They further add that "#a&s children with Loreto$ being illegitimate children$ are entitled to a lesser share of the proceeds of the policies. Thus$ they prayed that the shar e of "#a and portions of the share of Loreto&s illegitimate children should be awarded to them$ being the legitimate heirs of Loreto entitled to their respecti#e legitimes. Petitioners are third parties to the insuranc e contracts with nsular and !repalife and thus they are not entitled to the proceeds thereof. The nsular and !repa lif e ha#e no legal obligation to turn o#er the insurance proceeds to the petitioner. t is only in cases where the insured has not designated any beneciary$ or when the designated beneciary is dis%ualied by law to recei#e the proceeds$ that the insurance policy proceeds shall redound to the benetof the estate of the insured.
