Engineering Control
Method of reduction of risk by designing and constructing barriers to contain the hazard. Reduction of risk by this method is the most effective way of ensuring people’s and property safety because these measures are always present and less likely to go wrong.

Regulatory Authority
Rwanda Utilities Regulatory Authority (RURA) as established by the law n°09/2013 of 01/03/2013
Risk Is the likelihood that a person, persons or environment can be harmed by the hazard
Risk Assessment
Will involve the careful examination of how petrol and petrol station activities can cause fire or explosion. This in turn will help to determine whether the station has enough measures on the ground to guarantee people and people’s property safety or whether the stations needs to include more measures. While the main idea is to eliminate the risks, this is often not the case and as such the assessment will try to make them as low as they can be done.
Standard Operating Procedures
Standard Operating Procedures are documented series of steps to be carried out in a logical order for a defined operation or in a given situation.
Upgrade
Relocation of existing storage tanks, installation of additional storage tanks, replacement of storage tanks where there is an increase in total storage capacity, total demolition and rebuilt of service station where there’s either increase in capacity or change of location of a service station
Vent Pipe
A pipe provided for the underground storage tank venting system. Necessary to prevent tank distortion due to variations in internal pressure resulting from the normal operational filling and emptying

3. Management Summary
Rwanda Utilities Regulatory Authority (RURA) – a public institution mandated to regulate certain public utilities among which are the renewable and non-renewable energy, industrial gases, pipelines and storage facilities.
In exercising its mandate, RURA has developed a number of legal and regulatory instruments required to undertake its responsibilities. It is in the same context that, the regulations governing construction, installation, upgrade and operation of Petrol Service Stations (PSS) have been developed and eventually approved by RURA Regulatory Board initially in September 2013 and subsequently reviewed in April 2014.
In the framework of ensuring that the PSS are adhering to the regulations, RURA has recognized the valuable advantage of using Geographic Information Systems (GIS) to efficiently monitor PSS and their geographic locations for compliance enforcement on stipulated regulations. It is in this context that Esri Rwanda has been awarded by RURA the contract for “Consultancy Services to Conduct a Mapping Exercise for Petrol Service Stations Countrywide”.
Esri Rwanda has conducted the mapping exercise by physically visiting each PSS and collecting required data using tablet devices and a cloud-based mobile data collection application called iformbuilder. The application allowed to collect geographic coordinates of the petrol service stations, relevant pictures as well as required technical data that permitted to evaluate the compliance of PSS to RURA regulations.
After the data collection at each PSS, Esri Rwanda conducted a deep compliance analysis based on the RURA regulations; the analysis was divided into the following types of analyses:
Geographic location-based (spatial) analysis: using ArcGIS Desktop spatial analysis tools, the locations and parcels of PSS have been analyzed to check if they comply with RURA regulations about the size of PSS parcels, distance to sensitive areas (e.g. infrastructure, schools, hospitals, Memorial sites, etc.) and if they comply with districts land use master plans.
Technical and risk analysis: using data collected on site, PSS have been analyzed from different perspectives such as hazard and risk, safety and security, environment, available services, staff knowledge, compliance to RURA regulations of different parts (e.g. canopy, storage tanks, dispensing pumps, filling points, forecourt, building, etc.) of PSS, etc.
The results of the two types of analysis allowed to categorize the PSS into three categories:
Third category: PSS that cannot comply with regulations even if they do any type of upgrade. It is impossible for PSS in this category to comply with the regulations because their current location and parcel boundaries are completely inside prohibited areas.
Second category: PSS that do not comply with the most important regulations, but can do significant upgrades and comply. It is possible for PSS in this category to comply with the regulations after a significant investment like acquiring a neighbor plot to adapt their plot size or relocate its installations intersecting with protected areas.

