Disclosures and Disclaimers on ListingsThe NORES Rules and Regulations, Article I, Section 2.4 require “All listings shall have all legally required seller disclosure/disclaimer information attached, except where sellers expressly direct that such disclosure documents not be disseminated through the MLS. (5/20/10)Please make sure any disclosures or disclaimers are uploaded in the document section of each of your MLS listings.

Do Not CallThe Do Not Call Registry ("Registry") was created by the federal government; the Registry contains telephone numbers of consumers who, by registering their telephone number(s), have made it illegal for callers making a "telephone solicitation" to call them. A "telephone solicitation" is defined as, "a telephone call or message for the purpose of encouraging the purchase or rental of, or investment in, property, goods, or services, which is transmitted to any person" and covers the cold-calling activities of a real estate professionals. For some time, phone numbers provided in Realist have been scrubbed and showed who was on the Registry. Beginning in December, the numbers in Realist will no longer be able to be scrubbed, and will not show the numbers that are on the Registry. For that reason, the NORES Board of Directors has chosen to make all phone numbers unavailable in Realist. (See below for more information.)

Complying with Do Not CallDo Not Call Registry NAR Field Guide “Do-Not-Call”

Financials SupplementsThe GTAR Board of Directors has approved GTAR Financial Supplement Forms (Conventional, FHA, USDA, and VA) in addition to the OREC Financial Supplement Forms. The GTAR Financial Supplement Forms make the Buyer’s earnest money nonrefundable if certain actions are not taken within a certain time frame. Please make sure that you verify which Financial Supplement Forms are being used.

DO NOT CALL Registry and Realist Tax SystemThe NORES Board of Directors has decided to remove telephone numbers from Realist due to the responsibilities it places on brokerages to comply with all applicable state and federal regulations in connection with telemarketing activities, including the FTC’s Do Not Call guidelines. It has come to our attention that the brokerage of each agent accessing Do-Not-Call data via Realist will be required to obtain a “Subscriber Account Number” or “SAN” from the FTC. Failure to comply with

the SAN requirement creates a risk for the brokerages that belong to the MLS as well as the MLS itself.

As you may know, the National Do Not Call Registry (“Registry”) is a list of telephone numbers from consumers who have indicated their preference to limit the telemarketing calls they receive. Pursuant to the Federal Trade Commission’s Do Not Call (DNC) guidelines, telemarketers and sellers who make telemarketing calls to consumers are required to obtain a Subscriber Account Number (SAN) to access and search the Registry, and drop from their call lists the telephone numbers of consumers who are registered.

Please see the National Do Not Call Registry FAQs for more information.

Backpacks for Kids Gets Huge Boost from WCRAt the Women’s Council of REALTORS® (WCR) meeting on November 14, WCR presented a check to GTAR for more than $6,500 to support next year’s Backpacks for Kids campaign. The money was raised through a golf tournament that WCR

held back in September to benefit the popular program. 2012 GTAR Community Relations Committee Chair Stacey Pennington (right), and GTAR Director of Marketing Jennifer Smith (left), accepted the check.

This was the seventh year for GTAR’s Backpacks for Kids program. Through the generous donations of GTAR members, $18,601 was raised this year which provided 350 backpacks. To date, including this year, $95,796 has been raised, and 1,850 backpacks filled with basic essentials have been given to deserving children.

The recipients are chosen through Family Children’s Services with whom GTAR has built a strong relationship. They are very careful in selecting only the children who have the greatest need, and they are so grateful for our help.
