Thank you for choosing to protect Your Product with HarveyNormanProductCare.WerecogniseYour rightsunder theConsumerGuarantees Act 1993 (NZ) (‘Act’) are important, and cannot belimited or excluded.

TheActprovidesYouwithcertainguaranteeswhenYouacquire certaingoods and/or services.

The Act applies to goods and/or services supplied in trade by way ofgift, sale, exchange, lease, hire or hire purchase, to the extent suchgoods and/or services are of a kind ordinarily acquired for personal,domestic or household use and are not being acquired for resupply intrade, consumption in a process of production or repair or treatmentin trade of other goods or fixtures. Generally the guarantees given bysuppliers under the Act in relation to goods are: an acceptable quality,reasonable fitness for particular purpose, compliancewith description,compliance with sample or demonstration models, that the price (ifnot agreed) will be reasonable and a guarantee as to title.

If goods fail tomeet the supplier’s guarantees set out in the Act:(a) Wherethefailurecanberemedied,Youhavetheability torequire

that the supplier remedies the failure within a reasonable time.In order to remedy the failure, the supplier is able to choosewhether to:(i) repair the goods;(ii) remedy any defect in title (if applicable);(iii) replace the goodswith goods of an identical type; or(iv) refund the purchase price of the goods.

If the supplier refuses to remedy the failure or fails to do so within areasonable time, You can have the failure remedied elsewhere andbe reimbursed by the supplier for all reasonable costs related to theremedy. Alternatively,Youmay reject the goods.

(b) Where the failure cannot be remedied or is of a substantialcharacter,Youhave theoption toeither reject thegoods, or keepthegoodsand seekdamages in compensation for any reduction

in value of the goods below theprice paid. Substantial characteris defined in the Act and includes goods that are unsafe andwhichwould not havebeen acquiredby a reasonable consumerfully acquaintedwith the nature and extent of the failure.

In addition, You have the right to obtain from the supplier damagesfor any loss or damage incurred by You as a result of the failure of thegoods (other than loss or damage through the reduction in valueof the goods), which was reasonably foreseeable as liable to resultfrom the failure. You also have various rights and remedies against amanufacturer of products under the Act.

The scope and meanings of each of these guarantees and remediesis set out more specifically in the Act, and the description providedabove and the comparison table set out below, are necessarily brief. Inthe event of a problem with Your Product, You may have rights at lawagainst the seller ormanufacturer ofYour Product under warranties orguarantees expressed or implied bymandatory provisions of law suchas the Act. Your Harvey Norman Product Care does not replace theserights or make them void. You can choose to claim under your HarveyNorman Product Care or under the Act. For further information aboutYour legal rights, we suggest You contact the Ministry of ConsumerAffairs.

RIGHTOFCANCELLATIONYou have a right to cancel Your Harvey Norman Product Care within 5working days of purchase. You can cancel by contacting Us on one ofthecontactmethods setout inYourHarveyNormanProductCareorbyreturning toyour storeofpurchase.Youalsohavea rightof cancellationifWe fail to complywith certain disclosure obligations toYou.

Features Consumer Guarantees Act ‡ Harvey Norman Product CareType of goodor servicecovered

Applies to goods or services of a kind ordinarily acquiredfor personal, domestic or household use to the extent notacquired for resupply in trade, consuming in production/manufacture or repairing or treating in trade other goodsor fixtures.

Applies to all types of products sold by Us, regardless of theintended or ordinary usage of that product (subject to statedexclusions inYourHarveyNormanProduct Care).

Term Commences from date of purchase and ends after a‘reasonable period of time’, as determined by factorsapplicable to the specific guarantee.

Commences on expiry of Your Product’s manufacturer warranty(if any) and ends on the expiry of the Term or if You successfullyclaim under Your Harvey Norman Product Care. At all times,limited to 7 years fromOriginalDate of Purchase.

Coverage Allows claims where the Act’s guarantees have beenbreached.

If the failure can be remedied, the supplier is able to chooseto repair or replace thegoods, or refund thepurchaseprice.

If the failure cannot be remedied, isn’t remedied in areasonable time, is of a substantial character, then aconsumer has the option to replace or repair the goods orrefund thepurchaseprice.

Repair and other remedies may be available in othercircumstances

Allows claims in the event that the applicable product fails tooperate properly due to an Eligible Fault, subject at all times tothe terms and conditions ofYourHarveyNormanProduct Care.

If an applicable product suffers an Eligible Fault, then it will bereplaced with a brand new product with similar specifications. Ifa suitable replacement cannot be found,wewill offer you a storecredit or cash settlement.

Freight Ifaproductsuffersfromafault, theActallowsreimbursementof the cost to send it for an assessment and to send areplacement to you.

