COMPLIANCE REPORT TO THE CONDITIONS LAID IN THE

ENVIRONMENTAL CLEARANCE

PREAMBLE:

EIA follow up commonly referred to as Compliance reporting is the process of monitoring,

evaluation and validation of the outcomes of EIA. It is followed by management and

communication to the stakeholders. EIA Notification, 2006 (S. No. 1533) mandates the project

management to submit the half yearly compliance in respect of the stipulated prior environmental

clearance terms and conditions in hard and soft copies to the regulatory authority concerned, on 1st

June and 1st December of each calendar year (Para 10, sub para (i) of said Notification).

Follow-up is internationally considered essential to determine the outcome of EIA through

evaluating environmental performance of projects (Marshall et al., 2005; Morrison-Saunders et

al., 2007). It is also termed as monitoring and auditing. EIA follow up relates to the construction

as well as operational phase of the project. EIA follow-up is in place until the very end of the

project’s life cycle. It plays an important role in tracking the environmental performance of the

project.

4. Communication:

Communication is the act of informing project stakeholders and the general public about

the results from the EIA follow-up. Again the proponent and the regulator may be involved

in the communication process.

PROJECT INTRODUCTION:

The proposal involves construction of group housing project coming up at village, Dhunela,

Sector-33, Tehsil Sohna, Gurgaon, Haryana. The project is promoted by “Aum Shree Hotels &

Resorts Pvt. Ltd”. Total plot area of the project is 75,838.08 sq. m. and the built up area envisaged

is 1,48,644.68 sq. m. The project has been granted Environmental Clearance by State Environment

Impact Assessment Authority, Haryana vide letter no. SEIAA/HR/2014/870 dated 30th

June 2014.

Copy of environmental Clearance is enclosed as Annexure I.

• To establish the links between pre-project goals and targets and post project achievements.

METHODOLOGY:

1. Monitoring – Collection of Environmental data (one day) post project scenario during

construction phase. The parameters include:

• Ambient Air Monitoring

• Ambient Noise levels at the project boundary

• Ground water analysis

• Soil analysis

conditions were monitored and recorded during site visits.

2. Evaluation – the appraisal of the conformance with standards, predictions or expectations as

well as the environmental performance of the activity.

3. Management – making decisions and taking appropriate action in response to issues arising

from monitoring and evaluation activities.

4. Communication – informing the stakeholders about the results of EIA follow-up in order to

provide feedback on project/plan implementation as well as feedback on EIA processes.

COMPLIANCE OF THE CONDITIONS LAID IN THE ENVIRONMENTAL

CLEARANCE

PART A: SPECIFIC CONDITION

1. CONSTRUCTION PHASE

Safe drinking water: Effective arrangements for

sufficient supply of wholesome drinking water will

be provided at suitable points conveniently situated

for all persons employed.

Toilet Facility: Separate temporary toilets will be

provided for male and female workers at site. The

toilets will be conveniently situated so that they are

accessible to the building workers at all times.

Waste Water Disposal: Waste water generated

during construction phase will be routed to septic

tank followed by soak pit.

5. The project proponent shall ensure that

the building material required during

construction phase is properly stored

within the project area and disposal of

construction waste should not create

any adverse effect on the neighbouring

communities and should be disposed of

after taking necessary precautions for

general safety and health aspects of

people, only in approved sites with the

approval of competent authority.

Building material storage: Building material

required for construction will be properly stored

in designated storage area within the project

premises.

• Wooden blocks will be stored in the shed.

• Steel material will be stored in open

Construction Waste Management :

The construction waste generated during

construction phase will be managed effectively

by the contractors and site engineers. Instructions

will be given to the contractor to dispose-off the

solid waste with prior permission at the

municipality disposal sites only. However, efforts

will be made to reduce the quantity of the waste

generated by proper management of the

construction material and judicious use of the

resources. The management has been given at

point no. 3 above.

