I’d like to personally welcome each of you to the 55th Annual IRWA Region 2 Refresher Seminar and
Educational Courses. It is an exciting time for Region 2 as we continue to grow and adapt, to our industry’s
diverse and changing requirements. The world of Right of Way is an exciting area in which to work, and we’ll
continue to meet and bring inspired people together in forums like this, to insure the members of Region 2
remain on the cutting edge of our industry.
Staying aligned with International’s mission, Region 2 is also working to “empower professionals by elevating
ethics, learning, and a standard of excellence within the global infrastructure real estate community”. Our
theme this year is “Education: The Right Way to the Future”. I believe you will find that our agenda is filled
with outstanding workshops lead by excellent speakers.

Ana B. Rausch, SR/WA, R/W-RAC is a Senior Vice President with Percheron. She has over 25 years of project
management experience in the right of way industry. Her areas of expertise include project management, feasibility
studies, negotiation and acquisition, title research, title curative, permitting, relocation assistance, damage and claim
settlement, construction support, condemnation support, due diligence and budgeting for the pipeline, electric utility,
telecommunications,transit, wind, rail and public sector projects. Over her career Ana has worked as a consultant as well
as the Vice President of Real Estate for a major Transit Authority. Ana received a Masters in Business Administration
(MBA) along with a Bachelor of Science (BS) from the University of Houston. She is a Licensed Texas Real Estate
Broker. Ana is a member of the IRWA International Electric and Utilities Committee and served as Chair of IRWA
Region 2 from 2015-2017. Ana is a Certified IRWA Climb Instructor and is a past President and Professional of the Year
for IRWA Chapter 8. Ana was recently elected as the IEC Secretary for the IRWA.

J. Warren Doyle started his career in the Energy Industry in 1978 as a Landman and Right of Way Agent while attending
Tulane University. He focused his studies on business and oil and gas related courses (geology and law) before earning
his undergraduate degree in Business Administration in 1979. Upon graduation, he continued to work as an independent
contractor for numerous exploration companies before starting his own land services firm, now Doyle Land Services, Inc.,
in 1981. He has served in the capacity of owner and President continuously to present. Doyle Land Services, Inc.
www.doyleland.com employs over two hundred and fifty (250) land and right of way professionals performing, right of
way, permitting, title, exploration land, project management, property management and data and mapping services for the
pipeline, gas storage, utility, oil and gas exploration, telecommunications and transportation industries throughout the
United States of America. In service to the Energy Industry in particular, Warren has contractually constructed (title,
permitting and acquisition) or performed due diligence on mainline, lateral and gathering pipeline systems, gas storage
fields, transmission lines, 2D and 3D seismic surveys, oil and gas fields and managed in excess of 500,000 mineral acres.
He has designed, built and maintains data and mapping systems to manage all of the above efforts. He is recognized as an
expert on related matters in testimony before the Commissioner of Conservation for the State of Louisiana. Warren is
married to Laurie Ellis Doyle and they have four (4) children and one (1) grandchild. They live in New Orleans, Louisiana
and he travels the country extensively in service to his clients. He can be contacted at [email protected].

Randy Keyes a veteran leader and manager with over 36 years of petroleum and energy industry experience –
being 22 years in the Right of Way/Land profession and 14 years in pipeline operations [onshore and offshore].
Randy's industry background is seasoned by work with multiple upstream, midstream, and downstream energy
and exploration companies including GeoSource, Tenneco, El Paso Energy, TransCanada, and presently with
Anadarko Petroleum Corporation as Surface Land Manager. His professional industry affiliations include active
membership in the International Right of Way Association; American Association of Professional Landmen;
Southern Gas Association [Right of Way Committee Chairman] and Louisiana Oil and Gas Association. He
holds BBA and MBA degrees in Business Management from Belhaven College [Jackson, Mississippi]. Parallel
with a full-spectrum energy career, Randy is a fully-trained husband, father, grandfather, and happily retired US
Army Engineer Officer with 32 years of active and reserve military service

