On Thursday, June 19, 2014, at 9:30 a.m. the quarterly meeting of the Texas Commission
on Law Enforcement (TCOLE) was held at the J.J. Pickle Research Campus, The
Commons Learning Center, 10100 Burnet Road, Bldg 137, Austin, Texas.
Commissioners attending were Sheriff Joel W. Richardson, Presiding Officer; Ms. Patt
Scheckel-Hollingsworth, Assistant Presiding Officer; Dr. Johnny E. Lovejoy II,
Secretary; Major Jason Hester; Constable Ron Hood; Mr. Rob Kyker; Senior Police
Officer Joe Pennington; and Chief Ruben Villescas. Mr. James Oakley was absent.
Raymond Winter and William Van Shellenbeck from the Office of the Attorney General
were present. TCOLE staff members attending were Executive Director Kim Vickers,
Director Agency Operations John Helenberg, Legal Counsel John Beauchamp, Finance
Director Brian Roth, Laurie Abernathy, Michael Antu, Marty Baker, Lynn Beard, Gary
Connella, Thurman Felder, Lisa Fontenot, Dennis Graffious, Richard Gutierrez, Nicole
Hendrickson, Mike Hobbs, Malcolm Jackson, Carey McKinney, Kenneth Merchant, Ken

Agenda item #1, Call to order.
Presiding Officer Richardson called the meeting to order. Harris County Constable Pct.
8 Honor Guard members, Deputy Amanda Bullion, Deputy Mike Humphreys, Deputy
Brian Covey, Deputy Andrea Fogle, and Deputy Tyler Gossett, presented the colors.
Commissioner Villescas led the pledge of allegiance and Commissioner Hester gave the
invocation. Kaye Wilson called the roll and announced that Commissioner James
Oakley was absent and that there was a quorum present.
Agenda item #2, Reading of peace officer/jailer deaths since the March meeting.
Detective Charles Dinwiddie, Killeen Police Department, End of Watch 05-11-2014
Detective Charles Dinwiddie succumbed to a gunshot wound sustained two days
earlier while conducting a SWAT operation at an apartment complex. The officers were
serving a narcotics search warrant when the subject inside of the apartment opened fire.
Detective Dinwiddie and three other officers were wounded during the shooting.
Detective Dinwiddie had served with the Killeen Police Department for 18 years.
He is survived by his wife and two children.

Sgt. Paul Buckles, Potter County Sheriff’s Office, End of Watch 05-30-2014
Sgt. Buckles collapsed while participating in an active shooter training exercise
involving multiple agencies in the Canyon area. He was treated on the scene by officers
and EMT’s before being transported to a local hospital where he passed away. Sgt.
Buckles had served with the Potter County Sheriff’s Office for 26 years and was
assigned to the Criminal Investigation Division.
Agenda item #3, Approval of the minutes of the March 27, 2014, quarterly
commission meeting at Austin, Texas.
Commissioner Lovejoy moved for approval. Commissioner Hollingsworth seconded
the motion. The motion passed unanimously.
Agenda item #4, Receive Presiding Officer’s Report. Take action, if necessary.
Mr. Richardson introduced past presiding officer Charles Hall and thanked him for his
service on the Commission.
Agenda item #5, Receive Executive Director’s Report. Take action, if necessary.
The Executive Director introduced the newest TCOLE staff members.
Marty Baker has joined TCOLE as the Field Services Agent for West Texas. Marty has
31 years of law enforcement experience, 22 of those years as a Special Agent and
Assistant Commander with the West Central Texas Inter-Local Crime Task Force. He
has also worked as a police officer in Coleman, a deputy sheriff with Coleman County,
the Office of the Inspector General of the Health and Human Services Commission, and
the 226th Judicial District Attorney as an investigator.
Malcolm Jackson has joined the TCOLE staff as an Investigator after serving over 28
years of professional law enforcement and related experience. Most recently, Malcolm
was the Training Coordinator with the Tarrant County College District Criminal Justice
Training Center. He has also served as the Director of Public Safety for the City of
Watauga, Texas and the Deputy Director of Public Safety for the City of Southlake,
Texas.