6. Construction spoils, including

bituminous material and other

hazardous materials must not be

allowed to contaminate water courses

and the dump sites for such material

must be secured so that they do not

leach in to the ground water and any

hazardous waste generated during

construction phase, should be disposed

off as per applicable rules and norms

with necessary approval of the Haryana

State Pollution Control Board.

7. The diesel generator sets to be used

during construction phase should be of

ultra-low sulphur diesel type and

should conform to Environment

(Protection) Rules prescribed for air

and noise emission standards.

D.G. set conforming to the applicable rules for air

and noise emissions will be deployed at the site.

Low sulphur fuel (sulphur content: 0.05%) will

be used in the DG sets during construction phase.

8. The diesel required for operating DG

Sets shall be stored in underground

tanks and if required, clearance from

Chief Controller of Explosive shall be

taken.

Diesel used for D.G. sets will be stored in plastic

drums. Further, the same will be placed on

impervious base to avoid contamination of soil or

ground water due to spillages.

9. Ambient noise level should conform to

the residential standards both during

day and night. Incremental pollution

loads on the ambient air and noise

quality should be closely monitored

during construction phase. Adequate

measures should be taken to reduce

ambient air and noise level during

construction phase, so as to conform to

the stipulated residential standards of

CPCB/MoEF.

All necessary measures will be adopted to ensure

that air & noise levels conform to residential

standards laid down by CPCB.

The same are listed as under:

• Idling will be avoided to the extent possible.

• Regular sprinkling on haul road to minimize

the fugitive emissions.

• PUC Certified vehicles will be used.

• Enclosure construction will be fully bolted

keeping in view the major service

requirement.

• Provision of protective equipments like ear

muffs to the workers.

10. Fly ash should be used as building

material in the construction as per the

provisions of fly ash notification of

September 1999 and as amended on

27th

August 2003.

Fly ash will be used as building material as

11. Storm water control and its reuse as per

CGWB and BIS standards for various

applications should be ensured.

Storm water control and rain water harvesting

will be done as per the standards laid down by

CGWA & BIS.

12. Water demand during construction

should be reduced by use of pre mixed

concrete, curing agents and other best

practices.

Best construction practices will be adopted to

reduce the water demand for construction

activities:

• Ready mix concrete will be used to the extent

possible, for construction purposes to reduce

the water demand.

• Use of curing water: Spraying of curing water

and after liberal curing, all concrete structures

are covered with gunny bags, followed by

spraying of water.

• Use of polymer dispersion and air entraining

agents to reduce the construction water

demand.

• Admixtures will be used to reduce water

demand during construction.

• Discouraging the washing of vehicles and

equipment on the construction site. Workers

will not be allowed to wash their personal

vehicles on site. Vehicles and equipment that

regularly leave the construction site should be

13. In view of the severe constrains in

water supply augmentation in the

region and sustainability of water

resources, the developer will submit the

NOC from CGWA specifying water

extraction quantities and assurance

from HUDA/ utility provider indicating

source of water supply and quantity of

water with details of intended use of

water – potable and non-potable.

Assurance is required for both

construction and operation stages

separately. It shall be submitted to the

SEIAA and RO, MoEF, Chandigarh

before the start of construction.

Drinking water (Potable): will be met through

tanker water supply of HUDA.

Construction water (Non-potable): The water

demand will be met from STP treated waste water

supply from HUDA (primary & secondary

treated) treated) which will be treated in STP of

capacity 744 KLD (secondary & tertiary

treatment) and then reused for construction

activities.

Related records:

• No Objection Certificate from HUDA,

Gurgaon: Annexure V (a).

• Ground water will not be used for

construction activities.

• During operational phase of the project water

demand will be met through water supply

from HUDA. Ground water will not be used

for the project. Water assurance letter from

HUDA enclosed as Annexure VI.

14. Roof must meet prescriptive

requirement as per energy conservation

building code by using appropriate

thermal insulation material.

Thermal characteristics of the roof assembly shall

be as under:

which will help to reduce exposed area,

thereby, reducing the heat gains inside the

building.

• Energy efficient materials, heat reflecting

terrace surface and roof (by using broken

white china tiles & heat reflecting paint) will

be provided to reduce head gains.

