Continuing the drive to rebuild thestate’s infrastructure, the CaliforniaTransportation Commission (CTC)hasallocated$1billioninfundingfor153 transportationprojects thatwillstrengthen the state’s economy bysustaining and creating jobs whileproviding congestion relief for mo-toristsstatewide.

The projectincludes planting approximately200 trees, and beautifying andenhancinga two-milestretchofamaincityarterial.

•$651,000totheCityofCeresforthe Whitmore Avenue Landscap-ing Project. Install 5.9 acres oflandscaping and irrigation at theWhitmore Avenue Interchange inthecityofCeres.

• $7,551,000 to the City of Dinu-ba for the Avenue 416 Wideningproject,betweenRoad56toRoad80. The widening of three milesof 2-lane road to a 4-lane with a2-way left-turn lanewillease traf-ficcongestionandeliminatesightdistanceproblems.

Funding For Farm Worker Housing In Woodland

Allocated

Mutual Housing California an-nouncedlastweekthatithasbeenallocatedmore than$14.5millioninaggregatefederalandstatetaxcredits, which it can use to raisemore than $12million for the de-velopmentofhousinginWoodlandforagriculturalworkers.Construc-tionisexpectedtobeginthisfall.

Spring Lake is the first MutualHousingcommunityforagriculturalworkersandisthefirstpermanenthousingcommunity inYoloCoun-ty targeted to theseworkers.Thecommunitywillhaveopenareas,achildren’s play area, a basketballhoopandcommunitygarden.

es, meetings and social events aswell as offices. The 62 apartmentsand townhomesatSpringLakewillbe one of the first zero-net energycommunities for farm workers inthe nation. Energy-efficient designwill bring energy use down and aphotovoltaic system throughout thecomplexisexpectedtogeneratetheneededamountsofelectricity.

Hospital For Elk Grove

Dignity Health officials are movingforwardwithplanstobuildahospitalonitsmedicalcampusthat’scurrent-lysetfora2017opening.Thepro-posal that includesadesign reviewof the plannedhospital is amongahandful of items on the agenda fortheElkGrovePlanningCommissionmeetingonJune20.

Themedicalcampusplannedfor8220WymarkDrive,justsouthofElkGroveBoulevard, is poised to include twomedicalofficebuildings,ahelistop,and

aparkingstructurealongwiththehospi-tal.Thesiteincludesa68,190-square-footmedicalofficebuildingthatopenedlastyear.Constructiononthat$35mil-lionfacilitystartedearly in2011whentheorganizationwasknownasCatho-licHealthcareWest.

DignityHealthofficialssaidthemedi-calcentercouldultimatelyincludeupto a six-story, 456,700-square-foot,330-bedhospitalthatwouldbebuiltin three sections. The first sectionwouldbefourstorieswith106bedsforsurgeryandmaternity.Otheron-site facilities include a three-story,65,000-square-foot medical officebuilding and a five-level parkingstructure.

Federal green Light For High-Speed Rail Work

A federal railroad oversight boardhasgivenagreen light to theCali-fornia High-Speed Rail Authorityto start construction in the CentralValley. The Surface Transportation

Boardruled that theCaliforniaproj-ect could start building the first 65milesof theproject fromMerced toFresno,asplanned.

The Surface Transportation Boardsaidinits67-pagedecisionthatCali-forniaofficialsandtheFederalRail-road Administration have alreadyextensively reviewedpotentialenvi-ronmentalharmfromtheprojectandaretakingstepstomitigateit.

Oakley Will Get Modern Day Care Center

The Oakley City Council has ac-cepteda$700,000bidonaNerolyRoadparcel,wherethebuyerplansto build a day care center. SeekerDevelopment,aSouthernCaliforniaconstruction company that special-izesinchildcarecenters,submittedthelonebidonaparceljustnorthofDiamondHillsSportsClubandSpa.

Accordingtotheproposalthecoun-cil approved, the company will buy1.1acresinreturnforwhichthecitywillcontribute$925,000indeveloperfees.Theseso-calledchildcareim-pact feesare intended tooffset theeffect of building more homes bypaying for the cost of establishingchildcarefacilities.