Agenda item #6, Discuss and take action on the Request for Waiver of TCOLE Rules
217.1 Minimum Standards for Initial Licensure and 217.23 Basic Licensing
Enrollment Standards.
Class B Waiver for Caddo Mills Police Department for Leonard Jimmerson
Chief Brian Barrett, Caddo Mills Police Department, appeared before the
Commission stating he intends to hire Mr. Jimmerson as a reserve officer, and
will bring him on full time when a position is available. Mr. Jimmerson
addressed the Commission stating he was with the Oklahoma County Sheriff’s
Office and returned to Texas to be a bounty hunter for Rockwall County and as a
juvenile lead officer in Hunt County. Commissioner Hester asked Mr.
Jimmerson about his conviction of driving with a suspended license. Mr.
Jimmerson explained that at the time he was on his mother’s insurance, she
didn’t pay the premium, so he was arrested for driving without insurance. Since
that time, he has had his own insurance. Today this is a Class C misdemeanor.
Commissioner Lovejoy made a motion to approve the waiver. Commissioner
Villescas seconded the motion. The motion passed unanimously.
Class A Waiver for Waller County Sheriff’s Office, Randall Lewis
Sheriff Glenn Smith and Chief Deputy Joe Hester appeared before the
Commission. Chief Deputy Hester conducted the background on Mr. Lewis.
Sheriff Smith said he intends to hire Mr. Lewis after he completes his basic peace
officer training. Mr. Lewis said that he has been a resident of Waller County
since 1983 and currently works with the Waller County EMS. When
Commissioner Hollingsworth asked him to address the incident and Mr. Lewis
told of the events surrounding his arrest. He said he enrolled in the basic peace
officer course about ten years ago after submitting his fingerprints and being told
he was eligible to attend. While studying, he read that a Class A misdemeanor
was a bar from law enforcement. His conviction was deferred, so he believed he
was eligible to attend the training. After consulting with an attorney, and
speaking with the academy coordinator, he resigned from the class.
Commissioner Kyker made a motion to approve the waiver for Mr. Lewis and let
him attend the academy. Commissioner Lovejoy seconded the motion. The
motion passed unanimously.
At this point, Executive Director Vickers told the commissioners that the vetting
process for the Class A waiver is working. We received another waiver request,

but we did not bring it forward. This waiver was for an individual with three
Class A misdemeanors, one being for violation of a protective order.
Agenda item #7, Discuss and take action on proposed orders of amendments to
existing and new TCOLE rules.
Proposed Amendment 1, Rule 215.7, Training Provider Advisory Board
Mr. Beauchamp explained this is amendment expands the duties of the advisory
board allowing them to set policies and procedures with the consent of the chief
administrator. Executive Director Vickers explained that the original reason for
having an advisory board in this process was to provide transparency and public
input into the training of law enforcement officers. Through previous rule
changes, we deviated from the original intent of the advisory board. This
amendment clarifies the role of the advisory board. Commissioner Hester asked
if this rule proposal is a result from requests by administrators or a result of
discussion with training providers and advisory staff. Mr. Vickers said that this
change comes from a realization that the current rule deviates from the original
intent of the advisory boards. Commissioner Lovejoy noted that he has been
seeing applications where public members of the advisory board are ex-law
enforcement officers. Executive Director Vickers confirmed that staff is
monitoring this.
Commissioner Lovejoy made a motion for approval. Commissioner
Hollingsworth seconded the motion. The motion passed unanimously.
Proposed Amendment 2, Rule 215.9, Training Coordinator
Mr. Beauchamp noted that this amendment is in conjunction with Amendment 1.
The proposed amendment removes enforcement of admission, attendance,
retention, and other standards set by the commission from the training advisor to
the advisory board.
Commissioner Lovejoy made a motion to approve the amendment to Rule 215.9.
Commissioner Hollingsworth seconded the motion. The motion passed
unanimously.

Mr. Beauchamp stated that this combines the licensing enrollment standards rule
and the licensing standards into one rule. It includes telecommunicators.
Commissioner Hollingsworth made a motion to pass Proposed Amendment 3,
Rule 217.1 Minimum Standards for Enrollment and Initial Licensure.
Commissioner Lovejoy seconded the motion. The motion passed unanimously.
Proposed Amendment 4, Rule 217.2, Minimum Standards for Telecommunicators
Mr. Beauchamp noted that this is to repeal rule 217.2 as it is now incorporated
into 217.1
Commissioner Lovejoy moved for approval of Proposed Amendment 4, Rule
217.2. Commissioner Hollingsworth seconded the motion. The motion passed
unanimously.
Proposed Amendment 5, Rule 217.23, Basic Licensing Enrollment Standards
Mr. Beauchamp said that this is to repeal Rule 217.23 as it has been incorporated
into Proposed Amendment 1.
Commissioner Lovejoy moved for approval of the Proposed Amendment 5,
217.23. Commissioner Hollingsworth seconded the motion. The motion passed
unanimously.
Proposed Amendment 6, Rule 217.25, Telecommunicator Enrollment Standards
Mr. Beauchamp noted that this was incorrectly posted on the agenda as Rule
217.2 and asked that the minutes reflect the correct rule number as 217.25.
This amendment is to repeal Rule 217.25 as it has been incorporated into Rule
217.1
Commissioner Lovejoy recommends approval of Proposed Amendment 6,
217.25. Commissioner Kyker seconded the motion. The motion passed
unanimously.

