Mrs. Shabarekn-Leonard paid with check # 1402, a fee ofS1250.00, receipt #3904 on August 18, 2008. The Zoning request was scheduled for September 29, 2008. Onthat date Mrs. Shabarekn-Leonard asked, in writing, for her application to be withdrawnfrom the hearing. Problem Identification

Problem Identification

Drug use in Columbia County is a continuing problem primarily because of two inter-states that runthrough the county. There is 1-75 north and south and 1-10 east and west crossing each otherwithin Columbia County's borders. In addition hwy 441 and hwy 90. also contribute significanttraffic. Because Columbia County is just south of the state border, it and the County Seat, LakeCity, have been called the Gateway to Florida.

Drugs are being transported into Florida by these same roadways giving drug dealers free accessto meet in Columbia County to make drug transactions and be able to travel on an interstate orhighway in any direction. There is a high flow of illegal drugs coming to Columbia County and anincreasing number of drug dealers have been identified around motels near 1-75.

Despite two major interstates going through it, there are still vast rural areas in Columbia Countythat make it a prime location for Math-amphetamine dealers who target these secluded areas toset up their labs and a significant increase of such activity has been observed in the last severalyears. While dealing with the problems of methamphetamine, cocaine and marijuana. there alsoappears to have been growth in the use of other dangerous drugs such as Oxycontin and Ecstasy.

In addition to the major highways bisecting the county. which help to bring drugs into the area,there has been a continued increase in population resulting growth in the demand for illegalsubstances.

Columbia County continues to fight drugs on all levels with designated teams to fight drugproblems at their sources. There is one team that works the interstates to deal with drugs cominginto and leaving the area. The Multi-Jurisdictional Task Force works to fight against the drugdealers on all fronts. managing both short and long term drug investigations of all types.

investigative procedure.

Multi-Jurisdictional Task Force works with other local state and federal agencies to maximize theuse of available resources in reference to combat the sale manufacture and transportation ofillegal drug into and through the community. Direct lines of communication. as well as regularlyscheduled strategy meetings have been established between all agencies to further ensure thatour common goals and objectives are met. In addition regUlar meetings are held with the stateattorney's. third judicial circuit are held to ensure proper case preparation and successfulprosecution of the Multi-Jurisdictional Task Force's work product.

Drug violations on all levels will be targeted from the street level dealer to the complex drugorganizations. While the primary duties of the Multi-Jurisdictional Task Force will be long termdrug investigations they will also be instrumental in instructing patrol officers in effective counterdrug patrolling techniques. As a result of this training task force officers will be on call to respondto a patrol officer as a need would arise.

Area criminal justice agencies to include: Parole and Probation. Juvenile Justice and theDepartment of Children and Families will be educated on the configuration of Meth-Labs and anyidentification of other related drug paraphernalia. This training is going to be prOVided to ensurethat these agencies are provided the toolbox needed to identify hazardous environments. Thisknowledge will assist with officer safety issues and develop a source of intelligence development.

Conditions of agreement requiring compliance by units of local government (subgrant recipients),implementing agencies and state agencies upon signed acceptance of the subqrant award appear inthis section. Upon approval of this subqrant, the approved application and the following terms ofconditions will become binding. 3. Reports

a. Project Performance Reports - JAG Countywide Only

(1) Reporting Time Frames:The subgrant recipient shall submit Quarterly ProjectPerformance Reports to the Florida Department of Law Enforcement. hereafter known asthe Department within 31 days after the end of the reporting period. In addition, if thesubqrant award period is extended beyond the "original" project period, additionalQuarterly Project Performance Reports shall be submitted.

Failure to submit Quarterly Performance Reports that are cornptete. accurate and timelymay result in sanctions, as specified in item 17. Performance of Agreement Prov isions.

(2) Report Contents: Performance reports must include a response to aU objectives includedin your subgrant. A detailed response is required in the narrative portion for yes/noperformance objectives. The narrative must also reflect on accomplishments for thequarter and identify problems with project implementa tion and address actions beingtaken to resolve the problems.

b. Financial Reports

(1) Project Expenditure Reports

(a) The JAG Countywide subqrant recipient shall have a choice of submitting either aMonthly or a Quarterly Project Expenditure Report to the Department. ProjectExpenditure Reports are due thirty-one (31) days after the end of the reportingperiod. In addition. if the subqrant award period is extended. additional ProjectExpenditure Reports shall be submitted.

(b) The JAG Direct subgrant recipient shall submit one Project Expenditure Report forthe entire subgrant period.

(c) All project expenditures for reimbursement of subgrant recipient costs shall besubmitted on the Project Expenditure Report Forms prescribed and provided by theOffice of Criminal Justice Grants (OCJG) through the Subgrant InformationManagement ON-line (SIMON) system.

(d) All Project Expenditure Reports shall be submitted in sufficient detail for proper pre­audit and post-audit.

(e) Before the 'final" Project Expenditure Report will be processed. the subgrantrecipient must submit to the Department all outstanding project reports and musthave satisfied all special conditions. Failure to comply with the above provisionsshall result in forfeiture of reimbursement.

(f) Reports are to be submitted even when no reimbursement is being requested.

