    Constitutional Mandates (Labor Law II)

    ARTICLE 2

    Section 9. The State shall promote a just anddynamic social order that will ensure the prosperityand independence of the nation and free the peoplefrom poverty through policies that provide adequatesocial services, promote full employment, a risingstandard of living, and an improved quality of life forall.

    Section 10. The State shall promote social justicein all phases of national development.

    Section 18. The State affirms labor as a primarysocial economic force. It shall protect the rights ofworkers and promote their welfare.

    ARTICLE 3

    Section 1. No person shall be deprived of life,liberty, or property without due process of law, norshall any person be denied the equal protection ofthe laws.

    Section 8. The right of the people, including thoseemployed in the public and private sectors, to formunions, associations, or societies for purposes notcontrary to law shall not be abridged.

    5. The right to self-organization shall not bedenied to government employees.

    ARTICLE 13

    Section 1. The Congress shall give highest priorityto the enactment of measures that protect andenhance the right of all the people to humandignity, reduce social, economic, and politicalinequalities, and remove cultural inequities byequitably diffusing wealth and political power for thecommon good.

    To this end, the State shall regulate the acquisition,ownership, use, and disposition of property and itsincrements.

    Section 2. The promotion of social justice shallinclude the commitment to create economicopportunities based on freedom of initiative andself-reliance.

    LABOR

    Section 3. The State shall afford full protection tolabor, local and overseas, organized andunorganized, and promote full employment andequality of employment opportunities for all.

    It shall guarantee the rights of all workers to self-organization, collective bargaining andnegotiations, and peaceful concerted activities,including the right to strike in accordance with law.They shall be entitled to security of tenure, humaneconditions of work, and a living wage. They shallalso participate in policy and decision-makingprocesses affecting their rights and benefits as may

    be provided by law.The State shall promote the principle of sharedresponsibility between workers and employers andthe preferential use of voluntary modes in settlingdisputes, including conciliation, and shall enforcetheir mutual compliance therewith to fosterindustrial peace.

    The State shall regulate the relations betweenworkers and employers, recognizing the right oflabor to its just share in the fruits of production and

    the right of enterprises to reasonable returns toinvestments, and to expansion and growth.

    Section 14. The State shall protect working womenby providing safe and healthful working conditions,taking into account their maternal functions, andsuch facilities and opportunities that will enhancetheir welfare and enable them to realize their fullpotential in the service of the nation.