Althoughthespecificshaveyettobeformalized, the money in this caselikely will cover the cost of design-ingthestructure,havingthecitysignoff on thoseplans, andobtainingaconditionaluseaswellasabuildingpermit.

The$2.3millionprojectwillconsistofa10,000-square-footfacilitythatwillaccommodate about 180 childrenfrom very young infants to 6-year-olds.Inaddition,thefacilitywillhavean approximately 12,000-square-footoutdoorplayarea.

Should You Run Your Business As A Corporation Or LLC?

Whetheryouareafull-timeorpart-time business owner, everyone inthefieldof constructioncanbenefitfrom forming a corporation or anLLC. There are two reasons why:onehastodowithloweringyourper-sonal taxes and the other onewithgrowingyourbusi-ness.

First,nomatterwhattypeofwayyoumake your living, you are going tomake incomeandpay taxes. Ifyouare a business owner, your goal istohavethemoneyyoumaketaxedatthelowestrateallowedbylaw.Ifyou are doing your business as asoleproprietor,youaregoingtopaymoretaxesthanifyouoperatedyourbusinessasacorporationoranLLC.Period.

Second, you are in business. Part-time or full-time, every businessownerwantstheirbusinesstogrowandbecomemoresuccessful.How-ever,ifyouareasoleproprietor,yourbusinesscannotgrowtoitsfullfinan-cialpotentialbecauseitislimitedbyyou.Lookatthefacts:

Sole Proprietorship vs. Corpora-tion or LLC TAXESIfyouaredoingbusinessasasoleproprietor, you will make moneythroughouttheNewYearandreportthat incomeat theendof the year.Youwillclaimallexpensesandde-ductions that you are eligible for,and the remainderwill beyour tax-ablenetincome.Allofthisincomeis

nowsubjecttoself-employmenttax.This isbecause thereareonly fourways inwhich incomecancome tothe owner of a sole proprietorship:cash, fringebenefits, rent,and roy-alties.Therefore,almosteverydollarofincomeisgoingtobetaxedatthehighestpossibletaxrate.

If youoperated yourbusinessasacorporationoranLLC,eventhoughyouwouldmakethesameamountofincome,theendresultwouldbeverydifferent.Thetaxcodeprovidesad-ditionalincomereductiontoolstotheownersofcorporationsandLLC’s.Itallowsyoutotakeincomeoutofthebusinessinsixdifferentways:wag-es, fringe benefits, dividends anddistributions, loans, rent, and royal-ties.Asaresult,youcanchangethecharacter of themoney that comesto you, and reduce your personaltaxes!

Let’slookatthefourmostimportantways your corporation or LLC canhelpreduceyourpersonaltaxes.

1. WagesWages consist of the income youtakeoutofyourbusiness thatpaysyouforyourefforts.Wagesaretaxedatthesameratesasasoleproprietorexample.Soatfirstthereappearstobenodifferencebetweenasolepro-prietorandourentity.However, theowner of a corporation or LLC canregulate this income.Soourownerherecanhavesomeoftheirlifestylemoneytaxedaswages,butcanalsotakeitoutinavarietyofotherways.

For instance, he could take someincome out aswages, or he couldflowtheincomeintooneoftheoth-ersixcategoriesmentionedabove,so it can be taxed at a lower rate(if it is taxed at all). This is calledregulatingincome.Theownerbasi-cally has the ability to change thecharacterofmoney—anoption thesole proprietor does not have be-causeheorshehastodeclaretheirincomeascashsubjecttoself-em-ploymenttax.

2. Fringe BenefitsFringe benefits are legislative taxrules that benefit business. Theyallow businesses to write off non-traditionalbusinessexpenses,suchas health insurance and retirementplans. The woman apologized and ex-plained, “Wedidn’t have this greenthingback inmyearlier days.”Theyoung clerk responded, “That’s ourproblem today.Your generation didnotcareenoughtosaveourenviron-mentforfuturegenerations.”

Shewasright--ourgenerationdidn’thavethegreenthinginitsday.

Backthen,wereturnedmilkbottles,sodabottlesandbeerbottlestothestore.The store sent them back totheplanttobewashedandsterilizedandrefilled,soitcouldusethesamebottlesoverandover.Sotheyreallywere truly recycled. But we didn’thavethegreenthingbackinourday.

