ELIGIBILTY CRITERIA

1. The contractor should have completed during the last five years: (a) One similar completed work costing not less than amount equivalent to 80% of the

estimated cost. OR

(b) Two similar completed work costing not less than amount equivalent to 60% of the estimated cost.

OR (c) Three similar completed work costing not less than amount equivalent to 40% of the

estimated cost.

fields, PF, ESI details etc. should be attached with the Technical Bid. `Document in support of

ESI, EPF deductions should be attached with the Technical Bid. Details of health and safety

measures, the re-tenderer provide to his workers should also be attached with the technical

bid.

SCOPE OF WORK

1. Day to day operation 24x7 for 365 days & routine maintenance and to follow daily checks. 2. Provide professional, skilled & semi- skilled manpower for all the installed equipments

operation. 3. Preparation & Dosing Chemical Solutions of required concentration and quantity 4. Collection, removal and disposal of sludge. Maintain the MLSS level in Bio reactor. 5. General cleaning and house-keeping.

6. Operation of all electrical & mechanical machinery including electrical panels. 7. Clean / Preventive / minor the air filters on Air Blowers regularly. Change ate air Filters

periodically.

8. Preventive/minor maintenance of pumps, blowers, Motors and

Other equipments.

II) Instructions to Re-tenderers

1. The Re-tenderer are required to submit separate quotations for Part ‘A’ or Part ‘B’ or for both

the parts. Bids for Part ‘A’ and ‘B’ should be kept in separate envelopes. The envelope

containing the Technical Bid (including EMD & Re-tender Fee) should be superscripted as

“Technical Bid for PROVIDING COMPREHENSIVE OPERATION AND MAINTANENCE of STP and

ETP SERVICES. TO ESIC MEDICAL COLLEGE AND HOSPITAL,SANATHNAGAR HYDERABAD-

500038” and the Financial Bids (Annexures “E”, “F” & “G”) should be kept in a separate sealed

envelope and superscripted as “Financial Bid for “PROVIDING COMPREHENSIVE OPERATION

AND MAINTANENCE OF STP and ETP SERVICES. TO ESIC MEDICAL COLLEGE AND

HOSPITAL,SANATHNAGAR HYDERABAD-500038. Both the sealed envelopes should be put in a

third sealed envelope as “Re-tender for Operation and Maintenance of STP and ETP”

addressed to the Dean/Medical Superintendent(PMD Branch),ESIC MEDICAL COLLEGE

ANDHOSPITAL,SANATHNAGAR,HYDERABAD-50003

The declaration in the prescribed proforma (Annexure A) enclosed should be submitted along with the Technical Bid. 2. The Technical Bid should be accompanied by an Earnest Money Deposit (EMD) mentioned on Page No. 2 in the form of Demand Draft/Bankers Cheque drawn in favour of “ESIC Fund A/c No.1” payable at Hyderabad. It should remain valid for a period of 03 (Three) months from the last date of submission of the Re-tender. In the absence of EMD, the re-tender shall be rejected summarily. The earnest money shall be refunded to the unsuccessful Re-tenderers after finalization of the contract. It shall be refunded to successful Re-tenderer on the receipt of performance security deposit which will be 10% of the value of the contract. 3. All entries in the re-tender form should be legible and filled in clearly. Any overwriting or cutting which is unavoidable shall be signed by the authorized signatory.

4. The bid shall be valid for 120 (One Hundred Twenty) days from the date of opening. 5. The Re-tenderer can quote for one or more or all the services. However, Bidder cannot submit multiple bids for the Re-tender. 6. Re-tender incomplete in any form will be rejected outright. Conditional Re-tenders will be rejected outright. 7. No Re-tenderer will be allowed to withdraw after submission of the re-tenders within the bid Validity period otherwise the EMD submitted by the re-tendering firm would stand forfeited. 9. In case the successful Re-tenderer declines to take up the contract, for whatsoever reason(s), his EMD will be forfeited. 10. The successful Re-tenderer will have to deposit a Performance Security of 10% of the value of contract awarded by way of Demand Draft / Fixed Deposit Receipt (FDR) / from a nationalized bank and hypothecated in favour of ’’ ESIC Fund A/c No.1’’with a validity of

60 days beyond completion of work / contract and further renewable.