(2) The Financial Closeout Documentation shall be submitted to the Department within forty­five (45) days of the subgrant termination date.

(3) If applicable, the subgrant recipient shall submit Quarterly Project Generated IncomeReports to the Department within 31 days after the end of the reporting period coveringsubgrant project generated income and expenditures during the previous quarter. If anyPGI remains unspent after the subgrant ends. the subqrant recipient must continue

submitting quarterly PGI reports until all funds are expended. (See Item 10, ProgramIncorne.)

c. Other Reports

The recipient shall report to the Uniform Crime Report and other reports as may bereasonably required by the Department.

4. Fiscal Control and Fund Accounting Procedures

a. The subgrant recipient shan establish fiscal control and fund accounting procedures thatassure proper disbursement and accounling of subgrant funds and required non-federalexpenditures. All funds spent on this project shall be disbursed according to provisions of theproject budget as approved by the Department

b. All expenditures and cost accounting of funds shall conform to OJP Financial Guide, theCommon Rule, and OMB Circulars A-21, A-S7, and A-110, or A-102 as applicable, in theirentirety.

c. All funds not spent according to this agreement shall be SUbject to repayment by the subgrantrecipient.

5. Payment Contingent on Appropriation and Available Funds

The State of Florida's performance and obligation to pay under this agreement is contingent uponan annual appropriation by the Florida Legislature. Furthermore, the obligation of the State ofFlorida to reimburse subgrant recipients for incurred costs is subject to available federal funds.

6. Obligation of Subgrant Reclplent Funds

Subgrant funds shall not under any circumstances be obligated prior to the effective date orSUbsequent to the termination date of the subgrant period. Only project costs incurred on or afterthe effective date and on or prior to the termination date of the subgrant recipient's project areeligible for reimbursement.

7. Advance Funding

a. JAG CountyWide - Advance funding shall be provided to a subgrant recipient upon a writtenrequest to the Department.

b. JAG Direct - The Department shall award program funds to the recipient in a single, lumpsum payment

8. Trust Funds

a, The unit of local governmenl must establish a trust fund in which to deposit JAG funds. Thetrust fund mayor may not be an interest bearing account.

b. The account may earn interest, but any earned interest must be used for program purposesand expended before the subgrant end date.

9. Travel and Training

The cost of all travel shall be reimbursed according to the subgrant reciptent's written travelpolicy. If the subgrant recipient does not have a written travel policy, cost of all travel will bereimbursed according to FS 112.061

10. Program Income (also known as Project Generated Income)

a. All income generated as a direct result of a subgrant project shall be deemed programincome.

b. Any project that will potentially earn PGr must submit an Earnings and Expenditures Reportto report how much PGI was earned during each quarter. A report must be submitted eachquarter even if no PGJ was earned or expended.

c. PGI expenditures require prior written approval from OCJG. Program income must beused for the purposes of and under the conditions applicable to the award. If the cost isallowable under the Federal grant program, then the cost would be allowable usingprogram income.

d. Program income should be used as earned and expended as soon as possible. Anyunexpended PGI remaining at the end of the Federal grant period must be submitted toOCJG for transmittal to SJA.

11. Approval of Consultant Contracts

The Department shall review and approve in writing all consultant contracts prior to employmentof a consultant when the consultant's rate exceeds $450 (excluding travel and subsistence costs)for an eight-hour day. Approval shall be based upon the contract's comptiance with requirementsfound in the Financial Guide, the Common Rule, and in applicable state statutes. TheDepartment's approval of the subgrant recipient agreement does not constitute approval ofconsultant contracts. If consultants are hired through a competitive bidding process (not soresource), the $450 threshold does not apply.

12. Property Accountability

a. The subgrant recipient .aqrees to use aU non-expendable property for criminal justicepurposes during its useful life or dispose of it pursuant to FS 274.

b. The subgrant recipient shall establish and administer a system to protect, preserve, use,maintain and dispose of any property furnished to it by the Department or purchasedpursuant to this agreement according to federal property management standards set forth inthe OJP Financial GUide. U.S. Department of Justice Common Rule for State and LocalGovernments or the federal OMS Circular A-11 0 or A-102. as applicable. This obligationcontinues as long as the subgrant recipient retains the property, notwithstandinq expiration ofthis agreement.

13. Ownership of Data and Creative Material

Ownership of material. discoveries, inventions, and results developed, produced, or discoveredsubordinate to this agreement is governed by the terms of the OJP Financial Guide (asamended), and the U.S. Department of Justice Common Rule for State and Local Governments,or the federal OMS Circular A-11 0 or A-102, as applicable.

14. Copyright

The awarding agency reserves a royalty-free non-exclusive, and irrevocable license to reproduce.publish, or otherwise use, and authorize others to use, for Federal government purposes:

a. The copyright in any work developed under an award or subaward, and

b. Any rights of copyright to which a subgrant recipient or subrecipient purchases ownershipwith support funded under this grant agreement.

15. Publication or Printing of Reports

The subgrant recipient shall submit for review and approval one copy of any curricula, trainingmaterials, or any other written materials that will be pubtlsned, including web-based materials andweb site content, through funds from this grant at least thirty (30) days prior to the targeteddissemination date.