First category: PSS that comply with most of the important regulations but need to do some technical upgrade and risk mitigation. It is reasonably possible for the PSS in this category, to do necessary technical adjustments and comply with the regulations.
As RURA has to regularly inspect and monitor the PSS itself after this project, a computer based system has been developed to store information about existing and new PSS in a comprehensive and structured geodatabase, and to enable RURA staff to easily access information about any PSS in the country and evaluate its compliance to regulations and spatial regulations such as district land use master plans.
In summary, the following activities have been carried out during the project:
• Countrywide visit and mapping of all petrol service stations
• Analysis of their compliance with RURA regulations
• Analysis of their compliance with district land use master plans
• Analysis of their locations compared to sensitive areas
• Categorizing the PSS into three categories: PSS complying, PSS to be upgraded, PSS to be phased out
• Development of a computer based system for monitoring the location of the existing and new PSS

4. Objective of the Project
The project intended to identify the existing and under construction PSS by gathering relevant information in order to evaluate their compliances to RURA regulations and categorize them in three categories:
PSS complying with regulations
PSS to be upgraded to comply with regulations
PSS that have to be phased out
During this project, a computer based system has also been developed to offer the following services to RURA:
Hosting, managing and accessing a well-structured geodatabase containing required information about PSS and their geographic coordinates.
Monitoring and evaluating the location of existing and proposed PSS based on RURA regulations, and vis-à-vis neighboring environment (residential houses, apartments, hotels, road junctions and sensitive areas, etc.) and the districts land use master plans.
Ensure a well-informed process for issuing PSS installation licenses by providing accurate and location-based information.
Support in any decision making process related to PSS and in “what-if scenarios” whenever needed.

5. General Requirements for Construction and Installation of a Petrol Service Station
The design and construction of a petrol service station should consider potential environmental risks of operating a petrol station, and introduce enough engineering controls to ensure containment integrity of hazardous material (petrol) from the delivery truck, to the underground storage tank and into the customer’s vehicle.
Factors which should be considered during the design to minimize the potential loss of product and pollution include:
Environmental sustainability of the site and measures to be incorporated
Siting of the site
Storage tanks (tank design, tank contents, materials used to construct tanks and secondary containment)
Pipework and pipe trenches
Corrosion prevention systems
Fuel delivery and dispensing systems
Delivery facilities (e.g. overfill prevention, drainage of tanker standing area)
Site drainage systems (including interceptors)
Leak detection and environmental monitoring systems
5.1 Petrol Service Station Land
Existing petrol station land location should comply with requirements of environment law, national building regulations, and other relevant rules, regulations and standards, In addition to a minimum plot size of 900m2 for a petrol service station without a service bay and 1200m2 with a service bay.
5.2 Location, Design and installation of Petrol Storage Tanks
The petrol storage tanks shall be located underground, clear of the foundations of buildings and not within sensitive areas and they shall be separated from forecourts. They shall be as minimum requirements; single walled of rolled carbon or mild steel plate or fibre reinforced plastic material and shall comply with relevant international standards on petroleum equipment.
5.3 Location and Design of Pipelines and Vent Pipes
The pipelines from tanks to off-set filling points, metering pumps, dispensers and vent pipes shall be routed below the ground surface not under buildings or other obstructions at a depth of 300mm. The vent pipes shall extend to a height greater than 3.5m aboveground level and shall be in an open air to allow dispersion of vapour.
5.4 Dispenser and Pumping Facilities
All dispensers shall be of digital type and shall be calibrated by the national Body having standards in his attributions twice a year. They shall also be certified and installed in accordance with approved relevant standard on petrol products; their installation procedures must respect the manufacturer’s instructions. Dispensers shall be located at 6 m from the adjacent pump island.

