Health and Safety Policy Statement

Manaaki Adventures Ltd is committed to maintaining a safe and healthy working environment for the

safety and health of our employees and other persons in the workplace. We have an extensive

knowledge of the Health and Safety at Work Act, 2015 and apply it to all aspects of our tours and

workplace.

Health and safety is everyone’s business, and everyone is expected to share in our commitment to avoid

all accidents and incidents, which may cause personal injury, property damage or loss of any kind.

Every employee is expected to act safely at all times to ensure their own welfare and that of their fellow

employees and others in the workplace.

We will ensure the safety of employees by:

Providing and maintaining a safe working environment

Providing facilities for health and safety

Ensuring all plant and equipment is safe

Ensuring all employees (including any mobile workers), and other people at (or in the vicinity) of

the place of work are not exposed to unmanaged or uncontrolled hazards

Developing and implementing emergency and evacuation procedures

To achieve this we will:

1. Systematically identify and control all hazards in our workplace. Where there are significant

hazards we will take all practicable steps to eliminate or minimise these hazards to prevent any

injury or damage.

2. Inform all employees of these hazards and the hazard controls.

prevent these events from happening.

6. Carry out planned self­inspections to monitor health and safety issues.

7. Ensure all employees are given reasonable opportunities to participate effectively in ongoing

processes for the improvement of health and safety in our workplace.

COMPANY PROFILE

Manaaki Adventures was created in 2013 by Hemi Coates and Dan Meade. We are the only adventure tour organisation providing exciting experiences on and off the beaten track. We cater specifically for overseas students and provide an opportunity for them to grow and develop as individuals while experiencing exciting and new experiences in the breath-taking scenery our country has to offer.

Manaaki Adventures caters both for international students living within New Zealand, in the NZ education system, and those living overseas.

We have two main packages offered to our clients:

1. An adventure tour hitting the most popular hot spots NZ has to offer, as well as, a few hidden gems. On this tour the focus is fun and accommodation and transport are comfortable. 2. A more physically and mentally challenging tour that uses the outdoors as an avenue to develop interpersonal skills within youth. Aims include building self-esteem, confidence, leadership, communication, cooperation and decision making. These tours may use a variety of outdoor activities and the majority of time will be spent away from big cities. Hemi and Dan are both passionate outdoor enthusiasts. They have a combined 15+ years experience working in the outdoors as Outdoor Education teachers, and an even longer history ‘playing’ there. The inspiration for this venture was a German exchange student who entered the Outdoor Education programme at Hamilton Boys’ High School. He came to a curriculum evening by himself in full school uniform. Most students are dragged along

reluctantly by their parents, dressed in whatever scruffy attire might be classed as fashionable. With purpose he walked into the classroom doubling as the Outdoor Education information centre, and asked about the programme. He spoke very good English but had a strong German accent. The Outdoor Education programme is very popular at Hamilton Boys’ High and we usually turn away up to 60 students a year. Almost trying to put him off, he was asked “Do you have any experience in the outdoors?” He replied “No”. Before he could be interrupted and told how this “may not be the course for you” he continued. “I have grown up in a city surrounded by tall concrete buildings, my country is very different to yours and I have never had the opportunity to do this sort of thing, that is why I’ve come to New Zealand”. How can you say “no”? He entered the programme and made the most of every opportunity thrown at him. He is one student who definitely did not take anything for granted.

It was truly humbling to see such genuine awe, passion and enjoyment of the amazing natural environment Aotearoa, New Zealand has to offer. This provided that spark which has now become Manaaki Adventures.

LEADERSHIP AND MANAGEMENT

As stated, Hemi Coates and Dan Meade are the company directors and sole shareholders at present. They have clearly defined roles and responsibilities within the company to ensure a smoothly run operation.

Risk analysis and management systems, maintenance of the safe operational plan, ensuring all national safety standards are met and all other items relating to safety within the organisation is primarily the responsibility of Dan Meade but as a director, under the new act, Hemi Coates will also have a clear understanding of all safety aspects of the day to day running of Manaaki Adventures NZ.