All materials publicizing or resulting from award activities shall contain the following statements:"This project was supported by Award No. [contact OCJG for award number] awarded by theBureau of Justice Assistance, Office of Justice Programs. The opinions. findings, andconclusions or recommendations expressed in this publication/program/exhibition are those ofthe author(s) and do not necessarily reflect the views of the Department of Justice."

16. Audit

a. Subgrant recipients that expend $500,000 or more in a year in Federal awards shall have asingle or program-specific audit conducted for that year. The audit shall be performed inaccordance with the federal OMB Circular A-133 and other applicable federal law. Thecontract for this agreement shall be identified in the Schedule of Federal Financial Assistancein the subject audit. The contract shall be identified as federal funds passed through theFlorida Department of Law Enforcement and include the contract number, CFDA number,award amount, contract period, funds received and disbursed. When applicable. thesubgrant recipient shall submit an annual financial audit that meets the requirements of FS11.45, "Deflnitions: duties; authorities; reports; rules."; FS 215.97, "Florida Single Audit Act";and Rules of the Auditor General, Chapter 10.550, "Local Governmental Entity Audits" andChapter 10.650 1 "Florida Single Audit Act Audits Nonprofit and For-Profit Organizations."

b. A complete audit report that covers any portion of the effective dates of this agreement mustbe submitted within 30 days after its completion, but no later than nine (9) months after the .audit period. In order to be complete, the submitted report shall include any managementletters issued separately and managemenfs written response to all findings, both audit reportand management letter findings. Incomplete audit reports will not be accepted by theDepartment.

c. The subgrant recipient shall have all audits completed by an Independent Public Accountant(IPA). The IPA shall be either a Certified Public Accountant or a Licensed Public Accountant.

d. The subgrant recipient shall take appropriate corrective action within six (6) months of theissue date of the audit report in instances of noncompliance with federal laws andregulations.

e. The subgrant recipient shall ensure that audit working papers are made available to theDepartment, or its designee, upon request for a period of three (3) years from the date theaudit report is issued, unless extended in writing by the Department.

f. Subgrant recipients that expend less than $500,000 in Federal awards during a fiscal yearare exempt from the audit requirements of OBM Circular A-133 for that fiscal year. In thiscase, written notification, which can be in the form of the "Certification of Audit Exemption"form, shall be provided fa the Department by the Chief Financra' Officer, or designee, that thesubgrant recipient is exempt. This notice shall be provided to the Department no later thanMarch 1 following the end of the fiscal year.

17. Performance of Agreement Provisions

In the event of default, non-compliance or violation of any provision of this agreement by thesubgrant recipient, the subgrant recipient's consultants and suppliers, or both, the Departmentshall impose sanctions it deems appropriate incruding withholding payments and cancellation,termination, or suspension of the agreement in whore or in part. In such event. the Departmentshall notify the subgrant recipient of its decision thirty (30) days in advance of the effective date ofsuch sanction. The subgrant recipient shall be paid only for those services satisfactorilyperformed prior to the effective date of such sanction.

18. Commencement of Project

a. If a project is not operational within 90 days of the original start date of the award period, thesubrecipient must report by letter to the Department the steps taken to initiate the project, thereasons for delay, and the expected start date.

b. If a project is not operational within 90 days of the original start date of the award period, thesubrecipient must submit a second statement to the Department explaining theimplementation delay.

c. Upon receipt of the ninety (90) day letter, the Department shall determine if the reason fordelay is justified or shari, at its discretion, unilaterally terminate this agreement and re­obligate subgrant funds to other Department approved projects. The Department, wherewarranted by extenuating circumstances, may extend the starting date of the project past theninety (90) day period, but only by formal written adjustment to this agreement.

19. Excusable Delays

8. Except with respect to defaults of consultants, the subqrant recipient shall not be in default byreason of any failure in performance of this agreement according to its terms (including anyfailure by the subqrant recipient to make progress in the execution of work hereunder whichendangers such performance) if such failure arises out of causes beyond the control andwithout the Faullor negligence of the subqrant recipient. Such causes include, but are notlimited to, acts of God or of the public enemy, acts of the government in either its sovereignor contractual capacity, fires, floods, epidemics) quarantine restrictions, strikes, freightembargoes, and unusually severe weather, but in every case, the failure to perform shall bebeyond the control and without the fault or negligence of the subqrant recipient,

b. If failure to perform is caused by failure of a consultant to perform or make progress, and ifsuch failure arises out of causes beyond the control of subgrant recipient and consultant, andWithout fault or negligence of either of them, the subgrant recipient shall not be deemed indefault, unless:

(1) Supplies or services to be furnished by the consultant were obtainable from othersources,

(2) The Department ordered the subgrant recipient in writing to procure such supplies orservices from other sources, and

(3) The subgrant recipient failed to reasonably comply with such order.

c. Upon request of the subgrant recipient. the Department shall ascertain the facts and theextent of such failure, and if the Department determines that any failure to perform wasoccasioned by one or more said causes. the delivery schedule shall be revised accordingly.

