    ON THE "PLIGHT OF THE ROHINGYA, PART II: CRIME AGAINST HUMANITY"

    KUALA LUMPUR

    12 JUNE 2015

    RESOLUTION

    The International Conference on The Plight of the Rohingya, Part II: Crime Against Humanity" was

    convened by the Perdana Global Peace Foundation (PGPF) in Kuala Lumpur, Malaysia on 12 June, 2015. The Conference was attended by participants comprising representatives from the diplomatic corps, international organisations, human rights groups, academia, civil society, non-governmental organisa-tions and media as well as leaders of Rohingya organisations. The Honorable Tun Dr. Mahathir Mohamad, the fourth Prime Minister of Malaysia and President of PGPF, delivered the Keynote Address.

    Other prominent Speakers were as in the Appendix.

    We, the undersigned; Having regard to the Resolution issued following the convening of the "International Conference on The Plight of the Rohingya: Solution?" by the PGPF on 17 September 2012. Gravely concerned with the systematic human rights abuses perpetrated in Myanmar as constituting crimes against humanity including genocide and a modern form of apartheid, causing the current ex-odus of thousands of Rohingyas from the country; Observing with concern the failure of the government of Myanmar to resolve the Rohingya issue, in-cluding by failing to actively and comprehensively promote and support reconciliation between com-munities in the Rakhine State of Myanmar;

    Mindful of the irregular migration, smuggling of migrants and trafficking in persons via land and sea involving vulnerable groups including women, children and unaccompanied minors from Myanmar; Seriously concerned with the smuggling and trafficking of the Rohingyas from Myanmar by transna-tional organised criminal syndicates; Recognising the weaknesses and ineffectiveness of the relevant national law enforcement, justice, and protection agencies and the complicity of certain corrupt authorities; Noting with disappointment the failure of the Association of Southeast Asian Nations (ASEAN), the Organisation of Islamic Cooperation (OIC) and other international bodies, including the United Na-tions High Commissioner for Refugees (UNHCR), the UN Resident Coordinator's Office in Myanmar, and the International Organisation for Migration (IOM) in exercising their influence to satisfactorily ad-dress the Rohingya issue and provide adequate protections; Observing the need for more funds, resources and assistance from developed countries within ASEAN and outside ASEAN, in particular the United States of America (USA), Australia and the Eu-ropean Union (EU), as well as the Gulf States and the developed members States of ASEAN, to the Rohingyas, including options for resettlement and repatriation. Noting, the deliberate silence, inaction and refusal of moral and political leaders in Myanmar, in par-ticular, Nobel Laureate Aung San Suu Kyi, in playing a responsible leadership role to resolve the Rohingya issue internally for political expediency; Unequivocally agree to; Call upon the government of Myanmar to bear full responsibility for resolving the problems associ-ated with the Rohingyas, including the ongoing genocide, to remove the root causes that are forcing them to flee the country; Call upon the government of Myanmar to provide access to international inspection teams and the media to report on the situation affecting the Rohingyas in the country, including unfettered access to areas presently restricted in northern Rakhine State; Call upon the government of Myanmar to provide access to food, medical care, livelihoods, educa-tion, and other forms of assistance to Rohingya in Rakhine State, and ensure humanitarian agencies have unfettered access to internally displaced Rohingya populations; Call upon the government of Myanmar to urgently reinstate citizenship to the Rohingyas and end all restrictions on their freedom (in particular freedom of movement) with a view towards facilitating their reintegration into Myanmar society and with respect to the right of the displaced to return home; Call upon moral and political leaders in Myanmar, in particular Nobel Laureate Aung San Suu Kyi, to live up to principles of respect for human rights and the rights of minorities in Myanmar so as to re-gain her credibility in the eyes of the international community; Call upon all peace loving Buddhist leaders in Myanmar, consistent with their religious teachings, to take all necessary measures to protect and prevent acts of discrimination, extremism, hatred and vio-lence against the Rohingyas;

    Commend the position of Malaysia, Indonesia, Thailand, Philippines and Turkey, to provide humani-tarian assistance and temporary shelter to the Rohingyas and survivors of human trafficking who had been stranded at sea; Call upon Thailand, Malaysia and Indonesia to allocate more resources to strengthen their enforce-ment and protection measures aimed at combating the irregular migration, smuggling and trafficking of the Rohingyas in the region; Urge Myanmar, Thailand, Malaysia and Indonesia to investigate, arrest and impose severe penalties upon conviction on transnational organised criminal syndicates and their accomplices in government dealing with the Rohingyas; Call upon ASEAN, with Malaysia as the current Chair, to include the Rohingya issue as a permanent item in the ASEAN Agenda in order to work towards reaching a comprehensive solution, in close col-laboration with Myanmar and in the interest of regional peace and stability; Call upon developed countries including the US, the EU and Australia and the developed member states of ASEAN as well as international organisations, including the OIC, to provide direct socio-economic assistance to the Rohingyas in Myanmar as a way of discouraging them from leaving the country; Call upon developed countries that are not yet resettlement countries to agree to resettle refugees and set reasonable quotas, and for the US, Australia, the EU and other resettlement countries to in-crease their quotas with a view towards expediting the resettlement of refugees currently residing in Malaysia, Thailand and Indonesia; Call upon all countries to open up opportunities for Rohingyas to be resettled in third countries, to provide local immigration and possibilities for voluntary repatriation; Call upon the UNHCR and the IOM to be proactively involved in the smooth implementation of volun-tary repatriation and resettlement of refugees currently in Malaysia, Thailand and Indonesia to the relevant third countries; Call upon the UN member States to urgently secure a binding UN Security Council Resolution on Myanmar, including a provision for an independent international investigation into abuses in Rakhine State, and to act in accordance with the mandates on Prevention of Genocide and Responsibility to Protect via the Office of the Special Adviser; Fully support the NGOs in articulating their constructive and influential voice to secure humanitarian assistance, protections and temporary shelter to stranded Rohingyas at sea as well as advancing du-rable solutions, including resettlement; Convey a copy of this Resolution to the governments of Brunei, Cambodia, Indonesia, Laos, Malay-sia, Myanmar, the Philippines Singapore, Thailand, Vietnam, Bangladesh, USA, the EU and Australia as well as the ASEAN Secretariat, the OIC, the UNHCR and the IOM.
