“In these economically challenging times, the blame game remains as UK public criticism continues to grow against those that are regarded as not paying their fair share. As a result, we are now seeing measures such as naming and shaming of both users and promoters of tax avoidance schemes.”

Once again our attentions were drawn to another Chancellor’s Budget that focused on addressing tax evasion and avoidance. The Budget coincided with the release of a progress report on tackling avoidance entitled ‘No safe havens’ by HMRC’s new centre of excellence on offshore tax evasion.

In these economically challenging times, the blame game remains as UK public criticism continues against those that are regarded as not paying their fair share. As a result, we are now seeing measures such as naming and shaming of both users and promoters of tax avoidance schemes. The distinction between legal tax avoidance and illegal tax evasion can no longer be seen as the divide between what is acceptable behaviour and what crosses the line - the line, according to local tax experts PWC, has moved.

‘The UK is leading the charge on international automatic information exchange, and the Budget announced that an Intergovernmental Agreement has been reached with all three Crown Dependencies is an important step for the UK towards this cause. Cayman has also announced that it will enter into a UK IGA. The spotlight on tax evasion has not been limited to the UK but can be seen in other higher tax jurisdictions, and the idea that automatic information exchange will quickly become the international standard looks very credible,’ announced PWC following the Budget release.

Alongside the UK IGA is a disclosure facility. The UK expect to raise a startling £1 billion from the Jersey, Guernsey and Isle Of Man disclosure facilities over the next 5 years. Given the Lichtenstein disclosure facility (with more generous

terms) raised only £140 million in its fi rst two years, and in light of the fact that the three Crown Dependencies are highly regulated, this target looks highly ambitious. Perhaps in time the failure of the Jersey, Guernsey and Isle Of Man facilities to raise signifi cant amounts will fi nally dislodge the perception of the Islands as tax havens.

There were other aspects of the Budget that will raise concerns for Guernsey’s fi nance industry. In particular the changes affecting UK and offshore funds including measures to enhance the attractiveness of UK funds and closing loopholes in the offshore fund regime. The UK Government will also consult on measures to deal with offshore employment intermediaries being used to avoid UK NIC and income tax.

The spotlight on offshore fi nance continues unabated but as our contributors to Contact demonstrate, we do have an industry of experts who we can entrust to keep Guernsey a stable and well respected jurisdiction for a generation to come.

In this edition of Contact we identify the challenges facing the property investment sector, two of Guernsey’s bright young legal minds report from their sectors and we feature the opportunities for Guernsey in Malaysia. Once again our chamber is at the forefront of setting the business agenda in the Islands having hosted MATRADE during a recent visit to Guernsey.

Ogier recently acted as Guernsey legal adviser to HarbourVest Partners, LLC in the purchase of the investment portfolio of Conversus Capital, L.P. by HarbourVest Structured Solutions II L.P.

Debevoise & Plimpton LLP in London and New York and Ogier in Guernsey have advised HarbourVest Partners, LLC (HarbourVest) in connection with the acquisition by HarbourVest Structured Solutions II L.P., a newly formed Guernsey limited partnership managed by HarbourVest, from Conversus Capital, L.P. (a Guernsey investment fund listed on NYSE Euronext in Amsterdam) of Conversus’ portfolio of private equity fund interests and direct co-investments. HarbourVest Structured Solutions II L.P. acquired the portfolio for approximately US$1.2 billion, after adjustments for certain capital calls and distributions.

Guernsey – Last week Coutts hosted a client investment dinner at the prestigious Fermain Valley Hotel in Guernsey. The discussion centred on Coutts’ 2013 investment outlook: 5&10, highlighting Coutts’ view of the fi ve risks and ten opportunities within the investment landscape this year. Opportunities include: a revival in the US oil and gas industry, Japanese equities and the property market. Risks highlighted include political tensions and the prospect of infl ation being re-ignited over the course of the year.

Alan Higgins, Chief Investment Offi cer, UK; Niamh Wylie, Director within Coutts’ Investment Team; Richard Tribe, Director, Coutts Channel Islands and Maya Prabhu, Managing Director, Head of Philanthropy, discussed their latest insights following which the panel took Q&As from guests.

Alan Higgins comments: “Although the markets continue to be challenging, we see at least ten reasons to be optimistic. Progress is being made in the Eurozone as we begin to see the positive effects of austerity, we continue to see opportunities in India and China and have already seen some reward from the rise of equities. However, risks remain inherent in fi nancial markets and never more so than with politics. We believe the impact of political events and decisions, which have grown in the wake of the fi nancial crisis, remain a key risk.”

He continues, “This year could be a seminal year marking the reversal of recent trends; bonds are no longer the safe-haven asset they were perceived to be and equities are seeing a comeback. As bond valuations reach extreme levels, we are mindful of the real prospect of

investors losing money. Risk management is all the more essential and we continue to place this at the heart of every asset allocation decision we make.”

Richard Tribe added: “We have a strong team in Guernsey and it was great to see our clients so engaged. We were delighted to be able to give them access to the intellectual insights of our investment team. This dinner was held in response to client demand as the current economic climate continues to raise questions, especially around protection against infl ation. I am in no doubt that Alan and Niamh were able to instill our investors with renewed confi dence and spark some consideration to the opportunities for 2013.”

Two of Guernsey’s most respected independent trust companies, Aquitaine Group Limited and Goethe Management Limited have announced their merger on 1 January 2013. The two owner-managed businesses began formal discussions mid-way through 2012 and very quickly agreed that a merger would bring benefits to the combined businesses and their clients. The newly merged business has come together under the Aquitaine brand and its 22 employees are based at Mill Court, La Charroterie, St Peter Port.

The owners and management of Aquitaine and Goethe have known each other professionally for many years and quickly saw that their common goal of providing a consistent high quality, personalised client service could be best achieved in the future by combining their respective expertise, resources and infrastructures.

All existing staff, many of whom have worked together for a considerable time, have been retained. The merger gives critical mass to the business and the new company structure creates the ideal mix of operational staff and directors.

Aquitaine’s new Chairman is Chris Legge and its Directors are Adrian Pickering, Sarah Parkes, Paul Le Poidevin, Steven Ward, Simon Brooks, Nigel Robins, Paul Gaudion and Ciara Gurney. Adrian Pickering will assume the role of Managing Director when Sarah Parkes retires in April.

Goethe Management Limited opened for business in 1982 and latterly has been managed by former partners and staff from a big four accountancy firm while Aquitaine began life in 2008 and was formed by a team of individuals who previously managed the Channel Islands Fiduciary Services business for an international

private bank.

Adrian Pickering says: “The merger was designed

to bring an enhanced capability and efficiency to

MORE than 80% of breaches into a company’s IT system will be opportunistic.

Speaking at a seminar organised by Cable & Wireless Communications, Colin Whittaker, vice-president of payment system risk for VISA Europe, warned that just 17% of security breaches were targeted and the rest were opportunistic. He added that the sophistication of breaches now meant that it could sometimes be up to 18 months before they are discovered and that often it was impossible to identify what data criminals could make money from.

‘The threat will never go away, technology is not standing still,’ he said.

‘For data security to be meaningful, it needs to be applied sensibly. A security and compliance policy that relies on a single solution, a single approach and a single correct answer is not likely to succeed in its objectives.’

Mr Whittaker was joined on the panel by lawyer Tim Ryan, partner at Clarke Willmott LLP; Matthew Tyler, CEO of security, risk and compliance consultancy Blackfoot; and Frank Jennings, a lawyer ranked number for technology and media & entertainment by the independent legal directory Legal 500, who also holds the position of chairman of the UK Cloud Forum.

‘The seminar provided a fascinating insight into the complexities of collating and storing data, how best to release its full value and looked at how forthcoming changes to EU legislation will increase the level of penalties for breaches in data security. Although we are not part of the EU, that legislation will have an impact on the way we all do business and it would be foolhardy of us not to follow best practice and comply with European standards,’ said Justin Bellinger, business development of Cable & Wireless Communications who joined the off-island speakers on the panel.

The EU currently has a working party called W29 looking at data protection legislation but it has differing views to the UK’s Information Commissioner’s Office. Regardless of those views, it looks likely that from 2014, regulators could have the power to fine companies 2% of its annual global turnover if a data breach occurs.

‘Guernsey is in a unique position and can cherry pick the best of data protection legislation from around the world to ensure that our name is at the top of list. If we raise the bar then we can use that to attract business to the island. E-gaming and image rights are proven examples of Guernsey taking the initiative for the benefit of Guernsey and we could do the same with data protection,’ he said.

Companies warned to be aware of opportunists

The Teenage Cancer Trust Guernsey Appeal has been boosted by the cycling and fundraising efforts of the head of Deutsche Bank in the Channel Islands.

Having initially raised a total of £3,700 in aid of the local charity through his own fundraising efforts as part of the Ride Across Britain cycle challenge last year, Andreas Tautscher, Chief Country Officer for Deutsche Bank Channel Islands, was recently successful in receiving an additional £1,000 as part of Deutsche Bank’s national ‘Matched Giving’ scheme.

He also raised a further £3,700 in aid of the Children’s Cancer and Leukaemia Group.

The Ride Across Britain took place between the 8th and 16th September, covering the 960 miles from Lands End to John O’Groats, with nine cyclists from Guernsey forming part of the 600-strong field of participants. The route was broken down into nine daily stages averaging over 100 miles per day, with cyclists climbing over 65,000ft over the course of the challenge.

Deutsche Bank’s ‘Matched Giving’ scheme provides an incentive for staff who undertake sponsored challenges. Under the scheme, if an employee raises money for a Channel Islands or a UK charity,

Deutsche Bank can match their fundraising efforts up to a certain amount.

