Upon motion of Mr. Kendall, seconded by Mr. Schweser, Mr. Tremblay was excused from this meeting by
unanimous roll call vote.

INVOCATION : The meeting began with the Pledge
of
Allegiance. An invocation was given by Mr. Heath.
MINUTES: The Clerk gave a summary
of
the minutes
of
the January 20, 2015, meeting
of
Troy City Council.
There were no corrections or additions to these minutes. A motion was made by Mr. Clark, seconded by Mr.
Twiss, to approve these minutes. Motion passed by unanimous roll call vote.
COMMITTEE REPORTS:
Community and Economic Development Committee: Mr. Twiss, Chairman, reported that Committee
recommends Ordinance No. 0-1-2015 be adopted to provide for the rezoning
of
the 40 parcels that make
up
the
site at and adjacent to 600 W. Main Street, known as the former Hobart Brothers/ITW factory site and two parking
lots, from M-2, Light Industrial District, to OC-1, Office-Commercial District.

Recreation Parks Committee: Mr. Heath, Chairman, reported that Committee recommends legislation be
prepared authorizing the Recreation Board to enter an agreement with Crossroads Consulting Services for a
feasibility study related to a second sheet
of
ice at the Hobart Arena, at a cost not to exceed 50,000.

Short Street, was advised that Crossroads Consulting is located
in
Florida. She
commented that she has talked to people who support the second sheet
of
ice and who do not support closing
the Market Street Bridge (for the Strawberry Festival).
-Lester Conard, 1210 S. Clay Street, suggested the rezoning committee report could have said no one spoke for
the rezoning. He also gave his opinion that the City pays too much for consultants and staff could do the work
of
consultants. Mr. Titterington advised that the consultants have expertise
in
specific areas and can advise the
City as to the economic feasibility
of an
investment such as a second sheet
of
ice, including partnerships to fund
the cost if that
is
the recommendation.

COMMENTS OF THE MAYOR:
ORDINANCE ADOPTED
Mayor Beamish commented that the new class of Leadership Troy members started their program the past
week.
COMMENTS OF THE DIRECTOR OF PUBLIC SERVICE AND SAFETY:
Mr. Titterington commented that City offices will be closed February 16 for the Presidents Day Holiday.
COUNCIL COMMENTS:
-In response to Mr. Phillips asking if there is
an
update on three traffic light locations identified for possible
removal, Mr. Titterington commented that the one at Cedar and Main
is
not now scheduled for removal, but two
others are still under consideration.
-In response to Mr. Phillips regarding the trial LED street lights, Mr. Titterington commented that information is
still being evaluated for the trial
in
Troy and a few other communities
to
determine if the lights are cost effective
and
provide good lighting.
-Mr. Clark stated he was excited about the future development of the former Hobart Brothers/ITW factory site on
W. Main Street.
There being no further business, the meeting adjourned at 7: 18 p.m.

This Committee

on February 10, 2015, to consider recommending approval
of
the standard statement
of
services to be provided to the Miami County Board of Commissioners regarding the recently filed Cheney
Annexation. The meeting was also attended by Council President Baker, the Director
of
Public Service and
Safety, and members
of
the Ci ty staff.
A petition has been filed with the Board
of
Miami County Commissioners for the annexation
of
1.243 acres in
Concord Township. The parcel is located off Peters Road. The petitioner/owner is

Howard Cheney, and the
agent for the petitioner is William J Fulker. The Board
of
County Commissioners is the entity that holds a public
hearing on a proposed annexation. The public hearing has been set for April 7. At least 20 days prior to that
hearing, the City is required to adopt a statement indicating what services the municipal corporation will provide to
the territory proposed for annexation. Such services are those provided to any parcel within the City. Adopting
the statement does not provide consent to the annexation. The standard statement of
services is attached to the
report.
If the County proceeds to approve the annexation, documents would then be forwarded to the City.
RECOMMENDATION:
It is the recommendation
of
this Committee that legislation be prepared approving the standard statement
of
services related to the Cheney Annexation.

That immediately upon the effective date
of
the annexation
of
the 1.243 acre territory
the City
of
Troy Ohio
will
provide
to the
entire annexed
territory such
services
as
are
otherwise provided to incorporated areas under the Code
of
Ordinances
of
the City of
Troy Ohio in accordance with applicable contemporary law practice custom
regulation rates and resources. The services
of
the City
of
Troy currently include but
are
not
limited to: police f ire emergency medical service refuse collection repair
and
maintenance

This Committee met on February 2 to consider recommending the Resolutionof Necessity for the Streetscape 3B project. This
project includes both sides of

Main Street from Walnut Street to Mulberry Street. The current estimated costof the project is
575,000, and includes sidewalk and curbs, the paver brick design to the extent possible, underground utilities, light poles, and
other aesthetics identified as partof streetscape. 300,000 of the project cost willbe funded by
an
ODOT grant. Estimated to
be
assessed to property owners related to the sidewalk work is approximately 64,000. Those property owners will also
be
able to
present issues or questions related to the sidewalk work toan Assessment Equalization Board.