Speaker Bio: Paul Parker attended the University of New Orleans where he received a Bachelor of Arts in
Communication. He is presently IRWA Chapter 43 Treasurer. He's worked in the Right of Way industry under a
multitude of roles for the last 5+ years with Access Land Services as a right of way agent, projects manager and
permitting specialist. He recently joined Black & Veatch's TELCOM and Right of Way division to help with their large
scale fiber projects. He's been an active member of the IRWA and YPs at the Chapter, Region, and International level for
several years.

planning phase. Join us to learn more about potential pitfalls you may stumble upon and how to avoid them.
Speakers: Ryan Robol, Program Manager
Speaker Bio: Program Manager, Ryan Robol has provided natural resources consulting services, including wetland
delineations, biological assessments, and Army Corps of Engineers permitting since 2002. He is vastly experienced with
all aspects of complex environmental permitting and has the ability to identify potential obstacles in the planning stages of
a project and to develop innovative solutions for curtailing permitting and mitigation setbacks.

Presentation Title: SH99 Grand Parkway: Working with LPA’s on Design/Build Project
Abstract: In 2012 the Texas Department of Transportation (TxDOT) awarded a single Design-Build contract to Zachry
Odebrecht Parkway Builders (ZOPB) in the amount of $1.1 billion dollars for Segments F-1, F-2, & G (SH 249 to IH- 45
N / IH-45 N to US 59 N). At the time of construction Don Toner was the Director of Right of Way for TxDOT’s Strategic
Projects Division, Vic Rosen was the lead for the Right-of-Way Acquisition team for ZOPB and Marty Kobs was the lead
for the condemnation support for Lockwood Andrews and Newnam (LAN) of approximately 140 professionals to acquire
435 parcels, over 2100 acres, at a successfully achieved rate of just under 24 months. This pace of acquisition allowed the
construction disciplines to complete the roadway project in slightly over 3 years, both designed and constructed and
parallel to the property acquisition process. Come learn how this was accomplished and the lessons learned.
Speakers: Donald “Don” C Toner, Jr., SR/WA, Marty Kobs, J.D., Vic Rosen, Right of Way Manager
Speaker Bios:
Don Toner, SR/WA has a Bachelor's of Science Degree in Economics and Business Management from
Southern Connecticut State University. After college graduation, motivated by the warm climate, Don
moved to Texas where he began his 28 year career with the Texas Department of Transportation
(TxDOT). Don started as a review appraiser in the El Paso District and progressed to
Director of Strategic Projects Delivery for the Right of Way Division. Don was responsible for the
oversight and compliance review of right of way and utility coordination activities of Design Build
(DB) projects across the State of Texas. Don managed a staff of right of way and utility professionals
and successfully encouraged collaboration and partnership with the private sector, his team, and the Program Management
Consultant (PMC) providers who served as an extension of his staff.
Don holds a State Certification as a General Real Estate Appraiser and is a Licensed Real Estate Broker in Texas. In
addition to holding an SR/WA Designation of the International Right of Way Association (IRWA) and recently served as
President of Austin’s Chapter 74.
In late 2016, Don joined THC Inc., an Atlanta, Georgia based right of way acquisition and noise mitigation firm
strategically serving a diverse client base in Texas and the southern portion of the US. The firm has served as primary

