Ensuring Optimal Prosthetic Foot PerformanceTo maximize performance and user satisfaction with Freedom Innovations foot products, it is essential that they be ordered according to the appropriate specifi cations. When the optimal device is eff ectively fi t, users should experience a prosthetic foot that assists them with a natural gait and stands up to high impact forces.

• Check to be sure that the user’s prosthesis will have the build space needed for the prosthetic foot that has been chosen.

• To provide the most responsive energy storage and return device, clinicians should typically select the “tallest” foot that can be fi t within the given build space. This ensures utilization of the longest carbon fi ber spring possible and as a result, the most dynamic response.

• The patient’s “impact level” is determined by their desired regular daily activities. The following chart will help classify the impact level as Low, Moderate or High. Be careful not to overestimate the patient’s activity level, to avoid selecting a product that is too stiff .

• By matching the patient’s impact level with their weight the appropriate foot stiff ness category can be identifi ed.

Terms of Sale, Returns & Warranties

1.0 New Accounts 1.1 How to Open an Account We establish an open account when you place your fi rst order with Freedom Innovations, LLC (Freedom LLC).

We require a completed credit application prior to processing a second order. The review and approval process will normally take no longer than 24 hours from our receipt of your application. Orders must be pre-paid or shipped C.O.D. until credit has been established. Obtain a credit application by telephone at: (888) 818-6777 or by e-mail at: [email protected].

1.3 Order Information When transmitting your order by fax or e-mail, please insure that the order includes the following information.

Upon our receipt, thereof, our Customer Service Department will confi rm the order and schedule it for shipment. • Part # or Item Description • Quantity desired • Price (from the price list or the mutually agreed contract price) • Shipping date desired • “Ship to” address and phone number • “Bill to” address (if it diff ers from “Ship to” address) • Transportation mode desired (Fedex Overnight, UPS Ground, etc.)

3 Return Policy And Process2.1 Returns, General Principals 2.1.2 Return Authorization Number (RA#) Required

A. All returns require a Return Authorization Number (RA#). Call Freedom LLC's Customer Service Department for that authorization. Be prepared to provide the Order Number under which you seek to return product, or in the alternative, the related Invoice Number or Patient Name.

B. Place the provided Return Authorization Number on the shipping container, on or near the shipping label. We will not accept returns without a RA#.

2.1.3 Return Destination: Ship all authorized returns to Freedom Innovations, LLC's location in Gunnison, Utah. 2.1.4 Return Opportunity: We will not accept returns after 90 days from the Invoice date. 2.1.5 Return Documentation: Send a copy of the original Invoice or Packing List with the returned product to insure

that you receive the replacement or credit for which you qualify. Failure to provide the required documentation may delay or prevent return processing.

2.1.6 Responsibility: Until Freedom Innovations, LLC receives the returned product at the Gunnison Utah location, the Prosthetist remains responsible for the product and all related billing.

2.1.7 Special Orders: We do not accept returns of special orders (Custom products). Special orders are products of a Line, Style, Category, or Size not ordinarily stocked in our Utah distribution facility.

2.1.8 Resaleable Condition: All product returned after 60 days from Invoice will be evaluated to determine that it is in resaleable condition. Such product found to be damaged or not in resaleable condition shall be returned to the Customer, with no credit issued.

2.2 Types of Returns 2.2.1 “Satisfaction Guarantee” Returns: If our Customers are dissatisfi ed with standard stock products that are eligible

for a Trial Period, they may return the product for size alteration, stiff ness modifi cation or account credit. They may return the Inception Liner for credit within 14 days of Invoice. The Catapult and Nitro Running foot products may be returned for credit within 30 days of Invoice.

A. Exceptions:• Special order sizes, category variations and Custom foot products are not eligible for Satisfaction Guarantee

returns.• The Plié MPC Knee is not eligible for a 60-day “Satisfaction Guarantee” Return.

B. Cash Refunds for products returned under the Satisfaction Guarantee are subject to approval by Freedom LLC.

2.2 Types of Returns continued 2.2.2 Miscellaneous “No Replacement” Returns: When Customer does not place a reorder at the time the RA# is requested.