5.5 Position of Road Tanker
The road tanker stand for delivering petrol into storage tanks shall be in the open, away from buildings, dispensing activities and emergency escape routes. It shall be large enough to allow a road tanker to be positioned wholly within it during delivery.
5.6 Minimum Distance of a property Line of Petrol Service Stations and
Neighboring infrastructures
A minimum distance property line shall be as follows:
The distance of a property line of a petrol service station from the center line of the major arterial road (National Road) shall be not less than 22m;
The distance of a property line of a petrol service station from the center line of the minor (District) arterial road shall be not less than 12m;
The distance of a property line of a new petrol service station from sensitive areas shall be not less than 300m;
Any structure related with the petrol station shall be located a minimum of 50m from any residential building;
Petrol Service stations shall be sited at distance of not less than 1000m from each other on the same section of the single carriage road; this applies to either side of the dual carriage road;
NB: The distances measured from the property line of the PSS to the center line of the major/minor arterial e.t.c is taken from the parcel boundary lines.
5.7 Forecourt Construction
The forecourt area subject to vehicular traffic shall be of macadam material type or reinforced concrete and designed in a way capable of supporting the anticipated weight and intensity of traffic area under the canopy shall be concrete
5.8 Surface Drainage
Surface drainage of any area surrounding dispensers and road tanker delivery points shall be arranged to carry any spills or leaks of petrol, through trapped gullies or by channels, to petrol interceptors / oil-water separators before draining from the service station.
5.9 Construction Material Selection
Buildings shall be constructed generally of non-combustible materials and shall conform to the Rwanda Building Regulations. The Canopy shall have a minimum height of 5m.
5.10 Electrical Installations
The vent pipes and road tanker delivery stands shall be located away from the area beneath the overhead lines
The site shall be arranged so that there are no overhead power lines medium and high voltage or telephone lines. All electrical and electronic installations shall comply with the requirements of the RS 565-1 & RS 474

5.11 Facilities Identification
Each tank shall be marked with an identifying number to distinguish it from any other tank. In the case of multi-compartment tanks, each compartment shall be marked with a separate number and type of fuel with specific color. The Dark color shall be for Kerosene, Yellow for Diesel and Blue for Gasoline.
There shall be identification on dispensers’ panels and dispenser pumps, clearly marked the words to indicate the type of product dispensed as following:
a) Gasoline; b) Diesel; c) Kerosene
5.12 Fire and Emergency Equipment
At all petrol service stations, a supply of dry sand, foam or similar absorbent material shall be kept in a container with a close fitting lid and shall be installed in an accessible place within canopy area
The PSS shall have an Emergency Management Plan for fire and spills.
Have functioning and duly serviced fire and emergency equipment, including but not limited to fire extinguishers, fire alarms which shall be available and accessible at the service station in an open space.

6. Data Collection for Petrol Service Stations
Esri Rwanda has identified, visited and inspected 276 PSS countrywide. During the field visits, Esri field staff have collected required information using a digital and intelligent questionnaire that was agreed on with RURA prior starting the field visit and developed using iformbuilder and accessible via tablets devices.
The overall questionnaire for data collection about PSS was containing the following 19 specific sub-questionnaires:

Each of the above questionnaire was having several questions requesting information about specific requirements as stipulated by the RURA regulations. For the purpose of evaluating the compliance of PSS with the regulations, a grading scheme was established and agreed on with RURA which assigned marks over 100% for meeting all the requirements.
Some requirements were considered to be very critical than others and they were given high grades (e.g. compliance to master plans, compliance to fire, safety and security regulations, etc.); this is mainly due to their severity from the hazard and risk points of view, based on how they represent a likelihood or a serious potential source for harming people, properties or environment.

6.1 Routes taken for PSS data collection
During the PSS data collection, routes have been defined to be followed by field staff based on roads and on the number of field staff (10 field staff) that conducted this exercise on field.
The following 19 routes have been defined and followed to map PSS in Kigali:

7. Data Analysis for Petrol Service Stations
During the data analysis, Esri Rwanda conducted a deep compliance analysis based on the RURA regulations with two types of analysis: Geographic location-based (spatial) analysis plus technical and risk analysis
7.1 Geographic location-based (Spatial) Analysis
Using Spatial Analyst tools provided in ArcGIS for Desktop software, Esri Rwanda performed location-based analysis on the collected data that allowed to reveal the spatial relationship between PSS with parcels data, infrastructure data, social economic data, environmental data, sensitive areas data, etc.
The spatial analysis has allowed also to compare the geographic locations of the PSS with the local district land use master and development plans to check if they are in line with those master plans.
Based on the spatial requirements from RURA regulations, Esri Rwanda has checked the PSS locations to answer the following questions and has given grades based on the grading scheme defined and agreed on with RURA.
Is the plot size complying with RURA regulations?
Is the plot location complying with the Master Plan?
Is the PSS near (<300m) a sensitive area?
What is the distance from PSS property line to centre of the major road?
What is the distance from PSS property line centre of the minor road?
What is the distance from PSS property line to cross cutting road junction?
What is the distance from PSS property line to nearest residential area?
What is the distance from nearest petrol station?