• Broken bricks will be used for roof insulation.

• Roofs will be painted with reflective,

aluminium based paints with solar reflectance

ranging from 0.3-0.6. This will result in less

absorption of sunlight causing 40% back

reflection and less heating of building

structure during summer seasons.

15. Opaque wall must meet prescriptive

requirement as per Energy

Conservation Building Code which is

proposed to be mandatory for all air

conditioned spaces while it is desirable

for non-air conditioned spaces by use

of appropriate thermal insulation

material to fulfil requirement.

Thermal characteristics of the wall assembly shall

be as under:

The wall will be made with fly ash bricks, AAC

blocks, plastered outside and water proofing

paint. Shading devices provided to shade to

windows and external façade. Following

measures will be adopted to reduce the heat

ingress inside the building:

• Recessed windows and Covered balconies to

limit direct heat gains.

• For walls of the building, a maximum of 10%

window to wall ratio will be there to minimize

solar radiation

• There will be less no. of openings on the west

side and more no. of openings in the south

side.

• Use of fly ash based cement having lower U

& R values.

16. The approval from competent authority

shall be obtained for structural safety of

the building on account of earthquake,

adequacy of fire fighting equipments,

etc. as per National Building Code

including protection measures from

lightening etc. If any forest land is

involved in the proposed site, clearance

under Forest Conservation Act shall be

obtained from the competent authority.

Structural Stability:

The entire building will be designed as per the

provisions of National Building Code-2005 for

structural safety of the building against any

possible earthquakes.

Further, Forest Clearance under Forest

Conservation Act is not applicable as there is no

forest land involved in the project. Copy of letter

from Dy. Conservator of Forests, Gurgaon,

Haryana is enclosed as Annexure VII.

17. Overexploited groundwater and

impending severe shortage of water

supply in the region requires the

developer to redraw the water and

energy conservation plan. Developer

shall reduce the overall footprint of the

proposed development. Project

proponent shall incorporate water

efficiency /saving measures as well as

water reuse /recycling within 3 months

and before start of construction to the

SEIAA, Haryana and RO MOEF, GOI,

Chandigarh.

During construction phase water demand will be

met through treated water supply from HUDA.

Water conservation measures (Construction

Phase): has been detailed at point 12 above.

• There will be provision of using polymer dispersion and air entraining agents to reduce the

water demand for construction.

• Provisions to ensure the construction vehicles stick to the access track to prevent mud & dirt

being deposited on roads.

• Fence will be constructed around the site to trap sediments whilst allowing the water to flow

through.

Water conservation measures (Post Construction phase):

• Dual plumbing system will be used for the project to utilize the treated waste water .This will

help in reducing the fresh water.

• Dual flushing fixtures will be used to allow different volumes of water for solid and liquid

flushing which will help in conserving the water demand for flushing significantly.

• Landscape design & management of irrigation systems:

• Drought tolerant species will be selected.

• Turfs will be avoided to the extent possible.

• Central shut off valve will be provided

• Drip irrigation/ sprinkler irrigation system will be used to conserve water

• Water meters will be installed for the following:

• Potable water consumption

• Landscape water consumption

• Hot water consumption through solar systems, at building level

• Treated waste water consumption

Energy Conservation Measures (Construction Phase):

• Efficient work scheduling and methods that minimise equipment idle time and double

handling of material

• Switching off construction equipment when not in use

• Switching off site office equipment and lights and using optimum lighting intensity for

security and safety purposes

• Regular maintenance of equipment to ensure optimum operations and fuel efficiency.

18. The project proponent as stated in the Rain water harvesting (RWH) system for roof

19. The project proponent shall provide for

adequate fire safety measures and

equipments as required by Haryana Fire

Service Act, 2009 and instructions issued

by the local Authority / Directorate of fire

from time to time. Further the project

proponent shall take necessary permission

regarding fire safety scheme/NOC from

competent Authority as required.

The same will be complied with.

Adequate fire safety measure will be

adopted at site:

• All necessary precautions will be taken to

prevent outbreak of fires at the construction

site.