As the organisation grows, so will the leadership hierarchy. There will also be an opportunity for the development of a ‘Safety Officer’ and/or a Health and Safety team depending on number of employees, employee request and PCBU operator discretion.

WAIVERS AND MEDICAL FORMS

All clients must complete a detailed medical form and waiver. The medical form will indicate to staff any mental or physical issues a client has and outline the necessary treatment that must be provided. All information is confidential and will be stored in clear file or electronic device such as an ipad for easy access for all staff.

Special note of any serious concerns will be made so staff are fully prepared and practiced in

treatment.

If Manaaki Adventures deems a client's health to be too much of an impact on staff/other client time, they reserve the right not to take the individual on a tour. Alternatively a designated caregiver could come on the trip paying a prearranged, reduced price.

10% deposit is required to secure your seat. Full payment must be received no later than 21 days before the trip.

Tour fees, minus the 10% deposit is refundable up until 21 days before the trip if full payment has been made.

If a participant withdraws from a tour after this time they will not be eligible for a refund, but may negotiate transferring their fee to another student if all parties agree.

If a participant is sent home early due to a disciplinary matter or chooses to leave, no refund will be given. Manaaki Adventures reserves the right of staff to send a client/clients home for any major disciplinary incidents and/or putting themselves or others in extreme unnecessary danger.

OUTSIDE PROVIDERS – RELATIONSHIPS AND RESPONSIBILITIES

Manaaki Adventures employs the best outdoor providers the country has to offer. By contracting experts in each given area, we can ensure clients gain the maximum experience from their adventure and are always in safe hands.

Responsibility for client safety is clearly defined between Manaaki Adventures and outside providers. When in ‘their domain’, client safety is the responsibility of the company taking the tour; outside of that, client safety is Manaaki Adventures’ responsibility. For example, if rafting with Kaitiaki Adventures, as soon as the guides start giving the clients the safety spiel, getting them kitted out in appropriate clothing, transporting them to the river, on the river and transporting them back to the centre, they are in charge and liable during those times.

When outside providers are not present, Manaaki staff are responsible and liable for the safety of all clients.

All outside providers reserve the right to exclude clients from their trips if they feel they are not physically, mentally or emotionally capable of participating.

All outside providers enter into the following Contractor’s Agreement with Manaaki Adventures. All evidence of this is kept on file and can be produced upon request.

From time to time we may be a “principal”. A principal “means a person who or that

engages any person (otherwise than as an employee) to do any work for gain or reward.”

As a principal, we are required to take all practicable steps for a contractor’s safety (and the

safety of any employees of that contractor).

To achieve this, all contractors will be advised of:

1. All specific hazards they may be exposed to, and the hazard controls, whilst the

contractor is undertaking work on our premises.

2. Emergency and evacuation procedures.

Our policy is that:

Contractor shall be informed they are responsible for any hazards that they may

create while on our premises;

Contractor must advise us (the Principal) of all serious harm accidents to self or

others in the place of work;

The contractors must provide documentation to confirm they have complied with

their own responsibilities under the Health and Safety in Employment Act 1992;

Ensure the following is given to all contractors / sub-contractors:

1. Letter to Contractor / Sub-contractor;

2. Safety Requirements for Contractors;

All safety clothing/equipment required to minimise the risk of injury is to be provided, accessible to and used by any person engaged in the workplace.

1. Before commencing work on our premises, all contractors must ensure that any employees of the contractor, subcontractors on our premises, or if an individual, they are conversant with:

Emergency procedures (to be followed in the event of an emergency); Safety rules and procedures; Hazards which have been identified, and the hazard controls.

4.We as the Principal to the contract, retain the right to inspect the contract operation at any time, to ensure all safety procedures and rules are being followed. Failure to follow such rules and procedures may result in the contract being terminated immediately.

STAFF

Manaaki Adventures has high expectations of their staff members. Employment contracts are written up, clearly identifying job roles and responsibilities. See appendix for a copy of a Manaaki Adventures Employment Contract.