8. Categorizing Petrol Service Stations
After a deep analysis of PSS compliances to location-based and technical regulations, it was found that there is no PSS that has scored 100%. Therefore, there is a need to categorise PSS based on how much they scored and their possibility to comply with the regulations.
As RURA wants all PSS to respect the regulations, the categories proposed are based on the possibility of PSS to comply with regulations; it is in this context that the following three categories have been identified:
1. Third category: PSS that cannot comply with regulations even if they do any type of upgrade. It is impossible for PSS in this category to comply with the regulations because their current location and parcel boundaries are completely inside prohibited areas.
2. Second category: PSS that do not comply with the most important regulations, but can do significant upgrades and comply. It is possible for PSS in this category to comply with the regulations after a significant investment like acquiring a neighbor plot to adapt their plot size or relocate its installations intersecting with protected areas.
3. First category: PSS that comply with most of important regulations but need to do some technical upgrade and risk mitigation. It is reasonably possible for the PSS in this category, to do necessary technical adjustments and comply with the regulations.
More details about PSS falling in the above categories can be found in the next subchapters.
8.1 Third Category: PSS that cannot comply with regulations even after
doing any type of upgrade
In this category, we find PSS with at least any of the following characterstics:
PSS parcel is completely inside a reserved or prohibited land use zone (e.g. wetland, road reserve, environment reserve, etc.)
PSS parcel boundary lines are closer than 50 meters to residential buildings
PSS parcel boundary lines are closer than 300 meters to sensitive areas (e.g. schools, hospitals, trade markets, museums, etc.)

NB: The second and third possible conditions for a PSS to be in the third category, were not considered here because we believe that the required distances are not realistic and too strict. These would therefore make most of the PSS to fall in this last category. This is also in line with the new regulations that are yet to be approved which consider to reduce these distances. It is in this context that we have recommended (see chapter 10) to RURA to evaluate the feasibility of the regulations about required distances between PSS and residential houses as well as the sensitive areas because the current regulations will disqualify all of the operating PSS if the three criterias are used (Compliance to master plan, distances to residential houses and distance to sensitive areas).

9. Computer Application for Monitoring Petrol Service Stations
As RURA will continue to regularly monitor and inspect existing and new PSS about their compliance to the regulations, a desktop and GIS based system has been developed and implemented to assist RURA in this respect.
The system contains the following components:
ArcGIS Desktop Software: ArcGIS Desktop is the software that allow to store, manage, analyse and map georeferenced data. The software will be used by RURA for mapping PSS and monitor their geographic locations. ArcGIS will be used to evaluate the spatial relationship between PSS and their neighbourhood environment (e.g. if PSS are inside the right land use zone, distance from PSS property boundaries to road or to sensitive areas, etc.) by analysing PSS data and turning them into valuable information for decision making.
ArcGIS Geodatabase: this is the physical store of geographic information, primarily using a database management system (DBMS) or file system. The geodatabase is the native data structure for ArcGIS and is the primary data format used for editing and data management. While ArcGIS works with geographic information in numerous geographic information system (GIS) file formats, it is designed to work with and leverage the capabilities of the geodatabase.
More information about the above components can be found in the following sub-chapters.
9.1 ArcGIS Desktop Software
ArcGIS Desktop is the software that allow authoring and editing maps and geospatial content. Beyond showing your data as points, lines, polygons or as rasters on a map, ArcGIS Desktop gives you the power to manage and integrate your data, perform advanced analysis, model and automate operational processes, and display your results on professional-quality maps.
ArcGIS Desktop is the traditional GIS authoring, editing, and geoprocessing application that allows you to create beautiful maps, edit and manage spatial data, and perform the full spectrum of analyses needed to turn your raw data into valuable information.
The picture below shows how the interface of ArcGIS desktop looks like and shows the PSS distributions in the country, their spatial relationship to national roads and district boundaries.

