use by a recipient of a grant for a period of not less than 10

(e) TRIBAL SECURITY GRANT PROGRAM.—Section 12

2005 of the Homeland Security Act of 2002 (6 U.S.C. 13

606) is amended by— 14

(1) redesignating subsections (h) through (k) 15

subsections (i) through (l) respectively; and 16

(2) inserting after subsection (g) the following 17

new subsection: 18

‘‘(h) PERIOD OF PERFORMANCE.—The Secretary 19

shall make funds provided under this section available for 20

use by a recipient of a grant under this section for a period 21

SEC. 103. OPERATION STONEGARDEN. 1

(a) IN GENERAL.—Title XX of the Homeland Secu-2

rity Act of 2002 (6 U.S.C. 601 et seq.) is amended by 3

adding at the end the following new subtitle: 4

‘‘Subtitle C — Other Grant 5

Programs 6

‘‘SEC. 2031. OPERATION STONEGARDEN. 7

‘‘(a) ESTABLISHMENT.—There is established in the 8

Department a program to be known as ‘Operation 9

Stonegarden’. Under such program, the Secretary, acting 10

through the Administrator, shall make grants to eligible 11

law enforcement agencies to enhance border security in ac-12

cordance with this section. 13

‘‘(b) ELIGIBLE RECIPIENTS.—To be eligible to re-14

ceive a grant under this section, a law enforcement agency 15

shall— 16

‘‘(1) be located in— 17

‘‘(A) a State bordering either Canada or 18

Mexico; or 19

‘‘(B) a State or territory with a maritime 20

border; and 21

‘‘(2) be involved in an active, ongoing U.S. Cus-22

toms and Border Protection operation coordinated 23

through a sector office. 24

‘‘(c) PERMITTED USES.—The recipient of a grant 1

under this section may use such grant for any of the fol-2

lowing: 3

‘‘(1) Equipment, including maintenance and 4

sustainment costs. 5

‘‘(2) Personnel, including overtime and backfill, 6

in support of enhanced border law enforcement ac-7

tivities. 8

‘‘(3) Any activity permitted under the Depart-9

ment of Homeland Security’s Fiscal Year 2015 10

Funding Opportunity Announcement for Operation 11

Stonegarden. 12

‘‘(4) Any other appropriate activity, as deter-13

mined by the Administrator, in consultation with the 14

Commissioner of U.S. Customs and Border Protec-15

tion. 16

‘‘(d) AUTHORIZATION OF APPROPRIATIONS.—There 17

is authorized to be appropriated $110,000,000 for each 18

of fiscal years 2016 through 2020 for grants under this 19

section. 20

‘‘(e) REPORT.—The Administrator shall annually 21

submit to the Committee on Homeland Security of the 22

House of Representatives and the Committee on Home-23

land Security and Governmental Affairs of the Senate a 24

report containing information on the expenditure of grants 1

made under this section by each grant recipient.’’. 2

(b) CLERICAL AMENDMENT.—The table of contents 3

in section 1(b) of the Homeland Security Act of 2002 is 4

amended by inserting after the items relating to subtitle 5

B of title XX the following new items: 6

‘‘Subtitle C – Other Grant Programs

‘‘Sec. 2031. Operation Stonegarden.’’.