11. The successful Re-tenderer will have to deposit the Performance Security Deposit and commence the work within 15 days of acceptance of re-tender. Otherwise the contract will be cancelled and EMD will be forfeited. 12. Each page of the Re-tender document i.e., Technical and Financial bid should be signed and stamped by the Re-tenderer or an Authorized representative of Re-tenderer in acceptance of the terms and conditions laid down by ESIC. The financial bid and technical bid received without the signature of authorized person will not be entertained and will be rejected. 13. The competent authority reserves the right to accept/reject any or all re-tender in whole or in part without assigning any reason thereof.

14. For finalization of contract, the Re-tenderer whose rates are reasonable / economical in the

Financial Bid are the lowest in comparison to other re-tenderers will be considered as the Lowest Re-

tenderer. 15. The agency or the Re-tenderer should ensure timely payment of all statutory dues like ESI, EPF

etc. and ensure compensation as per payment of wages Act, Minimum wages Act, etc. This office is a

statutory body under Central Govt. and all central labour laws are applicable. 16. Payment of wages to the workers shall be made only through Bank/ ECS and copy of the same

should be submitted for scrutiny of ESIC after payment on every month. 17. Subletting of the contract is not permissible without prior consent. 18. Amendment of Bidding Documents:

(i) At any time prior to the bid due date, ESIC may, for any reason, whether at its own initiative or in response to a clarification requested by a prospective bidder may modify the bidding document. (ii) The amendment will be notified in writing by fax or email to all the prospective bidders, at the address, fax numbers, email ID provided by the bidder, who

have received the bidding documents and will be binding on them. (iii) To afford prospective bidders, reasonable time to follow with the amendment in

preparing their bid, ESIC may at its discretion, extend the bid due date, if needed. 19. The contractors shall visit the site to acquaint himself/ themselves with the site working

condition in detail prior to re-tendering and no claim will be entertained on the ground of ignorance

or otherwise of the conditions under which the work shall have to be executed.

20. The Contractor/s shall ensure all precautionary measures for safety of Personnel engaged.

Instructions on safety code shall be strictly followed.

21. Contractor/s will be solely responsible for any accidents to the personnel engaged by them 22. Only trained supervisor/Operators who are experienced in the respective field should be

positioned. 23. Re-tenders of those re-tenderers who fulfill the eligible criteria are only be considered for

opening the price bid. The incomplete/ Invalid Re-tenders are liable for rejection and no

correspondence will be entertained in case of rejection if necessary documents are not furnished. 24. The Re-tenderer are needed to consider while quoting their rates, all factors including any

fluctuations in the Market rates etc., No claim will be entertained on this account after acceptance of

the re-tender or during the currency of the contract.

25. The Successful Contractor shall submit the contract agreement on a non-judicial stamp paper of

Rs 100/- in a prescribed form duly signed within fifteen days of issue of Acceptance Letter to Medical

Superintendent/Dean. 26. The Contractor shall obtain labour license from Competent Authority within thirty days of issue of

acceptance and submit to the Officer-in-Charge/ Engineer-in- Charge. The cost of obtaining license i.e.

license fee etc., shall be borne by the contractor. However, Contractor shall not start work without

any labour license. 27. The Contractor shall take stock of machines and make immediate assessment for repairing and

servicing of pumps/ motors/ starters as soon as he has taken charge. 28. If any work remains unattended within the stipulated time, the same shall be got done from

other agency at the risk and cost of the successful contractor. Any expenditure incurred in this

connection will be recovered from the bills of contractor 29. The Contractors should supervise the working of the personnel provided by him. The rate Quoted include element of supervision etc., and no extra claim on this account whatsoever will be

entertained later. 30. All activities shall be carried out under the general direction and guidance of the any officer so authorized by Medical Superintendent/Dean. 31. The Contractor shall maintain proper record / register as required under the Contract Labour (Regulation and Abolition) Act 1970 and Rules and other relevant enactment’s thereon. The records / registers shall be produced for verification / inspection as and when required by Department / Central and State Government agencies. ESIC shall have powers to conduct checks regarding payments of wages, ESI, EPF etc., as considered necessary. The

contractor shall get his ESI records verified once in six months from ESI inspector and submit the

report.

