    to order at 8:34 a.m. The floor was opened for nominations for a Chairperson Pro Tem. Mr. Mochida nominated Mr. Kagawa as Chairperson Pro Tem. The nomination was seconded by Mr. Lee. There were no other nominations for Chairperson Pro Tem. Mr. Kagawa was unanimously elected as Chairperson Pro Tem.

    Agenda: The agenda for this meeting was filed with the Office of the Lieutenant

    Governor, as required by Hawaii Revised Statutes (“HRS”) section 92-7(b).

    Minutes: It was moved by Mr. Lee, seconded by Mr. Kamai, and unanimously

    carried to approve the July 25, 2014 meeting and executive session meeting minutes as circulated.

    The agenda was taken out of order and continued with “Chapter 91, HRS,

    b. Shimmick/Flatiron/Goodfellow A J V Edward B. Brown, RME “A” General Engineering “B” General Building Chapter 91, HRS, Adjudicatory Matters: Chairperson Pro Tem Kagawa called for a recess from the Board’s

    meeting at 8:40 a.m. to discuss and deliberate on the following adjudicatory matters pursuant to HRS chapter 91.

    1. Settlement Agreements

    a. In the Matter of the Contractors’ Licenses of Kauai Fire

    Protection, Inc. and Guy M. Menor, RME; CLB 2011-346-L

    Kauai Fire Protection, Inc. (“KFP”) was licensed in April 28, 1993, which license expired September 30, 2008. Guy Menor (“Menor”) was its president, secretary, director, and responsible managing employee. KFP was dissolved on January 14, 2010. Menor’s license will expire on September 30, 2014. In or around August 2005, KFP and Menor entered into a verbal agreement with James A. Duarte (“Duarte”) under which KFP and Menor would permit Duarte to use KFP’s name and license number to enter into a contract or contracts with the United States Fish & Wildlife Service (“USFWS”) to perform earthwork at the Hanalei Wildlife Refuge, with the understanding that Duarte would perform all of the work called for under the contract. Duarte was not licensed as a contractor or an employee of KFC and in August 2005, Duarte submitted a bid of the work to USFWS in KFP’s name but used his personal contact information. KFP was awarded the contract and Duarte performed the work on his own. KFP was paid a total of $23,500.00 for this contract, which KFP in turn paid Duarte $20,000.00. Menor cooperated with representatives of the United States government and testified as a government witness against Duarte in an April 2010 trial in the U.S. District Court for the district of Hawaii.

    In October 2010, Duarte was convicted of two counts of wire fraud and two counts of mail fraud, was sentenced to one year probation, fined $400.00, and separately entered into a consent judgment with RICO for his role and paid a fine. In June 2013, RICO filed a Petition for Disciplinary Action alleging Respondents KFC and Menor violated HRS sections 436B-19(6) (license prohibited from aiding and abetting an unlicensed person to directly or indirectly perform activities requiring a license), and 444-17(17) (entering into a contact with an unlicensed contractor). Respondents do not admit to violating any law or rule, but agree to pay a fine, jointly and severally, of $1,000.00. After discussion, it was moved by Mr. Lee, seconded by Mr. Kamai, and unanimously carried to approve the above First Amended Settlement Agreement After Filing of Petition for Disciplinary Action and Board’s Final Order in the above case. b. In the Matter of the Contractors’ Licenses of Engel

    Insulation & Firm Fill, Inc., and Anthony E. Warmuth; CLB 2014-19-L

    RICO received a complaint alleging that the State of Hawaii, Department of Labor and Industrial Relations (“DLIR”) issued respondent Engel Insulation & Firm Fill, Inc. (“Engel”) a Notification of Violation and Suspension (“Notification”) and a Suspension Order (“Order”) based upon work performed by Engel on the Pahoa Police Station and Vehicle Registration and Licensing Division. Respondents Engel and Warmuth did not report the Notification or Order to the Board within 30 days as required by law. Respondents do not admit to violating any law or rule, but agree to jointly pay a fine of $500.00. After discussion, it was moved by Mr. Konishi, seconded by Mr. Mochida, with Mr. Lee recusing himself, and carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

    2. Board’s Final Orders None.

    Following the Board’s review, deliberation and decisions in these matters, pursuant to HRS chapter 91, Chairperson Pro Tem Kagawa announced that the Board was reconvening to its open meeting at 8:44 a.m.