If Your Product suffers from an Eligible Fault, we will cover thecost of the freight to send it for an assessment and for sendinga replacement to you.

Consequentialloss

Allows damages for any loss or damage to the consumerresulting from the failure (other than a reduction in value)which was reasonably foreseeable as liable to result fromthe failure.

Also allows reimbursement for reasonable costs incurred inhaving failure remediedwhere supplier has failed to remedywithin a reasonable time.

Your claim under the Act can be greater than the originalpurchaseprice.

If Your Product suffers from an Eligible Fault,Wewill provideYouwith unlimited cover for damages for any loss or damage as aresult of that Eligible Fault.

For example if Your Product is a fridge or freezer,Wewill provideYou with unlimited cover for any food spoilage that occurs as aresult of an Eligible Fault.

IfYourProduct is awashingmachineordryer,Wewill provideYouwith unlimited cover for any laundry and/or drying services thatYou require as a result of an Eligible Fault.

GENERALPlease ensure that You keep a copy of Your HarveyNorman Product Care and Your Original Documents ina safe place. Your Original Documents constitute proofof purchase of Your Product and in the event of a claimunder Your Harvey Norman Product Care, the OriginalDocuments may need to be produced.

If you have purchased more than one product on thesame purchase receipt, then Your Harvey Norman ProductCare will only cover those products specifically describedon Your Original Documents as being covered.

The Original Documents attached to Your Harvey NormanProduct Care form part of Your Harvey Norman ProductCare between us. The Original Purchase Price and OriginalDate of Purchase are set out on the Original Documents.

The protection provided to You under Your HarveyNorman Product Care is subject at all times to YourHarvey Norman Product Care. All defined terms underYour Harvey Norman Product Care have the meaningcontained in the ‘Definitions’ section.

TERMThe Term of Your Harvey Norman Product Care dependson the type of product and level of cover purchased andwill be clearly stated on the Original Documents. In allcases, protection under Harvey Norman Product Care islimited to 7 years from the Original Date of Purchase andis effective from the date of expiry of the manufacturer’swarranty of Your Product (if any).

Any claim under Your Harvey Norman Product Care mustbe made during the Claim Period.

Your Harvey Norman Product Care ends either on theexpiry of theTerm or whenYour Product is replaced (eitherunder Your Harvey Norman Protection Care or under Yourrights under New Zealand law). On replacement of YourProduct (whether under Harvey Norman Protection Careor under New Zealand law), Your Harvey Norman ProductCare will not transfer to Your replacement product andwill automatically terminate.

REPLACEMENT OF YOUR PRODUCTYour Harvey Norman Product Care givesYou a benefit overand above Your rights under the Act in the circumstancesbelow.

If during the Term, Your Product fails to operate as a resultof:(a) an Eligible Fault in Your Product; or

(b) Normal Wear and Tear; or(c) dust, internal overheating, internal humidity or

condensation,and provided that such failure is not as a result ofan Eligible Fault Exclusion, if You make a claim forreplacement of Your Product during the Claim Periodin respect of Your Product then We will replace YourProduct, in accordance with the Replacement Terms ofYour Harvey Norman Product Care.

Eligible Fault, Normal Wear and Tear, Term, Eligible FaultExclusion and Claim Period are defined terms in the“Definitions”section of Your Harvey Norman Product Care.

EXCLUSIONS UNDER YOUR HARVEYNORMAN PRODUCT CAREThe following items are excluded under Your HarveyNorman Product Care:(a) We have no liability or responsibility to You in

respect of any Eligible Fault Exclusion.(b) Your Harvey Norman Product Care is not intended to

provide You with any right or entitlement in respectof any Eligible Fault Exclusion or Accessories whichare part of, or used in conjunction with Your Product.

(c) Apart from as set out in Your Harvey NormanProduct Care, we have no liability or responsibility toYou for indirect or consequential loss, including butnot limited to, loss of profits.

(d) We have no liability or responsibility for costsincurred in respect toYour Product if Our assessmentdetermines Your Product does not have an EligibleFault.

REPLACEMENT TERMSUnder Your Harvey Norman Product Care if Your Productsuffers an Eligible Fault, then We will replace it with anew product, or a like for like product that is the nearestequivalent to Your Product once only during the Term.When We replace Your Product under Your HarveyNorman Product Care, We will take into account features,quality and specifications of the original item as well asavailability of the technology. The choice of replacementproduct is always at Our discretion and Our decision isfinal.

Where the failure of Your Product is isolated to an eligiblecomponent of Your Product, We may choose to replacethat eligible component rather than replace the whole ofYour Product. This choice is always at Our discretion andOur decision is final.