32. The contractor shall comply with all the requirement of labour laws. 33. The contractor’s monthly bills should be supported with muster rolls / attendance along with

salary certificates, wage sheets of all the workers and staffs deployed. The Engineer-in-Charge shall

also render certificate regarding satisfactory completion of work every month. 34. The decision of the Officer-in-Charge is final about the satisfactory performance of the contract

and any matter arising there from is binding on the contractor. 35. The ESIC shall recover at source, Income Tax on the gross bill value, payable per month to the

contractor at the rate prescribed and remit the same to the concerned authorities. 36. Any amount due or recoverable from the contractor under this contract or any other contract

shall be recoverable, from the contractor as a debit payable by the contractor. 9 Contractor Signature and Seal

37. It shall be the sole responsibility of the contractor to settle dispute if any, arising out of the engagement between himself and the personnel engaged by him and the management of ESIC shall not in any way be responsible in the event, the personnel approach to the competent

authority, under the Act of the court . The entire expenses in this behalf shall be borne by the

contractor.

38. Pay slips showing the details of total wages, deductions and net wages paid shall be given to

each contract labour, each month along with the wages and wages shall be disbursed on or before

7th of every month without waiting for clearance of bills by ESIC. 39. All disputes arising out of or in any way connected with the agreement shall be deemed to have

arisen at Hyderabad and any court in Hyderabad shall have jurisdiction to determine the same. 40. Rates quoted shall be firm or fixed and are inclusive of cost of man power, materials, tools and

plants etc., all taxes (including service tax) duties, levies and insurance etc., no escalation of

whatsoever nature shall be payable. 41. Pre Bid Meeting and Clarification of Bids: A Pre Bid meeting will be organized by ESIC Medical

College and Hospital, Sanathnagar,Hyderabad on 10:30AM 15.03.2019 Bidders may seek any

clarifications from ESIC Medical College and Hospital, Sanathnagar,Hyderabad 42. During evaluation of bids ESIC MCH, SNR, at its discretion ask the bidder (s) for clarification of their bid. The request for clarification and the response shall be in writing and

no change in prices or substance of the bid shall be sought, offered or permitted.

43. The re-tenders should have Registered / Branch Office in Hyderabad

(iii) Terms & Conditions : - 1. The Plant should run as per the relevant rules/guidelines/ instructions issued by

TSPCB. 2. Any Log book, Register pertaining to operation of STP and ETP should be maintained as per

TSPCB. guidelines/requirement. 3. Service should be offered round the clock, 365 days in one calendar year. 4. Contractor should provide all Tools & Tackles as required for proper functioning of STP and

ETP.

5. Contractor Should Provide uniform, Shoe, gloves, Helmet and all PPEs

6. Arrangement for field testing of water i.e. Hardness, PH, Turbidity, Color should be always available for that testing kit and instrument to be provided by contractor.

7. The contractor should provide a Preventive Maintenance service periodically i.e. once in 15 days through offering a visit by a Environmental Engineer/Chemist (Master Degree in Environmental Science) to ensure the overall health of plant ,the report to be submitted to engineer-in-charge.

8. All disciplinary rules and regulations as enforced are to be followed by the work force of the

Contractor during their stay at the premises. Uniforms and safety kits etc. have to be provided to the staff by the successful firm/ contractor/agency.

9. All the materials, spare parts, consumable such as oil, grease etc. will be arranged by successful firm/ contractor/agency.

10. The instruction/s given to the Contractor from time to time should be properly carried out and necessary records of action taken should be maintained in a Log Book.

10. Any damages caused by the Contractor in existing facilities while carrying out the work shall be made good by the contractor to ESIC entire satisfaction at their own risk and cost.

11. The contractor should fulfill all statutory requirements pertaining to satisfactory performance of the job etc.

12. The firm/ agency/ contractor shall fulfill the requirement of various law enforcing agencies / local authorities, such as Pollution Control Board, Directorate of Electricity Safety, fire etc., by taking their approvals as needed.

13. In case any of staff is not found up to mark and not able to do work properly, he will have to be changed as per the instruction of ESIC.