    Executive Session: At 8:45 a.m., it was moved by Mr. Lee, seconded by Mr. Konishi, and

    unanimously carried to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

    At 9:06 a.m., it was moved by Mr. Lee, seconded by Mr. Mochida, and

    unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

    Appearances Before the Board: a. William E. Allgood (Individual) “B” General Building Executive Session: At 9:07 a.m., it was moved by Mr. Kamai, seconded by Mr. Lee, and

    unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

    At 9:16 a.m., it was moved by Mr. Lee, seconded by Mr. Kamai, and

    unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

    After discussion, it was moved by Mr. Mochida, seconded by Mr. Lee, and

    unanimously carried to defer Mr. Allgood’s application for licensure in the “B” classification pending the submission of additional “ground-up” projects, and verification of addressing financial issues.

    e. Alan C. Jacobsen, RME (Additional classification) South Pacific Contracting LLC “B” General Building Mr. Jacobsen was not present. f. Daniel Aiu, RME Solarcity Corporation C-13 Electrical Executive Session: At 9:19 a.m., it was moved by Mr. Lee, seconded by Mr. Kamai, and

    unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS

    At 9:30 a.m., it was moved by Mr. Suehiro, seconded by Mr. Mochida,

    and unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

    After discussion, it was moved by Mr. Suehiro, seconded by Mr. Lee, and

    unanimously carried to defer Mr. Aiu’s application for licensure in the C-13 classification pending the submission of additional electrical projects other than photovoltaic projects.

    g. Fermin P. Ragon, Jr. (Individual) C-52 Ventilating & air conditioning Executive Session: At 9:31 a.m., it was moved by Mr. Matsuoka, seconded by Mr. Lee, and

    unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

    At 9:45 a.m., it was moved by Mr. Lee, seconded by Mr. Suehiro, and

    unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

    After discussion, it was moved by Mr. Lee, seconded by Mr. Suehiro, and

    unanimously carried to approve Mr. Ragon’s application for licensure in the C-52 classification.

    h. James W. Mitchell, III, RME Coastal Development Inc. “B” General Building Executive Session: At 9:46 a.m., it was moved by Mr. Suehiro, seconded by Mr. Konishi, and

    unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J.     unanimously carried to defer Mr. Dilernia’s application for licensure in the “B” classification pending the submittal of a revised list of “B” projects verifying four years of “ground-up” experience.

    unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(4) to consult with Gary B.K.T. Lee, the Board’s recovery fund attorney, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities.

    At 10:15 a.m., it was moved by Mr. Kamai, seconded by Mr. Mochida,

    and unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

    unanimously carried to approve Ms. Santiago’s application for licensure in the C-60 classification. Ms. Santiago withdrew her application for licensure in the C-61 classification.

    l. Atunaisa Tongotea, RME H T M Contractors Inc. “A” General Engineering Executive Session: At 10:27 a.m., it was moved by Mr. Suehiro, seconded by Mr. Lee, and

    unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

    At 10:46 a.m., it was moved by Mr. Lee, seconded by Mr. Mochida, and

    unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

    After discussion, it was moved by Mr. Lee, seconded by Mr. Leong, and unanimously carried to defer Mr. Tongotea’s application for licensure in the “A” classification pending the submission of additional projects verifying four years of “A” supervisory experience, and that his financial issues have been adequately addressed.

    m. Joseph S. Bakos, RME Coconut Wireless LLC dba Coconut Wireless Construction “B” General Building C-48 Structural steel C-68TN Communication tower (approve 7/14) Executive Session: At 10:49 a.m., it was moved by Mr. Lee, seconded by Mr. Konishi, and

    unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

    At 11:06 a.m., it was moved by Mr. Konishi, seconded by Mr. Kamai, and

    unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

    After discussion, it was moved by Mr. Konishi, seconded by Mr. Kamai,

    and unanimously carried to defer Mr. Bakos’ application for licensure in the “B” and C-48 classifications pending the submission of additional “B” “ground-up” projects and C-48 projects verifying metal buildings and structural steel structure experience.