The value of the replacement product shall not exceedthe Original Purchase Price You paid for Your Product. Due

to changes in product technology and availability, thereplacement product We supply under Your HarveyNorman Product Care may have a lower selling price andmay not be the original manufacturer or brand of YourProduct. Replacement price differences, if any, will not berefunded.

Under Your Harvey Norman Product Care, if We cannotoffer You a suitable replacement, We may give You astore credit or cash settlement. The value of any storecredit or cash settlement that We give You under YourHarvey Norman Product Care will not exceed the OriginalPurchase Price of Your Product. The decision to replace,offer a store credit or cash settlement under Your HarveyNorman Product Care is always at Our sole discretion andOur decision is final.

Our obligations under Your Harvey Norman Product Careare limited to Your Product and do not extend to anyreplacement product which we provide you with. Foravoidance of doubt if:1. Your Product suffers an Eligible Fault and is replaced

under Your Harvey Norman Product Care; or2. Your Product is replaced under Your rights under

law; or3. Your Product suffers an Eligible Fault, a suitable

replacement cannot not found and You accept astore credit or a cash settlement under Your HarveyNorman Product Care,

then:(a) Your acceptance of any such settlement set out

above shall constitute fulfilment and discharge ofOur obligations under Your Harvey Norman ProductCare;

(b) Wewill owe no further obligations toYou underYourHarvey Norman Product Care; and

(c) Your Product will become Our property thereafter.

FREIGHTIn order to assess whether Your Product has an EligibleFault, Your Product will be sent to Our service agent forassessment. We will cover any freight costs associatedwith the assessment or replacement of Your Product (ifrequired) including redelivery costs. If Your Product isassessed and no Eligible Fault is found, We may chargeYou, andYoumust reimburse Us, for freight costs incurredbyUs and associatedwith the assessment ofYour Product.

DATA STORAGEIf Your Product is capable of storing User Generated Data,it is possible that Your data may be lost during the claimprocess. While due care and skill will be used to preservedata, We are not liable for any loss or corruption of YourUser Generated Data.We recommend thatYou back up alldata before Your Product is assessed.

FOOD SPOILAGEIf Your Product is a fridge or freezer, We will provideyou with unlimited cover for any food spoilage that has

occurred as a result of an Eligible Fault.

Wewill, on receipt of credible supporting documentation,reimburse You for any food spoilage losses incurred as aresult of such a failure. Youmust supply sufficient proof ofYour losses in a form and manner acceptable to Us. Ourdecision to reimburse is always at Our sole discretion andany decision is final.

LAUNDRYIf Your Product is a washing machine or dryer, We willprovideYouwith unlimited cover for any laundry cleaningand/or drying services that you require as a result of anEligible Fault.

Wewill, on receipt of credible supporting documentation,reimburse You for any laundry cleaning and/or dryingservice costs incurred as a result of such a failure. Youmust supply sufficient proof of Your losses in a form andmanner acceptable to Us. Our decision to reimburse isalways at Our sole discretion and any decision is final.

INTERNATIONAL COVERYour Product is covered by Your Harvey Norman ProductCare when You are overseas. If you need to make a claimunder Your Harvey Norman Product Care You mustcontact our customer service centre and provide us withdetails of Your Product and the fault. In order to assesswhether Your Product has an Eligible Fault, Your Productmust be sent to Our closest practicable service agent forassessment. We will cover any freight costs associatedwith the assessment or replacement of Your Product (ifrequired) including delivery. You must initially pay for thecost of the freight and subsequently claim the cost fromUs. You must provide us with an itemised invoice for anyfreight costs. If Your Product is assessed and no EligibleFault is found, We may charge You additional, and/or Wewill not reimburse You for, freight costs incurred by Youand associated with the assessment of Your Product.

Where Your Product is assessed as having an EligibleFault we will replace Your Product in accordance with ourReplacement Terms as set out in Your Harvey NormanProduct Care.

TRANSFER OF OWNERSHIPYour Harvey Norman Product Care as it applies to YourProduct can be transferred to a third party providedwritten advice of the transfer from You and the thirdparty is given to Our customer service centre before thetransfer. Please provide a copy of the Original Documentsto the third party on transfer. Please call Our customerservice centre on 0800 848 444, during Our operatinghours as set out in Your Harvey Norman Product Care, ormail Your notice to the address provided in Your HarveyNorman Product Care.

If you do not transfer Your Harvey Norman Product Careto a third party in accordance with Your Harvey Norman

Product Care, then Your Product may not be covered.Coverage in this instance is at Our sole discretion.

TECHNICAL SUPPORTYour Harvey Norman Product Care comes with technicalsupport for YourWhitegoods or Audio Visual Product.

During the Term, We will provide You with technicalassistance for Your Product during the hours of Mondayto Friday 9:00am to 5:00pm EST.