consultants and acquisition agents on many different type of projects, from wetland and flood mitigation buyout projects
to airport runway extensions, as well as noise studies and noise mitigation solutions. The firm has managed many
municipal roadway and state highway right of way acquisition projects in several states in conformance with the Uniform
Act.
Marty Kobs, has more than 30 years of right-of-way service experience, primarily focusing on
acquisition, eminent domain and project management. He graduated from Texas A & M University in
1980 with a B.A., majoring in history. He began his right-of-way career at the Houston District of the
Texas Department of Transportation in 1983, serving first as a Right of Way Agent and concluding in
1999 as Acquisition and Litigation Support Supervisor. He was appointed Task Force Manager for the
Houston District’s Eastex Freeway Right of Way Project, which was 22 miles in length, involved
fifteen construction segments, acquisition of over 750 parcels, and an equal number of displacements.
While employed at TxDOT, Mr. Kobs completed a Master’s Degree in Public Administration and a JD Degree from the
University of Houston. He was licensed as a Texas attorney in 1999. Mr. Kobs began work for Lockwood, Andrews &
Newnam, Inc. (LAN) in 1999 and has managed numerous right-of-way projects for TxDOT and various local
governments, including the cities of Houston, Del Rio and Pearland. Mr. Kobs has been a featured speaker for the
Houston Chapter of the International Right-of-Way Association, the Harris County Eminent Domain Seminar, and
numerous civic groups.
Vic Rosen, Right of Way Manager was born and raised in Amarillo, Texas and attended The Citadel,
The Military College of South Carolina in Charleston, SC where he earned a Civil Engineering degree
in 1979. Upon graduation, Vic entered the offshore construction industry supporting oil & gas
exploration, spending the majority of his 25 years involved in the steel construction of offshore
platforms. Vic later transitioned into the highway construction industry where he joined Zachry
Construction Corporation in 2008 and assumed the position of Right of Way Manager in 2012 for the
Houston Grand Parkway, Segments F & G project. Vic is married to his lovely wife, Heavenly, and
has two children, both graduate engineers from Texas Tech and Texas A&M. He and Heavenly reside in New Braunfels,
our Texas hill country. He also actively serves as a Board Member for the San Antonio Chapter of the Juvenile Diabetes
Research Foundation (JDRF). When not working, Vic enjoys cabinet making, carpentry, chainsaw carving, sculpting and
acrylic painting as past time activities at home. On the road, you may see him on his second interest, his Harley Davidson
motorcycle.

Speaker Bios:
Kyle Madsen serves as TxDOT’s Right of Way Division’s Deputy Director. Kyle’s career in transportation began with
the Office of the Attorney General (OAG) in the Transportation Division litigating eminent domain, inverse
condemnation, and contractual disputes for TxDOT. From the OAG, he entered the ROW Division’s Legal Branch and
was promoted to ROW Supervisor with responsibilities in the San Antonio and Laredo districts. He then became the
Director of Statewide Project Delivery for the ROW Division.
Kyle is an experienced real estate attorney, licensed by the State Bar of Texas and has a Bachelor of Arts Degree from
Texas A&M and a Doctorate of Jurisprudence from St. Mary’s University School of Law where he was a member of Phi
Delta Phi international legal honor society.
Lora Gunter, J.D., SR/WA is the District Field Services Manager for the Fort Worth District of the Texas Department of
Transportation (TxDOT). She oversees the right-of-way, utilities, and survey sections of the district, which encompasses
nine counties. Before taking on this role, Lora was the ROW Division Attorney assigned to the Fort Worth area. Lora
relocated to the Fort Worth-Dallas area in 2011 when she joined the Southlake law office of Cantey Hanger. There, she
represented Oncor in various condemnation actions in the state, including those related to legislatively-mandated CREZ
lines. Prior to this, Lora was an Assistant Attorney General based out of Austin, Texas. Though she represented TxDOT
in lawsuits across the State of Texas, Lora’s primary assigned area was Tarrant County as a member of the Fort Worth
team. She represented the State in over a hundred Special Commissioners’ Hearings, numerous condemnation trials, and
several appellate cases. In addition to being knowledgeable about condemnation law, Lora is very familiar with appraisals
and the valuation process.
Since moving to North Texas, Lora has been active in her community. She has served as President of the Northeast
Tarrant County Bar Association, Secretary of her neighborhood homeowners’ association, and co-basketball coach of her
daughter’s basketball team with her husband Chris. She has downsized her activities to focus on her involvement with the
IRWA, where she is currently the Treasurer for Chapter 36.
Bob Harwood is a graduate of the University of Texas School of Law. He has been with the Texas Department of
Transportation for 28 years where he has served as Right of Way Attorney, District Right of Way Administrator for the
Austin District, Acquisition Section Director for the Right of Way Division, and as Project Delivery Director for the Right
of Way Division.
Greg Polasek is the East Right of Way Project Delivery Supervisor serving the Bryan, Beaumont and Yoakum Districts.
He received a Bachelor of Science Degree in Agriculture Business from Southwest Texas State University in December,
1992.
David Harrah works for the Texas Department of Transportation (TxDOT) as a Right of Way Project Delivery
Supervisor in TxDOT’s Austin District office. Previously he worked in the Right of Way Division Headquarters office as
the Acquisition Section’s Lead Right of Way Agent and the state Relocation Program Administrator. He began his career
with TxDOT in 1999 and joined the ROW Division in 2000. Prior to working for TxDOT, David was a mechanized
infantry team and squad leader in the United States Army. While working for the department, David earned his Associates
degree in Business Administration from Austin Community College. He has received the International Right of Way