Andreas Tautscher said:“The generosity of people who had

initially sponsored me to undertake this challenge was fantastic, but to receive this additional boost from Deutsche Bank in the UK in aid of such a good local charity makes it even more special. It was a gruelling challenge for me and all the Guernsey cyclists who took part, but having the opportunity to see so much of the beautiful English and Scottish countryside and raise money for such worthy causes at the same time made it a particularly amazing experience.”

Claire Hermann-Smith, Assistant Treasurer, Teenage Cancer Trust Guernsey Appeal, added:

“Being the beneficiary of fundraising initiatives like this is always fantastic and we really appreciate Andreas’ amazing achievement and Deutsche Bank’s additional generosity. These funds are extremely welcome as part of our on-going work in raising awareness about cancer locally and in supporting young people diagnosed with cancer in Guernsey.”

Guernsey’s Chief Minister announced in March Guernsey’s intention to finalise a draft agreement on a proposed ‘tax package’ with the UK that will reinforce Guernsey’s commitment to tax transparency and its status as a leading and respected mainstream international finance centre

The proposed ‘package’ comprises: • agreement in principle to enhanced

reporting of tax information along FATCA principles through an Intergovernmental Agreement (‘IGA’), with alternative reporting arrangements for non-domiciled UK tax residents (non-doms);

• agreement to negotiate a revised Double Taxation Agreement; and

• agreement on a disclosure facility. The announcement comes as Guernsey also

moves towards concluding an IGA with the US on FATCA.

Both IGAs will be subject to the proper decision making process of the States and thus will be presented to the States for approval later this year.

The proposed package of measures would further reinforce Guernsey’s position as a tax transparent, co-operative jurisdiction and best positions Guernsey’s finance sector for long term growth opportunities.

Chief Minister Deputy Peter Harwood commented:

“Guernsey is fully committed to combating tax evasion and the principle of automatic exchange and our twin IGA approach to US / UK reporting will

provide our industry with a very strong platform to compete on the world stage against weaker, less transparent and compliant jurisdictions. The agreement that we are working towards with the UK will be consistent with our belief that Guernsey’s long-term sustainable economic future is best served by safeguarding our position and reputation as a respected, well regulated, tax transparent jurisdiction. With such a UK agreement, automatic exchange under the EU Savings Directive and importantly an IGA arrangement with the US for FATCA now almost concluded, we believe Guernsey business will have both certainty and a competitive advantage.”

Guernsey’s Treasury & Resources Minister, Deputy Gavin St Pier added:

“Securing a proportionate and workable non-dom reporting regime is clearly pivotal. The arrangements we have negotiated are non-intrusive and respect non-doms’ different status under UK tax laws. We are confident that they will secure Guernsey’s attractiveness for non-dom business, not least as they were devised in close consultation with industry groups and practitioners.

“We will also agree to a disclosure facility as part of a wider agreement between our two jurisdictions. Given our long-standing commitment to transparency, including our extensive network of tax information exchange agreements and the fact that we already exchange information

automatically under the EU Savings Directive, we don’t expect the facility to be used much, if at all.”

Guernsey’s Commerce & Employment Minister, Deputy Kevin Stewart said:

“Our industry asked for long-term certainty, and this proposed agreement and package of measures will give them that. That certainty will give them greater confidence and a competitive edge, as Guernsey will now be even better placed to capture future growth opportunities in finance as a mainstream tax neutral and transparent jurisdiction. The international finance sector has changed and Guernsey has not just changed with it, but has continued to influence that change. Our leadership on the international tax transparency agenda marks us as a mainstream and co-operative place to do business, and sets us apart from weaker, less transparent and co-operative jurisdictions. That will help our firms attract more business.”

The final terms and details of the enhanced reporting agreement and the alternative non-dom reporting arrangements will be published in due course and will be subject to consultation with industry on implementation issues. It is presently intended to publish both the US IGA and the UK IGA concurrently to provide for a streamlined consultation and implementation process.

Guernsey to agree package of tax measures with the UK

The mix adjusted average purchase price for local market property was £442,508 in the fourth quarter of 2012, 0.9% higher than the same quarter of the previous year.

Dr Andy Sloan, States Economist said:“The latest figures point to continued sof-tening of the local property market over the last quarter of the year - this is unsurprising given the subdued economic conditions experienced during 2012. Prices remained fairly flat and volumes of transactions for the fourth quarter were slightly weaker than a year previously. Looking forward, we should see a slight increase in both transaction numbers and the rate of property price inflation later in the year if economic conditions improve towards the middle of

the year, as is the current forecast. However, given high relative prices (to earnings) and limited potential for real earnings growth in the short term any pick up in general condi-tions is unlikely to see a return of rapid rates of house price growth as experienced just a few years ago.

More than 200 fund managers and advisers attended a Guernsey AIFMD Masterclass in London this week to hear how the Island’s plans for a dual regulatory regime mean it is perfectly positioned to continue to service clients in the wake of the EU’s Alternative Investment Fund Managers Directive (AIFMD).

Held at the Grand Connaught Rooms in London on Tuesday 19 March, the event, ‘Navigating AIFMD’, examined how Guernsey’s funds sector is preparing to introduce a regime that is AIFMD compliant, while also maintaining existing regulations for those investors and managers who are not obliged to follow the AIFMD route.

Fiona Le Poidevin, Chief Executive of Guernsey Finance, the promotional agency for the Island’s finance industry, said: “We are very pleased that the event was so well attended. The strong turnout shows the continued high level of interest not just in AIFMD itself, which remains a hot topic, but in particular Guernsey’s dual regulatory regime. The audience included many managers and advisers who are familiar with Guernsey and want to keep up to date with our plans regarding AIFMD. However, we also had a significant number of attendees who do not currently use Guernsey but are interested in our model in relation to AIFMD and the opportunities this might present for them.”

The event’s panel comprised Guy Rainbird, Public Affairs Director at the Association of Investment Companies (AIC); Jonathan de Lance-Holmes, Partner at Linklaters; Stephen Foster, Chief Operating Officer at Credit Suisse;

and Neale Jehan, Executive Director at KPMG and Chairman of the Guernsey Investment Fund Association (GIFA) Technical Committee. Jarrod Cowley-Grimmond, Director of Finance Sector Development for the Guernsey Government, moderated the panel discussion.

The event began with a short presentation by Mr Jehan on Guernsey’s proposed dual regime. He concluded: “We believe that embracing AIFMD, while recognising that we have a duty to our non-EU clientele and developing a regulatory regime that reflects this, will position Guernsey almost uniquely in the global fund industry in the years to come.”

Guernsey intends to operate dual regimes from July 2013, which is the deadline for the AIFMD rules to be transposed into EU law. At a basic level this will enable distribution of Guernsey products intoboth EU and non-EU countries via normal marketing routes, including EU national private placement regimes where they remain available. In addition Guernsey is examining the possibility of operating a Guernsey “opt in” AIFM regime in order to access (on a bilateral basis) EU member states that align their private placement rules with AIFMD. In addition, Guernsey will be engaged in future consultations in relation to how third country ‘passporting status’ will operate from July 2015.

Ian Garrett, Partner at FGG LLP, was one of those in attendance. He said the event was extremely informative.

“The quality of the panel was excellent - they provided depth and have got experience which is just what we need. Guernsey is like a friendly port

in a stormy sea of financial services and it is stable,” said Mr Garrett.

“We are often approached to form funds and we need to stay abreast of where the world is going in terms of regulation. Arenas and platforms like this are invaluable. They bring Guernsey to London which is a good thing, they keep the profile of Guernsey as a financial centre high and are user-friendly.”

Charles Fox, a member of the funds and financial services team at Mishcon de Reya, was impressed to hear how Guernsey was approaching AIFMD.

“Many other talks have been on the premise that you are in AIFMD. It was refreshing to hear the options and approaches available to managers to determine what market you want to approach and take an active decision about whether you want to be in AIFMD or not. It was interesting to take a step back and have an overview about how an offshore jurisdiction is approaching this in a pragmatic way,” he said.

Guernsey is hosting a further funds event in London in May. The Guernsey Funds Forum 2013 will examine the future shape of the global funds industry.

The event will be held at the Grange St Paul’s Hotel in London on Thursday 2 May and will culminate in a keynote debate featuring industry experts Nigel Vooght, PwC’s Global Financial Services Leader and head of its future-focused initiative ‘Project Blue’, and Better Capital’s Jon Moulton. The debate and the preceding panel sessions will be moderated by ITV News Anchor, Alastair Stewart.

Client data: Manage the risk, avoid the crisis …

Bedell Cristin hosted a seminar last week at the Old Government House Hotel in Guernsey on the subject of data management and, in particular, electronic data management.

Chaired by Jersey Litigation partner David Cadin and with an expert panel comprising Dr Stephen Chiang, Head of Group ICT at Bedell, Advocate Jon Barclay from Bedell Cristin in Guernsey and Kelvin McGregor-Alcorn, a Director leading the Electronic Disclosure Group at Deloitte London, the seminar covered a large number of the challenging issues presented by electronic data management.

The amount of information in paper and

electronic format produced by and available in organisations has had, and will continue to have, profound consequences.

According to Kelvin McGregor-Alcorn, director leading the Electronic Disclosure Group at Deloitte London and speaker at the Bedell Cristin seminar on data management, the average amount of data now being found in users’ corporate mailboxes on average is between 300,000 and 500,000 documents.

‘Multiply that by the number of users, and even small businesses are sitting on huge amounts of ever-increasing data that you probably cannot easily delete,’ he said.

Under the provisions of the Data Protection

(Bailiwick of Guernsey) Law, 2001, personal data must be ‘not kept longer than is necessary’.

For a business, however long data is kept there is a risk that at some stage that data might be required to be disclosed. If a business cannot comply with such a request, it may be subject to penalties.