9.2 ArcGIS Geodatabase
At its most basic level, an ArcGIS geodatabase is a collection of geographic datasets of various types held in a common file system folder, a Microsoft Access database, or a multiuser relational DBMS (such as Oracle, Microsoft SQL Server, PostgreSQL, Informix, or IBM DB2). Geodatabases come in many sizes, have varying numbers of users and can scale from small, single-user databases built on files up to larger workgroup, department, and enterprise geodatabases accessed by many users.
But a geodatabase is more than a collection of datasets; the term geodatabase has multiple meanings in ArcGIS:
The geodatabase is the native data structure for ArcGIS and is the primary data format used for editing and data management. While ArcGIS works with geographic information in numerous geographic information system (GIS) file formats, it is designed to work with and leverage the capabilities of the geodatabase.
It is the physical store of geographic information, primarily using a database management system (DBMS) or file system. You can access and work with this physical instance of your collection of datasets either through ArcGIS or through a database management system using SQL.
Geodatabases have a comprehensive information model for representing and managing geographic information. This comprehensive information model is implemented as a series of tables holding feature classes, raster datasets, and attributes. In addition, advanced GIS data objects add GIS behavior; rules for

managing spatial integrity; and tools for working with numerous spatial relationships of the core features, rasters, and attributes.
Geodatabase software logic provides the common application logic used throughout ArcGIS for accessing and working with all geographic data in a variety of files and formats. This supports working with the geodatabase, and it includes working with shapefiles, computer-aided drafting (CAD) files, triangulated irregular networks (TINs), grids, CAD data, imagery, Geography Markup Language (GML) files, and numerous other GIS data sources.
Geodatabases have a transaction model for managing GIS data workflows.
The geodatabase storage model is based on a series of simple yet essential relational database concepts and leverages the strengths of the underlying database management system (DBMS). Simple tables and well-defined attribute types are used to store the schema, rule, base, and spatial attribute data for each geographic dataset. This approach provides a formal model for storing and working with your data. Through this approach, structured query language (SQL)—a series of relational functions and operators—can be used to create, modify, and query tables and their data elements.
You can see how this works by examining how a feature with polygon geometry is modeled in the geodatabase as shown by the above picture. A feature class is stored as a table, often referred to as the base or business table. Each row in the table represents one feature. The shape column stores the polygon geometry for each feature. The contents of this table, including the shape when stored as a SQL spatial type, can be accessed through SQL.
All GIS users will work with three fundamental dataset types regardless of the system they use. They'll have a set of feature classes (much like a folder full of Esri shapefiles); they'll have a number of attribute tables (dBASE files, Microsoft Access tables, Excel spreadsheets, DBMSs, and so forth); and most of the time, they'll also have a large set of imagery and raster datasets to work with.

The following picture shows the three primary types of datasets (i.e. table, feature class, raster dataset) that can be stored in a geodatabase.

Fundamentally, all geodatabases will contain this same kind of content. This collection of datasets can be thought of as the universal starting point for your GIS database design.
With a geodatabase, all of an organization's GIS data can be stored in a central location and in a uniform format for easy access and management. Geodatabase models support virtually any type of geographic data, including image and raster data, vector features and their attributes, terrains, addresses, 3D objects, surveys, and maps.
RURA geodatabase will contain all PSS data plus other important data like roads, parcels, land use zones, sensitive areas, etc. and the ArcGIS software will access, map and analyse this data, and provide essential and accurate information to RURA about PSS compliance to regulations.