14. No advance payment will be made to the Contractor. Monthly payment/s will be released after submission of bill after 30 days (one month) and satisfactory completion of job, which is to be certified by the Engineer In- charge.

15. Service provider must provide one (01) year comprehensive on-site warranty for all the items which shall be replaced and it will be started from the date of the satisfactory installation the item against any defect, workmanship and poor quality. The replaced component/s will be handed over to ESIC Engineer in-charge or its representative.

16. All the contractor’s employees posted and working in ESIC premises for the above-mentioned work should be covered under ESIC making statutory contribution under ESIC Act as per Govt. laws.

17. The Contractor at all times should indemnify ESIC against all claims, damages or compensation under the provisions of Payment of Wages Act, 1936; Minimum Wages Act, 1948; Employer’s

Liability Act, 1938; the Workman Compensation Act, 1923; Industrial Disputes Act, 1947;

Maternity Benefit Act, 1961; or any modification thereof or any other law relating thereto and

rules made there under from time to time. ESIC will not own any responsibility in this regard. 18. The contractor will maintain Attendance Register, Leave Register , Payment of wages /

Statutory dues, Record of weekly off / Compensatory Holiday, Material Stock Registers 19. The contractor shall comply with all existing labour legislations and Acts, Provisions as

applicable, such as Contract Labour Regulation Act, Workmen’s’ Compensation Act, Minimum Wages Act, Payment of Wages Act, Provident Fund Act, ESI Act etc. For any lapse or breach on the part of the contractor in respect of non-compliance of any labour legislation in force during the validity of the contract, the contractor would be fully responsible and would indemnify the Institute, in case the Institute is held liable for the lapse if any, in this regard.

20. Work involves operation and maintenance of Sewage Treatment Plant and Effluent Treatment Plant, filtration Plant, Pump Set, spare and Electric Driven Pump Set etc.

21. The Engineer shall be at liberty to object to and request the Contractor to remove forthwith

from the works any person provided by the Contractor, who in the opinion of the Engineer, misconducts himself, or is incompetent or negligent in the proper performance of his duties, or whose presence on Site is otherwise considered by the Engineer to be undesirable, and such person shall not be again allowed upon the works without the consent of the Engineer. Any person so removed from the Works shall be replaced as soon as possible by a qualified person approved by the Engineer.

22. The Contractor shall, throughout the execution and completion of the works and the remedying of any defects therein: a) Have full regard for the safety of all persons entitled to be upon the site and keep the site (so far as the same in under his control) and the Works (so far as the same are not completed or occupied by the Employer) in an orderly state appropriate to the avoidance of danger to such persons, and b) Take all reasonable steps to protect the environment on and off the site and to avoid damage or nuisance to persons or to property of the public or others resulting from pollution, noise or other causes arising as a consequence of his methods or Repair.

22. During the Comprehensive operation and Maintenance period for loss or damage to property

and life arising from a cause for which contractor is responsible. For loss or damage

occasioned by the Contractor in the course of any Repairs carried out by him for the purpose of complying with his obligations. It shall be responsibility or contractor to notify the

Insurance Company of any change in the nature and extent of the works and to ensure the

adequacy of the insurance cover all times during the period of contract.

23. The Contractor shall, except if and so far as the Contract provides otherwise, indemnify the Employer against all losses and claims in respect of: a) death of or injury to any person, or b) loss or damage to any property (other than the works)

24. The Comprehensive Operation and Maintenance work shall be for a period as mentioned in the letter of commencement and shall start from the date of issue of letter commencement and shall stand terminated after the expiry of one year.

25. The Operation and Maintenance contract may be extended on the written mutual consent of both employer and Contractor for a further period of one year. However, employer reserves its right to terminate the Operation and Maintenance contract by giving 15 days notice at any time during the currency of the contract if the services of the agency are not satisfactory as per the opinion of employer or its representative.

26. In case of default on the part of the Contractor in carrying out defect rectification works, the Employer/Engineer shall be entitled to employ and pay other persons to carry out the same and if such work, in the opinion of the Engineer, the Contractor was liable to do at his own cost under the Contract, then all costs consequent thereon or incidental there to shall be determined by the Engineer and shall be recoverable from the Contractor by the Employer, and may be deducted by the Employer from any amount due or to become due to the Contractor.