SEC. 104. GRANTS METRICS. 7

(a) IN GENERAL.—To determine the extent to which 8

grants under sections 2003 and 2004 of the Homeland 9

Security Act of 2002 (6 U.S.C. 603 and 604) have closed 10

capability gaps identified in State Preparedness Reports 11

required under subsection (c) of section 652 of the Post- 12

Katrina Emergency Management Reform Act of 2006 (6 13

U.S.C. 752; title VI of the Department of Homeland Secu-14

rity Appropriations Act, 2007; Public Law 109–295) and 15

Threat and Hazard Identification and Risk Assessments 16

from each State and high risk urban area, the Adminis-17

trator of the Federal Emergency Management Agency 18

shall conduct and submit to the Committee on Homeland 19

Security of the House of Representatives and the Com-20

mittee on Homeland Security and Governmental Affairs 21

of the Senate an assessment of information provided in 22

such Reports and Assessments. 23

(b) ASSESSMENT REQUIREMENTS.—The assessment 1

required under subsection (a) shall include a comparison 2

of successive State Preparedness Reports and Threat and 3

Hazard Identification and Risk Assessments from each 4

State and high risk urban area. 5

SEC. 105. GRANT MANAGEMENT BEST PRACTICES. 6

The Administrator of the Federal Emergency Man-7

agement Agency shall include in the annual Notice of 8

Funding Opportunity relating to grants under sections 9

2003 and 2004 of the Homeland Security Act of 2002 10

(6 U.S.C. 604 and 605) an appendix that includes a sum-11

mary of findings identified by the Office of the Inspector 12

General of the Department of Homeland Security in au-13

dits of such grants and methods to address areas identi-14

fied for improvement and innovative practices instituted 15

by grant recipients. 16

SEC. 106. FUNDING PROHIBITION. 17

The Secretary of Homeland Security may not imple-18

ment the National Preparedness Grant Program or any 19

successor grant program unless the Secretary receives 20

prior authorization from Congress permitting such imple-21

mentation. 22

SEC. 107. LAW ENFORCEMENT TERRORISM PREVENTION. 1

(a) LAW ENFORCEMENT TERRORISM PREVENTION 2

PROGRAM.—Subsection (a) of section 2006 of the Home-3

land Security Act of 2002 (6 U.S.C. 607) is amended— 4

(1) in paragraph (1)— 5

(A) by inserting ‘‘States and high-risk 6

urban areas use’’ after ‘‘that’’; and 7

(B) by striking ‘‘is used’’; and 8

(2) in paragraph (2), by amending subpara-9

graph (I) to read as follows: 10

‘‘(I) activities as determined appropriate 11

by the Administrator, in coordination with the 12

Assistant Secretary for State and Local Law 13

Enforcement within the Office of Policy of the 14

Department, through outreach to relevant 15

stakeholder organizations.’’. 16

(b) OFFICE FOR STATE AND LOCAL LAW ENFORCE-17

MENT.—Subsection (b)(4) of section 2006 of the Home-18

land Security Act of 2002 (6 U.S.C. 607) is amended— 19

(1) in subparagraph (B), by inserting ‘‘, includ-20

ing through consultation with such agencies regard-21

ing Department programs that may impact such 22

agencies’’ before the semicolon; and 23

(2) in subparagraph (D), by striking ‘‘ensure’’ 24

and inserting ‘‘certify’’. 25

SEC. 108. ALLOWABLE USES. 1

Subsection (a) of section 2008 of the Homeland Secu-2

