Court House

Report of Martin Ellis, Director, Community and Library Services As foreshadowed in a report to Council (15 December 2014) Council has received an offer from the NSW Department of Justice for a three year lease over part of the North Sydney Courthouse for the development of a Youth Hub (integrated services to youth). The term is for three years with the potential for a long term lease after that. No rent is payable but there are outgoings and the Department is asking Council to pay the cost of separating the space on offer from the courtrooms which will need to remain as a fall back to the Children’s Court for 3 years. The costs for this opportunity ($32,000 per annum for 3 years, including electricity) are not as yet included in the Delivery Plan. The cost of separating the courtrooms from the rest of the building is $8,500. Recommending: 1. THAT Council considers allocating:

$32,000 annually towards operating costs for the Youth Hub at the North Sydney Courthouse, and

$8,500 towards separating the leased areas of the building from the courtrooms and if in the affirmative

2. THAT Council enters into a 3 year lease for the old Police Station area of the Courthouse.

17. CLS07: North Sydney Bus Shelters - Naming Proposals

Report of Helen Perry, Reader Services Coordinator A planning proposal was presented to the Legal and Planning Committee 16 March 2015, and there was discussion about unnamed bus shelters. They are: BS065 - corner of Carter Street and Cammeray Road, Cammeray, and BS066 adjacent to 19 Gerard Street, Cremorne. Concerning the latter, the Principal of Redlands has been consulted and has written to Council: “Thank you for contacting us in regards to the Heritage Bus Stop at 19 Gerard Street, Cremorne. On behalf of Redlands I am very happy to support your recommendation to name the Heritage Bus Stop at 19 Gerard Street as

20. CoS03: Investments Held as at 30 April 2015

Report of Garry Ross, Manager Financial Services (Responsible Accounting Officer) This report provides details of the performance of Council’s investment portfolio for the month of April 2015. The portfolio provided an annualised return of 4.41% for the year to date as at 30 April 2015, 1.74% above the reportable benchmark (BBSW Bank Bill Index) Interest returns for the month ended 30 April 2015 remain consistently above the benchmark. This was attributed to additional funds being made available for investment and prudent selection and allocation of these funds to the financial institutions which make up the investment portfolio. Interest returns for this financial year reflect estimated available funds and predicted expenditure of Council’s reserves. The 2014/15 budget estimates for returns from Council’s investment portfolio have been reviewed in the March Quarterly Budget Review. Recommending: 1. THAT the report be received.

21. CoS04: Financial Assistance Grants to Local Government

Report of Garry Ross, Manager Financial Services (Responsible Accounting Officer) The federal government announced, as a cost saving measure in the 2013/14 Federal Budget, that there would be a pause in the indexation on the national pool of financial assistance grants for a three year period to 2016-17. North Sydney Council receives the minimum per capita grant for the general purpose component, however, the importance of the Financial Assistance Grant is that it provides necessary funding to Council and reduces the constraints for competing budget priorities. The financial implications are estimated to be a reduction in net terms of approximately $130,000 over the next three years. The impact of the indexation freeze has been identified and has been incorporated into the Amended Delivery Program 2013/14-2016/17 Recommending: 1. THAT the report be received. 2. THAT the importance of the Financial Assistance Grant be acknowledged. 3. THAT the 2014-15 Financial Assistance Grant of $1,893,010 be acknowledged. 4. THAT all Commonwealth grant funding is identified in all relevant Council publications.

22. CoS05: Quarterly Budget Review - March 2015

Report of Darren Goode, Accounting Services Manager The purpose of this report is to inform Council of the results of the review of the budget for the quarter ended 31 March 2015 and to seek approval to make the necessary adjustments to the 2014/15 revised budget to reflect the current projected estimates of income and expenditure for the year. The net effect of the adjustments to the 2014/15 revised budget outlined in this report was the budget remaining in a balanced position at the end of the March quarter with net transfers from reserves of $6.2 million. Recommending: 1. THAT the Quarterly Budget Review Statement - March 2015 report be received. 2. THAT the recommended adjustments to the 2014/15 budget be adopted.