‘Data is anything that contains information which includes paper and electronic documents, emails, texts and voice records and also the metadata that goes with those documents.’ said Bedell Cristin Advocate Jon Barclay, adding that ‘how you manage and store your data now will ultimately dictate the cost, timescale and effort required to search and to produce any information required.’

According to the panel, there are four key questions to ask yourself:

• What data do we hold?• Where do we hold it?• In what format?• What do we actually need to

keep?As Advocate Jon Barclay said: ‘If you have a

policy and apply it then you may legitimately be able to limit the extent of requests for data that has passed its destruction date, however if you do not have a policy then there is a risk that at some stage you might have to roll up your sleeves and delve in to examine enormous amounts of data.’

Proactive risk management is therefore the best and most cost-effective form of defence.

A BURSARY aimed at giving young women in Guernsey the chance to develop essential life skills has been increased to £1,500.

Women in Professions, which provides networking and support for professional women in the Bailiwick, launched its bursary scheme in 2011 and is offering a bursary to enable a local woman between the ages of 18 and 25 the opportunity to broaden their skills by working with a voluntary organisation.

‘We know from our own membership that women in the Bailiwick possess outstanding skills, expertise and experience. Women are contributing at the very highest level but in order to do that effectively, we recognise that education is not enough,’ said Women in Professions’ president Elaine Gray.

‘Life experience develops skills which cannot be

learnt in the classroom but which are essential for moving organisations, in whatever industry, public or private. The aim of the Women in Professions bursary is to provide a future female bright star with the opportunity to develop and broaden those all important life skills which are invaluable at all stages of a career.’

The £1,500 will used for the cost of travel and living expenses during the placement which must be a minimum of four weeks, in any country and working with any organisation providing they are a registered charity.

‘We have tried to keep the criteria as broad as possible in order to allow applicants to choose charities which are close to their hearts and which they feel passionately about. By giving the

opportunity to experience something they may not ordinarily be able to do, we are investing in the future generation of the island,’ said Advocate Gray.

Applicants need to complete an application form, which includes questions about why the charity has been chosen, what they hope to achieve and why they think they should be chosen. Applications will be considered by a panel comprising of Advocate Gray, Women in Professions’ immediate past president Fionnuala Carvill and Magistrate Cherry McMillen who will shortlist three women for interview and then chose the successful applicant.

CICRA (the Channel Islands Competition and Regulatory Authorities) has formally announced its plans to review the cost of groceries in the Channel Islands today.

The aim of the study is to investigate the costs involved in the supply and retailing of groceries in both Guernsey and Jersey and to provide consumers with greater transparency as to the reasons for higher prices. If higher prices are not commercially justified, CICRA will make recommendations to Commerce & Employment in Guernsey and Economic Development in Jersey as to measures that would achieve better outcomes for consumers.

The study will focus on all products sold at supermarkets (i.e. groceries), and not just food and drink.

CICRA Chief Executive, Andrew Riseley, cautioned that consumers should not expect prices to fall as a direct result of the study.

“There is a general perception that prices for groceries in the Channel Islands are too high. Our study will undertake a comprehensive comparison of prices for a range of groceries in Guernsey, Jersey, the UK and the Isle of Man. We intend to

focus on investigating what causes differences in prices and to examine the extent to which these differences can be explained and justified.

“The main aim of the study is to provide more transparency to consumers; it is important to note that CICRA does not have the powers, under the competition laws in either island, to require that retailers reduce their prices. However, if there are steps that we can identify that may increase competition in this sector, then we would make recommendations to the relevant government departments.”

CICRA will be meeting with, and collecting information from, wholesalers, retailers and suppliers throughout the course of the investigation and will seek to publish the results in October once they have been shared with the States of Guernsey and Jersey. The Authorities will also be seeking the views of local consumers in Jersey and Guernsey and the launch of these surveys will be announced in the media in due course.

The importance of good customer service is a hot topic in Guernsey at the moment as the debate between ‘buying locally’ versus ‘embracing the online revolution’ continues to heat up. Local organisations such as the Institute of Directors and the Chamber of Commerce have been getting behind local companies and doing all they can to retain business within the island.

One key element in retaining customer loyalty is offering a service that’s second to none. Human nature is such that we all moan about a bad customer experience making silent (or perhaps not so silent) vows never to shop or do business with that company again. Equally, of course, we will remember an example of service excellence. Either way these experiences have signifi-cant influences on our future buying deci-sions. Our island is too small for a bad repu-tation not to spread like wildfire and offering a fantastic service to customers is crucial in ensuring business survival – particularly in today’s pretty tough business environment.

Guernsey has a vast number of employees and businesses who excel in this area but there had never been a process to give them the public recognition they deserved.

“Being polite, helpful and efficient is vital to any business organisation in today’s economic climate and that can be hard to attain when office bureaucracy and business red tape can often get in the way,” explained Julie.

“ But there are so many people who seem to have a true vocation in helping others to ensure all their expectations are met. Cus-tomers leave with a smile on their face and a spring in their step as a result.

A new Guernsey regulated fund has been launched to target the potential of the Euro-pean student accommodation market.

The Victus European Student Accommoda-tion Fund will invest in a blend of mature existing properties and new developments in major university cities across Europe. It has already raised more than £10 million of ini-tial investment prior to its first dealing day.

The fund will work with joint venture partners and local developers within the university locations to gain regional insight, complementing Victus’ property and invest-ment expertise. The expected annual return will be 10-12% pa.

Mourant Ozannes advised on the Guern-sey legal and regulatory aspects of the fund launch, while Pinsent Mason LLP were UK

legal advisers. Ardel Fund Services Limited in Guernsey has been appointed as adminis-trator to the fund, with Royal Bank of Canada (Channel Islands) as the custodian.

James Metcalf, of the Crosslane Group which is the property adviser for Victus, said: “After extensive research we’ve found that the European student accommodation market is around 10-15 years behind the UK. There are few open market transactions at the moment which means there are huge op-portunities for growth. At Crosslane, we have gained a great deal of experience in this sec-tor, having already created two UK student accommodation funds.”

The first acquisitions by the fund are ex-pected to complete imminently.

wood, CEO at Creechurch Advisory Services, said: “The property market presents pockets of opportunity at present and European student accommodation is one attractive op-tion that we’re incorporating into our clients’ portfolios.”

The first consumer show to take place in Guernsey for over five years could provide previously untapped business for local companies.

About 10,000 people are expected to visit the Guernsey Press Homelife Show to be held over three days at Beau Sejour Centre in November. It will provide a unique opportunity to meet face to face with potential customers.

After more than 25 years, BDO Limited director Paul Burnard is still celebrating his perfect career move.

The director of local business services at Guernsey accountants BDO Limited is celebrating 25 years with the island firm. When Paul Burnard joined the company in the late 1980s it was part of the Reads Group and in the year 2000 he was part of the management buyout that resulted in its re-launch with the BDO name.

The Guernsey Financial Services Commission is pleased to announce that William Mason will be appointed the Director General upon Nik van Leuven’s retirement.

William Mason will join the Commission from the position of Head of Risk at the Central Bank of Ireland, where he has led the development and implementation of its PRISM supervisory methodology. Most recently he has been working with the European Central Bank helping it plan for the Eurozone’s proposed Banking Union. Before that Mr Mason worked for the UK Financial Services Authority, joining shortly before the financial crisis, and led teams supervising a range of credit institutions, insurers and investment firms throughout the financial crisis.

Prior to becoming a financial regulator, Mr Mason worked as a strategy consultant and latterly at the UK Cabinet Office where he helped write Regulation – Less is More, a report to the Prime Minister. His other publications include: Freedom for Public Services; The Costs of Regulation; and PRISM Explained – Implementing Risk Based Supervision.

Commission Chairman Cees Schrauwers, who led the selection process, said: “There was substantial interest in the role and the search for the right candidate has been rigorous. The Commission appointed a UK executive search company, Hanson Green, and a long list of 16 was drawn up from

applicants arising from a candidate pool of some 150 people, with four making the final interview shortlist.

“The recruitment specialist consulted widely with representatives of Guernsey’s financial services industry and other relevant parties before commencing with the process.”

The nomination panel comprised Mr Schrauwers, two Commissioners, and Commerce and Employment Minister Deputy Kevin Stewart, while final interviews were conducted by all the Commissioners.

Mr Schrauwers said that Mr Mason’s career history and track record made him an excellent candidate for the role. Mr Mason will take up his post within the next few months.

Mr Mason said: “Guernsey is a mature and highly regarded financial services jurisdiction. I very much look forward to leading the Commission at a time when global financial services and markets continue to face many pressures and challenges. My wife and I are much looking forward to making our home on the Island, and moving there as soon as practicable.”

Nik van Leuven said: “I have come to know William recently through our consulting him on the PRISM project being undertaken for the Central Bank of Ireland. I am certain his knowledge and experience will be of great value to the Commission in these times of threat and change.”

A church might not seem the obvious “fi rst choice” venue for a business gathering, but then go back a few decades and you wouldn’t have expected to see people living in them

either. Most of us have probably been into St James at one time or

another – a visiting music artist, a wedding or for those ex-Eliza-bethans the daily school assembly some years ago – the main “Whittaker Hall” is a pretty well established venue for some of the Island’s more lavish events. This is however the tip of the iceberg. The full extent of the additional facilities and opportunities on offer at St James is something less known to the Guernsey business

Community and the public at large – unless you happen to belong to one of our many choirs and orchestras who get to see “back stage”.

In 2002, following an impressive fund-raising campaign by a group of dedicated individuals, St James three storey Dorey Centre was opened offering meeting rooms, a café and administration offi ces. This achievement demonstrated the seemingly endless generosity of the Guernsey public and the local business sector. The buildings are now run by a small dedicated and enthusiastic team, supported by The Friends of St James Association.

