Pharmacy Act and Regulations Definitions Regulations–amendment; Registration, Licensing and Professional Accountability Regulations–amendment
Order in Council 2020-123 dated April 16, 2020 Amendment to regulations made by the Governor in Council and
Amendment to regulations made by Council of the Nova Scotia College of Pharmacists and approved by the Governor in Council
pursuant to Sections 82 and 83 of the Pharmacy Act
The Governor in Council on the report and recommendation of the Minister of Health and Wellness dated April 15, 2020, and pursuant to Chapter 11 of the Acts of 2011, the Pharmacy Act (the “Act”), is pleased, effective on and after April 16, 2020
(a) pursuant to Section 83 of the Act, to amend the Pharmacy Act and Regulations Definitions Regulations, N.S. Reg. 251/2013, made by the Governor in Council by Order in Council 2013-237 dated July 9, 2013, in the manner set forth in Schedule “A” attached to and forming part of the report and recommendation; and
(b) pursuant to Section 82 of the Act, to approve of amendments to the Registration, Licensing and Professional Accountability Regulations, N.S. Reg. 252/2013, made by the Council of the Nova Scotia College of Pharmacists and approved by the Governor in Council by Order in Council 2013-237 dated July 9, 2013, in the manner set forth in Schedule “B” attached to and forming part of the report and recommendation.
N.S. Reg. 59/2020 Pharmacy Act and Regulations Definitions Regulations–amendment
Schedule “A”
Amendment to the Pharmacy Act and Regulations Definitions Regulations made by the Governor in Council under Section 83
of Chapter 11 of the Acts of 2011, the Pharmacy Act
Subsection 3(1) of the Pharmacy Act and Regulations Definitions Regulations, N.S. Reg. 251/2013, made by the Governor in Council by Order in Council 2013-237 dated July 9, 2013, is amended by
(a) in the definition of “present in the pharmacy”, adding “or other place where pharmacy services are provided” immediately before the semicolon;
(b) adding the following definition immediately before the definition of “record”:
“public health emergency” means a public health emergency declared under the Health Protection Act;
(c) striking out the period at the end of the definition of “record” and substituting a semicolon, and adding the following definition immediately after the definition of “record”:
“state of emergency” means a state of emergency declared under the Emergency Management Act.

2 Section 3 of the regulations is further amended by adding the following subsection immediately after subsection (2):
(3) During a state of emergency or public health emergency, the following definition applies in the Act and its regulations:
“physically present” means immediately accessible to a pharmacy or person being supervised under terms and conditions as Council may prescribe in the public interest.

Schedule “B”
Amendment to the Registration, Licensing and Professional Accountability Regulations made by the Governor in Council [Council of the Nova Scotia College of Pharmacists]
under Section 82 of Chapter 11 of the Acts of 2011, the Pharmacy Act
I hereby certify that the Council of the Nova Scotia College of Pharmacists, at a duly convened meeting of the Council held on April 3, 2020, and pursuant to Section 82 of Chapter 11 of the Acts of 2011, the Pharmacy Act, carried a motion to amend the Registration, Licensing and Professional Accountability Regulations, N.S. Reg. 252/2013, made by the Council of the Nova Scotia College of Pharmacists and approved by the Governor in Council by Order in Council 2013-237 dated July 9, 2013, in the manner set forth in the attached.
The amendments referred to in this certificate are effective on and after the approval of the Governor in Council.

of Chapter 11 of the Acts of 2011, the Pharmacy Act
1 The Registration, Licensing and Professional Accountability Regulations, N.S. Reg. 252/2013, made by the Council of the Nova Scotia College of Pharmacists and approved by the Governor in Council by Order in Council 2013-237 dated July 9, 2013, is amended by adding the following Section immediately after Section 16:
Registration and licensing during state of emergency or public health emergency 16A (1) During a state of emergency or public health emergency, if the Council is satisfied that it is in
the public interest to do so and that an applicant is otherwise competent, the Council may do any of the following:
(a) defer, waive or modify any requirement for registration or licensing for the applicant;

(b) waive or reduce any requirement under Section 21 for the applicant to resume practice.
(2) The authority set out in subsection (1) may only be exercised on and after the date that a state of emergency or a public health emergency is declared until the date the state of emergency or public health emergency ends.
The regulations are further amended by adding the following Section immediately after Section 30:
Replacement pharmacy manager—time periods during state of emergency or public health emergency 30A (1) During a state of emergency or public health emergency, the Council may waive or modify
any time period set out in Section 30 if the Council is satisfied that it is in the public interest to do so.
(2) The authority set out in subsection (1) may only be exercised on and after the date that a state of emergency or public health emergency is declared until the date that the state of emergency or public health emergency ends.