Engineering & Property Services Division 24. EPS01: Sustainable Transport Reference Group - Minutes 27

April 2015

Report of Michaela Kemp, Manager Traffic and Transport Operations This report presents the recommendations of the last meeting of the Sustainable Transport Reference Group held on 27 April 2015, for Council endorsement. The minutes are attached for information. Recommending: 1. THAT the information on Current Sustainable Transport Projects be received. 2. THAT in terms of Clause 4.1 of the Sustainable Transport Reference Group Charter the WestConnex project is inimical to promoting 'public, active and alternative transport modes to reduce the reliance on private use in and through the North Sydney local government area' because; a) WestConnex will directly increase the volume of private road traffic 'in and through' the North Sydney local government area b) WestConnex's enormous opportunity cost of $12 billion out of taxpayers' funds will mean that money will not be available to build preferred sustainable transport infrastructure projects such as the Second Harbour Rail crossing, Light Rail from North Sydney to Balmoral and Harbourlink that would be of much greater benefit to residents and ratepayers of the North Sydney LGA; and c) WestConnex will physically hinder or prevent North Sydney becoming a 'walkable' and ‘cyclable’ city connected with world-class public transport infrastructure. 3. THAT North Sydney Council write to the NSW Minister of Infrastructure to express these concerns. 4. THAT more information and updates about the proposed new rail line through North Sydney be sought from Transport for NSW for the information of the Reference Group.

25. EPS02: Traffic Committee - Minutes 1 May 2015

Report of Michaela Kemp, Manager Traffic and Transport Operations This report presents the recommendations of the last meeting of the Traffic Committee held on 1 May 2015, for Council adoption. The minutes are attached for information. At the Council meeting on 20 April 2015 it was resolved: THAT Council refer the matter of reporting delegated authority matters to the Director of Engineering and Property Services. The format of reporting the Traffic Committee Minutes and recommendations to Council has been changed to reflect the above resolution of Council. In the new format, the items approved under Traffic Delegated Authority, as well as the Traffic Committee recommendations for all Minor Parking Restriction and Minor Traffic Investigation items are now also attached for information. 26. EPS03: ‘Route 2’ Proposed cycleway and Streetscape Upgrade Concept

Report of Lindsay Menday, Sustainable Transport Project Coordinator Attached to this report is a streetscape upgrade concept that proposes significant improvements to streetscape quality, landscaping and the walking and cycling network in parts of North Sydney, Neutral Bay and Cremorne. In line with the vision of the North Sydney Community set out in the Community Strategic Plan 2013 -2023, the upgrades proposed will result in a high quality built environment that enhances sense of place and community connectedness, and strengthened walking and cycling links that facilitate a shift towards greater participation in sustainable transport modes. The study area for the concept follows the alignment of ‘Route 2’ from the North Sydney Integrated Cycling Strategy (‘the Cycling Strategy’). The Cycling Strategy highlights that cycling projects need to be integrated with broad streetscape upgrades that benefit for the community as a whole, and accordingly, the concept places equal emphasis on general streetscape and landscaping

upgrades, pedestrian amenity improvement, and traffic calming measures as part of a comprehensive streetscape improvement concept. The upgrades proposed include:

New landscaping, including new garden beds, street trees and new or refurbished paving and footpaths;

New pedestrian crossings and improvements to safety and amenity along key walking routes;

New cycle lanes and cycle route treatments to make cycling safe and convenient for people of all ages and cycling abilities;

No change to exciting car parking provision in the study area;

Traffic calming measures to improve residential amenity and road safety.

Council have received a funding pledge for the RMS for a $470,000 contribution to the construction of these works in the 15/16 financial year. A cost estimate has been prepared which estimates the total project value including all elements of streetscape upgrade proposed in the study area at between $5.5 and 8 million. Details of current Traffic and Transport Operations budgets are provided in the table below. Parts of the project will likely be eligible for part of full funding under the RMS Active Transports Program. Totals $1,490,000 $625,000* The project has been designed to allow delivery in stages, with priority given to sections that will provide the most significant improvement to pedestrian and cycling network safety and accessibility. The highest priority sections are:

Stage 1 – Merlin Street to Park Avenue, including new traffic signals at the intersection between Merlin and Ernest Streets to provide a safe pedestrian and cycle crossing point and improved amenity. This will address a key missing link in the pedestrian and cycling network and barrier to the uptake of active transport. (Approximate value = $1.6 Million)

Stage 2 – Lodge Road Playground Road Reserve. This section currently has a shared path providing pedestrian and cycle access with compromised access for both user groups. A separation of pedestrian and cycle access through this reserve is proposed. (Approximate value = $300,000 including upgrades to open space, landscaping and the road reserve)

While the project stages have been designed to provide complete walking/cycling network connectivity, the design will also allow for Stages 1-5 to function as effective walking/cycling connections and provide significant benefit independently. This report recommends that the concept be placed on public exhibition, that feedback received during community consultation be used to inform refinements

to the design prior to construction, and that Council work with key funding and approvals bodies to deliver the improvements proposed. The proposed cycle way and associated streetscape upgrades will result in no loss of on street car parking. Three (3) additional car parking spaces would be created in the Merlin Street section of the study area, and increases to car parking zones would also occur in locations where kerb build outs are proposed. Funding for cycling projects is allocated in the adopted 4 year delivery program. Funding has also been allocated to this project by the Roads and Maritime Services (RMS) and Transport for New South Wales (TfNSW). These will allow part delivery of the project, however additional funding will be required to deliver the project in full over coming financial years. The report includes a recommendation that Council seek additional funding for this project under the Active Transport Project funding program. The provisional total cost estimate for the project is between $5.5-8 million. This includes all streetscape works, landscaping and traffic/cycleway facilities upgrades as proposed. The project has been designed to be delivered in stages subject to funding availability. A number of project components will be eligible for part or full funding under RMS funding programs. Recommending: 1.THAT the concept design be placed on public exhibition for a period of 28 days, including two (2) community information and feedback sessions (one during business hours and one in the evening), a presentation board in Council’s Customer Service Centre, and notification (via letterbox drop) of residents/businesses along streets where fully separated cycleway is proposed. 2. THAT the concept be forwarded to the North Sydney Traffic Committee for consideration. 3.THAT at the end of the public exhibition period, a further report be prepared detailing the outcomes of consultation and any issues to be considered as part of further development of detailed designs. 4. THAT should no significant objection be raised regarding Stages 1, 2 and 3 of the project as identified in this report, that Council proceed to detailed design of these sections and construction subject to RMS approval and funding availability. 5. THAT Council seek additional funding from the Roads and Maritime Services for the construction of the project. 6. THAT Council seek partnerships with the RMS to further develop and implement/construct changes proposed on land owned and managed by the RMS.

27. EPS04: New Air Conditioning Installation at Kirribilli Neighbourhood Centre - Contract 41/2015

Report of John Butterworth, Projects Manager, Engineering & Property Services Tenders were called and were received until 4pm, Tuesday 24 March 2015 for the submission of tenders to undertake the Stage 2 Executive Offices Fitout on the ground floor of the Council Chambers. In order for Councillors to discuss the content of this Commercial in Confidence report it will be necessary to close the Council meeting to the public. This project will be funded from the Capital Works Reserve. Recommending: 1. Report of Peter Massey, Manager Environmental Services This report presents the recommendations of the last meeting of the Environment Reference Group held on 27 April 2015, for Council endorsement. The minutes are attached for information. Recommending: 1. THAT the NSW Container Deposit Scheme report be received. 2. THAT the Earth Hour 2015 Festival Evaluation report be received. 3. THAT Council’s Senior Sustainability Programs Coordinator Niki Carey be congratulated on her efforts during the Earth Hour 2015 Festival. 4. THAT the Participation in Community Recycling Centre (CRC) report be received. 5. THAT the Electronic Waste (E-Waste) Recycling Collection Services Program report be received. 6. 31. OSE02: Draft North Sydney Recreation Needs Study - Post