• Proper training will be provided to all the

workers in fire fighting and extinguishing

methods.

• All the combustible materials like timber,

bamboos, coal, paints, etc., will be properly

stored at designated place to avoid

unnecessary fire hazards at site.

• All Safe construction practices &

precautionary measures will be adopted and

use of PPE will be mandatory.

• Adequate fire-fighting arrangements will be

as per National Building Code - 2005 &

conditions laid in fire NOC.

• All applicable IS standards for electricity

20. The project proponent shall obtain

assurance from the DHBVN for supply of

5000 kVA of power supply before the start

of construction. In no case project will be

operational solely on generators without

any power supply from any external power

utility.

during the power cuts & failure only and the

21. Detail calculation of power load and

ultimate power load of the project shall be

submitted to DHBVN under intimation to

SEIAA Haryana before the start of

construction. Provisions shall be made for

electrical infrastructure in the project area.

Detailed calculation of power load will be

assurance letter will be obtained from DHBVN

before the start of construction.

22. The project proponent shall not raise any

construction in the natural land depression

/ Nallah / water course and shall ensure

that the natural flow from the Nallah/

Water course is not obstructed.

The same is noted and no construction will be

raised on the natural land/ nallah or water

course.

23. The project proponent shall keep the plinth

level of the building blocks sufficiently

above the level of the approach road to the

project. Levels of the other areas in the

group housing project shall also be kept

25. The project proponent shall submit an

affidavit with the declaration that ground

water will not be used for construction and

only treated water should be used for

construction.

During construction phase of the project water

demand will be met from treated water from

HUDA. Copy of Certificate in this regards

issued from HUDA, Gurgaon, is enclosed as

Annexure V. The affidavit in this regard was

submitted during the EIA stage. We would like

to assure that ground water will not be used for

construction activities.

26. The project proponent shall not cut any

existing tree and project landscaping plan

should be modified to include those trees

in green area.

27. The project proponent shall provide 3

meter high barricade around the project

area, dust screen for every floor above the

ground, proper sprinkling and covering of

stored material to restrict dust and air

pollution during construction.

measures will be adopted for mitigating dust

pollution during construction phase:

• 3 meter high barricade

Dust screen will be provided for every floor

to minimize the dust emission.

• Water sprinkling

Water sprinkling will be done on haul roads

to minimize dust emission. Water or Dust

suppressants which are more effective than

water will be applied judiciously.

• Covering of stored material

Covering the stockpiles to prevent wind

whipping. Storage pile activity will be

conducted downwind. Unpaved roads will

be properly maintained. Minimizing the haul

roads by construction of semi pucca roads

during construction phase.

28. The project proponent shall construct a

sedimentation basin in the lower level of

the project site to trap pollutants and other

wastes during rains.

29. The project proponent shall provide proper

rasta of proper width and proper strength

for the project before the start of

31. The project proponent shall adequately

control construction dust like silica dust,

non-silica dust and wood dust. Such dusts

shall not spread outside project premises.

Project Proponent shall provide respiratory

protective equipments to all construction

workers.

The same will be complied with. Following

measures will be adopted for mitigating dust

pollution during construction phase:

• Cutting & grinding operations on site will be

conducted using equipment and techniques

that suppress and reduce dust emissions

housing colony including internal roads,

green belt development, sewerage line, rain

water harvesting arrangements, storm

water drainage system, solid waste

management site and provision for

treatment of bio-degradable waste, STP,

water supply line, dual plumbing line,

electric supply lines etc. and shall offer

possession of the units/flats thereafter.

infrastructural facilities will be provided before

operational phase of the project.

• Proper internal roads with adequate width

will be provided.

will result in optimal use of water for

33. The project proponent shall provide one

refuge area till 24 meter, one till 39 meter

and one after 15 meter as per National

Building Code. The project proponent shall

not convert any refuse area in the habitable

space and it should not be sold

out/commercialized.

requirements. There should be no traffic

congestion near the entry and exit points

from the roads adjoining the proposed

project site .Parking should be fully

internalized and no public space should be

used.