Manaaki Adventures is also responsible for ensuring guides hired are suitably qualified and skilled in the area/for the position they are hired.

Police checks, a detailed CV and proof of qualifications must be provided.

MINIMUM STAFF REQUIREMENTS

All Manaaki staff must have a current first aid certificate and must be enthusiastic and passionate about the outdoors. Manaaki staff do not need specific qualifications in pursuits such as rafting, kayaking etc as outside providers are contracted for these activities.

See appendix for copy of staff first aid certificates.

All staff will be provided with the following;

Every employee shall take all practicable steps to ensure:

Their own safety while at work; and

That no action or inaction of the employee while at work, causes harm to any other person(s);

and

That all personal protective clothing (and equipment) is worn (as identified by hazard

management controls)

No untrained employees will be permitted to perform any task, operate any machinery, or deal with any

substance or material without prior experience (unless closely supervised by some with such

experience).

To ensure that we are complying and maintaining this system, we will:

1. Ensure new, and existing staff read and understand this Manual.

2. Ensure Manual is available and accessible to all new, and existing employees.

3. Review this Manual at least annually, or as need be.

4. Maintain records to ensure all staff have read and understood this Manual.

Employee Participation

As an employer we will provide all reasonable opportunity for employees to participate in ongoing

processes for improving health and safety.

Note: A director will complete the outdoor pre­hospital emergency care course with Peak

Outdoor Safety and Emergency Management. This will be completed by January 2017.

Manaaki Adventures puts extensive risk management systems in place for all tours. We also research other providers who we contract to ensure their safety standards meet our high expectations. Please see the following RAMS forms

For all tours requiring specialist outdoor skills and qualifications, Manaaki Adventures employ staff with specific qualifications in the relevant discipline(s). All CVs and qualifications will be thoroughly evaluated by Manaaki Adventures director and employees with the highest skills and qualifications will be employed. When on these tours, the qualified staff take a leadership role in terms of decisions and actions for and of the group. Underqualified Manaaki Adventures staff who accompany clients on the tour will be used to make up client to guide ratios as the qualified employee sees fit.

In this case qualified staff will provide their owns risk analysis forms and they will be combined with existing Manaaki Adventures RAMS to ensure all aspects of the trip are considered and risks managed.

INCIDENT AND INJURY REPORTING

An incident can be defined as “A significant event or occurrence” Google definitions. In this case the significant occurrence may have happened and not had a significant consequence but needs addressing none the less. The staff member directly involved must fill the incident report out and file it with Dan Meade or Hemi Coates. Together, these two will review the incident, interview or question the persons involved and make a decision on whether a change needs to made to the programme.

Injury reports are filled out by staff after a significant injury to students or staff. A significant injury is defined by Manaaki Adventures as anything needing first aid treatment beyond a plaster. Again these must be filed with Dan Meade or Hemi Coates for them to review and possibly make changes to the programme.

It is important to note that not all incident or injury reports will result in a change to a programme or leadership style.

Templates of incidents and injury reports can be found in the appendix of this document. All injury and incident reports filed with company directors will have digital copies made and those digital copies filed on the Manaaki Adventures Google drive.

DISCIPLINARY STANDARDS AND ACTION PLANS

CLIENTS

Manaaki Adventures endeavors to maintain a friendly, positive atmosphere at all times on our tours. However, we have implemented processes to deal with the actions or behaviours of certain clients.

Clients must not;

Clients must;

Follow the instructions of Manaaki staff and contracted staff at all times Ensure they abide by all New Zealand laws

Failure to follow these rules may result in exclusion or isolation from some activities or events and/or the client may be sent to their legal guardian/asked to leave the tour (age dependent). The cost of this will be incurred by the legal guardian and no refund will be given.

INTENTION SHEETS

Intention sheets are written up in the form of itineraries and one will always be left with the partners of Hemi Coates and Dan Meade. Regular phone contact will be made with them to inform them of the group whereabouts and any changes that may be made to the itinerary. Partners are instructed to inform police if a trip has not returned within five hours of the designated return time and no contact can be made with any trip leaders.

