What is Copyright?
• Reproduction of work
• Derivative works based upon an original
• Distribution
• Publicly perform work
• Publicly display work
• Publicly perform work by means of a digital audio or visual transmission
Section 108 of the 1976 Copyright Act
• (a) Except as otherwise provided in this title and notwithstanding the provisions of section 106. • No public performances (section 202)• Videos can be shown to “a normal circle of
family and its social acquaintances”(section 101)
• Semipublic performance are illegal without a license, this includes schools (Senate Report No. 94-473, p. 60; House Report No. 94-1476, p. 64)
• Non-profit educational purposes in face-to-face teaching activities(110.1)
Penalty
• If a person purposefully shows a video without a license, when one is required, for gain it is a federal crime and they can be fined $150,000 per showing
• Even if a person inadvertently shows a video there might be a civil fine of between $750 and $30,000.