Exhibition

Megan White, Landscape Planner The new draft North Sydney Recreation Needs Study (RNS) will form the basis for future decision-making regarding sport and recreation development in the North Sydney local government area. The new Study will enable the provision of recreation facilities and services that meet identified community needs in North Sydney in a rational, equitable and efficient manner. The new draft RNS supersedes Council’s Recreation Needs Study 2005. The new draft RNS was completed in January 2015. Public exhibition of the draft document was widely advertised to the general community, and identified stakeholder groups including sport clubs, schools and other organisations involved in recreation were also informed that a new draft RNS was available for viewing and comment. The public exhibition period ran for 10 weeks, and closed on 27 March 2015, however the draft RNS is still available for viewing on Council’s website in the ‘Latest News’ area. 8 written submissions were received. This report documents the content of these submissions and the alterations it is proposed to make to the draft RNS as a result. This report also documents some of the major findings of the draft RNS. It sets out key goals, strategies and actions to be undertaken over the next 5 - 10 years. Implementing the Study’s recommendations will ensure that current and future

32. OSE03: Debrief report of “Party in the Park’ event North Sydney Oval

THAT Council call for a comprehensive report on the North Sydney Leisure and Lifestyle Festival held in and around North Sydney Oval from 5-7 February 2015 ensuring that the report incorporates an itemised breakdown by event (Bose Youth Eisteddford, Celebrity Cricket Match, Concert, Mayoral/Festival Ball, Fitness Class, Food and Wine Festival, Rebel Run, Spartan Kids race, Sports, the Hub, etc) including financials, all correspondence between Council/Councillors and Harte International (or its representative/sponsor/third party), feedback from third parties/sponsors involved in the event and the cost to Council (financial and Council staff time). 2. THAT Council also call for a similar report on the Party in the Park event. The event created a positive financial implication for Council Recommending: 1. THAT the Debrief report of “Party in the Park” event North Sydney Oval be received.

33. OSE04: Participation in Community Recycling Centre (CRC)

Bo Karaula, Executive Environmental Health Surveyor Northern Sydney Regional Organisation of Councils (NSROC) has been successful in obtaining funding from the NSW EPA’s Waste Less, Recycle More Initiative to establish a Community Recycling Centre (CRC). A Community Recycling Centre is a permanent drop-off facility for the community to recycle or safely and easily dispose of household problem waste which cannot be disposed of in household bins. It is an endorsed project in the Northern Sydney Regional Waste Strategy. The Centre will be established in Artarmon in alliance with Willoughby City Council, Hunter’s Hill Council, Lane Cove Council and City of Ryde Council. It is recommended that North Sydney Council proceed to work in partnership with the alliance to set up a Community Recycling Centre based in Artarmon. This regional approach will ensure safe and easy disposal of household problem waste. The financial implications on the Domestic Waste Management budget from 2014/15 to 30th June 2017 are outlined within the report. Recommending: 1. THAT Council resolves to establish a Community Recycling Centre (CRC) in alliance with Willoughby City Council, Hunter’s Hill Council, Lane Cove Council and City of Ryde Council.

Re: Urban Speed Limit Reduction to 40km/h

1. THAT Council resolve to make a submission to the RMS recommending that the default urban speed limit be reduced to 40km/h across North Sydney Council area. Reasons:

Reduced speed limits will result in reduced fuel and vehicle operating costs and a reduction in vehicle emissions and noise.

Lowering the default urban speed limit to 40km/h would make walking

and cycling more attractive modes of transport by creating a safer and more amenable road environment;

Lowering the default urban speed limit to 40km/h would meet the

objectives of Council’s long-held Vision and Delivery Program by improving community safety;

Reduction in average travel speeds results in fewer and less severe crashes and road trauma;

Some areas within Australia and throughout the world have implemented

reduced speed limits to 40km/h eg City of Sydney and Unley, SA and Yarra, Victoria (Some cities as Stockholm in Sweden have implemented 30km/h);

Vulnerable road users would benefit the most from a reduction in speed

limits;

Lowering the default urban speed limit is one step closer to long-term goals as part of the safe systems approach to road safety particularly in dense urban areas like North Sydney, thus making allowance for human error and to minimise the consequences;

Decreasing speed limits will negligibly reduce total travel time.

In conclusion the significant overall benefits of lowering the default urban speed limit to 40km/h of North Sydney would far outweigh any negatives associated with such a change.