20. Written Approval of Changes in this Approved Agreement

a. Subgrant recipients must obtain prior approval from the Department for major substantivechanges such as changes in project activities, target populations, service providers,implementation schedules, project director. designs or research plans set forth in theapproved agreement and for any budqet changes that win transfer more than 10%) of the totalbudqet between budget categories.

b. Subqrant recipients may transfer up to 10% of the total bUdget between budget categorieswithout prior approval as rang as the funds are transferred to an existing line item

C. Under no circumstances can transfers of funds increase the total budgeted award.

21. Disputes and Appeals

a. The Department shall make its decision in writing when responding to any disputes,disagreements or questions of fact arising under this agreement and shall distribute itsresponse to all concerned parties. The subgrant recipient shall proceed diligently with theperformance of this agreement according to the Department's decision.

b. If the subgrant recipient appeals the Department's decision, the appeal also shall be made inwriting within twenty-one (21) calendar days to the Department's clerk (agency clerk). Thesubgrant recipient's right to appeal the Department's decision is contained in Chapter 120,Florida Statutes, and in procedures set forth in Rule 28-106.104, Florida Administrative Code.Failure to appeal within this time frame constitutes a waiver of proceedings under Chapter120, Florida Statutes.

22. Conferences and Inspection of Work

Conferences may be held at the request of any party to this agreement. At any time, arepresentative of the Department. of the U.S. Department of Justice. or the Auditor General of theState of Florida, have the right of visiting the project site to monitor, inspect and assess workperformed under this agreement.

23. Access To Records

a. The Department of Law Enforcement, the Auditor General of the State of Florida. the U-S.Department of Justice. the U.S. Comptroller General or any of their duly authorizedrepresentatives, shall have access to books. documents. papers and records of the subgrantrecipient implementing agency and contractors for the purpose of audit and examinationaccording to the Financial Guide and the Common Rule.

b. The Department reserves the right to unilaterally terminate this agreement if the subgrantrecipient, implementing agency, or contractor refuses to allow public access to all documents.papers, letters. or other materials SUbject to provisions of Chapter 119. Florida Statutes, and

made or received by the subgrant recipient or its contractor in conjunction with thisagreement.

c. The subqrant recipient will give the awarding agency or the General Accounting Office,through any authorized representative. access to and the right to examine all paper orelectronic records related to the financial assistance.

24. Retention of Records

The subgrant recipient shall maintain all records and documents for a minimum of three (3) yearsfrom the date of the final financial statement and be available for audit and public disclosure uponrequest of duly authorized persons.

25. Signature Authority

The Subqrant Recipient Authorizing Official or Designated Representative and the ImplementingAgency Official. Administrator or Designated Representative, who sign the Signature Page, havethe authority to request changes to the approved agreement The prior mentioned individualshave authority to sign or make amendments to the Sole Source, ADP Justification and thePrivacy Certification forms, The Project Director has authority to submit requests for approval ofspecific travel. and Performance Reports, with the exception of the Financial and CloseoutPackage. which also requires the signature by the Chief Financial Officer of the SubqrantRecipient or authorized designee.

26. Delegation of Signature Authority

When the authorized official of a subgrant recipient or the implementing agency designates someother person signature authority for him/her, the chief officer or elected official must submit to theDepartment a letter or resolution indicating the person given signature authority. The letterindicating delegation of signature authority must be signed by the chief officer or elected officialand the person receiving signature authority. The letter must also specify the authority beingdelegated.

27. Personnel Changes

Upon implementation of the project. in the event there is a change in Chief Executive Officers forthe Subgrant recipient or Implementing Agency, Project Director. or Contact Person} theDepartment must be notified in writing with documentation to include appropriate signatures.

28. Background Check

Whenever a background screening for employment or a background security check is required bylaw for employment. unless otherwise provided by law. the provisions of Chapter 435, FloridaStatutes shall apply.

a. All positions in programs providing care to children, the developmentally disabled. orvulnerable adults for 15 hours or more per week; all permanent and temporary employeepositions of the central abuse hotline; and all persons working under contract who haveaccess to abuse records are deemed to be persons and positions of special trust orresponsibility and requrre employment screening pursuant to Chapter 435, F.S., using thelevel 2 standards set forth in that chapter.

b. All employees in positions designated by law as positions of trust or responsibility shall berequired to undergo security background investigations as a condition of employment andcontinued employment. For the purposes of the subsection, security backgroundInvestigations shall include, but not be limited to, employment history checks. fingerprinting

for all purposes and checks in this subsection. statewide criminal and juvenife records checksthrough the Florida Department of Law Enforcement, and federal criminal records checksthrough the Federal Bureau of Investigation, and may include local criminal records checksthrough local law enforcement agencies.

(1) Any person who is required to undergo such a security background investigation andwho refuses to cooperate in such investigation or refuses to submit fingerprints shall bedisqualified for employment in such position or. if employed, shall be dismissed.

(2) Such background investigations shall be conducted at the expense of the employingagency or employee. When fingerprinting is required. the fingerprints of the employeeor applicant for employment shari be taken by the employing agency or by anauthorized raw enforcement officer and submitted to the Department of LawEnforcement for processing and forwarding, when requested by the employing agency,to the United States Department of Justice for processing. The ernployinq agency shaltreimburse the Department of law Enforcement for any costs incurred by it in theprocessing of the fingerprints.