Grocerystoresbaggedourgroceriesinbrownpaperbags,thatwereusedfor numerous things, most memo-rable besides household garbagebags, was the use of brown paperbagsasbookcoversforourschool-books.Thiswastoensurethatpublicproperty,(thebooksprovidedforourusebytheschool)wasnotdefacedby our scribbling’s. Then we wereabletopersonalizeourbooksonthebrownpaper bags.But too badwedidn’tdothegreenthingbackthen.

We walked up stairs, because wedidn’t have an escalator in everystoreandofficebuilding.Wewalkedtothegrocerystoreanddidn’tclimbintoa300-horsepowermachineev-

ery time we had to go two blocks.But she was right. We didn’t havethegreenthinginourday.

Back then, we washed the baby’sdiapersbecausewedidn’thavethethrowaway kind. We dried clothesonaline,notinanenergy-gobblingmachineburningup220volts--windand solar power really did dry ourclothesbackinourearlydays.Kidsgothand-me-downclothesfromtheirbrothersorsisters,notalwaysbrand-newclothing.Butthatyoungladyisright;wedidn’thavethegreenthingbackinourday.

Back then, we had one TV, or ra-dio,inthehouse--notaTVineveryroom.AndtheTVhadasmallscreenthesizeofahandkerchief (remem-berthem?),notascreenthesizeofthestateofMontana.

In the kitchen, we blended andstirred by hand because we didn’thaveelectricmachinestodoevery-thing for us.Whenwe packaged afragile item to send in themail,weusedwaddedupoldnewspaperstocushion it, not Styrofoam or plasticbubblewrap.

Back then,wedidn’t fire upanen-gineandburngasolinejusttocutthelawn.We used a pushmower thatranonhumanpower.Weexercisedbyworkingsowedidn’tneed togotoahealthclubtorunontreadmillsthatoperateonelectricity.Butshe’sright;wedidn’thavethegreenthingbackthen.

We drank from a fountain whenwewere thirsty insteadofusingacup or a plastic bottle every timewehadadrinkofwater.Werefilledwriting pens with ink instead ofbuyinganewpen,andwereplacedtherazorbladesinarazorinsteadof throwing away the whole razorjustbecausethebladegotdull.Butwedidn’thavethegreenthingbackthen.

Backthen,peopletookthestreet-car or a bus and kids rode theirbikes toschoolorwalked insteadof turning their moms into a 24-hour taxi service. We had oneelectrical outlet ina room,notanentirebankofsockets topoweradozen appliances. And we didn’tneedacomputerizedgadgettore-ceiveasignalbeamedfromsatel-lites23,000milesout in space inorder to find the nearest burgerjoint.

Butisn’titsadthecurrentgenerationlaments how wasteful we old folkswerejustbecausewedidn’thavethegreenthingbackthen?

Q:MyCompany’sResponsibleMan-agingEmployee(RME)hasresignedandIhavebeenaskedtobetheRe-sponsible Managing Officer (RMO)for the corporation’s license. How-ever,Ihavemyownpersonallicensethat I need to keep active for smalljobsthatIdoontheside.

I understand that I need to have atleast20%ownershipinthecompanyinordertokeepbothlicensesactive,whichisn’taproblem.Myconcernisthatifsomethinggoeswrongonajobthat my company contracts for andthere isacomplaintfiled, is thatgo-ingtoaffectmySoleOwnerlicense?And will I be held responsible forjudgments/claims against the otherlicense?

A:While it depends on the circum-stance, as the ResponsibleManag-ingOfficeryoudoholdsomeliabilityforclaims,judgments,andcomplaintsagainst the license. If thecompanylicensehasanunsatisfied judgmentthat results in thesuspensionof thelicensewhileyouare theRMO, it islikelythattheCSLBwillalsosuspendyour Sole Owner license until thejudgmenthasbeensatisfied.

PREQUALIFICATION OF PROSPECTIVE PROPOSERS: TheUniversity’sprimaryobjectiveinutilizingthedesignbuildapproachis tobring thebestavailable integrateddesignandconstructionexperienceto thisproject. TheUniversityhasdeterminedthatproposerswhosubmitproposalsonthisprojectmustbeprequalified.PrequalifiedproposerswillberequiredtohavethefollowingCaliforniacontractor’slicense:BGeneralBuildingContractorandvalidCaliforniaarchitect’slicense.