rity Act of 2002 (6 U.S.C. 609) is amended— 3

(1) in the matter preceding paragraph (1), by 4

inserting ‘‘including by working in conjunction with 5

a National Laboratory (as defined in section 2(3) of 6

the Energy Policy Act of 2005 (42 U.S.C. 7

15801(3)),’’ after ‘‘plans,’’; 8

(2) by redesignating paragraphs (6) through 9

(13) as paragraphs (7) through (14), respectively; 10

(3) by inserting after paragraph (5) the fol-11

lowing new paragraph: 12

‘‘(6) enhancing medical preparedness, medical 13

surge capacity, and mass prophylaxis capabilities, in-14

cluding the development and maintenance of an ini-15

tial pharmaceutical stockpile, including medical kits 16

and diagnostics sufficient to protect first responders, 17

their families, immediate victims, and vulnerable 18

populations from a chemical or biological event;’’; 19

and 20

(4) in subsection (b)(3)(B), by striking 21

‘‘(a)(10)’’ and inserting ‘‘(a)(11)’’. 22

SEC. 109. NATIONAL DOMESTIC PREPAREDNESS CONSOR-1

TIUM. 2

Paragraph (1) and (2) of section 1204(d) of the Im-3

plementing Recommendations of the 9/11 Commission Act 4

(6 U.S.C. 1102(d)) are amended to read as follows: 5

‘‘(1) for the Center for Domestic Preparedness, 6

$65,000,000 for each of fiscal years 2016 and 2017; 7

and 8

‘‘(2) for the remaining Members of the National 9

Domestic Preparedness Consortium, $98,000,000 10

for each of fiscal years 2016 and 2017.’’. 11

SEC. 110. RURAL DOMESTIC PREPAREDNESS CONSORTIUM. 12

(a) IN GENERAL.—The Secretary of Homeland Secu-13

rity is authorized to establish a Rural Domestic Prepared-14

ness Consortium within the Department of Homeland Se-15

curity consisting of universities and nonprofit organiza-16

tions qualified to provide training to emergency response 17

providers from rural communities. 18

(b) DUTIES.—The Rural Domestic Preparedness 19

Consortium authorized under subsection (a) shall identify, 20

develop, test, and deliver training to State, local, and trib-21

al emergency response providers from rural communities, 22

provide on-site and mobile training, and facilitate the de-23

livery of training by the training partners of the Depart-24

ment of Homeland Security. 25

(c) AUTHORIZATION OF APPROPRIATIONS.—Of 1

amounts appropriated for Continuing Training Grants of 2

the Department of Homeland Security, $5,000,000 is au-3

thorized to be used for the Rural Domestic Preparedness 4

Consortium authorized under subsection (a). 5

SEC. 111. NATIONAL RESPONSE FRAMEWORK. 6

(a) UPDATE.—Paragraph (13) of section 504(a) of 7

the Homeland Security Act of 2002 (6 U.S.C. 314(a)) is 8

amended— 9

(1) by inserting ‘‘, periodically updating (but 10

not less often than once every five years),’’ after 11

‘‘administering’’; and 12

(2) by striking ‘‘National Response Plan’’ each 13

place it appears and inserting ‘‘National Response 14

Framework’’. 15

(b) EMERGENCY SUPPORT FUNCTIONS.—Section 16

653 of the Post-Katrina Emergency Management Reform 17

Act of 2006 (6 U.S.C. 753; title VI of the Department 18

of Homeland Security Appropriations Act, 2007; Public 19

Law 109–295) is amended— 20

(1) by redesignating subsections (d) and (e) as 21

subsections (e) and (f), respectively; and 22