Proposed Amendment 7, Rule 221.13, Emergency Telecommunications Proficiency
Mr. Beauchamp stated the amendment to this rule adds a Master proficiency
certificate for telecommunicators.
Commissioner Hollingsworth made a motion to accept the amendment to Rule
221.13, Emergency Telecommunications Proficiency. Commissioner Lovejoy
seconded the motion. The motion passed unanimously.
Proposed Amendment 8, Rule 221.31, Retired Peace Officer and Federal Law
Enforcement Officer Firearms Proficiency
Mr. Beauchamp noted that this removes redundant cross-referencing to Rule
217.21.
Commissioner Lovejoy requested approval of Proposed Amendment 8, 221.31.
Commissioner Hester seconded the motion. The motion passed unanimously.
Agenda item #8, Discussion of and take actions on proceedings for revocation,
suspension, and other disciplinary actions.
Raymond Winter with the Attorney General’s office addressed the Commission.

Mr. Winter noted that these individuals were convicted of or received deferred
adjudication for offenses that, under Commission rules and laws, would qualify them
for suspension of licenses. Proper notification was sent to each. Each failed to respond.
Therefore they have defaulted on their right to a contested case hearing.
Commissioner Hollingsworth made a motion that the Commission accept and adopt
the recommendations of the Executive Director to enter a default final order as
authorized under the provisions of 37 Texas Administrative Code, Section 223.3, and as
required under the provisions of Texas Occupations Code, Chapter 1701, Section

1701.501 to suspend the license of Ray L. Grimes, John B. Lyons, Domingo N. Martinez,
Maria L. Palomo, Christina N. Pretzman, and Lauren C. Roesch Tonihka.
Commissioner Lovejoy seconded the motion. The motion passed unanimously.
Default Cancellation Order Starnes, Bobby S. 14-02-2425 Hickory Creek Police Department
Mr. Winter stated that Mr. Starnes did not qualify for a license due to a Class A
misdemeanor conviction from 1994 for the offense of assault. Proper notification was
sent to him. He failed to respond. Therefore he has waived his opportunity for a
contested case hearing.
Commissioner Hollingsworth made a motion that the Commission accept and adopt
the recommendations of the Executive Director to enter a final Default Cancellation
Order to cancel the license of Bobby S. Starnes. Commissioner Lovejoy seconded the
motion.
Commissioner Hester asked if Mr. Starnes is working and Executive Director Vickers
responded that he is not. Commissioner Villescas asked how the arrest was discovered.
Mr. Helenberg said that Mr. Starnes was arrested for a subsequent offense, the arresting
agency ran a CCH, and found that he had a previous arrest that didn’t show up on a
previous criminal history check. Commissioner Hester asked if Mr. Starnes was
employed the second time that he was arrested to which Mr. Vickers stated that he was.
The Presiding Officer called for a vote on the motion. The motion passed unanimously.
Agreed Suspension Order Marquez, Roy A. 12-10-0101 Houston Police Department
Mr. Winter said that there has been a negotiated agreement. Mr Beauchamp said that
Mr. Marquez was convicted of Driving While Intoxicated in 2013. He submitted to staff
evidence which determined both a period of suspension and evidence which goes
toward mitigating that suspension. There is a signed agreed suspension order pending
approval by the commission. Mr. Marquez is willing to agree to the suspension order
with the understanding that if he fails to successfully meet all of the requirements, his
license will be suspended for a term of 10 years. The term of suspension is 10 years, the
entire term will be probated with the actual 60 day suspension backdated to run with