Adequate parking will be provided to avoid

traffic congestion near the entry and exit

points. The movement pattern inside the

project area will be guided traffic ways with

one-way traffic movement to avoid traffic

congestion. Fully internalized parking

facilities will be provided at basement, stilt

and open surfaces at well designated parking

places and no public space will be utilized for

the same.

q) The Project shall be operationalized only

when HUDA/local authority will provide

domestic water supply system in the area.

r) Operation and maintenance of STP, solid

waste management and electrical

Infrastructure, pollution control measures

shall be ensured even after the completion of

project.

s) Different type of waste should be disposed

off as per provisions of municipal solid

waste, biomedical waste, hazardous waste,

e-waste, batteries & plastic rules made under

Environment Protection Act, 1986.

Particularly E-waste and battery waste shall

be disposed of as per existing E-waste

management Rules 2011 and Batteries

management Rules 2001.The project

proponent should maintain a collection

center for E-waste and it shall be disposed of

Hazardous waste or bio medical waste will not

be generated from the project. However, the

municipal solid waste generated from the

project will be handled as per the Municipal

Solid Waste (Management & Handling) Rules.

The same is detailed in point number (d)

above. E-Waste and battery waste generated

from the project will be disposed off as per

norms and rules.

KVA shall be as per CPCM latest standards

for high capacity DG sets.

The same will be complied with. DG sets will

be provided with effective stack height as per

the norms of CPCB.

w) All electric supply exceeding 100 amp, 3

phases shall maintain the power factor

between 0.98 lag to 1 at the point of

connection.

The same is noted and will be followed.

x) The project proponent shall not use fresh

water HVAC and DG cooling. Air based

HVAC system should be adopted and only

treated water shall be used by project

proponent for cooling. If it is at all needed.

The same will be complied with. The project

does not envisages the use of HVAC system.

The project proponent shall also use

evaporative for cooling technology and

double stages cooling system for HVAC in

order to reduce water consumption .Further

temperature, relative humidity during

summer and winter seasons should be kept

at optimal level. Variable speed drive, best

Co-efficient of Performance (Cop), as well

as optimal Integrated Point Load value and

minimum outside fresh air supply may be

resorted for conservation of power and

water. Coil type cooling DG sets shall be

used for saving cooling water consumption

for water cooled D.G sets.

y) The project proponent shall ensure that the

transformer is constructed with high quality

grain oriented, low loss silicon steel and

virgin electrolyte grade copper. The project

proponent shall obtain manufacturer’s

certificate also for that.

The content of para (y) is noted and will be

z) The project proponent shall ensure that exit

velocity from the stack should be

sufficiently high. Stack shall be designed in

such a way that there is no stack down-wash

under any meteorological conditions.

suppress the dust in addition to the already

suggested mitigation measures in the Air

Environment Chapter of EMP.

Air Ventilation and light system in the

basements area for comfortable living of

human being and shall ensure that number of

Air changes per hour/(ACH) in basement

never falls below 15.In case of emergency

capacity for increasing ACH to the extent of

30 must be provided by the project

proponent.

ac The project proponent shall ensure drinking

/domestic water supply as per prescribed

standard till treated water supply is made

available by HUDA.

The same will be complied with.

PART B: GENERAL CONDITION

i. The project proponent shall ensure the

commitments made in Form-1, Form-1A,

EIA/EMP and other documents submitted to the

SEIAA for the protection of environment and

proposed environmental safeguards are complied

with in letter and spirit.

The content of para (i) is noted and will

be complied with.

ii. The project proponent shall also submit Six

monthly reports on status of compliance of the

stipulated EC conditions including results of

monitored data (both in hard copies as well as by

e-mail) to the northern Regional office of MoEF,

the respective Zonal Office of CPCB, HSPCB

and SEIAA Haryana.

