Paramedic Services Toy Drive Update – Week Four Midhurst/ December 7, 2018 – County of Simcoe Paramedic Services kicked off the 16th annual Toy Drive on November 15, 2018, so far collecting 1,652 toys, 3,545 lbs of food and more than $4,582 in cash and gift cards. The Toy Drive benefits local children and families during the holiday season. Donations of new, unwrapped toys will be accepted at various locations and parades across Simcoe County until December 17, 2018. Paramedics will be collecting donations at the following locations this weekend: December 8, 2018 Barrie Toys R Us (Bayfield Street) Collection - 11 a.m. to 3 p.m. Barrie Walmart (Bayfield Street) Collection - 11 a.m. to 3 p.m. Barrie Walmart (Mapleview Drive) Collection - 11 a.m. to 3 p.m. Wasaga Beach Walmart Collection - 10 a.m. to 4 p.m. December 9, 2018 Barrie Toys R Us (Bayfield Street) Collection - 11 a.m. to 3 p.m. Barrie Walmart (Bayfield Street) Collection - 11 a.m. to 3 p.m. Barrie Walmart (Mapleview Drive) Collection - 11 a.m. to 3 p.m. Donations can be made at the County of Simcoe Administration Centre, 1110 Highway 26 in Midhurst between 8:30 a.m. to 4:30 p.m. and at all County of Simcoe Paramedic stations, where outdoor drop boxes are now available (please do not leave monetary donations in drop boxes – only non-perishable food items and new, unwrapped toys). In addition to the previously listed venues, the 2018 Paramedic Services Toy Drive will be collecting donations at these following events across Simcoe County throughout the holiday season: December 13 and 14, 2018 Simcoe County Museum Victorian Christmas - 6 to 9 p.m. December 15, 2018 Craighurst Foodland Collection - 10 a.m. to 2 p.m. *Events are subject to change and additional locations may be added throughout the Toy Drive. December 13, 2018 Re: Value of AMO Membership 2019-2020 You would be right to think of AMO as a highly influential policy development and advocacy organization, but it is so much more. We are also a provider of programs of direct support through our Local Authority Services (LAS). We also advance municipal employer interests in OMERS as your sponsor representative through the Municipal Employer Pension Centre of Ontario (MEPCO). Take a few minutes to look at this video that speaks to our roles. In the meantime, let me highlight a few of the benefits as I ask you to renew your AMO membership. In the first 100 days of the new provincial government, our work has resulted in positive changes for municipal government in Ontario. We now have fairer and clearer criteria for municipal governments to argue capacity to pay in fire service negotiations and interest arbitration. We now have full, absolute protection for “doublehatter” firefighters and we have seen the repeal of recent labour laws that would have added costs to municipal governments. We know the Government of Ontario is facing a very big fiscal challenge, one that has it looking at every single funding program, including those that support municipal governments and others in the broader public sector. We know consultations are occurring on development charges, housing and reducing the reporting burden on municipal governments – and that is just in one of many ministries that have an impact on municipalities. Your membership in AMO gives the sector a seat at the provincial table. It gives us the ability to coordinate municipal governments and tap the talents and front-line knowledge of members on any number of topics. The coming year is going to be a pivotal year – a year when the municipal sector needs a strong, clear and united voice. We are a constant and influential voice at Queen’s Park when it is needed most. Please renew your AMO membership. OMERS is also a significant policy area if you are an OMERS employer. Take a look at your employer pension contributions – which average 10.7%. It is a significant budget line for your municipality. Even with some solid investment returns, OMERS remains in deficit from the last recession. In addition, the future is going to be more challenging for plan sustainability. OMERS estimates that by the year 2030, the ratio of contributing members to retirees with be 1:1. MEPCO is the municipal employers’ pension voice. Its work is critical to protecting municipal employer interests. Without MEPCO, work on pension issues would be weakened and municipal representation would suffer. Employee-side sponsors are fully supported and resourced by their union associations. Employer sponsors must be fully supported too. I promise that we will continue our hard work on your behalf in 2019. To do that we need your membership in AMO and MEPCO. The related membership invoices have been mailed to your treasury department for payment. Municipal governments are the frontline of governments. Let us work together in 2019. October 29, 2018 Request of Municipal Clerks: Could you please make this document available to all new and incumbent council members coming out of your October 22 municipal election? We do not have all their email addresses at this point. ROMA Policies and Procedures sets out the requirements for the Notice and deadline for Zone Nominations. Deadline for receipt of nominations is December 31, so if an individual of your 2018-2022 council is interested in running for the ROMA Board, then Council will need to pass a supporting resolution at a December 2018 meeting. The following pages provide all the information related to the election process, time commitment for the Board, expense policy and a sample nomination resolution. Thank you for forwarding to members of your new council and tabling this on council agenda.