A. We will accept all returns with RA#s issued between 0 and 60 days of the Order Date, and will not charge a restocking fee.

B. We will accept returns with RA#s issued within 61 to 90 days of the Order Date, if the returned product is resaleable. We will charge the customer a restocking fee of $20 or 20 % of the returned product’s invoiced value, whichever is greater.

2.3 Account Credit: We grant an account credit and apply it to a Customer’s account, pursuant to existing procedure or a negotiated agreement with the Customer (e.g. credit for returned goods, overpayments, duplicate payments, etc.).

3.0 Warranty Policy & Procedure3.1 Warranty Policy: We guarantee all of our products to be free from defects in material and workmanship. Any product found

to be defective, when used in a customary and proper manner according to published Instructions for Use, shall at Freedom LLC's discretion be repaired at our expense, or replaced at no charge with the same item. If we elect to replace a product returned under warranty, we will ship the replacement item in a timely manner accompanied by an invoice for the full retail cost. We will issue credit upon our receipt of the product’s return.

3.2 Warranty Terms: We calculate Warranty duration from the original invoice date.

3.2.1 FeetA. The Kinterra, DynAdapt, Agilix, Sierra, Pacifi ca, Pacifi ca LP, Highlander, Renegade, Renegade LP Original, Renegade

LP Revised, Runway, Thrive VS2, Silhouette, Silhouette (VS), Freestyle and LP Symes foot modules are under warranty for 36 months, irrespective of attached mechanisms or componentry.

B. The Senator prosthetic foot module is under warranty for 24 months.C. The Pediatric Defender foot module is under warranty for 18 months.D. The WalkTek foot module is under warranty for 12 months.E. The Slalom Ski foot, Catapult and Nitro Running foot modules are under warranty for 12 months.

3.2.2 JointsA. The Plié MPC Knee is under warranty for 36 months, with mandatory service checks at 12 and 24 months.

3.2.3 Mechanisms and ComponentryA. The Runway’s Push Pin and Hex Key Ankle mechanisms are under warranty for 18 months.B. The Renegade MX Multi-Axis Rotator mechanisms are under warranty for 24 months.C. The Freestyle Swim foot ankle mechanism is under warranty for 12 months.D. All prosthetic components are under warranty for 24 months.

3.2.4 Foot Covers A. All cosmetic foot covers are under warranty for 6 months from the original invoice date

3.2.5 Liners A. The Inception Gel prosthetic liner is under warranty for 12 months.B. The Inception Sil prosthetic liner is under warranty for 6 months.

3.3 Exclusions: The warranties set forth herein do not cover the battery, battery charger, adapters and optional accessories (each of which are covered under separate warranty), or test sockets, nor do they cover any alteration, repair or substitution of parts by others that, in Freedom LLC's judgment, materially or adversely aff ects the product or part, damage due to accidents, cosmetic damage, water damage deemed as abuse, neglect, misuse or operation beyond capacity, or parts damaged by improper installation.

DISCLOSURE: THE FOREGOING WARRANTIES ARE IN LIEU OF ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, WRITTEN OR ORAL, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR OTHERWISE, AND OF ANY OTHER OBLIGATION ON THE PART OF SUPPLIER. THE SOLE AND EXCLUSIVE LIABILITY OF SUPPLIER HEREUNDER SHALL BE TO REPLACE, REPAIR OR REFUND THE PURCHASE PRICE OF A DEFECTIVE PRODUCT, AS DESCRIBED ABOVE. 3 MPC KneeService and Limited Warranty InformationWarrantyThe Plié® 3 MPC Knee is provided with a 36 month limited warranty. Freedom Innovations warrants the product to be free of defects in materials and workmanship. This limited warranty is applicable to knees utilized according to manufacturer recommendations. Manufacturer required service and maintenance intervals must be completed to maintain the warranty. Accessories such as the battery and battery charger are provided with a 12 month warranty.