29. Drug Court Projects

A Drug Court Project must comply with FS 397.334, 'Treatment-Based Drug Court Programs."

30. Overtime for law Enforcement Personnel

Prior to obligating funds from this award to support overtime by law enforcement officers, the U.S.Department of Justice encourages consultation with all allied components of the criminal juslicesystem in the affected jurisdiction. The purpose of this consultation is to anticipate and plan forsystemic impacts such as increased court dockets and the need for detention space.

31. Criminal Intelligence System

The subqrant recipient agrees that any information technology system funded or supported byOJP funds will comply with 28 C.F.R. Part 23, Criminal rntelligence Systems Operating Policies, ifOJP determines this regulation to be applicable. Should OJP determine 28 C.F.R. Part 23 to beapplicable, OJP may. at its discretion, perform audits of the system, as per 28 C.F.R. 23.20(g).Should any violation of 28 C.F.R. Part 23 occur, the recipient may be fined as per 42 U.S.C.3789g(c)-(d). Recipient may not satisfy such a fine with federal funds.

32. Confidential Funds

A signed certification that the project director or the head of the Implementing Agency has read.understands. and agrees to abide by all of the conditions for confidential funds as set forth in theeffective edition of OJP's Financial Guide is required from all projects that are involved withconfidential funds. The signed certification must be submitted at the time of grant application.

33. Equal Employment Opportunity (EEO)

a. Federal laws prohibit recipients of financial assistance from discriminating on the basis ofrace, color, national origin. religion, sex J disability, or age in funded programs or activities. Allsubgrant recipients and implementing agencies must comply with any applicable statutorily­imposed nondiscrimination requirements. which may include the Omnibus Crime Control andSafe Streets Act of 1968 (42 U.S.C. § 3789d); the Victims of Crime Act (42 U.S.C. §10604(e)); The Juvenile Justice and Delinquency Prevention Act of 2002 (42 U.S,C. §5672(b)); the Civil Rights Act of 1964 (42 U.S.C. § 2000d); the Rehabilitation Act of 1973 (29U.S.C. § 7 94); the Americans with Disabilities Act of 1990 (42 U.S.C. § 12131-34): theEducation Amendments of 1972 (20 U.S.C. §§1681. 1683,1685-86); the Age DIscrimination

Act of 1975 (42 U.S.C. §§ 6101-07); and Department of Justice Non-DiscriminationRegulations 28 CFR Part 42; see Ex. Order 13279 (equal protection of the laws for faith­based and community organizations).

b. A subqrant recipient or implementing agency must develop an EEO Plan if it has 50 or moreemployees and it has received any single award of $25,000 or more from DOJ. The planmust be prepared using the on-line short form athttp://www.ojp.usdoj.gov/abouUocr/eeop_comply.htm. must be retained by the subgrantrecipient or implementing agency, and must be available for review or audit. Theorganization must also submit an EEO Certification to FDLE.

c. If the subgrant recipient or implementing agency is required to prepare an EEO Plan and hasreceived any single award of $500,000 or more from DOJ, it must submit its plan to DOJ forapproval. A copy of the DOJ approval letter must be submitted to FOLE. The approval letterexpires two years from the date of the letter.

d. A subgrant recipient or implementing agency is exempt from the EEOP requirement if it ishas fewer than 50 employees or if it does not receive any single award of $25,000 or morefrom DOJ or if it is a nonprofit organization, a medical or educational institution, or an IndianTribe. If an organization is exempt from the EEOP requirement, it must submit an EEOCertification to FDLE,

e. The subgrant recipient and implementing agency acknowledge that failure to comply withEEO Requirements within 60 days of the project start date may result in suspension ortermination of funding, until such time as it is in compliance.

f. In the event a Federal or State court of Federal or State administrative agency makes afinding of discrimination after a due process hearing on the grounds of race, color, religion,national origin, sex, or disability against a recipient of funds, the recipient will forward a copyof the finding to the Office for Civil Rights, Office of Justice Programs.

34. Americans with Disabilities Act

Subqrant recipients must comply with the requirements of the Americans with Disabilities Act(ADA), Public Law 101-336, which prohibits discrimination by public and private entities on thebasis of disability and requires certain accommodations be made with regard to employment(Title I), state and local government services and transportation (Title II), public accommodations(Title III), and telecommunications (Title IV).

35. Immigration and Nationality Act

No public funds will intentionally be awarded to any contractor who knowingly employsunauthorized alien workers, constituting a violation of the employment provisions contained in 8U.S.C. Section 1324a(e), Section 274A(e) of the Immigration and Nationality Act CINA"). TheDepartment shall consider the employment by any contractor of unauthorized aliens a violation ofSection 274A(e) of the INA_ Such violation by the subgrant recipient of the employmentprovisions contained in Section 274A(e) of the INA shall be grounds for unilateral cancellation ofthis contract by the Department.