    Executive Officer Tamanaha explained how to complete the project lists,

    including the actual time spent supervising the work crews and the contract price should correlate to this amount of work (not the overall cost of the entire project). She also explained that fabrication in the shop does not require a license for the C-48, and therefore, he will need to submit experience fabricating at the job sites (e.g., metal buildings and frames).

    unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

    After discussion, it was moved by Mr. Lee, seconded by Mr. Kamai, and

    unanimously carried to deny Mr. Madzhitov’s application for licensure in the “B” classification, and approve him for the C-5 Cabinet, millwork, and carpentry remodeling and repairs and C-6 Carpentry framing classifications based on the experience he provided.

    o. Liangguang Chi (Individual) “B” General Building Executive Session: At 11:34 a.m., it was moved by Mr. Lee, seconded by Mr. Suehiro, and

    unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J.     unanimously carried to defer Mr. Jackow’s application for licensure in the C-37 classification pending the submission of additional C-37 projects verifying a broader range of plumbing work experience.

    6. Scope of Activity Committee:

    Nathan Konishi, Chairperson Toshiba International Corporation (“Toshiba”) – Toshiba requests determination on whether a license is required to perform routine mechanical and electrical maintenance on their steam turbine generator at the AES Hawaii Power Plant at Barber’s Point. Arnold Wong of the Ironworkers Stabilization Fund Local Union 625 (“Ironworkers”) stated that any footing or structural steel work should be performed by the C-48 Structural steel contractor. Recommendation: No license is required to perform routine maintenance and repair of the existing equipment; provided that there are no new installations. Sheet Metal Contractors Association (“SMCA”) – SMCA requests the Board reconsider its prior determination that the “B” General Building, C-5 Cabinet, millwork, and carpentry remodeling and repairs, C-22 Glazing and tinting, and C-44 Sheet metal contractor can install the metal louvers on the Kailua District Park Gymnasium project. Following its July 25, 2014 meeting, the Board requested additional information from the project owner, the City and County of Honolulu (“CCH”). Neal Arita, Executive Director of the SMCA, stated that he put together additional information that was not available at the last meeting, and that they did consult with the designing architect. SMCA’s position is that the C-44 Sheet metal contractor is the only qualified installer of metal louvers. Mr. Arita summarized his August 14, 2014 letter as follows:

    The Board’s rules specifically state that only the C-44 classification can install metal louvers.

    The bid form shows that the replacement of louvers is under a separate item from windows.

    The louvers are made of aluminum.

    The Air Movement and Control Association (“AMCA”) is a testing agency of louvers. AMCA certifies performance of the louvers for air circulation, which is important for indoor air quality. AMCA certification is required for these louvers.

    The American Society of Heating, Refrigeration and Air Conditioning Engineers (“ASHRAE”) has established guidelines for indoor air quality, which is a health and safety concern. This is a natural ventilation system and does not need to be connected to a mechanical air handler.

    The Sheet Metal and Air Conditioning Contractors’ National Association (“SMACNA”) has published information regarding the fabrication and installation of metal louvers.

    Windows generally restrict elements, including air, from entering a

    structure (keeps it out), while the louvers’ main purpose is to allow for air ventilation (allowing for adequate amounts of outside air for occupied spaces) and is a health and safety concern under ASHRAE. The louvers are not situated in one place, but are located in different parts of the building.

    An opening in a structure is not window, and a louver is not a window.