ROMA Notice and Zones

Please be advised that in accordance with the Rural Ontario Municipal Association’s Policies and Procedures, this is notice of nominations for Zone Representatives to the 2019 – 2020 ROMA Board. The term of the ROMA Board is four years.

The election will take place on Monday, January 27 at the 2019 Annual Conference. The conference is January 26 to 29, Sheraton Hotel, 123 Queen Street West, Toronto, Ontario.

Qualifications of Directors

Every Director shall: be an individual of eighteen (18) or more years of age; be an elected official of a municipality which is an AMO member; not be an undischarged bankrupt; and not be declared incapable.

Nomination Requirements

The attached Nomination Form completed by the individual plus a Council Resolution supporting the individual must be received by the deadline. The Nomination Form and Sample Resolution that specifies the Zone are attached. The names of all qualified individuals who are duly nominated will appear on the ballot.

A completed Nomination Form and supporting resolution must be received no later than 4:00 p.m. on Monday, December 31, 2018. Nominations will not be accepted beyond that date. Please forward a completed Nomination Form to ROMA via email [email protected] or fax at (416) 971-6191 or mail to the attention of Pat Vanini, Executive Director as noted on the Form. Allcandidates will be contacted to confirm receipt of their nominations.

ROMA’s Chief Returning Officer, Peter Fay, will certify the nomination. He will contact all candidates. A Nominations Report will be issued in advance of the conference. Information as to the election process at the conference will be sent as well.

Other Important Information Time Commitment: ROMA Board meetings are held eight times per year, typically on the second Thursday of the month in January, March, April, June, October, November and December in Toronto. The August meeting is held at the AMO Conference. A mid-term meeting is held every two years, in May or June. In addition, Board members may serve on sub-committees from time to time or asked to be a ROMA representative on others’ committees. Time for this will vary with the activity.

ROMA Expenses: ROMA Board members are entitled to a per diem of $75 per day (effective Jan 1, 2009) when attending meetings on behalf of ROMA business, these meetings include the ROMA Board, AMO Board, Committees and any other meetings where attendance has been pre-approved by the ROMA Chair. A per diem is not applicable to the ROMA mid-term meeting. ROMA will reimburse travel expenses to all ROMA Board meetings, AMO Board meetings (if applicable) and the Summer Retreat. Travel expenses refer to airfare, train fare and car mileage, parking costs, public transit, and accommodation. Meal costs will also be paid subject to a maximum of $75/day. Nomination Form follows.

[1] John Millard (the “Applicant”) applied for a minor variance in order to permit relief

from the zoning by-law provision for minimum lot frontage for his property at 415

Local Planning Appeal Tribunal Tribunal d’appel de l’aménagement local

ISSUE DATE: November 26, 2018 CASE NO(S).: PL180716

Heard: November 15, 2018 in Midland, Ontario

2 PL180716 Midland Point Road. The relief is required to permit the future severance of a new

building lot.

[2] The Town of Midland (the “Town”) Committee of Adjustment (the “COA”)

approved the application notwithstanding that the Town planning staff did not support

the requested variance. A decision was made by Town Council to appeal the COA

decision. This hearing was held for the appeal by the Town of the COA decision to

approve the minor variance application of the above noted property.

[3] The Applicant did not attend the hearing and did not send any representative.

[4] Candice Lee, a local resident, attended in opposition to the requested variance;

however Ms. Lee did not provide any evidence to the Local Planning Appeal Tribunal

(“Tribunal”). No one else requested status at the hearing.