Association (IRWA) Senior Right of Way Agent designation (SR/WA), the Uniform Act Certification (R/W-URAC), the

he was voted Chapter 74’s professional of the year. David has been active throughout the IRWA currently serving as
chapter 74’s relocation committee chair, as well has having served as the Region 2 representative to the International

David helps certify recreational scuba divers and travels the world pursuing his passion for underwater photography.

Abstract: What does Utility Coordination have to do with Customer Focus? Have we lost sight of the end use customer?
Does it always have to be about budget or can we focus on our customers for a change? "Utility Coordination and
Customer Satisfaction" is a module that focuses on the processes involving utility coordination and how it affects our end
use customer. Customer satisfaction and focus could be our key to success if we just look outside our box! This module
interacts with attendees at the Region 2 IRWA conference and may open eyes as to how often the middleman gets caught
in the "middle" or placed in uncomfortable spots of negotiation. In the end, our customers are our most important asset.
2. Presentation Title: What is the difference in SUE, Utility Coordination, and Utility Engineering?
Abstract: Ever wonder what that Subsurface Utility Engineering (SUE) was? What is the difference between SUE,
Utility Coordination, and Utility Engineering, and how does ROW enter the picture? When do you need a SUE provider, a
Utility Coordinator, or a Utility Engineer? This session will discuss the roles and responsibilities of the many participants
involved in the the placement and relocation of utility facilities on transportation projects and when their services are
required. Don't let utilities ruin your project!

Roger Lindsey currently serves as the Manager of the Distribution ROW & NJUNS (National Joint
Utility Notification System) Groups for Oncor Electric Delivery. He brings 30 years of service to the
utility industry and is passionate about being and remaining the customer advocate. Roger believes
customer focus is critical to success in the business world and phone calls, face-to-face meetings and
working through issues surrounded by a good meal helps to foster relationships and business success.
Jessie Cooper has a Bachelor of Science in Civil Engineering from the Texas A&M University and is
a Registered Professional Surveyor in Texas (No. 5110). His 30 year career has been centered on all
aspects of utility coordination/utility engineering/utility relocation/SUE/ utility adjustment monitoring
& verification. Jesse currently provides leadership for the HDR team on the Rapid Bridge
Replacement Project in Pennsylvania for the utility relocation analysis of over 500 bridges. As the
former TXDOT Section Director of the Map, Survey, & Utility Section, Jesse provided oversight of the
Texas Utility Program. He also managed Subsurface Utility Contracts and developed Utility
Coordination and Engineering Contracts. He was part of the team presented the FHWA 2006 Utility
Outstanding Achievement Award in the Category of Utility SUE (Subsurface Utility Engineering).

