Conditions of PartiCiPation statement of Consent and Waiver of LiabiLity

for the Brazzeltag at the TECHNIK MUSEUM SPEYER on 09th through 10th May 2020, hereinafter called “EVENT”

As a participant, with my signature I hereby confirm that I am acquainted with the following facts and circumstances:The Brazzeltag is involving a motor show on a circuit on a roadway blocked for public transport for the duration of the event. The event does not intend to achieve maximum speed results. A competition of participants does not take place. Any kind of time keeping and risky passing manoeuvres will not be allowed.Entitled to participate are road legal vehicles exclusively, as well as vehicles bearing a so-called “red number” or dealer plate carrying the appropriate insurance coverage. A corresponding permit or confirmation of an appropriate insurance has to be taken along and produced upon request by the organizer.I am aware of the fact that I will have to follow the directions of the route master and the organizer‘s personnel without fail. In the event of noncompliance, the organizer is entitled to exclude entrants from further participating in the event.Each driver and co-driver is responsible for his own personal- and property insurance. All drivers and co-drivers have to wear protective clothes. Drivers and co-drivers of two-wheelers must wear helmets.I am aware of my own exclusive responsibility for my personal belongings during the entire duration of the event and the corresponding activities. In the event of loss or damage of the said objects, I hereby waive personally and on behalf of my successors in interest any liability of the organizer, its vicarious agents or any other third parties involved in the organization of the event, unless this damage were due to an act of gross negligence or intent on the part of the organizer, his legal representatives or one of his vicarious agents.I am aware of the fact that participation in the event is involving certain dangers in spite of supervision and briefing. It is my personal obligation to have a close look at the facility where the event is taking place to examine its suitability. Should I come across safety risks in the course of my examination I am under the obligation to inform the organizer accordingly without delay. Furthermore, I confirm that my state of health is adequate to conform with the requirements of the event. The organizer will not be liable for damage caused by the state and quality of streets / locations / routes inclusive of fixtures and accessories thereof used in the course of the event. There is no arrangement covering the guard of vehicles.The Brazzelparcours and the Brazzelarena are closed to ALL from 20:00 clock. The Brazzelparcours will be closed at 20:00, so driving is no longer allowed for safety reasons.

Waiver of LiabiLity

I am aware of the fact that participation in the event will involve risks and dangers for my life and health and the vehicles and property holdings employed. Therefore, I hereby declare:Personally and on behalf of my successors in interest I hereby waive any liability claims against the organizer of the event, his legal representatives as well as his vicarious agents for whatever legal reason as far as they do not fall under the existing insurance cover. Included therein are any direct and indirect damages as well as any damages I, my legal successors, or otherwise entitled third parties could claim due to injuries incurred or in the event of death. This waiver of claims against the organizer does not apply to liability for damages resulting from injuries to life, body or health or other damages resulting from grossly negligent violation of duty on the part of the organizer, his legal representatives or vicarious agents.I hereby keep the organizer of the event, his legal representatives as well as his vicarious agents indemnified against all liability for claims of third parties as far as damages are incurred by them as a consequence of my participation in the event, be it in the course of this event or in connection therewith. As far as I am signing as parent of a minor participant on behalf of him/her, I assure that the other parent – as far as she or he does not sign personally – is aware of and in agreement with this statement and has authorized the undersigned to execute this statement also on behalf of the other parent.

media Coverage

I give my irrevocable consent to all media present and intended for gratuitous use of my picture and voice for photographers, live-broadcasts, transmissions and/or video and audio recordings authored by the organizer or his representatives in connection with the event. I consent that German law shall apply for the event and this statement under the exclusion of international private law.

Place of jurisdiction for any litigation in connection with the aforementioned event is Speyer unless the value in litigation were to require the venue of the district court Frankenthal.

Waiver of vehiCLe oWner

(only required if participant and driver are not owners of the vehicle employed, see foregoing details)

I consent to the participation of the specific car in the event (qualification, warm-up, practice- and inspection runs) and hereby waive all and any claims for damages of any kind occurring in connection with the event, namely with respect to

- the own participants and aids,

- any other participants and vehicle owners of all cars participating in the event (as far as the event is taking place on a permanently or temporarily closed route) and their aids,

- the event organizer, their vicarious agents, their legal representatives, any full-time or voluntary personnel of the aforementioned persons and institutions and all other persons in connection with the organization of the event.

The waiver of liability applies to any claims irrespective of the legal basis, thus in particular also to claims resulting from contractual or non-contractual liability and to claims resulting from unlawful acts. The waiver of liability does not apply to injury to life, body or health or to other damage or injury as a result of wilful or grossly negligent violation of duty nor to damages as a result of violation of a fundamental contractual obligation by the group of persons released from liability.