36. National Environmental Policy Act (NEPA)

a. The subqrant recipient agrees to assist FDLE in complying with the NEPA and other relatedfederal environmental impact analyses requirements in the use of subgrant funds by thesubgrant recipient. This applies to the following new activities whether or not they are beingspecifically funded with these subgrant funds. That is, it applies as long as the activity isbeing conducted by the subqrant recipient or any third party and the activity needs to beundertaken in order to use these subgrant funds,

(1) New construction;

(2) Minor renovation or remodeling of a property either (a) listed on or eligible for ristj~g onthe National Register of Historic Places or (b) located within a 1DO-year flood plain;

(3) A renovation, lease, or any other proposed use of a building or facility that will either (a)result in a change in Its basic prior use or (b) significantly change its size; and

(4) Implementation of a new program involving the use of chemicals other than chemicalsthat are (a) purchased as an incidental component of a funded activity and (b)traditionally used , for example, in office. household, recreational, or educationalenvironments.

b. For any of a subgrant recipient's existing programs or activities that will be funded by thesesubqrants, the subgrant recipient, upon specific request from the Department and the U.S.Department of Justice, agrees to cooperate with DOJ in any preparation by DOJ of a nationalor program environmental assessment of that funded program or activity.

37. Non-Procurement, Debarment and Suspension

The subgrant recipient agrees to comply with Executive Order 12549, Debarment and. Suspension and 2 CFR 180 1 110MB Guidelines To Agencies On Governmentwide Debarment AndSuspension (Nonprocurernent)" These procedures require the subqrant recipient to certify it shallnot enter into any lower tiered covered transaction with a person who is debarred, suspended.declared ineligible or is voluntarily excluded from participating in this covered transaction, unlessauthorized by the Department. If the subgrant is $100,000 or more. the subgrant recipient andimplementing agency certify that they and lheir principals:

a. Are not presently debarred, suspended, proposed for debarment. declared ineligible,sentenced to a denial of Federal benefits by a State or Federal court, or voluntarily excludedfrom covered transactions by any Federal department or agency;

b. Have not within a three-year period preceding this application been convicted of or had a civiljudgment rendered against them for commtssion of fraud or a criminal offense in connectionwith obtaining, attempting to obtain, or performing a public (Federal, State, or local)transaction or contract under a public transaction; violation of Federal or State antitruststatutes or commission of embezzlement, theft, forgery. bribery, falsification or destruction ofrecords. making false statements, or receiving stolen property;

c. Are not presently indicted for or otherwise criminally or civilly charged by a governmentalentity (Federal, State, or local) with commission of any of the offenses enumerated inparagraph (1)(b) of this certification; and

d. Have not within a three-year period preceding this application had one or more publictransactions (Federal, State, or local) terminated for cause or default.

38. Federal Restrictions on Lobbying

a. Each subgrant recipient agrees to comply with 28 CFR Part 69, "New Restrictions onl.obbyinq" and shaH file the most current edmon of the Certification And Disclosure Form, ifapphcabte. with each submission that initiates consideration of such subgrant recipient foraward of federal contract. grant , or cooperative agreement of $100,000 or more.

b. This certification is a material representation of fact upon which reliance was placed whenthis agreement was made. Submission of this certification is a prerequisite to entering into

this agreement subject to conditions and penalties imposed by Section 1352, Title 31, UnitedStates Code. Any person who fails to file the required certification is subject to a civil penaltyof not less than $10,000 and not more than $100,000 for each failure to file. .

c. As required by Section 1352, Title 31 of the U.S. Code. and implemented at 28 CFR Part 69.for persons entering into a grant or cooperative agreement over $100, 000. as defined at 28CFR Part 69. the applicant certifies that:

(1) No Federal appropriated funds have been paid or will be paid. by or on behalf of theundersigned. to any person for inffuencinq or attempting to influence an officer oremployee of any agency, a Member of Congress, an officer or employee of Congress.or an employee of a Member of Congress in connection with the making of any Federalgrant, the entering into of any cooperative agreement, and the extension, continuation,renewal. amendment. or modification of any Federal grant or cooperative agreement;

(2) If any funds other than Federal appropriated funds have been paid or will be paid toany person for influencing or attempting to influence an officer or employee of anyagency, a Member of Congress. an officer or employee of Congress. or an employee ofa Member of Congress in connection with this Federal grant or cooperative agreement,the undersigned shall complete and submit Standard Form - LLL. "Disclosure ofLobbying Activities," in accordance with its instructions;

39. State Restrictions on Lobbying

In addition to the provisions contained in Item 39. above, the expenditure of funds for the purposeof lobbying the regislature or a state agency is prohibited under this contract.

40. Additional Restrictions on lobbyingRecipient understands and agrees that it cannot use any federal funds, either directly orindirectly, in support of the enactment, repeal, modification or adoption of any law, regulation orpolicy, at any level of government, without the express prior written approval of OJP.

41. "Pay - to - Stay"

Funds from this award may not be used to operate a "pay-to-stay" program in any locat jail.Furthermore, no funds may be given to locar [atls that operate "pay-to-stay" programs. II local[arl", as referenced in this condition, means an adult facility or detention center owned and/oroperated by city, county, or municipality. It does not incrude juvenile detention centers. "Pay-to­stay" programs as referenced in this condition, means a program by which extraordinary services.amenities and/or accommodations, not otherwise available to the general inmate populatlon, maybe provided, based upon as offender's apparent abiUty to pay. such that disparate conditions ofconfinement are created for the same or similar offenders within a jurisdiction.