M. Renee Mayer, PE, has a Bachelor of Science in Civil Engineering from the Texas A&M
University and she is a licensed Professional Engineer in Texas (No. 98652). Her 24 year career has
been centered around all aspects of utility design/coordination/engineering/utility adjustment
verification. She began working with CPS Energy, the major gas/electric company for San Antonio
where her passion grew in the utility industry. She saw quickly how utilities play an intricate part of
project delivery. Her background has given her an appreciation of the dynamic interaction required
between the utility owners, design personnel and construction contractors necessary to successfully
execute complex, fast paced projects. Through her depth of experience she has created an impeccable
process of identifying and resolving utility conflicts through solutions that benefit both the agency and
the utility company while maintaining project schedules. As the Transportation Utility Program Manager for HDR
Engineering, Inc., she has a proven record managing successful on-time/on-budget delivery of projects of all sizes in
Texas’ urban and rural environments with a multitude of agencies including several TxDOT Districts, many Cities (San
Antonio, San Marcos, Kyle, Buda, Cedar Park, Leander, Austin, Pflugerville, Round Rock), Counties (Bexar, Hays,
Travis) and Union Pacific Railroad. She was Utility Manager for the team that was the recipient of the FHWA 2011
Excellence in Utility Accommodation and Relocation Award for Incentives and part of the team presented with the
APWA Texas Chapter Project of the Year for 2017.

Presentation Title 1: Relocation: Understand the Interpretation
Abstract 1: In this session, we will provide an overview of case study relocation projects and situations and how the
Uniform Act is applied. Best practices, and policies will be discussed by relocation professionals and be available to
provide insight as to how FHWA and TxDOT handle complicated relocation challenges.
Presentation Title 2: US 181: Harbor Bridge and the Hillcrest Neighborhood Relocation Program
Abstract 2: The US 181 Harbor Bridge project will replace the existing bridge over the Corpus Christi Ship Channel. In
March 2015, a Title VI complaint was filed with the FHWA alleging that appropriate consultation with the community for
alternative analysis and mitigation was not completed and the Hillcrest neighborhood had suffered discrimination for
decades due to its location by the Port, the Harbor Bridge and the refineries. FHWA and TxDOT entered into a Voluntary
Resolution Agreement to voluntarily relocate property owners and tenants at their request from the Hillcrest neighborhood
over a three year period to comparable homes in the Corpus Christi area. The offer for voluntary relocation as a Title VI
mitigation is the first of its kind in the country and will be closely watched by other Departments of Transportation and
civil rights advocates. This presentation will explain the acquisition and relocation program and the unique way the
Uniform Act is being utilized for mitigation purposes.

Speaker Bio: Gary Maler is the director of the Real Estate Center at Texas A&M University
in College Station. He has served as director since 2005. Prior to becoming the Center’s chief
administrative officer, Maler was the Associate Director. As Director of the Center, Maler
focuses his attention on garnering and managing the resources and talent of the Center,
creating a work culture that is favorable to creativity, collaboration and accountability and
looking for opportunities to grow the Center’s expertise and reputation for excellence. Maler
is passionate about strategy and has led the Center in developing a refined list of bold
strategic initiatives. Before joining the Center he worked in the private sector in real estate
development. His past employers include Friendswood Development Company (FDC) in
Houston, Texas. While with Friendswood he performed numerous land suitability and
homebuyer preference surveys and the original market studies recommending successful projects including Copperfield,
Greenspoint and Kingwood’s office as well as entertainment and retail centers. He also oversaw the construction of those
and other FDC projects and managed 16 municipal utility districts and their infrastructure. During Maler’s tenure at Texas
A&M, he worked as a Special Assistant on Assignment to the Vice Chancellor for Development of the Texas A&M
Research Park, preparing the original ground leases and initial marketing strategies, as well as conducting comprehensive
special studies of real estate owned by Texas A&M. He also initiated and identified decision-making criteria that became
the underpinnings of a formalized real estate management system at Texas A&M. He has taught strategic thinking in the
Mays Business School Center for Executive Development. Maler regularly makes presentations and assists real estate
trade associations by conducting focus groups, business planning and strategy development sessions. He has assisted over
90 organizations during his 32- year career at Texas A&M.