10. GIS Training for RURA Staff
According to the contract signed between RURA and Esri Rwanda on the 18th July 2016 to conduct a mapping exercise for petrol service stations countrywide, part of the work to be done was provision of training to RURA staff on using and maintaining the computer application for monitoring activities incorporating the District Master Plans and collection of data using tablets and iform application.
10.1 Objectives of the GIS Training
The training aimed to introduce RURA GIS staff to various processes conducted by Esri
Rwanda in collection, mapping and analysis of the Petrol Service Stations according to
RURAs regulations. The knowledge acquired allows RURA staff to be able to carry out
the data collection, operate, maintain and update the geospatial database and carry out
monitoring activities of the petrol service stations countrywide.
10.2 Content of the Training
The training on Data collection and analysis covered the following topics:
Introduction to GIS – The cornerstone of a GIS
Introduction to ArcGIS Desktop Interface
Introduction to the Geodatabase
Creating a Geodatabase in ArcGIS
Create Feature Datasets
Adding x,y coordinate data as a feature dataset
Performing Spatial Analysis
Designing questionnaire using iForm technology
Collecting data using tablets
Esri Rwanda provided a training manual together with data collected and used during the analysis. Participants were taken through all the steps that Esri used to arrive at the score based on different analysis conducted.
10.3 Training schedule and Facilities:
The training took place in the afternoons from Monday to Thursday while on Friday this was conducted in the morning so as to accommodate sports in the afternoon. For the next trainings Esri recommends RURA to allocated a whole day for such trainings and preferably the training to be conducted out of the office so as to allow maximum concentration on the participants.
10.4 Software Versions
Esri installed the permanent ArcGIS software versions 10.2 on one of the machines to be used by the administrator of the computer application. For purposes of training Esri installed trial software ArcGIS licenses and recommends that RURA factors in the purchase of additional software.

The stakeholders’ validation workshop was conducted on 15th December at Classic hotel in Kicukiro District. The aim of the workshop was to convey the results of the analysis conducted from the mapping exercise of the petrol service stations countrywide and get the views on the same.

The stakeholders’ validation workshop started by a welcome note from Mr Gerard Rusine, Director of Gas and downstream petroleum regulations at RURA. who also took the members through the objectives of the mapping exercise for the PSS and why it was necessary to conduct such an exercise.
This was followed by a presentation from Esri Rwanda who took the participants through the methodology adopted in carrying out the analysis on the data collected for the petrol service stations and the criteria used in categorizing PSS into the three categories namely;

Third category: PSS that cannot comply with regulations even if they do any type of upgrade. It is impossible for PSS in this category to comply with the regulations because their current location and parcel boundaries are completely inside prohibited areas.
Second category: PSS that do not comply with the most important regulations, but can do significant upgrades and comply. It is possible for PSS in this category to comply with the regulations after a significant investment like acquiring a neighbor plot to adapt their plot size or relocate its installations intersecting with protected areas.
First category: PSS that comply with most of important regulations but need to do some technical upgrade and risk mitigation. It is reasonably possible for the PSS in this category, to do necessary technical adjustments and comply with the regulations.
A demonstration of the computer application was also given to indicate the location of the existing petrol service stations in relation to the different land use proposed in the District master plans, National and District, residential areas as well as other sensitive areas such as schools and hospitals. This was illustrated through a web application designed on ArcGIS Online with various datasets indicated above received from different institutions such as RHA, CoK, RTDA and RNRA.
After the presentation from Esri, the participants were invited to give their input on the work done and results displayed. The points below summarize the discussions and the question and answer session:
Participants wanted to find out if the Rwanda Building Codes and the Law on Roads were consulted in stablishing the PSS regulations.
Participants wanted to find out if the mapped PSS were available to the public as this was a very good initiative to make such data especially on the location of the PSS available and whether they could be accessed on different devices or availed to the public via a web platform (e.g: Google map)
Participants pointed out that careful evaluation of the PSS to be phased out needed to be looked at carefully as this would impact negatively on investors and also drive away potential investors who view the country as a great business and investment destination.
One of the participant insisted that PSS must comply with the international standards. He emphasized that as much as there was the wish to promote trade, safety issues also had to be taken care of and this led to the distances which were proposed and which were based on fire safety standards
Due to most of the PSS not adhering to the current regulations, participants inquired whether it would be appropriate to review and analyse the new PSS based on the current regulations since the old PSS are affected mostly by the regulations
Participants wanted to find out who or which institution will bear the cost of phasing out or relocation of the PSS. It was emphasized by participants that PSS construction dates needs to be considered when phasing out.
The City of Kigali representatives suggested that the PSS map should be open and accessible to everyone, like the Kigali city master plan. He pointed out that based on the existing PSS regulations, it is difficult to provide construction permit, since 2016, no new PSS was approved. A collaboration between CoK and RURA is needed for the new regulations.
Participants wanted to find out if there was room for the Master Plans to be amended to reflect the current situation on the ground. This was seen necessary based on the numerous stations which were found to be located in restricted land