With separate access away from the main hall, the Dorey Centre can cater for any type of “off-site” business event. The largest – The Dorey Room - caters for up to 90 people (theatre style) the smallest offers boardroom facilities for eight. The Dorey Room also benefits from an external terrace area. From breakfast briefings to board meetings, staff presentations to drinks receptions, the accommodation is versatile and can be configured to individual specifi-cations. The first floor meeting facilities when hired en bloque create the additional option of offering breakout rooms – often useful for training sessions. All rooms are equipped with data communication and patch-bay facilities.

Whilst room hire rates are already extremely competitive St James also has a Corporate Membership scheme, the benefits of which a number of well known local businesses have found extremely appealing. The three-tier system offers a range of benefits including free and dis-counted seats, preferential room hire rates and recognition on the members’ board in the Centre foyer and the monthly newslet-ter distributed to the Friends of St James (numbering around 2,000 in total). For Gold and Silver Corporate members, free ticket vouchers can be exchanged for free room hire instead.

Too good to be true? Well in this case seemingly not!

St James is undoubtedly one of the jewels in Guernsey’s crown. Its fascinating history means that its regular visitors have included soldiers and schoolboys, choirs and corporations.

Today the building is at the very heart of the Island’s cultural life, but offers so much more. A pleasant contrast from some of the characterless conference rooms we have all had the dubious pleasure of using in city centres, St James’ corporate facilities are well worth a look.

Who would have thought a church could be so versatile?

The History Lesson.It was at a public meeting on 30 October 1815 that Admiral Sir James Saumarez, later Lord de Saumarez, conceived the idea of building St James.

The church was to provide a place of worship for the British garrison in Guernsey , where services could be held in English. At that time, services in the Town Church were held in French.

The building was completed in 1818.

After a full life, which included its use as the Elizabeth College chapel for many years, the building finally became redundant in 1970 and fell into partial decay.

In 1981 The Friends of St James Association was formed to achieve St James’ restoration and then to administer the building as a concert and assembly hall. The States agreed to pay for this restoration in 1983 and the building was officially re-opened on 5 July 1985 by HRH the Duke of Kent.

Following intense fund raising the single storey tin-roofed annexe, built during the 1930s, was demolished and in 2002 Dorey Centre was completed.

Recognition of Guernsey’s expertise as a highly respected business centre continues to build in the Far East, following the recent visit of the Malaysian High Commission as Contact reports.

The opportunity to develop trade links between Malaysia and Guernsey was evident during

MATRADE’s (Malaysia External Trade Development Corporation) time in the island. The high commissioner for Malaysia, His Excellency Dato Sri Zakaria Sulong, and the Malaysian trade commission, were visiting Guernsey for the first time and held a number of meetings with individual businesses, trade bodies and the Island’s government.

During the visit the Malaysian delegation were hosted by Guernsey’s Chamber of Commerce and Kevin

Stewart, the Commerce and Employment Minister, held a reception for the visiting dignitaries at OGH Hotel where they met with representatives from Guernsey’s government. During their visit, MATRADE also spent time with numerous local businesses with interests in the Far East.

‘The visit of the Malaysian delegation to Guernsey is credit to the work undertaken by Chamber members in developing businesses in the region. We intend to work closely with MATRADE to provide Guernsey companies with a platform to move into this exciting economy,’

said Chamber director Barry Cash. Guernsey already has a number

of businesses operating in the region with the likes of Louver Group, Ogier, CollasCrill, Mourant Ozanne, Marine Electronics and Newhaven Trust developing trade with this important market.

‘It is extremely pleasing to see the progress that these firms are making in the Far East. They are helping Guernsey to build strong relationships with Asia and lay the foundations for future business growth between the regions. Guernsey has a very strong heritage in using structures such as

trusts and companies and of course our new foundations legislation will be relevant to the Asian market,’ said Guernsey Finance’s Fiona Le Poidevin.

Guernsey has made steady progress in establishing its reputation for financial services in Asia in recent years. In 2010, the Island signed a Tax Information Exchange Agreement (TIEA) with the Chinese central government tax authorities and a Memorandum of Understanding (MoU) for exchange and cooperation with the Shanghai Financial Services Office, while last year saw the Island given approval for companies incorporated in Guernsey to list on the Hong Kong Stock Exchange (HKEx) and Guernsey’s financial services regulator, the Guernsey Financial Services Commission (GFSC), sign a statement of cooperation with the China Banking Regulatory Commission (CBRC), moves that suggest the island are well on their way to embedding routes for a sustainable and long term relationship with the region. This has now extended to Malaysia and the visit is a significant development for Guernsey.

In a similar way in which Guernsey Finance promote the Island’s interests overseas, so too MATRADE’s mission is to promote Malaysia’s export. ‘MATRADE has enabled many local

companies to carve new frontiers in global markets. Today as we continue to put the spotlight on capable Malaysian companies on the international stage, we are helping make the phrase ‘Made-In-Malaysia’ synonymous with excellence, reliability and trustworthiness,’ said Malaysian trade commissioner Raja Badrulnizam.

MATRADE’s mission is unsurprisingly focused on increasing Malaysia’s presence in a global economy but the expertise required to enter these markets is something the delegation are keen to learn more about. ‘The world is a global village today and getting smaller. There are plenty of opportunities and we have a government transformation programme looking into how Malaysia can be relevant on the international scene. In this regard, the expertise available to our industries from Guernsey is of genuine interest to us,’ said His Excellency Dato Sri Zakaria Sulong.

Leading Guernsey legal professional, Sean Cheong who is Malaysian by birth and first qualified as a lawyer in Kuala Lumpur, believes the two jurisidictions can work closely together. ‘At CollasCrill, we currently service our Malaysian clients from our base in Singapore (Ms Cheong set up the office in August 2012). Malaysia is a

sophisticated market; indeed the market leader in Islamic finance offerings in Asia,’ said Ms Cheong. ‘Guernsey, with its highly developed funds industry and in-depth Shariah knowledge can offer its funds expertise to managers looking to access European markets with their Shariah compliant funds. There are also opportunities for Malaysian companies raising capital in London on the Alternative Investment Market (AIM) using a Guernsey holding company.’

Britain has also been working hard to increase trade relations with Malaysia. British Prime Minister David Cameron recently visited Malaysia to attend a bilateral meeting with Malaysian officials as well as witness the signing ceremony of Malaysia-United Kingdom Joint Statement in Higher Education.

‘Our relationship with Malaysia is hugely important to the UK but quite frankly it’s one that has been neglected in the past. Malaysia is becoming one of the great emerging powers of the 21st century with the 26th largest economy in the world. But the UK only accounts for 1% of Malaysia’s total imports and I want to change that. We already have strong educational ties with Malaysia but I want our commercial ties to match this,’ said Prime Minister Cameron.

in the UK, education ties are seen as the opportunity to build sustainable and long-term relations. Many British universities are also setting up campuses in Malaysia. From Newcastle to Nottingham, the Prime Minister believes this represents a real example of the high quality education the UK can offer Malaysia. ‘We have signed a new agreement which commits both countries to an enhanced partnership in education and skills training, alongside the doubling of Chevening scholarships as a result of support from BAE Systems. In the field of energy, British technology is playing a key role in supporting the further development of Malaysia’s oil and gas industry,’ said the Prime Minister Cameron.

And as Malaysia invests in its

infrastructure to keep up with its economic development, Guernsey can offer its world-class experience in more than just financial services. One company that is already trading with Malaysia is Guernsey business Marine Electronics. Marine Electronics Limited was established in Guernsey in 1983 and design and manufacture sonar and acoustic products for the offshore oil and gas industry. Over the years the company has diversified into other areas using its skills in electronic and acoustic design for the medical industry, the water industry, the mining industry, Customs and The Ministry of Defence and are now exporting their range of products to Malaysia and the Far East including a pipe profiling sonar. This particular product provides an acoustic

method for profiling the interiors of liquid filled pipes or boreholes.

The company’s managing director Mr Brian Evans met with the Malaysian delegation during their visit. ‘Marine Electronics has a client base in the far east including Malaysia and the MATRADE visit was a great opportunity to meet with delegates from the region. Our products are bought by various sectors in Asia and we will be attending a major exhibition later in the year to build on our existing business in the region,’ said Mr Evans.

The facts.Malaysia is the EU’s second trading partner inside ASEAN, behind Singapore.

In 2010 the Malaysian Government presented the New Economic Model and the 10th Malaysian Economic Plan to facilitate Malaysia’s transition to become a high-income economy by the year 2020. This economic model advocates the need to enhance the role of the private sector and re-focus the Government’s role in the economy as a facilitator and enabler. Malaysia’s policy of liberalisation with regard to its services sector, has led to increased opportunities for trade in services.

Malaysia enjoys trade preferences with the EU under the current Generalised Scheme of Preferences. In 2011, Malaysia was the EU’s 23rd largest trading partner in goods. Bilateral trade between the EU and Malaysia is dominated by industrial products. The EU mainly imports machinery and appliances and mainly exports electrical equipment and machinery (both ways industrial products account for more than 90% of trade). Other sectors of relevance in terms of EU imports from Malaysia are plastics and rubber and animal and vegetable fats and oils and in terms of exports, mechanical products.

EU imports from Malaysia have gradually increased since 2003, experiencing a significant decrease in 2008-2009 (16% fall). With the exception of fisheries, EU exports have also seen a growing trend since 2000, with an 18% decrease in 2008-2009 due to the economic downturn.