Presentation Title: Right of Way FEED/Feasibility Studies for Pipeline Projects
Abstract: Right of Way Service Providers and operating company ROW personnel are becoming more involved in the
pre-planning for major pipeline projects. This phenomenon is understandable due to the need by operating companies to
manage budget in times of financial uncertainty in the oil and gas industry. Some of the ROW issues which are typically
evaluated during the FEED (Front End Engineering Design) or feasibility studies are route selection, detailed project
timelines (Gantt charts, etc.), cost for acquisition of land rights, cost of right of way services, adversarial potential,
identification of owners along the proposed route, availability of eminent domain and the risk factors associated with each
of these. This presentation will discuss best practices for developing these various aspects of FEED and feasibility studies
Speakers: Kerry Malone
Speaker Bio: Kerry has been with CLS since 1999 and brings over 34 years of experience in pipeline Right of
Way industry as well as the electric utility and construction industry.
As Senior Vice President, Projects & Operations, Kerry’s responsibilities include project management and
quality control for major pipeline and electric utility acquisition projects. Kerry served as the Right of Way
Project Manager for the Rockies Express Pipeline, one of the most significant pipeline projects to be undertaken
in the last 20 years. Kerry is Contract Land Staff’s most senior expert in pipeline safety, operation and DOT
compliance and has extensive experience in management of FERC regulated pipeline projects. Based on his
vast industry experience and knowledge, Kerry oversees development and customization of policies and
procedures for management of projects staffed and managed by Contract Land Staff. He also works with clients
to plan projects, prepare feasibility studies and ensure their employment needs are being met. Prior to joining
CLS, Kerry spent 20 years with Amoco in the Midwest and Texas. Kerry is an instructor in the CLS
Professional Development Institute and for The University of Houston – Downtown Right of Way Certificate
Program. He holds BS and MEd degrees with considerable additional post-graduate study in business and real
estate law. He is a member of Chapter 8 Gulf Coast Chapter of the International Right of Way Association
(IRWA) and is a Founding Member and serves as Vice-Chair of the Board of Directors for the IRWA
Consultants Council.

Speaker Bio: Mark A. Lewis, ARA, RPRA has been engaged in real estate appraisals and
consultation since 1984. Mark began his appraisal career as a contract appraiser for
Dickerson-Seely & Associates, Inc., a full service appraisal firm in Lufkin, Texas. Today he
and Scott Seely own and manage the firm, now known as Lewis & Seely Appraisals, Inc.
Mark joined the American Society of Farm Managers and Rural Appraisers (ASFMRA) in
1996 and earned his ARA designation in 1999 and his RPRA designation in 2014. He has
served ASFMRA as President of the Texas Chapter, Chair of the Appraisal
Education/Accreditation Committee, and District V Experience Review Chairman. In 2007, he was awarded
the H. E. “Bulk” Stalcup Excellence in Education Award by ASFMRA. He is presently Vice-Chair of the
Appraiser Qualifications Board (AQB) of The Appraisal Foundation. On a local level, he has also served as
President of the Lufkin Multiple Listing Service and Chair of the Grievance Committee for the Lufkin
Association of Realtors.
Mark has been lead instructor for many of ASFMRA’s core courses and was actively involved in the writing
and design of the current Cost, Sales Comparison, and Income Approach courses. He has also taught and
authored many seminars on various subjects through the years and is an AQB Certified USPAP Instructor.
Mark and his wife Alica have two children, Amber and Aaron.