The same will be noted and complied

iii. STP outlets after stabilization and stack emission

shall be monitored monthly. Other environmental

parameters and green belt shall be monitored on

quarterly basis. After every 3 months, the project

proponent shall conduct environmental audit and

shall take corrective measure, if required, without

delay.

iv. The SEIAA Haryana, reserves the right to add

additional safeguards measures subsequently, if

found necessary. Environmental Clearance

granted will be revoked if it is found that false

information has been given for getting approval

of this project. SEIAA reserves the right to

revoke the clearance if conditions stipulated are

not implemented to the satisfaction of

SEIAA/MoEF.

If any additional safeguards measures

will be given, it will be followed and

complied.

v. The project proponent shall not violate any

judicial orders/ pronouncements issued by the

Hon’ble Supreme Court/High Courts.

We will try to the best possible extent not

to violate any judicial orders/

pronouncements issued by the Hon’ble

Supreme Court/ High Courts.

vi. All other statutory clearances such as the

approvals for storage of diesel from Chief

Controller of Explosive, Fire Department, Civil

Aviation Department, Forest Conservation Act,

1980 and Wildlife (Protection) Act 1972, Forest

Act 1927, PLPA 1900, etc. shall be obtained, as

applicable by project proponents from the

respective authorities prior to construction of the

project.

The same will be complied with as per

applicability on the project.

Forest Clearance under Forest

Conservation Act is not applicable as

there is no forest land involved in the

project. The copy of certificate obtained

from Dy. Conservator of Forests,

Gurgaon is enclosed as Annexure VII.

vii. The project proponent should inform the public

that the project has been accorded Environmental

Clearance by the SEIAA and copies of the

clearance letter are available with the State

Pollution Control Board & SEIAA. This should

be advertised within 7 days from the date of issue

viii Under the provision of Environment (Protection)

Act, 1986, legal action shall be initiated against

the project proponent it was found that

construction of the project has been started before

obtaining prior Environmental Clearance.

ix. Any appeal against this Environmental Clearance

shall lie with the National Green Tribunal, if

preferred, within a period of 30 days as

prescribed under Section 16 of the National

Green Tribunal Act, 2010.

x. The project proponent shall put in place

Corporate Environment Policy as mentioned in

MoEF, GoI OM No. J-11013/41/2006-IA II (I)

dated 26.04.2012.within 3 months period .Latest

Corporate Environment Policy should be

submitted to SEIAA within 3 months of issuance

of this letter.

The same will be complied with.

xi. The fund ear-marked for environment protection

measures should be kept in separate account and

should not be diverted for other purposes and

year wise expenditure shall be reported to the

SEIAA/RO MoEF GoI under rules prescribed for

Environmental Audit.

compliance of all conditions in Environment

Clearance letter and project proponent cannot

absolve himself /herself of the responsibility by

shifting it to any contractor engaged by project

proponent.

Environmental Clearance letter.

xv. The project proponent shall seek fresh

Environment clearance if at any stage there is

change in the planning of the proposed project.

xvi Besides the developer/applicant ,the

responsibility to ensure the compliance of

Environmental Safeguards/conditions imposed in

the Environmental Clearance letter shall also lie

on the licensee/licensees in whose name/names

the license/ CLU has been granted by the Town &

country Planning Department ,Haryana.

xvii. The proponent shall upload the status of

compliance of the stipulated EC conditions,

including results of monitored data on their

website and shall update the same periodically. It

shall simultaneously be sent to the Regional

Office of MoEF, the respective Zonal Office of

and Nickel. (Ambient level as well as stack

emissions) or crictical sectoral parameters,

indicated for the project shall be monitored and

displayed at a convenient location near the main

gate of the company in the public domain.

xviii The Environment statement for each financial

year ending 31st march in Form V as is mandated

to be submitted by the project proponent to

HSPCB, Panchkula as prescribed under the

Environment (Protection) Rules, 1986, as

amended subsequently, shall also be put on the

website of the company along with the status of

the compliance of EC conditions and shall also to

be respective Regional Office of MoEF by e-

mail.

The same will be followed.

xix. The project proponent shall conduct environment

audit at every three months interval and thereafter

corrected measures shall be taken without any

delay. Details of environmental audit and

corrective measures shall be submitted in the

monitoring report.
