Practicability (Negative Side)

As the 3rd speaker of the negative side, it is my duty to destroy all obstacles

and to establish a rm standing for the smooth continuance and enforcement of the

ordinance! Also to prove the e"ectiveness of the said ordinance#s status $uo %hich

is indeed e&isting and doing its very part in protecting the people#s interest!

'! o further my colleague#s necessity points, as to the issue of P '*+3 and

%ith the e&istence of egulation ordinance -..-/0.1! P '*+3 is a general

la% made by late Pres! 2erdinand arcos on '145 %hich is to be applied to

the entire country regardless of the severity of the problems! he City#s

egulation ordinance -..-/0.1 %as passed and authenticated by the 6ocal

government in order to resolve the city#s current problems alone, in %hich

has certain specicity regarding the eligible candidates for apprehension

%hen compared to the P '*+3 in %hich is absent! hereby %e could

conclude, that the ordinance passed by the 6ocal government had

distinguished itself from penalties and in the addition of the parameters of

eligible candidates for apprehension! his penalties is such as the ne of

P*.. to both mendicants and to those people caught giving alms or %ho

abets mendicancy! he ordinance has also penalties such as imprisonment for

the mendicants and community service to those people caught giving alms,

%hich is also stated in the P '*+3, but it %as not stated in the Presidential

ecree about such syndicates %ho upholds mendicancy for self/enrichment

and for the e&ploitation of children and elderly to engage in such activities

%hich endangers their lives and rights! he big di"erence of the City#s

egulation ordinance from the P '*+3 is the ne being asked for the penalty

of such crime from P-. to P*..! his is evidence by Section + on penalty

amount is higher compared to the presidential decree! herefore, repeal

%ould not mean that P '*+3 can completely replace the ordinance -..-/

0.1! 7ther%ise %hat is the use of the city ordinance if that is co/e$ual %ith

P '*+38-! City 7rdinance -..-/0'. creating committee to enforce the mendicancy

ordinance becomes part and parcel to the reference 0.1 because it %as an

amendment to sustain section of 0.1 and made enacted also in the same

day! hereby, the issue of completeness cannot be accepted as a ground for

the repeal of ordinance -..-/0.1!3! According to Councilor 9oshua Alim , this ordinance is self/sustaining on the

premise that the agencies delegated to handle the mendicants after

apprehension and decision of the court has already been supplemented bythe government!

0! he scrapping of the current ordinance is not essential to time or to simply

state it as the process is timely, %hich is a ma:or problem %hen %e talk about

the actions or the proposition#s practicability!*! Proposition of a ne% ordinance %ould not only be a %aste of time, but also a

%aste of such resources!