Although Malaysia has not been a major trading partner in services so far, opportunities have already been increasing due to its liberalisation policies and would even further advance with a Free Trade Agreement. In 2009 Foreign Direct Investment outflows to Malaysia were €1.1 billion.

And as Malaysia invests in its infrastructure to keep up with its economic development Guernsey can offer its world-class experience in more than just financial services. One company that is already trading with Malaysia is Guernsey business Marine Electronics

Malaysia both want to ensure the security of the region and the world is maintained. Malaysia are committed members of the Commonwealth and argued strongly at the Commonwealth Summit in Perth last October 2012 for a reinvigorated organisation that is more relevant to its citizens. Malaysia and the UK’s respective monarchies provide stability that many other countries envy.

The Channel Islands received a specifi c mention in the 2013 Budget. Not sur-prisingly, in an effort to promote tax

transparency and combat tax evasion, the Chancellor announced the agreement by the Isle of Man, Guernsey and Jersey to a package of tax measures with the UK government.

The packages comprise intergovernmental agreements with the UK, which introduce obligations for the automatic exchange of in-formation regarding assets held in the Islands by UK tax residents. UK residents who are not domiciled in the UK may also be affected by the reporting arrangements. A disclosure facility has been agreed in principle, which allows UK investors with assets in the Islands to come forward and regularise their past tax affairs prior to information on their accounts being automatically exchanged. It is expected

that limited information for 2013 and 2014 will be exchanged, with further and more de-tailed information being provided from 2015.

The Chancellor advised that approximately £1billion in tax will be raised over the next fi ve years due to these agreements with Jersey, Guernsey and the Isle of Man. The intergovernmental agreements with the Is-lands are part of a larger, tough package of tax avoidance and tax evasion measures to raise money. This package includes a consultation on naming and shaming promoters of aggres-sive tax avoidance schemes, the introduction of a General Anti Abuse Rule and leading international action on profi t shifting.

The Budget confi rmed much of what had already been proposed and consulted on. Legislation on the Statutory Residence Test (with some minor changes), the UK Resi-

dential Property Taxes (CGT and the ARPT, now renamed ATED, annual tax on envel-oped dwellings, with some additional reliefs included) and the General Anti Abuse Rule (now confi rmed to include ATED) will be introduced by the Finance Bill 2013.

Other measures which may be of interest to those in the islands’ fi nance industry are:

- Confi rmation of the changes to legislation regarding the transfer of assets abroad;

- amendments to the offshore funds rules with a view to making aspects of the legisla-tion fairer for UK investors in offshore funds;

- the abolition of stamp duty on the trans-fer of units in onshore unit trusts and the removal of stamp duty in respect of all shares listed on growth markets such as AIM and the ISDX Growth Market; and

- the introduction of legislation to limit the

deduction of liabilities when calculat-ing UK inheritance tax.

The usual increases on alcohol duty and tobacco were announced, except for beer, which the Chancellor con-firmed would see ‘a penny taken off the pint’. Any fuel duty increase expected in September has been cancelled and this will be good news for our neigh-bours in the UK.

As in prior years, the UK has been confirmed as being ‘open for business’ with the corporation tax rate dropping to 20% from April 2015. However, the banks will not see the benefit of this rate drop as the bank levy will increase from 0.13% to 0.142%.

UK tax residents and others includ-ing certain Channel Islands residents will see the benefit of an increase in

personal tax allowances. A promise was made by the current government to increase the allowance to £10,000 by the end of the governments term. However, it was today confirmed that the increase to £10,000 will apply from 6 April 2014.

So overall, rather a flat Budget, reflecting the lack of room for ma-noeuvre with some heavily trailed announcements seeking to stimulate the economy with what little he had to give in a fiscally neutral Budget. And little of concern for us locally. A Budget that was more aspirational then inspirational.

Tax Agreements with Isle of Man, Jersey and GuernseyThe UK has agreed a comprehensive package of measures with the Isle of Man, Guernsey and Jersey governments to clamp down on those who choose to hide their money offshore. This demonstrates the commitment of all parties to tackle tax evasion.

The package consists of:• agreement to automatically exchange a wide range of financial information on UK taxpayers with accounts in the Isle of Man, Guernsey and Jersey which will significant-ly enhance HMRC’s ability to crack down on those who do not declare their offshore affairs;• a disclosure facility to allow people to come forward to disclose their previous tax affairs in advance of the information being automatically exchanged.

HMRC has signed Memoranda of Under-standing with each of the Crown Depend-encies.HMRC has also published its offshore eva-sion strategy ‘No safe havens’. This strategy sets out a coherent and coordinated frame-work for HMRC’s approach to tackling offshore evasion.

Offshore employment intermediariesThe Government will consult on strength-ening obligations to ensure the correct income tax and NICs are paid by offshore employment intermediaries, with a view to legislating in Finance Bill 2014. This is a result of the review announced in Autumn Statement 2012.

Stamp Duty Land Tax (SDLT) avoidanceLegislation will be introduced in Finance Bill 2013 to put beyond doubt that certain SDLT avoidance schemes that abuse the transfer of rights rules do not work. These changes will have retrospective effect to 21 March 2012.

IS THE BUBBLE ABOUT TO BURST FOR GUERNSEY PROPERTY INVESTMENT?

I’ve heard it said that the best time to buy property was 20 years ago. But when is the second best time? Well many property professionals and investors in the property sector would say…now.

Whilst Guernsey has not been completely immune from the turmoil that has beset the global economy over the past fi ve years, it was fared considerably better than most domestic economies and despite the uncertainty in the local housing market and tightening of lending as a consequence of the dislocation of the credit markets, property continues to be viewed as one of the better long-term investments as investors recognise the benefi ts of a tangible asset.

Furthermore, the increase in rental demand in Guernsey property has corresponded with the growth in the number of fi rst-time landlords purchasing buy-to-let properties who see bricks and mortar as a preferred investment compared with other asset classes.

At the end of December 2012, the total number of domestic property units on the island was 26,172 of which 27% was rented. This is up from 26% in December 2011.

This demand has also contributed to the continued increase in property values with the mix adjusted average purchase price for local market properties rising to £442,508 in the fourth quarter of 2012. This is

0.9% higher than the same quarter of the previous year and up from £411,074 in December 2010.

So is residential property a good investment? Well in the long run, the value of property almost always rises and so this therefore offers capital appreciation. In the meantime, investors can benefi t from the letting income and rental yields on buy-to-let are stronger and generally more stable than in other asset classes.

There are downsides to consider before investing:

A property can be diffi cult and expensive to sell should you need to release capital quickly;

• Transaction fees are high When you invest in a savings account, it’s rare that it will cost you anything to set up. Even when investing in stocks and shares, the transaction costs are usually quite low as a percentage of the amount you invest. When you invest in property you may have to spend money on legal fees, valuation fees, mortgage lending fees etc.

• Income can be

inconsistent and property can cost you money - Other than property, there are few investments that might actually cost you money. For example, if you have periods without tenants you not only lose income but you still need to fund the maintenance costs. This may mean having to pay these property expenses from your own resources whilst the property is empty.

• It can take a long time for the value of your asset to recover - Stock markets can be volatile although they can often recover much quicker than other forms of investment.

• Property Management is time

consuming - Do you have you the time and resources to manage the property? Other types of investment do not require such pro-activity and are unlikely to give you as many sleepless nights.

There are however, good reasons to invest and why increasing numbers of investors have turned to property in recent years. These include:

• Real returns – the continued low interest rate environment has resulted in low savings rates which rarely keep pace with rises in the cost of living;

• Stable investment – Stock market volatility has eroded the value of many investments;

• Safety - Property is still regarded by many as a ‘safe and secure’ asset class as there is always a demand for housing;

• Control – acquiring property is a direct investment where you retain ownership and control of the underlying asset. If you invest in the stock market there is always the potential that you could lose all your capital if for example, the company in which you have invested goes out of business.

Based on a survey carried out by Investec Bank (Channel Islands) Limited, the majority of respondents considered residential property to be one of the safest investments and whilst there may be fl uctuations in value from time to time, given the continued demand and limited availability of stock, the general opinion would appear to be that residential property remains a sound investment over time.

There is a great deal of confi dence in the Guernsey property market at the moment. House prices are stable and relatively buoyant and the island has avoided the peaks and falls seen in the UK and even in Jersey.

The number of transactions is falling however: 166 in the fourth quarter 2012 compared to 205 in the same period the previous year. It is clear then that despite confi dence in the value of property fewer people are moving and the question should be asked, as it has been in the UK and indeed in Jersey, whether the States should be looking to intervene in the market and provide a stimulus to aid those looking to get on the property ladder.

Firstly, it is important to understand the barriers preventing people from making the decision to buy a home, or to move into a new home; whether that is to upgrade or to downsize.

In Guernsey, the cost of moving is relatively high; not just the cost of housing

and agents fees; loan bonds and legal fees also play a part. It is often seen as more cost effective to stay put and develop extra living space than it is to move to a larger property. Homeowners are also more likely to look for what banks call ‘rate switching’, where new deals are made on the basis of the loan to value percentage being reduced over time, or through increases in market value thanks to gradual price infl ation or from home improvements.

The incentives to sit tight are well known, however the States of Guernsey have already intervened in part of the process by approving a review of conveyancing fees, encouraging competition in the market which should drive down prices and potentially encourage more people to move.

Getting a mortgage can still be diffi cult for many however. The lending environment is very different compared to four or fi ve years ago, particularly for fi rst time buyers. Banks in Guernsey are often

subject to criteria that are applied by a UK parent. At Barclays for example we are able to loan up to a maximum of 85% of the value of a property. This is seen as prudent in the UK, where there is more uncertainty in the market, but can be seen as frustrating in an island where property prices, and the job market, are much more stable.