27. The re-tenderers are required to visit the plant site to see the actual installations themselves

to assess the quantum of work involved before submitting the re-tender. Once the re-tender is submitted, it will be presumed that the re-tenderer has seen and understood the complete work involved for each of the system.

28. The technical bid shall be opened first. The Price Bid (Envelope No. 2) will be opened only of those re-tenderer whose technical bid is found to be in order and for opening of financial bid they shall be intimated separately about date and time.

29. The re-tenderer who do not submit the re-tender documents as per pre- qualification criteria

and re-tender conditions, have major deviations, do not submit proper EMD and experience

certificates etc. then their re-tender may be treated as non-responsive and their Price Bid

(Envelop No. 2) shall not be opened.

30. The Re-tender for the work shall remain open for acceptance for period of 120 days from date opening of Re-tender.

The successful firms/ agencies/ contractors will be intimated and contract agreement will be entered

initially for a period of one year which may be extended depending on the performance of the

contractor or till finalization of the next re-tender, whichever is earlier. 30. Subletting - contract shall not be assigned or sublet to another party. 31. The firm shall rectify any breakdown within 24 hours failing which penalty for non-

performance @ 0.5 % per week of delay subject to a maximum of 10% of the contract price

will be imposed and in the event of any damage to the property or life or any machinery and installation in the STP and ETP arising out of non-performance or negligence of the workers, contractor will be solely responsible. The contractor shall be responsible for proper

maintenance of decorum, punctuality, discipline and work out put etc. 32. In case of any repair/other works which is not covered in Annexure F, Contractor will be

paid Actual Material Cost .

Details of ETP:

Source of effluent: Lab and Operation Theatre The plant has been designed to treat 50 cum/day ETP process description: The effluent from the lab and OT section enters the ETP through a bar

screen chamber where coarse particles like paper and thrash are removed. The effluent is collected into equalization tank. The equalization tank is provided at the bottom with air grid to keep the contents in complete mix condition. Lime is added to the contents of the equalization tank. The contents from the equalization tank are provided with the pumping station to pump the effluent at a uniform rate to further process. The effluent from the equalization tank is pumped to a Flash Mixer Where coagulant is added to the the Flash mixer to break the effluent. The overflow from the Flash mixer is taken to a lamella separator with tube settler media. Sludge is allowed to settle at the bottom and the supernatant is send to intermediate collection tank from there it is transferred to STP.

1. Details of Manpower and their Qualification :

a. Operator / Technician (Skilled) -04 Persons (one person in each shift of 8 hours and one

reliever)

b. Qualification for Technicians (Skilled): - Minimum 3 years’ experience in handling STP & ETP

plant operational and maintenance work. With ITI / ITC Certificate [B.Sc / HSC (Science) will be

given preference]. Certificate of experience in similar plants of minimum capacity of 500KLD is

essential.

c. Attendance will be marked on day-to-day basis and recovery will be done per person per day

2. DUTIES AND OBLIGATIONS 1. Duties of Operators & Staff Employed:

The Contractor should submit the names of the persons engaged for the work and they have to

report to the Engineer-In-Charge on day-to-day basis. Persons employed should not be changed

frequently.In case of change the same will be intimated to the employer.

Operation and the maintenance of STP and ETP system comprising of various pumps, motors,

blowers, pipelines, setting tanks, filter unit, etc. together with the electrical panels and connections.

The Contractor has to keep the area of plant neat and clean.

2. Repairs: a. The contractor has to do all minor repair work which are repairable at site by the Operator/

Technician on duty immediately, for which no additional labour charge will be paid.

b. Except above if there are any other repair work which are not possible to be repaired at site

by the Operator/Technician on duty, that should brought to notice of ESIC Engineer immediately and

same should be repaired from outside by original manufacturer/ manufacturer Authorized dealer.

The expenditure will be paid on submission of original bill.

c. For any spares/materials replacement actual charges will be paid as per the bills from the

Original manufacturer/Manufacturer authorized dealers after ascertaining the rates on submission of

original bills (except damage caused to any machinery/plant due to negligence of contractor), and

such materials to be checked-in by Engineer-in-Charge as evidence being materials brought in.