GENERAL DESCRIPTION OF WORK:TheWorkshallincludealldesignwork,labor,material,tools,equipment,excavation,shor-ing, testing, inspection,commissioningandallnecessarygeneralconditions thatmaybereasonably inferred fromtheContractDocumentstoprovideallDesignWorkandConstructionWorkfor:athreestoryclassroombuilding,includingacommons/lounge,administrativeoffices,outdoorcourtyard,landscapingandsupportspacesforfacility.

Thesiteplanhasbeenestablished,andincludesthelocationofthebuilding,openspaces,hardscapeandlandscaping.Preserva-tionofseveraltreesonsitewillberequired.

Thefloorplanshavebeenestablishedandmaybereconfiguredslightlytomatchproposedstructuralormechanicalsystems,butingeneralareexpectedtofollowthefloorplansthatwillbeprovided.

Otheraspectsofthebuildings,includingelevationsandqualityofmaterials,areleftopenfortheproposerandwillbeevaluatedintheselectionprocess.

Workshallalso includeachievingLEEDGoldcertificationwith theUSGreenBuildingCouncil, includingpreparingallsubmittalrequirements.

TargetContractAmount$21,500,000.00.

EstimatedContractTime: 1,020 calendar days. Scheduled completion in August, 2016.

PROCEDURES:TheprequalificationprocesswillbeconductedintwostepsandwillresultintheselectionofuptothreefinalistswhowillbeprequalifiedandwillbeissuedproposaldocumentsforthisProject.Theprequalifiedproposerswillsubmitpriceandtechnicalproposals.Thetechnicalproposalswillbescoredaccordingtoanestablishedscoringsystem.Thepricewillbedividedbythescoretodetermineapricepertechnicalpoint.TheprequalifiedproposersubmittingthelowestpricepertechnicalpointwillbetheapparentlowproposerfortheProject.PrequalificationRequirementsSubmitted information (seesubmittal requirements inPrequalificationQuestionnaire)willbeevaluatedbasedonbothminimumrequirementsandcriteriathatarescoredasdescribedbelow.

RequestsforclarifyinginformationandadditionaldatamayberequiredbytheUniversityduringthisphase.Afterreceiptandreviewoftheclarificationsandadditionaldataeachprequalificationsubmittalwillreceiveafinalpointscore.

•TheContractormusthavesuccessfullycompletedatleastoneprojectsince2005thatwasdesign/builddelivery,i.e.wherethearchitectforthatprojectwasasubconsultanttotheContractororajointventurewiththeContractor(negotiatedorconstructionmanagementdoesnotmeetthisrequirement).

•TheContractormusthavesuccessfullycompletedatleastoneprojectsince2005thatwasapublicworksproject—i.e.throughaconstructioncontractdirectlytoapublicuniversity,Federal,state,county,ormunicipalagency.

•TheContractormusthavesuccessfullycompleted,orisunderconstructionwith,aprojectthathasbeenregisteredwiththeUSGreenBuildingCouncilforLEEDcertification.Certification.

•TheContractor’sProjectManagermusthavemanagedbothadesign/buildprojectandaprojectinCalifornia(neednotbesameproject),completedsince2005,thatwasover$12,000,000constructionvalue.

•TheproposedArchitectmusthavedesignedaprojectinCalifornia,completedsince2005,thatwasover$12,000,000constructionvalue.

•TheproposedMechanicalSubcontractormusthavedesignedaprojectinCalifornia,completedsince2005,thatwasover$12,000,000(total)constructionvalue.

•TheproposedElectricalSubcontractormusthavedesignedaprojectinCalifornia,completedsince2005,thatwasover$12,000,000(total)constructionvalue.

•BoththeContractor’sProjectManagerandSuperintendentmusthavebeenanemployeeofthiscontractoraminimumof3years.

OnlyProposerswhomeetalloftheminimumrequirementslistedabovewillbeevaluatedfurtherbyscoringthecriterialistedbelow.