uses. The Director of One Stop Center reacted by saying that Master Plans could be amended if it was deemed necessary

12. TV Spot Content
Esri together with RURA agreed on the key contents to be incorporated in the TV spot which would incorporate pictures and videos where possible. The key contents will briefly highlight RURAs mandate in respect to downstream petroleum and serve to sensitize the public.
The TV spot message was based on the following RURAs mandate:
RURA regulates the implementation and operation of petroleum infrastructures (Fuel depots, Petrol Stations, Fuel transportation in Road tankers / trucks,).

Based on applicable standards RURA has set a number of Regulations governing
the construction and installation of petroleum infrastructures including petroleum
storage depots and petrol service stations.

RURA yashyizeho amabwiriza (Regulations) agenga imyubakire

RURA was given a mandate to regulate fuel pricing at retail sites, and a close
follow up of fluctuation of petroleum price at international market.

Liquefied Petroleum Gas (LPG) is also a petroleum product that is entering the
Rwanda market as cooking means. Its related filling plants and retail sites in
cylinders are also regulated by RURA.

installation and operation of fuel storage and distribution facilities

13. Conclusion and Recommendations
13.1 From Stakeholders Validation workshop
The following recommendations were given by the participants from the different government institutions during the Stakeholders validation workshop conducted to relay the outcome of the mapping and analysis done on data collected for the PSS.
1. The computer application for PSS to be developed further and make necessary information such as location freely accessible by the public in terms of motorists finding which is the nearest PSS incase they needed to refuel.
2. Mapping and analysis of fuel depots and liquefied petroleum gas filling points to be conducted as these are also components of petroleum products which also affect the petrol service stations
3. RURA to conduct an exercise to establish the projected demand for PSS so as to ascertain how many PSS need to be put up and compare this to the existing number. This would be useful in indicating whether there was need to put up more PSS or the current number would be able to meet the projected demand
4. Careful assessment of the identified PSS to be phased out to be done so as to not impact negatively on the investors
5. Need to revise the current regulations on PSS to also reflect the current situation on ground and also adapt it to local conditions
6. Amendment of the District Master Plans where necessary so as to allow for PSS to be put up and operate.
7. RURA to reflect on the cost for phasing out or relocation and who would bear the cost in cases where the PSS were constructed before the regulations in 2014 and if possible this to be to be reflected in the new regulations
8. RURA to collaborate with different institutions such as City of Kigali and Other Districts who might be having the missing information like construction date of the PSS which was seen very vital
13.2 On GIS Training to RURA staff
As the training was focused on introducing the participants to ArcGIS Desktop as well as spatial and technical analysis conducted on the PSS data, it was noted that the time allocated for the training which was conducted in the afternoons was not sufficient. Since the participants were new in using the ArcGIS Desktop software, everything about the software could not be taught within duration given in the contract.
Esri Rwanda therefore recommends the following:
1. Another training session be budgeted for to engage the participants more on the
software and also a follow up done to ensure that the participants are comfortable
in using the software and the computer application for monitoring PSS in general.
2. RURA to budget for the purchase of additional ArcGIS Desktop software as
currently only one license is available for the institution.