You can access this assistance by calling 0800 848444 or You can submit Your inquiry by visiting www.productcareclaims.co.nz

We will outsource the technical assistance service tosuitably qualified agent technicians according to thenature of Your Product. The assistance You receive willbe based on the latest technical knowledge availableto Our agents at the time of Your enquiry. The technicalassistance available is limited to advice to You, and willnot include any other work or testing.

PRICE GUARANTEEYour Harvey Norman Product Care Replacement Plancomes with a price guarantee.

Following the purchase of Your Product with Your HarveyNorman Product Care, if Your Product is advertised byHarvey Norman at a lower price within 30 days of theOriginal Date of Purchase then You are entitled to returnto the Harvey Norman store from which You purchasedYour Product with Your Original Documents and We willrefund you the difference between the Original PurchasePrice and the lower advertised price.

This price guarantee applies to any cheaper advertisedprice found in a Harvey Norman New Zealand store, onHarvey Norman’s New Zealandwebsite or published in anadvertisement. It applies where the final price, inclusiveof delivery, taxes, fees and charges, is lower than theOriginal Purchase Price. The price guarantee excludestrade quotes, limited quantity offers, stock liquidations,commercial quantities, online only offers, where the lowerprice is due to the product being combined with anotherproduct or due to participation in a loyalty scheme.

Definitions in Your Product Care

Accessories includes, but is not limited toheadphones, microphones, cords, cables, chargers,external batteries, memory cards, ancillary gamecontrollers, blades, remote controls, line, filters and sparkplugs.

The Act means the Consumer Guarantees Act 1993(NZ) as amended from time to time.

Claim Period means the Term plus 14 days.

Eligible Fault: means, a failure of Your Product tooperate and:

(i) which is not caused by an Eligible Fault Exclusion;and

(ii) which is not merely superficial or cosmetic, to bedetermined in Our sole discretion.

Eligible Fault Exclusion: means, in respect of YourProduct a fault or failure which is caused by:

(i) the installation, uninstalling, dismantling, or re-installation of Your Product by any person otherthan Us;

(ii) acts, omissions or damage that occurs duringtransportation, installation, uninstalling, dismantlingor re-installation of Your Product, where the damageis not caused by Us;

(iii) accident, misuse or abuse of Your Product;(iv) negligent acts or omissions of any person other than

Us, accidental or deliberate misuse, or unauthorisedalterations of or to Your Product;

(v) liquid penetration;(vi) infestations of vermin, pests or insects;(vii) use of Your Product for a predominantly commercial

purpose (rather than domestic) without expressauthorisation from Us;

(viii) rust, corrosion or mould;(ix) use of Your Product outside of manufacturer’s

operation and care instructions. You must ensurethat you read the manufacturer’s operational andcare instructions prior to using Your Product andmaintain any servicing on Your Product that may bedescribed within the manufacturer’s instructions;

(x) failure or consumption of consumables used withYour Product, including, but is not limited to,batteries, fridge seals, cables, cords, fuses and bulbs;or

(xi) failure of any Accessory used in conjunction withYour Product.

Normal Wear and Tear means a failure of YourProduct to operate as intended due to a defect causedthrough the normal usage of Your Product, that is notcaused as a result of an Eligible Fault Exclusion. Examplesof this include, but are not limited to, faulty hinges, wornout seals or belts.

Original Documents: means Your original purchasereceipt and/or tax invoice issued by the Retailer whichsold Your Product to You.

Original Date of Purchase: means the date ofpurchase of Your Product as shown on Your OriginalDocuments.

Original Purchase Price:means the amount shownon the Original Documents as the purchase price of YourProduct.

Term: means the term of Your Harvey Norman ProductCare as set out on the Original Documents, commencingon the expiry of Your Product’s manufacturer’s warranty(if any) and terminating in accordance with Your HarveyNorman Product Care. At all times, the Term is limited to 7years from the Original Date of Purchase.

User Generated Data, Your Data: All datagenerated by You and stored on or in Your Product. Forexample, songs, photos, telephone numbers, electronicdocuments and computer programs.

You, Yourself: means the person/s or business namedas the purchaser on the Original Documents in respect ofYour Product.

Your Product: means the product that You purchasedwith Your Harvey Norman Product Care, as described inthe Original Documents.

Your Product Care and Your Harvey NormanProduct Care means the Harvey Norman ProductCare Plan that You have purchased with Your Product.

We, Us, Our, Retailer: refers to the selling Retaileror an authorised agent of the selling Retailer whose nameappears on the Original Documents as the supplier.

Any term or expression used in Your Harvey NormanProduct Care which has a defined meaning in the Actshall have the same meaning in Your Harvey NormanProduct Care as is ascribed to that term or expression inthe Act.