In the matter of prescribing prices for petroleum products pursuant to Section 14 of the Petroleum Products Pricing Act and Sections 16 to 19 of the Petroleum Products Pricing Regulations

Whereas the purpose of the Petroleum Products Pricing Regulations is to ensure just and reasonable prices for specified petroleum products taking into consideration the objectives of preserving the availability of such products in rural areas, stabilizing prices of such products and minimizing the variances in prices of such products across the Province;
And whereas the Nova Scotia Utility and Review Board (“Board”) considered the manner in which it would proceed to set petroleum product prices in its decision, 2006 NSUARB 108, issued on October 16, 2006;
And whereas the Board revised the wholesale margin effective January 4, 2013, in its decision, 2012 NSUARB 213, issued on December 12, 2012;

And whereas the Board revised the retail margin and the transportation allowance effective October 28, 2016, in its decision, 2016 NSUARB 168, issued on September 26, 2016;
And whereas the average of the average of the daily high and low reported product prices (in Canadian cents) for the period ended April 15, 2020, are:
Grade 1 Regular gasoline 22.12¢ per litre Ultra-low-sulfur diesel oil 34.87¢ per litre
Now therefore the Board prescribes the benchmark prices for petroleum products to be:
Gasoline: Grade 1 22.12¢ per litre Grade 2 25.12¢ per litre Grade 3 28.12¢ per litre
Ultra-low-sulfur diesel oil 34.87¢ per litre
And now therefore the Board has determined, based on historical data regarding price changes and to achieve revenue neutrality, it is appropriate to apply, and the Board so orders, forward averaging corrections of:
Gasoline: minus 1.1¢ per litre Ultra-low-sulfur diesel oil: minus 1.9¢ per litre
And whereas a winter blending adjustment of plus 0¢ per litre is required for ultra-low-sulfur diesel oil;
And now therefore the Board prescribes the prices for petroleum products as set forth in Schedule “A” effective on and after 12:01 a.m., April 17, 2020.

Order
Whereas the Board having heard an application by the Municipality of the County of Cumberland pursuant to s. 368 of the Municipal Government Act and the Board having issued its decision on April 16, 2020;
It is hereby ordered that the application is approved as follows:
1. The number of polling districts for the Municipality of the County of Cumberland is set at eight;
2. The number of councillors is set at eight;
3. The boundaries of the polling districts are approved as outlined on the digital maps attached to this Order.
And it is further ordered that all provisions of the Municipal Government Act and the Municipal Elections Act and any other Acts of the Province of Nova Scotia applying to the preparation for and holding of the regular election of councillors of the Municipality in the year 2020 will be complied with as if the above-noted changes had been made on the first day of March, 2020, but for all other purposes, such changes shall take effect on the first day of the first meeting of the Council after the election of councillors for the year 2020.

I, Mark Peachey, Executive Director of Maintenance and Operations, Department of Transportation and Infrastructure Renewal, as delegated by the Minister of Transportation and Infrastructure Renewal under subsection 20(1) of Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act (“the Act”), hereby order that the Spring Weight Restriction Regulations, N.S. Reg. 31/2018, made under subsection 20(1) of the Act are effective in the counties listed in Column 1 of the following table during the period set out in Column 2 of the table opposite the names of the counties.

Amendment to the Milk Pricing Regulations made under the Dairy Industry Act
I certify that on April 21, 2020, the Dairy Farmers of Nova Scotia, pursuant to clauses 9(b) and 14(1)(c) of Chapter 24 of the Acts of 2000, the Dairy Industry Act, as delegated by clause 2(1)(b) of the Delegation of Powers to Dairy Farmers of Nova Scotia Regulations, N.S. Reg. 136/2001, carried a motion to amend the Milk Pricing Regulations, N.S. Reg. 84/2008, made by the Dairy Farmers of Nova Scotia on September 21, 2007, and approved by the Natural Products Marketing Council on February 12, 2008, in the manner set forth in the attached Schedule “A”, effective on and after April 24, 2020.

pursuant to clauses 9(b) and 14(1)(c) of Chapter 24 of the Acts of 2000, the Dairy Industry Act
Section 1A of the Milk Pricing Regulations, N.S. Reg. 84/2008, made by the Dairy Farmers of Nova Scotia on September 21, 2007, and approved by the Natural Products Marketing Council on February 12, 2008, is amended by adding the following definitions immediately before the definition of “certified organic”:

“Canadian Dairy Commission” or “CDC” means the body created under the Canadian Dairy Commission Act (Canada);
“Canadian Milk Supply Management Committee” or “CMSMC” means the body created under the National Milk Marketing Plan responsible for determining policy for the Plan;

pursuant to Section 3 of the Assessment Act
The Governor in Council on the report and recommendation of the Minister of Municipal Affairs and Housing dated April 8, 2020, and pursuant to Section 179 of Chapter 23 of the Revised Statutes of Nova Scotia, 1989, the Assessment Act, is pleased to make regulations respecting the definition of “small-scale residential tourist accommodation establishment” in the form set forth in Schedule “A” attached to and forming part of the report and recommendation, effective on and after May 1, 2020.

Citation 1 These regulations may be cited as the Small-Scale Residential Tourist Accommodation Establishments
Regulations.
Number of rooms prescribed for definition of “small-scale residential tourist accommodation establishment” 2 For the purpose of defining a small-scale residential tourist accommodation establishment pursuant to
Section 47A of the Assessment Act, the number of rooms in a small-scale residential tourist accommodation establishment that may be rented to the travelling or vacationing public to provide overnight sleeping accommodation is 4 or fewer.