[5] Angela Zhao, a planner with the Town, was qualified by the Tribunal to provide

expert evidence limited to this matter on the basis of her experience on the question

before the Tribunal in this matter. This was Ms. Zhao’s first time qualified by the

Tribunal. Ms. Zhao has been employed with the Town for less than two years. She

explained to the Tribunal that she is a Candidate member of OPPI. She has amassed

the requisite experience to be qualified as a professional planner but has not yet written

the required exam. Ms. Zhao was the principal author of a planning report for a similar

application for the property immediately to the east at 399 Midland Point Road. This

application was approved by the COA and appealed to the Tribunal by Ms. Lee and her

husband. The Tribunal, constituted as this Member, allowed the appeal and did not

authorize the requested variance. Wesley Crown, the Director of Planning and Building

Services for the Town, authored the planning report that recommended refusal of this

application. Ms. Zhao indicated that she had reviewed that report.

[6] In the current matter, Ms. Zhao provided uncontested expert land use planning

evidence in opposition to the requested variance. No other evidence was provided.

3 PL180716 REQUESTED VARIANCES

[7] The application requests relief from Zoning By-law No. 2004-90, as amended.

Section 9.1.3.2: The by-law requires a minimum lot frontage of 35.0 m; whereas the proposed lot frontage will be 30.0 m. Condition of Approval required by the COA: 1. That the Applicant submit an evaluation, prepared by a qualified

professional, of the suitability of the two lots for private septic systems to the satisfaction of the Town.

2. That the applicant submit an Environmental Impact Study addressing the proposed development and the impact, if any, including any proposed mitigation required to ensure no negative impact on the environmental features and functions of the subject property.

3. That the Applicant obtain Provisional Consent Approval for the subject property.

ISSUE

[8] Section 45(1) of the Planning Act (“Act”) allows the Tribunal to authorize

variances to a zoning by-law where the variance is minor; is desirable for the

appropriate development or use of the land, building or structure; maintains the general

intent and purpose of the Official Plan; and maintains the general intent and purpose of

the zoning by-law. The Tribunal must be satisfied that all four tests are met in order to

authorize the requested variances.

EVIDENCE

[9] Ms. Zhao provided the planning context for this application, referencing the

documents provided in the Document Book at Exhibit 1.

[10] The subject property is an irregular shaped lot of about 2.7 hectares located on

the southwest side of the intersection between Curry Road and Midland Point Road. It

4 PL180716 has a width of about 60.28 metres (“m”); a depth of 466.04 m on the west side; and, a

depth of 411.46 m on the east side. The subject property is currently vacant and

wooded.

[11] Ms. Zhao explained that the Applicant wishes to sever the subject property to

have a new vacant building lot which would front onto Midland Road. The new lot would

have a 30.0 m frontage and an area of 2,743.2 square metres (“sq. m.”). The resultant

retained lot would have a frontage of 30.28 m, and an area of 24,719 sq. m.. This area

is not serviced so any new development would require a private water and septic

system.

[12] The subject lands are designated Residential District in the Town’s Official Plan.

The property is also part of the Shoreline Residential Special Policy Area 337 and the

lands are designated as Woodlot. The Town’s Zoning By-law No. 2004-90, as

amended, zones the lands Rural – RU. This zoning permits a single detached dwelling

and accessory buildings.

[13] Ms. Zhao testified that when planning staff reviewed this application, staff

considered the intent of the application, which was to facilitate the development of a

future severed lot.

[14] Ms. Zhao testified that the Growth Plan for the Greater Golden Horseshoe 2017

and the County of Simcoe Official Plan direct future growth in areas where services,

such as water and sewer, currently exist, and that this is not the case for the subject

property.

[15] In her evidence, Ms. Zhao referred to the staff report of June 29, 2018, entered

into evidence as Exhibit 1, Tab 8, to support her opinion that the requested variance

does not meet the four tests of the Act.

[16] She testified that the planning report reviewed the lot frontages in the vicinity of

the subject property and found that the variance would allow the creation of a lot with

5 PL180716 the shortest frontage in the vicinity, with the exception of two lots further to the east.

These two lots are differentiated due to the fact that they front onto the shoreline rather

than Midland Point Road. She stated that the proposed variance would result in two

lots with reduced lot frontage and this would not fall within the established character of

the neighbourhood and cannot be considered minor. Additionally, the proposed new lot

is not a desirable or appropriate development of the land because the reduced lot

frontage will set an undesirable precedent within the neighbourhood. The variance

does not meet the intent of the zoning by-law as it departs from the established

neighbourhood character and standards.