Under no circumstances plant should remain under breakdown for more than 03 hours. In the event

of breakdown/shut down the onus of attending to the problem in the shortest possible time will rest

on the Contractor failing which ESIC is empowered to get the breakdown/shut down any defect

rectified from any outside agency at the risk and cost of the Contractor and make necessary deductions from their bills. The Contractor has to keep all the area and surroundings at the site neat

and clean and dump the scrapped materials at the scrap yard.

It will be Contractor’s responsibility to maintain STP and ETP, Plant in healthy state all the time, to

plan and undertake preventive maintenance of STP at regular intervals and attend routine

maintenance activity every day. Contractor should make a service report for all the maintenance jobs

carried out and get it counter signed by the Engineer-in-charge. The Hospital will provide the

necessary registers.

Contractor has to carry out testing of water at the regular interval of every month and whenever felt

necessary as instructed to do so by the Hospital and furnish the test reports to the Engineer-In-charge

on priority. The Contractor will also give a Tests Certificate every month of effluent water before and

after treatment and certificate must be obtained from the Telangana State Pollution Control Board

authorized laboratories, For B.O.D, C.O.D, PH, TSS, and O&G etc. contractor should keep logbook, on site test reports etc. up to date as per IS.

It will be the responsibility of Contractor to remove excess sludge from sludge holding tank. In

addition, Contractor shall also carryout cleaning of Grease/Sludge holding Tanks periodically, and

disposal of grease / sludge outside the premises on own cost.

Operating of the pumps erected inside the pump house for water supply and constructed beside the septic tanks, taking care to check the levels of a) Water in the UG sump. b) Sewage in the tank and maintaining of the pumps and clearing any chokes / blocks in the conveyance lines lying throughout the internal roads. 19 Contractor Signature and Seal

Motors & Pumps

· Cleaning and tightening of all screw connections and terminals on controllers. · Examining of fuse contacts and terminals for cleanliness and tightness. · Checking the pump immediately after starting the motor, to see if the pump is generating the rated head, by reading the pressure gauge. · Checking for any undue vibration of stuffing boxes. · Checking of glands for overheating and leakage. Gland packing around the pump set is adjusted to

permit only a slight leakage of droplets of water to cool and lubricate the shaft.

· Checking if the voltage fluctuation is within the permissible limit of 420-440 V. · Checking of current rating and actual loading of motor to prevent overloading, by frequently monitoring the ammeter reading. · Ensuring that the water level in the water source does not drop more than 1 meter above foot

valve and water at the receiving end is not wasted by overflow.

Checking the bearings of the pump periodically and applying grease sufficiently. · Checking the gland packing once in two months. · Checking the valves and pressure gauges and tightening the gland at closer intervals when too much leak of water occurs. · Checking the exhaust pump, its auxiliaries and impeller periodically. · Operating of submersible pump once a week, and its maintenance.

Other Duties

Daily entries will be recorded in the logbook as per requirement and get verified by the Engineer-in-

charge.

Any complaint noticed shall be reported to Engineer-in-charge.

The Contractor shall supervise and maintain the Sewage Treatment Plant maintenance work every

day and maintain a logbook as per guidelines of the Operation Manual. Security deposit of 10% of the

total value of the contract to be submitted in the form of Demand Draft which will be free of interest

and the same will be refunded to Contractor only after the satisfactory completion of the Contract

and defect liability period of one year whichever is earlier.

The short listed contractor will submit a monthly maintenance schedule of all equipment’s for

approval before commencing operating of the system. Sump Pump required to be maintained by the

Contractor installed in the Effluent Treatment Plant.

3. Liquidated Damages:

a) A penalty of Rs.1000/- per month will be deducted from the bill for the months when test Certificate from approved Lab is not submitted.

b) A penalty of Rs.300/- per day will be deducted from the bill for each day the skilled helper is not provided.

c) A penalty of Rs.600/- per 8 hours shift will be deducted from the bill for each 8-hour shift

when the Skilled Technician/ operator is not provided. 4. Contractor’s Employees

(a) The Contractor shall provide on the Site qualified and experienced technical staff in

connection with the Repair and Maintenance of the works and the remedying of any defects

therein. The persons deployed by the Contractor should be properly trained, have requisite,

experience and skills for carrying out a wide variety of running, operation and maintenance

with the required materials and tools/ equipments.