Service & Maintenance IntervalsTo maintain the limited warranty, the Plié 3 MPC Knee must be returned to the manufacturer for free service inspections at 12 and 24 month intervals (Time intervals are subject to change). The product will be inspected for proper function. Mandatory repairs and component upgrades will be completed at no charge. A loaner knee unit will be provided for use while the service inspection is underway. Although it is ultimately the responsibility of the user and his or her prosthetist to comply with the service and maintenance requirements, Freedom Innovations will attempt to notify the attending prosthetist that a service interval is due.

Extended Warranty (Optional)An optional 2 year limited warranty extension may be purchased to protect your investment past the included 3 year warranty. During this period, repairs deemed as mandatory by the manufacturer will be provided at no cost, including the use of a loaner knee unit. The extended warranty also includes two obligatory service and maintenance inspections at 36 and 48 months. The extended warranty must be purchased within 12 months of the original Plié 3 MPC Knee invoice date.

3 MPC Knee Limited WarrantyFreedom Innovations warrants that all of its products and services are free from defects in factory-supplied material and factory workmanship, subject to normal wear and tear; provided that the products are used in a customary and proper manner according to published Instructions for Use, without unapproved modifi cations, and are fi tted by or under the direct supervision of certifi ed/licensed practitioners.

The express warranties provided for herein are eff ective from the date of Freedom Innovations’ original invoice. The duration of the limited initial warranty for the Freedom Innovations Plié 3 MPC Knee is 36 months, provided that the product receives the required 12 and 24 month service checks. For additional terms of this limited initial warranty, please see the Terms of Sale, Returns & Warranties. The duration of the optional limited extended warranty for the Freedom Innovations Plié 3 MPC Knee is an additional 24 months, provided that the product receives the required 36 and 48 month service checks.

The sole and exclusive obligation of Freedom Innovations under the optional limited extended warranty shall be to replace, repair, refabricate at no charge, or refund the purchase price of a defective product, system or component, at Freedom Innovations’ sole discretion. If Freedom Innovations elects to replace a product returned under warranty, we will ship the replacement item in a timely manner accompanied by an invoice for the full retail cost, and issue credit upon our receipt of the product’s return.

The express warranties set forth herein do not cover the battery, battery charger, adapters and optional accessories (each of which are covered under separate warranty), or test sockets, nor does it cover any alteration, repair or substitution of parts by others that, in Freedom Innovations’ judgment, materially or adversely aff ects the product or part, damage due to accidents, cosmetic damage, water damage deemed as abuse, neglect, misuse or operation beyond capacity, or parts damaged by improper installation.

THE FOREGOING EXPRESS WARRANTIES ARE IN LIEU OF ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, WRITTEN OR ORAL, INCLUDING WITHOUT LIMITATION, ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR OTHERWISE, AND ALL SUCH OTHER WARRANTIES ARE HEREBY DISCLAIMED AND EXCLUDED BY FREEDOM INNOVATIONS, TO THE EXTENT PERMITTED BY LAW. IF FREEDOM INNOVATIONS CANNOT LAWFULLY DISCLAIM STATUTORY OR IMPLIED WARRANTIES, THEN, TO THE EXTENT PERMITTED BY LAW, ALL SUCH LIMITED WARRANTIES ARE LIMITED IN DURATION TO THE DURATION OF THE EXPRESS LIMITED WARRANTY. IN NO EVENT SHALL FREEDOM INNOVATIONS’ LIABILITY OF ANY KIND INCLUDE ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, EVEN IF FREEDOM INNOVATIONS SHALL HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH POTENTIAL LOSS OR DAMAGE, UNLESS SUCH EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES IS DISALLOWED BY STATE LAW.

This Limited Warranty gives you specifi c legal rights, and you may also have other rights which vary from state to state. Freedom Innovations does not grant to any person or entity (including its fi eld representatives, dealers or distributors) the authority to create for it any obligation or liability in connection with its products.

Freedom Innovations reserves the right to make changes, improvements or additions to its products in the future without incurring obligations to make such changes, improvements, or additions to its products previously manufactured. Freedom Innovations reserves the right to change the terms of these express warranties in the future without incurring any obligations to make the changed terms applicable to products previously manufactured.