What it does mean is that buying a house is not as simple or affordable as many people would like. Deposits are large, with £50,000 to £60,000 very common for a typical fi rst time property such as a two bedroom fl at. With fewer fi rst time buyers coming into the market there is a lack of buyers at all levels; those in the middle looking to move on can’t, as there is no-one to buy their current property, and those at the top that might be looking to downsize, or even retire abroad, are stuck with a property that is too big for them.

as having been successfully introduced as part of the States social housing programme. But wider measures could be introduced, as they have been in the UK and now in Jersey. As well as the launch of the ‘Funding for Lending Scheme’ which has helped reduce the cost of mortgages in the UK the government is offering incentives to banks to lend to first time buyers through the New Buy scheme. In Jersey a new scheme has been introduced for new developments led by the parishes. In St Brelades for example a new development is in place and the parish is helping homebuyers by effectively offering to pay their deposits for them. The house prices are discounted by 20% and thanks to some flexibility in our criteria Barclays, as a lender, is able to offer the remaining 80% as a mortgage, without the need for a further deposit. The deposit is paid back to the parish on the sale of the property but with the buyers retaining some of any profit made when they come to sell.

This has the potential to boost the number of people on the housing ladder, effectively helping those that can afford to make payments on a mortgage, but who cannot spend years saving the necessary deposit. This influx of buyers would stimulate movement at all levels. This

would obviously be good news for the property sector, but it is also important to remember the knock-on effects on related industries, with retail, building trades, removals, gardens and other lifestyle sectors seeing benefits from people investing in new properties.

Any changes to the market need to be introduced with caution however. The last thing anyone wants or needs is to create an imbalance that would negatively affect house prices. A ‘glut’ of new buyers, all arriving in the market at once would potentially have this affect, so the right approach would be to provide the means to get onto the housing ladder for many people and let market forces manage the rest of the process to ensure a steady flow.

Strong demand for modern apartment liv-ing in St Peter Port shone through last week as 50% of the apartments in the

initial phase of a luxury development were reserved within hours of being released.

Six of the 12 apartments in the fi rst phase release of the 32 apartment and penthouse de-velopment, One St Julian’s Avenue, in St Peter Port were reserved in less than two hours. The development includes 29 local market loft-style one, two and three-bedroom apartments, and three open market penthouses. They have exceptionally large living spaces that are light, airy and modern, and some of the best balco-ny views towards Candie Gardens and across to Herm, Sark, Jethou and Castle Cornet.

Although the apartments and penthouses

are not due for completion until May 2014, the developers, Vauxlaurens Property Hold-ings Limited, have worked closely with local advocates to create a reservation fee format to enable prospective buyers to secure an apartment or penthouse now. The reservation fee is based on a percentage of the total sale value of the apartment or penthouse and the effect is that the developers agree not to sell the reserved apartment or penthouse to any other party.

The developer’s advocates, Babbé says: “We are delighted to be associated with such a prestigious development. The reservation fee arrangement means that interested purchas-ers can reserve their preferred apartment or penthouse at a very early stage of the

development. The reservation fee will be rolled into the purchase price so they would not ultimately be paying anything for this advantage.”

Attempting to make sense of the current situation in Sark is challenging enough

but as one who has spent a lifetime enjoying the Island’s pleasures and investing the family’s holiday kitty in doing so, I do feel I have sufficient insight to present what I believe to be a rationale for hope.

Back in 1993 when the Barclay’s arrived in the Bailiwick, Guernsey businesses rubbed their hands in excitement. Fortunes were spent on a skilled Guernsey workforce and to this day they are still employed to carry out work on Brecqhou and Sark. In Sark itself however, certain sections of society saw it as an invasion – not an opportunity.

My recollection of Sark in the early nineties was of a well-loved neighbour who should be taking more pride in itself. Yes, the island was charming, quintessentially unique in a way that only the Bailiwick can be but it was in desperate need of investment. Very few appeared to be willing to help create an industry fit for purpose in today’s competitive economic landscape. There was no Mark Warner resorts or Hoseasons clambering on the ‘toast rack’ to make Sark’s economy thrive. It was in the hands of the few with access to considerable resources who could afford to avoid economic pressure from outside the island but reluctant to pump the necessary funds to build a tourist economy fit for modern purpose. In bygone times there were sufficient people with

wealth to cushion the island against the problems created by increasing pressure on its subsistence economy. In today’s world there are insufficient wealthy people to maintain Sark’s traditional way of life with all its anomalies and sustain an economy for the new generation of young Sark residents. The expectations of the well travelled tourist did not appear to be recognised as a priority for the Sark authorities back in the nineties. ‘Sark is the antidote to modern living’ was the promise to all visitors. It is, if managed correctly but Sark in my opinion took it for granted. The lack of official building regulations, fire regulations and little if any concern for health and safety or the management of waste do not sit comfortably in the minds of the modern and well informed visitor. It was inevitable that when, an organisation so familiar with the requirements of a 21st century hospitality industry, arrived on a rural idyll so blindingly ignorant to the standards required for a modern holiday destination, i.e. safe, comfortable and value for money tourism, the place was going to change forever.

Such is the quiet almost secretive nature of the Feudal system pre Barclay Brothers; any new moneyed incumbent was likely to ruffle a few feathers. However, such is the huge investment made by Sark Estate Management (SEM) within the island, the community is now completely divided between those that have seen the potential in the

era changing environment created by SEM and those that reject any kind of outside intervention.

A further reality is that of Sark’s ageing and diminishing population, due in part to a weak economy and lack of job opportunities for the young. This, Colin Kniveton, Sark’s former temporary chief secretary believes, could eventually threaten its ongoing viability as a self-governing Crown Dependency. Before leaving his post Mr Kniveton urged Sark’s authorities to be ‘proactive’ not ‘reactive’ in safeguarding the Island against changing economic pressures.

‘Jobs are drying up as tourist numbers are dropping, the construction sector has stopped as there is currently limited investment in hotels – all these things have a knock-on effect. If there are less people coming in and out and less freight, that has a knock-on effect on shipping,’ he said. ‘Some people may say that’s fine, Sark may be quieter but that’s the way we like it. But if you’re a younger person in Sark, you may be thinking what are my kids going to be doing when they finish their education?

Educating the Island about diversifying its economy is also vital. We talk at length about diversification in Guernsey and I presume we include our Bailiwick neighbours in this. In Guernsey, the business community knows that diversification is not a reality. History demonstrates that the small available labour force can sustain only one major industry. Diversification has to happen within that major industry. Our finance industry is a conglomeration of lots of separate and discrete activities. The thought of not relying on one major industry fills us with optimism but it is far from any kind of reality in the short or medium term. The actual reality is that in a small community educated to the ways of international finance, it is likely to take a generation to truly diversify our economy and we simply need to keep our finance industry relevant and seek out opportunities to support it whether that’s ITC or tourism.

In Sark the pressure is even greater. I can’t visualise a broader/mainstay industry outside of tourism that would suit Sark so surely it’s time to get the one sector that stands a chance, working to its maximum. The anti-Barclay feeling should not cloud the fact that tourism is Sark and will be for years to come. In business parlance the island has a lot going for it and numerous ‘Unique Selling Points’ to think of. Most are focused on the age-old promise of ‘Sark is the antidote to modern living’. The tourist that this promise is most likely to attract is wealthy, busy, stressed and ultimately familiar with the finer things in life. This target audience expects a higher degree of hospitality than your norm. I have fond memories of sleeping on my father’s small cabin cruiser in Dixcart Bay but expectations for ‘modern city dwellers’ means the combination has to be a break from the modern world but in quality and comfort. They want to be free of stress without being denied the external connectivity should it be required.

Quality and comfort in Sark’s accommodation has not been the norm but the investment in Dixcart, Aval de Creux, La Moinerie, Petit Champs and Stocks means the Island now compliments its stunning scenery with stunning hospitality venues. Investment is also something that is required in promoting the island. The Sark authority’s tourism budget is not small, close to £100,000. This goes towards off island promotion but is dwarfed by the amount spent by the new generation of Sark hotels. The tourist experience is also now enhanced with coasteering and outdoor activities organised by Sark Adventures along with Sark’s Folk Festival and other activities. Everything would appear to be going in the right direction in terms of ‘Sark the Brand’ but once again it’s the Sark authorities who fail to grasp the opportunity. The lack of a customs office means all passengers must arrive via Guernsey or Jersey and without such a department you could argue visiting pleasure/

private vessels are also unchecked unless they have arrived from Guernsey or Jersey. There is only one licence granted to Isle of Sark Shipping to bring visitors to the Island via Guernsey. Visitors can arrive via Jersey through La Manche Isle Express but the service is infrequent and often criticised for unreliability by Sark hoteliers. Retaining a lifeline service outside of the summer months has been the mainstay argument for keeping a status quo or monopoly with Isle of Sark Shipping but this is cutting off the huge potential of attracting visitors direct from France and Jersey. Travel Trident tried for a licence a few years ago but failed in an attempt to provide an alternative service. My observation would be to encourage Isle of Sark Shipping to run a licence service between France and Jersey during the summer months only, with some kind of guarantee of business from the Hotels. If Isle of Sark Shipping aren’t interested then give it to someone else such as Travel Trident, Condor or other regional ferry services. They would see the potential investment from the new generation of Sark hotels and their business experience as a viability for introducing a service. Let the hotels build demand and then the implication of a lack of passengers is irrelevant.

Guernsey residents have been relied upon to keep Sark’s economy viable over the years because ultimately we eat the fish they catch, we enjoy lazy lunches at the ‘Sablonnerie’ and share a pint with locals in the Mermaid and Bel Air. I doubt this will ever change and although some argue arable land should never have been altered to accommodate vines, the serenity of Sark has been enhanced by the investment made in the creaking hospitality venues. Certain sections of the Sark community may never resolve a dispute with its immediate neighbours but the investment made in its key economic generator should be leveraged for the future health of Sark’s economy.