13.3 On PSS Data analysis
During the data collection on field and data analysis, it was found that none of the 249 Operating PSS is complying 100% with RURA regulations. The data analysis has shown that:
40 (Forty) PSS corresponding to 16.06 % are completely inside a reserved or prohibited land use zone. These PSS cannot be upgraded and they have to be phased out.
194 (One Hundred and Ninety-Four) PSS corresponding 77.9 % are having a part of their parcel intersecting a prohibited land use zone. These PSS can be upgraded after doing significant investment on their parcel.
33 (Thirty-Three) PSS corresponding to 13.25 % are having their parcel size smaller than the required. These PSS can be upgraded after doing significant investment on their parcel.
11 (Eleven) PSS corresponding to 4.41 % are complying to the regulations about the parcel size and are completely in an authorized land use zone. These PSS can be upgraded by just improving their technical and risk management.
209 (Two Hundred and Nine) PSS corresponding to 83.93 % (except the 40 PSS to be phased out) have to improve their technical and risk management.
The above distribution of scores shows clearly that regulations are not respected at different levels by PSS. It is in this context that we are proposing the following recommendations to ensure that the regulations are respected:
1. RURA should carefully evaluate the feasibility of the PSS regulations especially the location-based regulations about required distances between PSS and its neighbourhood features. There are some regulations that have been judged to be not realistic because if they are applied they would disqualify most of the PSS (e.g. the required distance of 50m between PSS and residential house is disqualifying 92% of the PSS).
2. As a PSS can fulfil the required distance to residential houses or sensitive areas during the license application period and later on a residential house get built next to the PSS, we do recommend to RURA to lower the required distances but restrict these distances withn the PSS plot boundary. This implies reducing the distance to residential houses but increase in the size of the PSS plot. Therefore, we recommend the following distances that we consider to be reasonable for PSS: 20 meters to be kept within PSS parcel boundaries to the nearest residential or commercial building, and 100 meters to the sensitive areas from the PSS parcel boundaries.
3. RURA should improve its collaboration with City of Kigali and Districts One Stop Centers (OSC) and ensure that it is involved before a PSS is authorized for construction. While we understand that it is mainly the role of OSC to check if a PSS is in the right land use zone, results of the data analysis have revealed this not to be the case as some of the recently construted or upgraded PSS have been found in prohibited areas.
4. There are many PSS that have been found not having RURA licenses due to different reasons (i.e. constructed before the licenses were established, operating with Rwanda Devepment Board (RDB) business registration license etc.); while this is understandable in some cases, we are recommending RURA to give the license to qualifying PSS after they have completed the upgrades. A sensitization is also needed to make aware of this to the oil marketing companies.

5. Based on our findings especially on how PSS operators do not take seriously the safety, security and risk prevention regulations, we would like to recommend RURA to introduce a safety operation license valid for one year so that operators do not neglect the regulations and start compromising safety of the population and surrounding environment.
6. Due to lack of professionalism for most of PSS regarding the safety mesures, we have found that PSS are more dangerous during the offloading which always happen at the same time with customers filling their cars. It is in this context that we would like to recommend RURA to set up evening hours (e.g. 10pm to 6am) for petrol offloading at PSS especially in cities and congested areas to mitigate the fire risks.
7. We would like to recommend to RURA to establish a certification programme for PSS managers during which they will have to be trained, pass an exam before becoming PSS registered managers. A registered manager would be accountable for anything that might happen to the PSS he manages. The certificate of the manager can be revoked in case of serious negligence and should be renewed every year after successfully participating in an annual refresher course.
8. PSS operators should be tasked to carryout semi annually enviromental, health and safety audits at the sites and submit a compliance report to the regulator.
9. PSS operators should maintain a daily wet-stock reconcilation in a proper documentation (i.e. we found many unproper books) and any variables should be explained to ensure intergrity of underground storage tanks and product lines.
10. PSS operators should have an impermeable floor at the forecourt and offloading area to contain any spills in additional to draining these floors through an interceptor.
11. PSS operators should ensure uniform colour coding and product labelling which was found to be very different.
12. Most PSS visited did not display safety signs i.e. no smoking and emergency contacts. This should be enforced. This should be extended to offloading points and vent pipes.
13. PSS operators should make sure that their staff are having uniform and protective clothing
14. PSS operators should maintain good housekeeping especially free and clear station entrance and exit without obstruction.
15. Ensure all staff are adequately trained (retain training records)