This Committee met
on

2015, to consider recommending the Resolutionof Necessity for the Streetscape
3B
project.
The meeting was also attended by Mayor Beamish, Council President Baker, Council Members Clark and Kendall, the City
Auditor, members of the City staff, and a citizen.
Streetscape 3B includes both sides of
E.
Main Street from Walnut Street to Mulberry Street. Project elements include
replacement sidewalk and curbs, the paver brick design to the extent possible, underground utilities, light poles, and other
aesthetics identified as part of this program. The current estimated costof the project is 575,000. 300,000
of
the cost will
be funded by
an
ODOT/MVRPC grant. Some of the cost will be paid through the City's utility funds, approximately 64,000 will
be assessed to the benefitting property owners for sidewalk related work, and the balance
of
the project paid from the fund
balance of the Capital ImprovementFund.
With the design nearly completed and submitted for ODOT approval, the next step is for Council to approve the Resolution
of
Necessity for this project, so that the property owners can
be
advised of the estimated sidewalk assessments. e were advised
that Council may also need to establish
an
Assessment Equalization Board (AEB) in the future to hearissues raised by the
property owners, with any recommendations of the AEB provided to Council for consideration. These are steps that must
be
accomplished ahead of bidding the project early
in
May so that the City can meet the ODOT requirement that a contract is
awarded in June (with construction after the Strawberry Festival).
It was noted that the property owner portion has increased, but that estimate was made prior to the design being nearly
completed. Because of all the elements of this project, and the need for a finished streetscape with common appearance, a
property owner is not permitted to contract with other than the successful bidder to
do
the work. However, the property owners
may also present concerns to the AEB. Once the projectis completed, and property owners advisedof the final assessments,
those owners may either pay the entire amount or have it assessed to taxes over five years, plus any fee included by the County
for
handling the assessment.
John Wilson, one of the property owners
in
the project area, commented that property owners have recently been improving this
area and
he
encouraged Council to consider some other way than assessing property owners for the sidewalks.
RECOMMENDATION:
It is the recommendation
of
this Committee that legislation be prepared authorizing the Resolution of Necessity for the
Streetscape 3B project.

RESOLUTION DECLARING THE NECESSITY
OF CO
NSTRUCTING SI
DEWALKS
IN THE CITY
OF TROY. OHIO
WHEREAS, the Council of the City
of
Troy has previously determined that sidewalk repair is a
priority item for the City has had determined to proceed with this continuing project; and
WHEREAS, this Council has endorsed the proposed plan for the sidewalks and streetscape
renovation on East Main Street between Walnut Street and Mulberry Street
in
Troy, Ohio, known as the
Downtown Sidewalk Program, Phase 38.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City ofTroy , Ohio as follows:

ON I: That this Council declares the necessity for such improvement.

ON II: That the Downtown Sidewalk Program, Phase 8 shall consist of a sidewalk
renovation and streetscape renewal on East Main Street between Walnut Street and Mulberry Street,
located
in
Downtown Troy, Ohio and that the attached Exh ibit A stated the lots of land to be assessed
for the improvement.
SECTION Ill:
That the costs paid by the City
of
Troy shall be the cost
of
handicap ramps,
strain poles, traffic signals, public electrical supplies, public utilities, curbs, intersection improvements,
pavement improvements, street lighting, pedestrian signals, landscaping, benches, and comer parks.

of
the cost

the Downtown Sidewalk Program, Phase 8

SECTION IV: That the cost that shall be assessed to be paid for by special assessment to the
adjacent property owners shall be the cos t

sidewalks less the cost

SECTION V: That the method of levying the special assessment shall
be
in proportion to the
benefits which may result from the improvements.
SECTION VI: That payment of such assessment shall be made

a lump sum payment to the
City
of
Troy within thirty 30) days
of
the published notice
of
the passage
of
the Assessing Ordinance in
accordance with the law. If payment is not made within such time as stated for lump sum payment,
such assessment shall be certified to the Auditor of Miami County for concurrent collection with property
taxes as assessed by said Auditor total number
of
payments not to exceed ten over a five year period .
SECTION VII: That securities will not be issued b y the City of Troy in anticipation of the levy
or collection of these special assessments.
SECTION VIII: That the Director of Public Service and Safety
of
the City of Troy, Ohio, is
hereby authorized to cause to be prepared an estimated assessment in accordance with the method of
assessment against each lot or parcel of land to be assessed and shall be filed in the Office of the Clerk
of Council upon its completion, and kept available for public inspection.
SECTION IX: That upon the filing of the estimated assessments, the Clerk of Council is
hereby directed to cause notice
of
the passage
of
this Resolution and
of
the filing
of
the estimated
assessment to be served on the owners
of
all lots and lands to be assessed , as provided by law.
SECTION X: That this Resolution shall be effective at the earliest date allowed by law.

Lining
Project - contractors are lining the SW Interceptor between
Peters Road and Southview subdivision. Manhole replacements and
various lining work
will occur at
the Public Square beginning on
February
23rd. Public Square traffic will be maintained, but quadrant parking will
be
limited.
Businesses
and
residents
were
notified
of
the proposed
work.

Attached is
a
copy of the Snow and
Ice
Removal
Expenses
report through
February 10, 2015. To date
the City
has used 481 tons
of the salt
supply
and
the total
cost is 48,767.71.
• As a
reminder,
City Offices will
be closed
on Monday, February
16 in
observance of

Presidents' Day holiday. Trash
collection and
curbside
recycling
will be on
schedule

Chief
Christopher Boehringer has announced
his
retirement effective
March
7 after
over
24
years of
service. Chief
Boehringer
began his
career
with
the City
of
Troy in July
of
1981
as
a Police Officer. He
resigned
in August
of
1984,
and then
came
back
to
the
Fire
Department
as
a
Firefighter
in
January
of
1994.
He
was
promoted to Assistant Fire Chief in July
of
2000,
and
Fire Chief
in December
of
2006.
• Recreation Director Ken Siler reports
that
the Tesla
Concert
on
February 7 was
a
sellout. Ticket
sales for both the February
13 and February 14
concert are
going quite
well.
• As a reminder, spring clean-up at Riverside Cemetery begins
on
March 1. All
old deteriorated,
or
noncompliant
decorations
either
on the
ground or
on
monuments) will be removed
by cemetery
personnel. New decorations
may
be
placed
starting