(b) The Contractor must employ adult and skilled labour only. Employment of child labour will

lead to termination of the contract. The Contractor shall engage only such workers, whose

antecedents have been thoroughly verified, including character and police verification and

other formalities. The Contractor shall be fully responsible for the conduct of his staff. 21 Contractor Signature and Seal

(c) The Contractor should ensure Health and safety of the workers. ESIC may also conduct

health check of the staff deployed at regular intervals.

(d) The Contractor must provide standard liveries to its staff. The staff shall be in proper

uniform with their identity properly displayed. Samples of liveries will have to be submitted by

the Contractor for approval of ESIC.

(e)The re-tenderer should deploy planned number of personnel in all the shifts, covering first

second and third shifts or other shifts or on holidays/Sundays, etc., as may be coordinated by

the Officer-in-Charge. State / Central Government Holiday pattern for National Festival

holidays will be followed.

(f). The qualification of personnel deployed is subject to verification by ESIC and in the event

that they do not possess the prescribed qualification such personnel(s) shall be replaced by

the contractor next day. Failure to replace in time leading to work being affected will lead to

ESIC resorting to risk purchase at your risk and cost.

(g). Any replacement (s) should have the prior approval.

(h) The personnel deputed by contractor would be medically fit and the Contractor shall

certify the same to ESIC.

(i). The workers and the agencies are prohibited from going on strikes due to whatsoever

reason and stopping of work and going on strike will attract penalty clause notified elsewhere

in the re-tender document.

(j) Full list of employees, viz, name, age, employee code, designation, experience in the

relevant field, PF, ESI details should be submitted before commencing of work. Document in

support of ESI, EPF detections, health and safety measures should be attached.

(k) All the contractor’s supervisors should report to Engineer-in-Charge (AE & JE) for taking

instruction and monitoring day to day maintenance work and other civil work on daily basis. 5. Default of Contractor

(a) If the performance of the contractor is not satisfactory and not corrected within 15 days

of receiving notice, then employer shall be at liberty to terminate the contract and get the

work executed through other means at the risk and cost of the Contractor.

(b) In the event of termination of the contract, the employer shall be at liberty to get balance

work done at the risk and cost the contractor and due payment of the contractor, if any shall

be released after the completion of whole of the works.

6. Arbitration. Any dispute and differences relating to the meaning of the specifications, as to the quality of workmanship of materials used in the work or as to any other question, claim, right, otherwise concerning the works or the execution or failure to execute the same whether arising during the progress of the work or after the completion or abandonment thereof in respect of which :- Amicable settlement has not been reached.

Shall be referred to the Sole Arbitration of the MS/Dean, ESIC who shall proceed as per the

Arbitration Act, 1996.

(a)The work under the contract shall continue, during the Arbitration proceedings. (b)The award

of the Arbitrator shall be final, conclusive and binding on both the parties

7. Force Majeure: - For purposes of this clause, “Force Majeure” means an event beyond the control of the service

provider and not involving the contractor/service provider’s fault or negligence and not foreseeable.

Such events may include, but are not limited to, acts of the service provider either in its sovereign or

contractual capacity, wars or revolutions fires, floods, epidemics, quarantine restrictions and freight

embargoes.

If a Force Majeure situation arises, the contractor/ service provider shall promptly notify the NIFT in

writing of such conditions and the cause thereof. Unless otherwise directed by the employer in

writing, the service provider shall continue to perform its obligations under the contract as far as is

reasonably practical, and shall seek all reasonable alternative means for performance not prevented

Guidelines to fill up the Log Sheet

1. The Log sheet should be filled up once in every hours

2. Inlet Flow to be measured by bucket method at the outlet of Equalization tank and pressure

to be set at Feed Pump discharge

3. Air Blower changeover to be done once in Shift, Oil level of Blower to be checked and

changed if required.

4. Air blower suction filter to be cleaned once in a week.

5. Under the columns Air to Eq Tank, Air to Bio Reactor mention 'OK' or 'NOT OK' by seeing