They want to be free of stress without being denied the external connectivity should it be required.

We speak to Glyn Smith, MD of Insurance Corporation about his life in business. Glyn Smith has worked in the world of insurance since he left Grammar School in 1977 after studying A levels. He is quietly ambitious and admits to targeting roles which gave him a wide breadth of experience in the various aspects of his chosen career, then moving on when he felt the time was right. He was delighted to be asked to take on his dream role as MD of Insurance Corporation in

2009 - a company he says, that he has been a part of for much of his early career path.A keen sportsman, and coach of Begrave Wanderers FC fi rst team, Glyn admits that his competitive spirit, stamina and the ability to motivate on and off the pitch past and present has stood him in good stead for what has been a positive climb up the corporate ladder.

“I started out as an A level trainee for Commercial Union and ended up as a Local Manager. After ten years I became an insurance broker for two years and in 1989, I then joined Insurance Corporation for the first time and worked for them for 11 years ending up as their Operations & Claims Manager.”

By this time Glyn had also studied for his MBA and was ready for new horizons.

“I decided that it was time to move on as, regretfully, at the time I had gone as far as I could within the organisation. My next roles were in captive insurance management at HSBC and Heath Lambert.

But Glyn explains, he had always enjoyed the company culture within Insurance Corporation and believed strongly in the local business model centred on local underwriting, leader-ship, decision making and service.

“There is no doubt that our strength comes from the fact that we are a local company, operating independ-ently with an acute awareness of how things operate in the Channel Islands. This does give us an edge as a lot of our competitors are UK insur-ers doing business from the UK. We are in a position to be able to work closely with our local brokers and clients - both in Guernsey and Jersey - and be literally on hand to react to whatever may be happening. Take for instance the recent snowfall and the problems that resulted. The phone lines were busy and many of our staff had braved the snow and ice, walked in and knew exactly what support the local brokers needed. It’s all about local knowledge, local relationships and being totally customer focused.”

He says that when he was ap-proached by the Chairman to take on the role of MD he was aware that there were challenges ahead.

“The company’s growth had not been what it should have been over the previous three years and the culture had shifted and was a bit in disarray because the team had lost a bit of focus on who our custom-ers actually are. We have two sets of customers, insurance brokers and the people and businesses who are or want to insure with us. We chose to distribute our products through local insurance brokers that provide impartial and professional advice. It was clear to me that we had lost sight of the need to continue to build value adding relationships with our broker friends. An experienced ex-Island Junior and Senior Muratti player, and now a well-respected senior coach

at Belgraves FC, Glyn likes to think that he is able to transfer his sporting strengths into the workplace.

“Yes, it’s about being competitive and results driven, but it’s also about working together as a team and being committed to being the best you can be. I am also very aware of the need to give something back to the com-munity and Insurance Corporation is involved in many charitable and com-munity based projects like our Con-servation Awards across the Islands, Les Bourg’s Hospice in Guernsey and Durrell in Jersey. We like to support a balanced cross section of local causes spread across heritage, sport, the arts, education, conservation and charita-ble organisations.”

Sport has certainly taught me many things that I have been able to take with me into my working life. Team work, professionalism and friend-ships are extremely important; we all draw on these throughout our life in our family life and in business.”

“In some ways that has resulted from both business and sporting re-lationships. Chris Schofield is MD of Hepburn’s Guernsey, one of the bro-kers we do business with, but is also president of the Guernsey Football Association, and like me, he shares a love of football. It was he that ap-proached us to see if we would be interested in sponsoring the Channel Islands Muratti Vase. For us, we see it as a great opportunity, particularly because of the pan-Island nature of the competition, our objective being to keep the Muratti at the pinnacle of local sport and to keep the competi-tion an exciting advert for both Chan-nel Islands football and Insurance Corporation

Where Belgraves is concerned, I feel it is important for the club to move forward every season and I see my job as coach being a three to five year project, provided of course my players and the club officials contin-ue to be happy with my performance!

I am similarly focused when it comes to business and in all areas of my life. I always believe that there is only one way of doing things and that means being positive, leading by ex-ample and putting everything into it.

The Jack Daniels ‘Sinatra Select’ cam-paign features a series of iconic images of the singer together with his signature and the campaign is very much along the lines that Jack and Frank were great pals during the singer’s lifetime and now you can enjoy some of that same magic.

The use of the imagery is all powerful. Sinatra still resonates a degree of cool and there is a nostalgia for a more relaxed time. Whilst this is clearly designed to entice the bourbon drinking Jack Daniel’s audience, the commercial reality is one of the licens-ing of a dead man’s image rights to sell product.

It is hard to imagine twenty or thirty years ago that dead celebrities would be being used in this way. Now it is common-place - the currency of image is all prevail-ing and is something we all associate with to a degree. If we didn’t, corporates would not be falling over themselves to have these brand associations. This follows a whole host of similar brand tie-ins such as James Dean with Lee Jeans and even Audrey Hepburn for Galaxy chocolate.

This shift in how image rights are treated, valued and managed has not escaped Guernsey. In fact, last December it became the fi rst place in the world where it is possible to register an image right - and you don’t even have to be famous.

In the past, famous or well-known personalities would endeavour to protect their images with a combination of trade mark rights and rights of privacy. Both of these options have their drawbacks and have certain limitations when it comes to celebrity rights. In the case of trade marks, for instance, no one actually believes that the goods or services protected come from the celebrity concerned, which ultimately undermines the very function of the trade mark system.

Guernsey recognised these limitations and has introduced a law allowing the registration of personality rights and their

associated image rights. These rights effectively identify the

personality and the various component images which go to make up their overall image. Such image rights can include still images, video, voice, gestures, mannerisms, computer images and any other identifi ers such as nicknames.

The initial personality rights are split into fi ve categories - individual, joint, group, fi ctional characters and legal enti-ties. Each of these categories has the fol-lowing distinct qualities.

Individual - this can be any human who is alive or for whom the application is made up to 100 years after the date of death. This clearly has many applications for the type of celebrities mentioned above.

Joint - this can be two or more people who are inextricably linked together and can not be separated. Examples of this would be Morecambe and Wise, or Laurel and Hardy.

Group - this relates to two or more people who are in a group but the compo-nent parts of that group are able to change - think pop groups such as Queen, the line up of which has changed over the years, or any sports team.

Fictional character - this can be any character, whether it relates to a human or otherwise.

Legal entity - this fi nal category is de-signed for corporate registrations for busi-nesses whose main assets are the images associated with them. Examples of this would include Disney or Marvel Comics.

As can be seen from the above examples, just about anyone can register for a Guern-sey Image Right and it gives great potential to be able not only to recognise these rights formally for the fi rst time, but also to then deal with and manage these rights on an ongoing basis.

In the United Staes there are, varying from state to state, various provisions for the protection of what they call a Right

of Publicity. Such rights only extend to famous people and have terms of between zero and 100 years after death. The dif-fi culty with these rights is that they are not based on a formal registration system and they have a fi nite life to them.

The Guernsey rights are, subject to their renewal (personality rights last 10 years and image rights 3 years), able to last in perpetuity. As a result of this, any owner of the rights is able to deal with them know-ing that they can be managed just like any other form of property. The rights can be licensed, assigned, and willed to anybody and it is this fi nal part that perhaps offers the greatest interest to image rights owners.

The ability to leave such rights in a will is a very powerful one and also means that any income producing image rights assets can be left to whomsoever the holder decides. Before the introduction of these rights it was a diffi cult thing to be able to determine and therefore leave to another. This is especially true when, under English law, the whole existence of image rights has not even been recognised.

As the market for celebrity and im-age matures, as it already has and will continue to do so, so brand tie-ins like the Sinatra one will become ever more popular. Whereas once it was impossible to easily protect such images as a signature, a trilby hat, a 50’s style microphone, even the im-age of a cigarette and a stiff drink, this has all been made possible by the introduction of the Guernsey Image Rights.

We see these rights as becoming the sub-ject of widespread registration. Already in the few months since the registry opened for business, we have seen registrations from people as diverse as international DJs and a top London hairdresser. As these registrations grow and the acceptance of the rights becomes more mainstream we see great scope for all manner of celebrities and entertainment personalities.

IntroductionIn its recent judgment in Rubin v

Eurofinance S.A.; New Cap Reinsur-ance Corpn. v Grant [2012] UKSC 46 (Rubin), the UK Supreme Court con-sidered the extent to which the English courts should recognise and enforce a judgment made in non-EU foreign insolvency proceedings. The Supreme Court ruled that there is no separate rule at common law in England for foreign insolvency judgments, and that the English courts will not enforce a foreign insolvency judgment where the English creditor was not present in nor had submitted to the foreign court.

As a result of this decision (which will be persuasive in the Guernsey courts), Guernsey businesses with for-eign counterparties may breathe a sigh of relief. Foreign insolvency judgments against Guernsey businesses, including funds and other investment compa-nies that carry on investment activities in foreign jurisdictions, may only be recognised and enforced in Guernsey under the statutory regime relating to the reciprocal enforcement of foreign judgments or traditional common law principles.

The Supreme Court Decision in RubinThe Supreme Court judgment dealt

with two conjoined appeals, namely Rubin v Eurofinance S.A and New Cap

Reinsurance Corpn Ltd v Grant. The main issue for consideration before the Supreme Court was whether, and to what extent, a judgment of a foreign in-solvency court in relation to avoidance claims available in that jurisdiction (e.g. claims to claw back unfair prefer-ences or transactions at an undervalue) would be enforced in England where the defendant had not submitted to the jurisdiction of the foreign court. In particular the Supreme Court was asked to consider whether, following the decision of Lord Hoffman in the Privy Council in Cambridge Gas Transporta-tion Corporation v Official Committee of Unsecured Creditors of Navigator Hold-ings plc [2006] UKPC (Cambridge Gas), such a judgment constituted a special category which fell outside of the scope of traditional English common law rules relating to the enforceability of foreign in personam judgments (i.e. judgments against the person, as opposed to an in rem judgment attaching to property).