42. Mitigation of Health, Safety and Environmental risks dealing with ClandestineMethamphetamine Laboratories

If an award is made to support methamphetamine laboratory operations the subgrant recipientmust comply with this condition, which provides for individual site environmentalassessmenUimpact statements as required under the National Environmental Policy Act.

a. General Requirement: The subgrant recipient agrees to comply with Federal, State, andlocal environmental, health and safety laws and regulations applicable to the Investigationand closure of clandestine methamphetamine laboratories and the removal and disposal ofthe chemicals, equipment, and wastes used in or resulting from the operation of these ..laboratories.

b. Specific Requirements: The subgrant recipient understands and agrees that any program orinitiative involving the identification, seizure. or closure of clandestine methamphetaminelaboratories can result in adverse health. safety and environmental impacts to (1) the lawenforcement and other governmental personnel involved; (2) any residents, occupants.users. and neighbors of the site of a seized ctandestine laboratory; (3) the seized laboratorysite's immediate and surrounding environment of the sitets) where any remaining chemicals,equipment. and waste from a seized laboratory's operations are placed or come to rest.

Therefore, the subgrant recipient further agrees that in order to avoid or mitigate the possibleadverse health, safety and environmental impacts from any of clandestinemethamphetamine operations funded under this award, it will (1) include the nine. belowlisted protective measures or components; (2) provide for their adequate funding to includefunding. as necessary. beyond that provided by this award; and (3) implement theseprotective measures directly throughout the life of the subgrant. In so doing, the subgrantrecipient understands that it may implement these protective measures directly through theuse of its own resources and staff or may secure the qualified services of other agencies.contractor or other qualified third party.

(1) Provide medical screen ing of personnel assigned or to be assigned by the subgrantrecipient to the seizure or closure if of clandestine methamphetamine laboratories;

(2) Provide Occupational Safety and Health Administration (OSHA) required initial andrefresher training for law enforcement officials and other personnel assigned by thesubqrant recipient to either the seizure or closure of clandestine methamphetaminelaboratories;

(3) As determined by their specific duties, equip personnel assigned to the project withOSHA required protective wear and other required safety equ ipment;

(4) Assign properly trained personnel to prepare a comprehensive contamination report oneach closed laboratory;

subject to arrest for other criminal violations; (iii) ensure immediate medical testing formethamphetamine toxicity; and (iv) arrange for any follow-up medical tests,examinations. or health care made necessary as a result of methamphetamine toxicity.

43. Limited English Proficiency

In accordance with Department of Justice Guidance pertaining to Title VI of the Civil Rights Act of1964.42 U,S.C. § 2000d, recipients of Federal financial assistance must take reasonable steps toprovide meaningful access to their programs and activities for persons with limited Englishproficiency (LEP). 44. The Coastal Barrier Resources Act

The subqrantee will comply and assure the compliance of all contractors with the provisions ofthe Coastal Barrier Resources Act (P.L 97-348) dated October 19, 1982 (16 USC 3501 et seq.)which prohibits the expenditure of most new Federar funds within the units of the Coastal BarrierResources System.

45. Enhancement of Security

rf funds are used for enhancing security, the subgrant recipient agrees to:

a. Have an adequate process to assess the impact of any enhancement of a school securitymeasure that is undertaken on the incidence of crime in the geographic area where theenhancement is undertaken.

b. Conduct such an assessment with respect to each such enhancement; and, submit to theDepartment the aforementioned assessment in its Final Program Report.

46. Environmental Protection Agency's (EPA) list of Violating Facilities

The subqrantee assures that the facilities under its ownership, lease or supervision which shall beutilized in the accomplishment of the Program Purpose are not listed on the EPA's list of VioratingFacilities and that it will notify the Department of the receipt of any communication from theDirector of the EPA Office of Federal Activities indicating that a facility to be used in the project isunder consideration for listing by the EPA.

47. Flood Disaster Protection Act

The subgrantee win comply with Section 102(a) of the Flood Disaster Protection Act of 1973.Public Law 93-234, 87 Stat. 975. requiring that the purchase of trood insurance in communitieswhere such insurance is available as a condition of the receipt of any federal financial assistancefor construction or acquisition purposes for use in any area that has been identified as an areahaving special flood hazards.

48. National Historic Preservation Act

It will assist the Department (if necessary) in assuring compliance with section 106 of the NationalHistoric Preservation Act of 1966 (16 U.S. C § 470). Ex. Order 11593 (identificatIon and

49. Omnibus Crime Control and Safe Streets Act

The subgrant recipient will comply and assure the compliance of all contractors, with theapplicable provisions of Title I of the Omnibus Crime Control and Safe Streets Act of 1968, asamended; the Juvenile Justice and Delinquency Prevention Act, or the Victims of Crime Act; asappropriate; the provisions of the current edition of the Office of Justice Program Financial andAdministrative Guide for Grants; and all other applicable State and Federal laws, orders,circulars, or regulations.