(2) by inserting after subsection (c) the fol-23

lowing new subsection: 24

‘‘(d) COORDINATION.—The President, acting through 1

the Administrator, shall develop and provide to Federal 2

departments and agencies with coordinating, primary, or 3

supporting responsibilities under the National Response 4

Framework performance metrics to demonstrate readiness 5

to execute responsibilities under the emergency support 6

functions of such Framework.’’. 7

(c) CONFORMING AMENDMENTS.— 8

‘‘(g) DURATION OF GROUP.— 1

‘‘(1) IN GENERAL.—The Group shall terminate 2

on the date that is five years after the date of the 3

enactment of this section unless the chairperson re-4

news the Group for a successive five-year period be-5

fore the date on which the Group would otherwise 6

terminate by submitting to the Committee on Home-7

SEC. 128. STATEWIDE INTEROPERABILITY COORDINATORS. 1

(a) IN GENERAL.—Paragraph (2) of section 2004(b) 2

of the Homeland Security Act of 2002 (6 U.S.C. 605(b)) 3

is amended by— 4

(1) redesignating subparagraphs (B) and (C) as 5

subparagraphs (C) and (D), respectively; and 6

(2) inserting after subparagraph (A) the fol-7

Subtitle C—Medical Preparedness 8

SEC. 131. PRE-EVENT ANTHRAX VACCINATION PROGRAM 9

FOR EMERGENCY RESPONSE PROVIDERS. 10

(a) ANTHRAX PREPAREDNESS.— 11

(1) IN GENERAL.—Title V of the Homeland Se-12

curity Act of 2002 (6 U.S.C. 311 et seq.) is amend-13

ed by adding at the end the following new section: 14

‘‘SEC. 526. ANTHRAX PREPAREDNESS. 15

‘‘(a) PRE-EVENT ANTHRAX VACCINATION PROGRAM 16

FOR EMERGENCY RESPONSE PROVIDERS.—For the pur-17

pose of domestic preparedness for and collective response 18

to terrorism, the Secretary, in coordination with the Sec-19

retary of Health and Human Services, shall establish a 20

program to provide anthrax vaccines from the strategic 21

national stockpile under section 319F-2(a) of the Public 22

Health Service Act (42 U.S.C. 247d-6b(a)) that will be 23

nearing the end of their labeled dates of use at the time 24

such vaccines are to be administered to emergency re-25

thrax and who voluntarily consent to such administration, 2

and shall— 3

‘‘(1) establish any necessary logistical and 4

tracking systems to facilitate making such vaccines 5

so available; 6

‘‘(2) distribute disclosures regarding associated 7

benefits and risks to end users; and 8

‘‘(3) conduct outreach to educate emergency re-9

sponse providers about the voluntary program. 10

‘‘(b) THREAT ASSESSMENT.—The Secretary shall— 11

‘‘(1) support homeland security-focused risk 12

analysis and risk assessments of the threats posed 13

by anthrax from an act of terror; 14

‘‘(2) leverage existing and emerging homeland 15

security intelligence capabilities and structures to 16

enhance prevention, protection, response, and recov-17

ery efforts with respect to an anthrax terror attack; 18

and 19

‘‘(3) share information and provide tailored an-20

alytical support on threats posed by anthrax to 21

State, local, and tribal authorities, as well as other 22

national biosecurity and biodefense stakeholders.’’. 23

(2) CLERICAL AMENDMENT.—The table of con-24

tents in section 1(b) of the Homeland Security Act 25

‘‘Sec. 526. Anthrax preparedness.’’.