    Arthur Tolentino of the Sheet Metal Workers’ International Association thanked the Board for not making a decision at the last meeting before gathering more information. He stated that they did contact the architect, who did specify that the louvers are designed to meet the design and code parameters. The louvers are required to be sight-proof and weather proof. The main purpose of the louvers is to ventilate the gym. The louvers are designed to exchange air from inside the gym with fresh air from the outside, thereby preventing a “sick building syndrome”, and is necessary for public health and safety. He believes that the C-44 classification is the only classification that specifically states the installation of metal louvers. In addition, the National Energy Management Institute curriculum includes installation of metal louvers by C-44 sheet metal contractors. Mr. Tolentino stated that more buildings in the future will use louvers and use natural resources to sustain buildings in the movement toward being green. It is not a case of incidental and supplemental to any other trade. The louvers are stand-alone louvers that are installed in concrete. Shannon Alivado of the General Contractors Association testified that she sent a letter to the Board this morning requesting that the Board deny the request by SMCA that only C-44 contractors can install the metal louvers and reaffirm its June 20, 2014 determination that either the B” General Building, C-5 Cabinet, millwork, and carpentry remodeling and repairs, C-22 Glazing and tinting, and C-44 Sheet metal contractor can perform such installation of metal louvers. There was no real evidence that the architect, designer, or warranty manufacturer required that only the C-44 Sheet metal contractor install the metal louvers. She urged the Board to reaffirm its prior determination. Mr. Wong of the Ironworkers stated that if structural steel is involved with the project, the C-48 contractors have dealt with installation of metal louvers. Dwayne Arelliano of the Glaziers Local Union 1889 (“Glaziers”) stated that the question is who can install these metal louvers. At the last Board meeting, he showed photos of past projects performed by glaziers that included stand-alone louvers and louvers connected to windows. The louvers are being placed into concrete openings, just like installing

    windows, and did not think that only the C-44 contractors can install the louvers. Jeff Masatsugu of the Glaziers Stabilization Fund agreed with Mr. Arelliano’s testimony and stated that there is nothing in the description of the C-44 classification that makes the installation of louvers specific to the C-44 contractor. Richard Wurdemann, an attorney representing the Sheet Metal Worker’s Union, stated that his understanding at the last meeting was that the Board was going to ask the CCH for additional information. He knows that Mr. Arita went on his own to get the information. He welcomed the opportunity to present more information if the Board requests it. The louvers are mechanical because they are engineered to deliver adequate ventilation for proper air quality. Mr. Arita reminded the members of the Board that they are a licensing board and not a union, and that they should follow the Board’s rules and not past practice, and to consider what was presented when making their determination. Mr. Arelliano stated that they have installed metal louvers before and have always had a good track record of public safety. The Board thanked those present for their testimonies. Department of Education, Facilities Development Branch (“DOE”) – The DOE requests determination on whether an individual who is licensed as an “A” General Engineering contractor and “B” General Building contractor may: (1) fabricate and install metal pipe railings; (2) not list the specialty contractor for the fabrication of metal pipe railings; and (3) fabricate and install metal pipe railings without employing a C-48 Structural steel specialty contractor to fabricate the railings. Mr. Wong of the Ironworkers felt that the answer should be “no” because galvanized steel is toxic, especially when welding. The workers need to wear respirators and have to take a break because of the toxins. Mutual Welding is one of the companies that has done this type of work before and they are licensed in the specialty trade. He stated that it is a safety issue and welders can do this work if they are properly trained. Mr. Arelliano of the Glaziers stated that they have been installing aluminum for a long time and felt the “A” and “B” contractors are not properly trained to do this type of work. He did not know if it is a stairwell in this project, but they are trained in and have been installing aluminum railings on balconies or lanai areas.

    Recommendation: Question 1: An “A” General Engineering contractor may fabricate and install metal pipe railings. However, the “B” General Building contractor cannot fabricate and install metal pipe railings. Question 2 is not within the Board’s jurisdiction. This question should be addressed by the State Procurement Office. Question 3: The “A” General Engineering contractor may fabricate and install metal pipe railings without employing a C-48 Structural steel specialty contractor to fabricate the railings. However, the “B” General Building contractor cannot fabricate and install metal pipe railings without employing a C-48 Structural steel specialty contractor or other appropriately licensed contractors to fabricate the railings.