his department suspension. The remainder of the suspension will be probated, subject
to his fulfillment of the conditions of probation set forth in the agreed suspension order.
Robert Armbruster, Houston Police Officer’s Union, noted that the chief of police has
decided to keep Mr. Marquez as an officer. He considered the conditions of probation
from the criminal court, the Internal Affairs investigation results, and the details of the
criminal court proceeding when making this decision. Commissioner Villescas asked if
the time period between the conviction in 2013 and coming before the Commission in
2014 is a normal time period. Executive Director Vickers offered the explanation that he
believes officers should be held accountable for their actions. But he also understands
that officers sometime make bad choices and an administrator may want to salvage the
officer’s career. The Houston Police Department program is extensive. Before this
request for an agreed suspension comes to TCOLE, the individual has gone through all
the steps of the HPD program. With the agreed order, we require our own
probationary steps that the officer must fulfill. If he fails our probation, he will receive
a 10 year hard suspension. Commissioner Hester noted that he didn’t see the offense
report in the packet of information that was provided to the Commissioners. Mr.
Beauchamp said the offense report is not included in the packet with agreed suspension
orders, but if the Commissioners want that in the future, it can be provided.
Commissioner Hester stated he can support the chief’s decision to salvage an officer’s
career. But if the officer decides to leave the agency and become employed by another
law enforcement agency, the agreed suspension shouldn’t move with him.
Commissioner Lovejoy made a motion that the Commission accept and adopt the
recommendations of the Executive Director to enter a final Agreed Suspension Order
for Roy A. Marquez. The Presiding Officer called for a second to the motion. There
being no second, the motion died. The Presiding Officer called for another motion.
Commissioner Hester requested additional discussion and asked Mr. Beauchamp if
there is a way to require the officer to remain with the agency. Mr. Beauchamp noted
that because this is not part of the current agreed suspension rule, it wouldn’t apply to
today’s decision. The Presiding Officer asked Mr. Vickers to review the process of the
agreed suspension order. Mr. Vickers said had Houston PD not sought the agreed
suspension order, it would have come before the Commission with up to a 10 year
suspension with the normal request being 2 years hard suspension and 8 years
probated. With the agreed order, it doesn’t go to SOAH. Without a second to the
motion, it will go to SOAH where the Administrative Law Judge makes a decision, it
returns to TCOLE to review, then goes before the Commission at another meeting.

Commissioner Lovejoy made a motion that the Commission accept and adopt the
recommendations of the Executive Director to enter into a final Agreed Suspension
Order for Roy A. Marques. Commissioner Kyker seconded the motion.
Commissioner Villescas asked how the agreed order is decided. Mr. Beauchamp said
the licensee submits a packet as required by rule. It is reviewed by legal counsel, and
before it is placed on the SOAH docket, it is discussed with the Executive Director. The
Executive Director with the advice of legal counsel suggest the appropriate suspension.
Mr. Vickers explained that they look at all the facts, determine what they believe is the
appropriate suspension, send it back to the officer, and if they are agreeable then it
comes before the Commission. Suspension is based on the mitigating and aggravating
factors of each case. Commissioner Villescas confirmed that staff has seen the offense
report in these cases. Commissioner Hester noted that the arrest occurred in 2011 and
asked what Mr. Marquez has been doing since that time. Mr. Armbruster explained
that an officer in this situation is placed in “relieved of duty” status where he will either
be at home or conducting administrative duties. In this situation, the criminal case was
not resolved until April 2013. After that, Mr. Marquez met with the chief to determine
the appropriate discipline. After the discipline was served, he was allowed to work in
uniform. The criminal part of the case is resolved before moving to the disciplinary
part. The arrest was in 2011, the conviction was in 2013. The Commission doesn’t
become involved until after notification of the conviction. Mr. Marquez has completed
23 counseling sessions and under the conditions of the agreed order, he will be required
to complete 15 more sessions. Mr. Beauchamp noted that when TCOLE receives agreed
suspension requests, they are vetted and only those that staff deems acceptable are
brought before the Commission. He then reviewed the list of requirements for the
agreed suspension order. If Mr. Marquez doesn’t comply 100%, the probated
suspension reverts to a 10 year hard suspension. Commissioner Villescas asked if the
Executive Director has spoken with the HPD chief, or reviewed the documents. Mr.
Vickers stated that he has reviewed the documents and believes it is apparent the chief
wants to salvage the officer’s career. He has not personally spoken with the chief.
The Presiding Officer called for a vote by show of hands. The motion passed with
Commissioners Kyker, Pennington, Hood, Villescas, and Lovejoy voting in favor of the
motion. Commissioners Hollingsworth and Hester voted against the motion.
Commissioner Villescas asked that legal counsel explore whether an officer under an
agreed suspension order can be required to stay with the agency that requested the

order. Commissioner Pennington asked if TCOLE can suggest the HPD program as
best practices around the state and at LEMIT classes to the chiefs. Mr. Vickers
understands that Dallas Police Department is considering emulating the HPD program.
The Commission took a brief break, resuming at 11:15 a.m.