(b) PILOT PROGRAM.— 3

(1) IN GENERAL.—In carrying out the pre- 4

event vaccination program authorized in subsection 5

(a) of section 526 of the Homeland Security Act of 6

2002, as added by subsection (a) of this section, the 7

Secretary of Homeland Security, in coordination 8

with the Secretary of Health and Human Services, 9

shall carry out a pilot program to provide anthrax 10

vaccines to emergency response providers as so au-11

thorized. The duration of the pilot program shall be 12

24 months from the date the initial vaccines are ad-13

ministered to participants. 14

(2) PRELIMINARY REQUIREMENTS.—Prior to 15

implementing the pilot program under paragraph 16

(1), the Secretary of Homeland Security shall— 17

(A) establish a communication platform for 18

such pilot program; 19

(B) establish education and training mod-20

ules for such pilot program; 21

(C) conduct economic analysis of such pilot 22

program; and 23

thrax vaccine request process under such pilot 2

program. 3

(3) LOCATION.—In carrying out the pilot pro-4

gram under paragraph (1), the Secretary of Home-5

land Security shall select emergency response pro-6

viders based in at least two States for participation 7

in such pilot program. 8

(4) DISTRIBUTION OF INFORMATION.—The 9

Secretary of Homeland Security shall provide to 10

each emergency response provider who participates 11

in the pilot program under paragraph (1) disclosures 12

and educational materials regarding the associated 13

benefits and risks of any vaccine provided under 14

such pilot program and of exposure to anthrax. 15

(5) REPORT.—Not later than one year after the 16

date of the enactment of this Act and annually 17

thereafter until one year after the completion of the 18

pilot program under paragraph (1), the Secretary of 19

Homeland Security shall submit to the Committee 20

on Homeland Security and the Committee on En-21

ergy and Commerce of the House of Representatives 22

and the Committee on Homeland Security and Gov-23

ernmental Affairs of the Senate a report on the 24

progress and results of such pilot program, including 25

viders, as determined by each pilot location, that vol-2

unteer to participate, the degree to which partici-3

pants obtain necessary vaccinations, as appropriate, 4

and recommendations to improve initial and recur-5

rent participation in such pilot program. Each such 6

report shall include a discussion of plans to continue 7

such pilot program to provide vaccines to emergency 8

response providers under subsection (a) of section 9

526 of the Homeland Security Act of 2002, as 10

added by subsection (a) of this section. 11

(6) DEADLINE FOR IMPLEMENTATION.—The 12

Secretary of Homeland Security shall begin imple-13

menting the pilot program under paragraph (1) by 14

not later than the date that is one year after the 15

date of the enactment of this Act. 16

SEC. 132. CHIEF MEDICAL OFFICER. 17

(a) IN GENERAL.—Subsection (c) of section 516 of 18

the Homeland Security Act of 2002 (6 U.S.C. 321e) is 19

amended— 20

(1) in the matter preceding paragraph (1), by 21

inserting ‘‘and shall establish medical and human, 22

animal, and occupational health exposure policy, 23

guidance, strategies, and initiatives,’’ before ‘‘includ-24

(b) MEDICAL LIAISONS.—The Chief Medical Officer 17

of the Department of Homeland Security may provide 18

medical liaisons to the components of the Department who 19

may provide subject matter expertise on medical and pub-20

lic health issues and a direct link to the Chief Medical 21

Officer. Such expertise may include the following: 22

(1) Providing guidance on health and medical 23

aspects of policy, planning, operations, and work-24

force health protection. 25

131 of this Act, is further amended by adding at the end 11

the following new section: 12

‘‘SEC. 527. MEDICAL COUNTERMEASURES. 13

‘‘(a) IN GENERAL.—The Secretary shall establish a 14

medical countermeasures program to protect the Depart-15

ment workforce, working animals, and individuals in the 16

Department’s care and custody from the effects of chem-17

ical, biological, radiological, and nuclear agents, and explo-18

sives, as appropriate, and to support Department mission 19

continuity. 20

‘‘(b) OVERSIGHT.—The Chief Medical Officer, estab-21

lished under section 516, shall provide programmatic over-22

sight of the medical countermeasures program established 23

pursuant to subsection (a), and shall— 24

‘‘(2) maintain a stockpile of medical counter-4

measures, including of antibiotics, antivirals, and ra-5

diological countermeasures, as appropriate; 6

‘‘(3) preposition appropriate medical counter-7

measures in strategic locations nationwide, based on 8

threat and employee density, in accordance with ap-9

plicable Federal statutes and regulations; 10

‘‘(4) provide oversight and guidance on dis-11

pensing of stockpiled medical countermeasures; 12

‘‘(5) ensure rapid deployment and dispensing of 13