Under the English common law, a foreign court has jurisdiction to give judgment in personam capable of enforcement where the person against whom it was given was present in or submitted to the jurisdiction of the for-eign court. The precise circumstances in which such a person will be held to have submitted to the jurisdiction of

the foreign court is beyond the scope of this article; however submission will typically involve voluntarily participa-tion in the foreign proceedings or being present in the foreign country where the proceedings are instituted.

In Cambridge Gas, the Privy Council (on appeal from the Isle of Man Court of Appeal) stated that bankruptcy proceed-ings did not constitute judgments in rem or in personam but instead constituted a special category of judgment peculiar to insolvency proceedings. Ultimately, the majority of the Supreme Court in Rubin held that the decision in Cambridge Gas was wrong and stated that there was no reason to adopt a more liberal rule as regards foreign insolvency judgments in avoidance proceedings in the interest of universality.

The Supreme Court held that there was no difference in principle between a foreign judgment against i) a debtor on a substantial debt due to the com-pany in liquidation based on normal contractual and tortious principles, and ii) a creditor based on avoidance type claims. Secondly, the Supreme Court held that such a distinction would in any event require the court to develop new jurisdictional rules determining the nexus between insolvency and the for-eign court and the judgment debtor and the foreign court. leading judgment, stated that “There is a reason for the limited scope of the Dicey rule and that is that there is no expecta-tion of reciprocity”. The Supreme Court stated that a change in the settled law of enforcement of foreign judgments is properly a matter for the legislature.

Therefore there is no separate rule at common law in England for foreign insolvency judgments (whether in rem or in personam). It is likely that the Guernsey court, which has in modern jurisprudence adopted English princi-ples of private international law and accords considerable weight to deci-sions of the UK Supreme Court where Guernsey law follows the English com-mon law, will see the decision in Rubin as persuasive absent public policy considerations peculiar to the Island. A test case is eagerly awaited.

The Guernsey Cross-Border Insol-vency Regime in light of Rubin

Guernsey is neither part of the UK nor a member of the EU. Therefore the English Cross Border Insolvency Regulations and the EC Regulation on Insolvency Proceedings do not apply in Guernsey. Guernsey has not adopted the UNCITRAL Model Law and does not have a specifi c statutory regime dealing with cross-border judicial co-operation in insolvency proceedings. It should be noted that neither Rubin nor New Cap

concerned any issues arising under the EU law.

The Insolvency Act 1986 (Guernsey) Order 1989 extended the operation of sub-sections 426(4), (5), (10) and (11) of the English Insolvency Act 1986 (the 1986 Act) to the Bailiwick of Guernsey, the effect of which is that Guernsey’s Royal Court may assist courts of the UK, the Bailiwick of Jersey and the Isle of Man having jurisdiction in relation to insolvency law.

Importantly, the majority of the Supreme Court in Rubin held that subsections 426(4) and (5) of the 1986 Act are not concerned with the enforce-ment of judgments but are restricted to facilitating the provision of assistance to designated foreign courts exercising jurisdiction in relation to insolvency proceedings. It is submitted that the Guernsey courts may be persuaded to adopt a similar interpretation.

In light of the above, a party who has obtained a judgment in foreign insol-vency proceedings may either enforce it in Guernsey at common law (following English principles of private interna-tional law) or under The Judgments (Reciprocal Enforcement) Law, 1957 (the 1957 Law).

If the foreign judgment is made by a prescribed court of one of the jurisdic-tions approved by the 1957 Law, then

the 1957 Law must be applied (i.e. there is no option to use the common law). In circumstances where the 1957 Law does not apply, the foreign insolvency judgment must be enforced at common law. An analysis of those principles is beyond the scope of this article. Expert advice should be obtained from a quali-fi ed legal practitionerConclusion

ConclusionThe extent to which foreign insolven-

cy judgments will be enforced against Guernsey businesses by the Guernsey courts will necessarily have strategic implications as regards the extent to which those businesses elect to partici-pate in foreign insolvency proceedings.

Guernsey businesses can draw com-fort from the Supreme Court decision in Rubin as foreign offi ceholders should have no expectation that a judgment obtained in foreign insolvency proceed-ings will be enforced on the basis of universal reciprocity, in circumstances where the Guernsey business was not present in or had not submitted to the jurisdiction of the foreign court.

As one of the founding shareholders of the First Central Group, Mike Leonard, Deputy Group Chief Executive Officer tells Contact Magazine the philosophy behind the company and the vision for the business, which remains committed to its Guernsey roots.

As an online provider of private motor insurance, selling predominantly through UK price comparison sites, 1st Central has seen phenomenal growth in its first five years. Having started

with just 50 staff in Haywards Heath, West Sussex and with Mike alone representing the company in Guernsey, it now has over 500 UK based staff and 14 Guernsey based employees. The company is now one of the top ten sellers of private motor insurance through the top four comparison sites.

It is not just the staff numbers which have grown, but with around 300,000 customers and one million policies sold since launch, the First Central Group has laid some strong foundations upon which it plans to build in the next five years. After the usual hockey stick business start up, profits of £4.5m were realised in 2011 and £8m in 2012. 1st Central is now looking to move into its next phase,

linked to its strategy of reinforcing a sustainable growth business model.

So what will this business model look like and what are the main areas of focus for 1st Central now solid foundations have been established?

Due to the online nature of the business, revolutionising its IT infrastructure to support further business growth is a key priority for 1st Central in the coming year. We live in an increasingly virtual world, in which customers’ expectations have changed dramatically since the early days of selling insurance policies online. Many other industries are further advanced in their online trading capabilities and the insurance sector is now starting to catch up. Customers demand a

The focus for 1st Central is to enhance and optimise every element of its online presence to ensure every customer is delivered the right policy at the right price. Insurance fraud never seems to be far away from the headlines. With fraud costing the insurance industry over £19 Million every week, and honest customers around £50 per policy, 1st Central has identified this as a key area where it can differentiate itself and truly lead the market with an innovative anti-fraud strategy, supported by unique in-house IT systems and processes. 1st Central’s flexibility and sophisticated approach to fraud detection and prevention ensures fraudsters are tackled right at the start, not just when claims are made, as fraud is often committed when applying for insurance by not fully disclosing previous claims or convictions, or using false addresses. 1st Central’s intention is to ensure that it can provide very competitive rates for honest customers, but it does also strengthen its underlying business performance by focussing its efforts on those customers 1st Central values rather than those who are trying to obtain cover or claims falsely. 1st Central is committed to staying at the forefront of the industry fight against fraud and is in regular dialogue with the UK police force’s Insurance Fraud Enforcement Department (IFED). The Department made over 260 arrests relating to insurance fraud during 2012, its first year in action.

Alongside its leading fraud defences, 1st Central is dedicated to tackling the rising issue of cyber crime. With one in three people falling victim to online crime last year, and businesses footing the estimated £21Billion cost implications, this is an area 1st Central believes

every online organisation should be committed to tackling, and this applies to insurance groups as well as other leading financial institutions . As an online business, protecting customers’ personal data, and reporting any suspect information to the authorities, is a top priority for 1st Central. Investment in its IT infrastructure means it has the resources to identify, stop and report this activity in real time, whilst many in the market, although aware of the threat, struggle to combat it effectively. Recently, 1st Central highlighted the issue of “Ghost Brokers” with an appearance on the BBC’s One Show. These “Ghost Brokers” in the UK are not regulated but manage to buy insurance policies online, sometimes for innocent individuals, using false identities and stolen credit cards. By tackling this particular aspect of cyber crime, 1st Central wants to ensure that the innocent are not shocked to find they are not covered when they do have to make a claim.

Motor insurance is often regarded as a grudge purchase driven by a regulatory requirement for cover. Insurers are typically accused of applying blanket rules to cover vast segments of a community. 1st Central likes to look beyond traditional stereotypes and views its customers as individuals. An effective website and IT interface, combined with skilled underwriting capabilities, means 1st Central can view and analyse risk and remain competitive in markets where others struggle.

Further ambitious growth plans for the business aim to service around 3-5% of the UK motor insurance market within the next 5 years, generating as a result circa £0.5 Billion income per annum. Guernsey, as the base of the Group’s holding company will be the conduit for building capital and leveraging opportunities.

As well as strengthening the Guernsey business community, 1st Central is also committed to investing in and being

involved with the local community. 2013 is looking to be another exciting

Mike is one of the founding shareholders of the First Central Group. The Group was formed in 2008 and began trading in October 2008, selling motor policies via price comparison sites.

Prior to joining the First Central Group in 2008, Mike Leonard was Managing Director of Diagonal Underwriting Agency Limited, a Lloyd’s managing agency which established a new Syndicate for the Far Eastern market. Diagonal was wholly owned by IAG based in Australia. Mike joined Diagonal in 2006 having previously been the Managing Director of the Zenith UK group of companies, a group which

underwrote car insurance in the UK via a network of brokers.

Mike is a qualifi ed CIMA accountant and has a degree in International Business & German.

Mike and his family love living near the beach at Port Soif and he really enjoys being entertained by his four children. Mike is a keen rugby fan, following not only Guernsey’s rather decent rugby team but also London Wasps and England whenever he can. Mike can sometimes be found at Footes Lane supporting Guernsey’s incredibly successful football team as well!