[17] Ms. Zhao testified that the intention of the Official Plan is to preserve the low

density character of the rural part of town and the shoreline area. She stated the intent

of the Residential District is to foster a sense of neighbourhood and to protect areas

from inappropriate development. Ms. Zhao took the Tribunal to s. 3.3.7.7 Lots by

Consent; wherein it states: “Within this area there are limited opportunities for the

creation of new residential lots. ...”. She also referenced s. 4.9.19.2 under the Woodlots

section; wherein it states: “.... Development proposals for woodlots or land situated

adjacent to and within 15 metres (49.0 feet) of identified woodlots may be permitted by

the Town, subject to the completion of an Environmental Impact Assessment (E.I.A.) to

the satisfaction of the Town and applicable commenting agencies......”

[18] She takes these policies collectively to mean that there are few opportunities for

new lot creation, and that this specific area, due to the need for a variance for lot

frontage and the presence of the woodlot that requires an EIA prior to any development,

is not an area conducive to lot creation. It is her opinion that the reduced lot frontage to

permit lot creation does not meet the intent and purpose of the Official Plan.

ANALYSIS AND FINDINGS

[19] The Tribunal heard uncontroverted planning opinion evidence from Ms. Zhao

who went through the four tests of the Act that are required to be met for the

authorization of a variance. It was her opinion that none of the four tests are met by this

do not meet the character of the surrounding area, and hence the application does not

meet the intent and purpose of the Official Plan or the zoning by-law, and is not minor

nor desirable.

[20] The Applicant did not appear at this hearing and did not provide any evidence to

refute this opinion.

[21] The Tribunal has reviewed the evidence provided in this hearing and accepts the

opinion of Ms. Zhao. The Tribunal finds that the requested variance results in a lot that

does not meet the four-part test of the Act and therefore the requested variance should

not be authorized.

ORDER

[22] The Tribunal allows the appeal. The requested variance to Zoning By-law No.

2004-90 is not authorized.

From: OPP News Portal <[email protected]> Sent: December 10, 2018 6:00 PM Subject: News release from the OPP ‐ OPP R.I.D.E. Checks in Full Swing on North Simcoe Roads A new media release has been made by the OPP for Southern Georgian Bay. The release content is below. If you wish to unsubscribe from these alerts, log into the OPP News Release Portal and select "Manage Account".  FROM/DE:   Southern Georgian Bay Detachment                          DATE: December 10, 2018            OPP R.I.D.E. Checks in Full Swing on North Simcoe Roads  (MIDLAND, ON) ‐ Members of the Southern Georgian Bay Detachment of the Ontario Provincial Police (OPP) have been busy checking for impaired drivers since the Festive R.I.D.E. program was kicked off here in Midland on Dec 3, 2018. Officers have checked over 1000 drivers for signs of impairment due to consumption of alcohol or drug at 24 separate locations in North Simcoe since then. To date, only one driver has been charged at these locations with a criminal code drinking and driving offence since the kick off.  Officers were also kept busy investigating vehicle crashes with the winter weather being a contributing factor to the 27 vehicle crashes that OPP officers were dispatched to between December 6‐10, 2018.  Officers on patrol at 05:09 am December 6, 2018 observed a vehicle strike the media at the intersection of Highway 12 and 93 in the Town of Midland. The vehicle then left the scene of the crash and was stopped by OPP officers shortly after. The lone female driver was spoken to by the officers who administered an approved screening device (ASD) test resulting in a 3 day suspension of her licence and a 7 day seizure of her vehicle under the Administrative Drivers Licence Suspension (ADLS) program. Further investigation resulted in the driver Danielle SHEA 28 years of Innisfil being charged with the following‐ 

Careless driving contrary to section 130(1) of the Highway Traffic Act of Ontario  Fail to report damage to property on highway contrary to section 201 of the Highway Traffic Act of 

Ontario  Driving while under suspension contrary to section 53 (1) of the Highway Traffic Act of Ontario  Fail to remain contrary to section 200 (1) (a) of the Highway Traffic Act of Ontario  Drive motor vehicle, no currently validated permit contrary to section 7 (1) (a) of the Highway Traffic