medical countermeasures in a chemical, biological, 14

radiological, nuclear, or explosives attack, naturally 15

occurring disease outbreak, or pandemic; 16

‘‘(6) provide training to Department employees 17

on medical countermeasure dispensing; and 18

‘‘(7) support dispensing exercises. 19

‘‘(c) MEDICAL COUNTERMEASURES WORKING 20

GROUP.—The Chief Medical Officer shall establish a med-21

ical countermeasures working group comprised of rep-22

resentatives from appropriate components and offices of 23

the Department to ensure that medical countermeasures 24

standards are maintained and guidance is consistent. 25

than 180 days after the date of the enactment of this sec-2

tion, the Chief Medical Officer shall develop and submit 3

to the Secretary an integrated logistics support plan for 4

medical countermeasures, including— 5

‘‘(1) a methodology for determining the ideal 6

types and quantities of medical countermeasures to 7

stockpile and how frequently such methodology shall 8

be reevaluated; 9

‘‘(2) a replenishment plan; and 10

‘‘(3) inventory tracking, reporting, and rec-11

onciliation procedures for existing stockpiles and 12

new medical countermeasure purchases. 13

‘‘(e) STOCKPILE ELEMENTS.—In determining the 14

types and quantities of pharmaceuticals to stockpile under 15

subsection (d), the Chief Medical Officer shall utilize, if 16

available— 17

‘‘(1) Department chemical, biological, radio-18

logical, and nuclear risk assessments; and 19

‘‘(2) Centers for Disease Control and Preven-20

tion guidance on medical countermeasures. 21

‘‘(f) REPORT.—No later than 180 days after the date 22

of the enactment of this section, the Chief Medical Officer 23

shall report to the Committee on Homeland Security of 24

the House of Representatives and the Committee on 25

amended by section 131 of this Act, is further amended 6

by inserting at the end of the items relating to title V 7

the following new item: 8

‘‘Sec. 527. Medical countermeasures.’’.

Subtitle D—Management 9

SEC. 141. MISSION SUPPORT. 10

(a) ESTABLISHMENT.—The Administrator of the 11

Federal Emergency Management Agency shall designate 12

an individual to serve as the chief management official and 13

principal advisor to the Administrator on matters related 14

to the management of the Federal Emergency Manage-15

ment Agency, including management integration in sup-16

port of emergency management operations and programs. 17

(b) MISSION AND RESPONSIBILITIES.—The Adminis-18

trator of the Federal Emergency Management Agency, 19

acting through the official designated pursuant to sub-20

section (a), shall be responsible for the management and 21

administration of the Federal Emergency Management 22

Agency, including with respect to the following: 23

(1) Procurement. 24

(2) Human resources and personnel. 25

(4) Real property investment and planning, fa-3

cilities, accountable personal property (including 4

fleet and other material resources), records and dis-5

closure, privacy, safety and health, and sustain-6

ability and environmental management. 7

(5) Security for personnel, information tech-8

nology and communications systems, facilities, prop-9

erty, equipment, and other material resources. 10

(6) Any other management duties that the Ad-11

ministrator may designate. 12

(c) REPORT.—Not later than 270 days after the date 13

of the enactment of this Act, the Administrator of the 14

Federal Emergency Management Agency shall submit to 15

the Committee on Homeland Security and the Committee 16

on Transportation and Infrastructure of the House of 17

Representatives and the Committee on Homeland Security 18

and Governmental Affairs of the Senate a report that in-19

cludes— 20

(1) a review of financial, human capital, infor-21

mation technology, real property planning, and ac-22

quisition management of headquarters and all re-23

gional offices of the Federal Emergency Manage-24

ment Agency; and 25

capital, information technology, real property plan-2

ning, and acquisition data. 3

SEC. 142. SYSTEMS MODERNIZATION. 4

Not later than 120 days after the date of the enact-5

ment of this Act, the Administrator of the Federal Emer-6

gency Management Agency shall submit to the Committee 7

on Homeland Security and the Committee on Transpor-8

tation and Infrastructure of the House of Representatives 9

and the Committee on Homeland Security and Govern-10

mental Affairs of the Senate a report on the Federal 11

Emergency Management Agency’s efforts to modernize its 12

grants and financial information technology systems, in-13

cluding the following: 14

(1) A summary of all previous efforts to mod-15

ernize such systems. 16

(2) An assessment of long term cost savings 17

and efficiencies gained through such modernization 18

effort. 19

(3) A capability needs assessment. 20

(4) Estimated quarterly costs. 21

(5) Estimated acquisition life cycle dates, in-22

cluding acquisition decision events. 23