If Hemi or Dan are not on the trip, either Hemi or Dan will be left with the intention sheet and will be the individual responsible for notifying police if a party is five hours or more late.

See appendix for an example of an itinerary/intention sheet.

EQUIPMENT LIST AND MAINTENANCE PROCEDURES

Currently Manaaki Adventures has little to no equipment. As the inventory grows equipment and maintenance procedures will be developed.

Equipment and clothing lists are supplied to all clients well in advance. These vary depending on the client, season and specific tour taking place.

Prior to participation in environments or activities that are testing (e.g. the snow, or water-based activities), clients will have their gear thoroughly checked.

If a client has insufficient clothing and/or equipment, every endeavour will be undertaken to provide the required gear. This may include but is not limited to, borrowing off another client or staff member or the client purchasing/hiring appropriate gear.

If the client is still underprepared he/she will have to be withdrawn from the activity at the discretion of a Manaaki Adventures staff member.

Note: the client will not receive a refund for this activity if the clothing or equipment was identified on the gear list provided.

It is also the responsibility of the tour leaders (Hemi Coates, Dan Meade or the person they appoint to be tour leader) to ensure the vehicle being used for the tour is of the required standard. The tour leader must ensure:

Vehicle and trailer has the appropriate WOF or COF Each student has their own seat and seat belt if seat belts are supplied Trailer is properly attached Vehicle is appropriate for tour and clients.

CLIENT GEAR LISTS Client gear lists will vary depending on the time of year the trip takes place, the locations the trip will be going to and the activities participated in. All gear lists for ‘standard’ tours are downloadable from the website and can be sent to clients upon request.

INSURANCE POLICIES

Manaaki Adventures has Public Liability Insurance through AIG and Bizcover for up to $1 million NZD.

REFLECTION AND REVIEW CYCLES OF TOURS

Reflection takes place during and immediately after all tours in an informal sense. This process is formalised within 3 months of a tour ending and will take place in the form of a staff meeting. All staff who attended the trip and at least one member of the management team will attend the meeting with staff. The meeting will be led by management and a number of key questions will be asked. These include;

Did the tour meet the intentions and values Manaaki Adventure states in their ‘vision statement’, please expand

Did any injuries/medical accidents occur (injury report to be presented by most ‘affected’ staff member)?

Did any serious incidents occur (incident report to be presented most ‘affected’ staff member)?

Did clients enjoy their tour/gain a meaningful experience Feedback from client feedback forms to be discussed How can the tours be improved in terms of safety, efficiency and enjoyment for

clients Are there any concerns with the working environment? Once these points are discussed management and staff will make changes to

future tours.

All minutes from these meetings will be recorded and stored in an online folder with copies sent to staff involved.

INDEPENDENT ASSESSMENTS FROM GOVERNING BODIES

Ensuring client safety is of the utmost importance at Manaaki Adventures. In combination with the above systems we have in place, we have also had an independent review from “Worksafe New Zealand” acting on behalf of The Department of Labour Health and Safety Standards, to ensure we meet their stringent criteria for adventure operators as per the “Health and Safety in Employment (Adventure Activities) Regulations 2011, Guidance for operators”.

Below is an extract from the ministry website explaining the function of the regulation

“New Zealand’s adventure activity sector is world-renowned and is an important contributor to our economy and our national identity.

It is imperative that New Zealanders, visitors and the adventure activities sector can be assured that all operators have sound safety practices.

The Health and Safety in Employment (Adventure and Activities) Regulations (2011) established a safety audit and registration process that is a key part of providing that assurance. The regulations aim to enhance professionalism and ensure consistent good practice across the sector.”

Worksafe found Manaaki Adventures to be exempt from these standards as we contract outside providers for all activities deemed dangerous adventure activities.

In October 2015, Manaaki Adventures NZ became qualmarked. Assessed by a qualified assessor, the feedback about our safety practices and business in general was very positive. We are very proud to meet the high standards of this organization which is governed by the government department Tourism New Zealand and the AA (Automobile Association).