50. Public Safety Officers' Health Benefits Provision

The recipient has certified it is in compliance with the Public Safety Officers' Health BenefitsProvision of the Fiscal Year 2002, Departments of Commerce, Justice. and State. the Judiciary,and Related Agencies Appropriations Act (Pub. L_ No- 107-77) and agrees to remain incompliance during the life of the grant. This provision requires that the unit of local governmentwhich employs a public safety officer (as defined by Section 1204 of Title I of the Omnibus CrimeControl and Safe Streets Act of 1968. as amended) to afford such public safety officer who retiresor is separated from service due to injury suffered as a direct and proximate result of a personalinjury sustained in the line of duty while responding to an emergency situation or hot pursuit (assuch terms are defined by State law) with the same or better level of health insurance benefits atthe time of retirement or separation as the officer received while employed by lhe jurisdiction. Ifthe recipient demonstrates noncomptia nce during the life of the grant. 10 percent of the awardamount must be returned to the grantor.

51. Human Research SUbjects

Grantee agrees to comply with the requirements of 28 C.F.R. part 46 and all Office of JusticePrograms policies and procedures regarding the protection of human research subjects, includingobtainment of Institutional Review Board approval, if appropriate. and subject informed consent.

52. National Information Exchange Model specifications

To support public safety and justice information sharing. OJP requires the grantee to use theNational Information Exchange Model (NIEM) specifications and guidelines for this particulargrant. 59. Uniform Relocation Assistance and Real Property Acquisitions Act

61. Equal Treatment for Faith Based Organizations

The grantee agrees to comply with the applicable requirements of 28 C.F.R. Part 38, theDepartment of Justice regulation governing "Equal Treatment for Faith Based Organizations" (the"Equal Treatment Regulation"). The Equal Treatment Requtation provides in part that Departmentof Justice grant awards of direct funding may not be used to fund any inherently religiousactivities , such as worship, religious instruction, or proselytization. Recipients of direct grants maystili engage in inherently religious activities. but such activities must be separate in time or placefrom the Department of Justice funded program, and participation in such activities by individualsreceiving services from the granlee or a sub-grantee must be VOluntary. Work Camp(hereinafter referred to as "Department"), and the Colwnbia County Public Works, (hereinafterreferred to as "Agency"), is done so in accordance with section 946.40, Florida Statutes and Rule33-601.201, lnrnate Work Program, and 33-601.202, Use of Inmates in PubJic Works, FloridaAdministrative Code.

Work performed under this Local Agreement is determined to be value added or cost savings asdefined in the Community Work Squad Manual (check one).

This Local Agreement shall begin on the last date of signature by all parties.

This Local Agreement shall remain in effect from year to year unless terminated by either party,pursuant to the provisions of Section VII., Suspension or Termination of Local Agreement.

The Department and the Agency acknowledge that this Local Agreement is not intended to createfinancial obligations between the parties. However, in the event that costs are incurred as a result ofeither or both of the parties performing their duties or responsibilities under this Local Agreement,each party agrees to be responsible for their own costs.

ANNUAL FIRE PROTECTION, SOLID WASTEAND LOCAL ROAD IMPROVEMENT ASSESSMENT PROGRAMS

Scope of Services

1) Advise the County on the Jegal requirements for imposing annual fire protection, solid wasteand Jocal road improvement special assessments, including special benefit, fairapportiorunent, and procedures.

2) Advise the County on any judicial decisions or legislative actions that may affect or requiremodifications to the County's fire protection, solid waste and local road improvementassessment programs.

3) Draft the preliminary and annual rate resolutions that conform to the assessment ordinances,already adopted.

4) Assist with the legal requirements for the adoption of the preliminary and annual rateresolutions and certification of the assessment roll in accordance with section 197.3632,Florida Statutes, including: (a) the development of the first class notice or TRlM notice, (b)publication of the public hearing, and (c) certification of the assessment roll.

Fees and Costs

For legal services provided by Nabors, Giblin & Nickerson, the County will be billed a lump sum feeof$11,OOO.OO. The fees will be due and payable in two equal payments as follows:

Expensesrelated to additional meetings will be billed in conformance with section 112.061, Florida Statutes.In lieu of on-site visits, we are available to participate in telephone conferences to discuss projectstatus, assessment issues, and procedural concerns.

MAJOR FUNCTION This is a supervisory position with responsibility of overall management of the County’s landscape and parks needs. SUBJECT: Security Camera Policy for the West Branch Library

Due to the architectural shape (half moon) of the West Branch Library, staff have longexpressed concern for the safety of library patrons and staff because neither ends of the libraryare visible to staff from the Circulation Desk. The children's area has an emergency door withdirect access to the outside and the nearby parking lot. The front entrance door opens to ahallway with the public restrooms immediately off to the right. The Meeting Room is to the left.Staff can hear the front door opening and closing, but can not see the activity going on. Thecurrent location of the Circulation Desk provides the widest view of the library, but cannot providevisible access to the two far ends with doors to the outside. Concern for staff and patronheightened after the Main Library was burglarized and vandalized in 2007.

A two camera security system was installed by the Security Safe Company and paid for by theFriends of the Columbia County Public Library. One camera is inside positioned to view the frontdoor entrance to the West Branch Library and the second camera, also inside, is positioned at theopposite end of the Library in the children's area to view that area and the emergency door to theoutside. The monitor is located at the Circulation Desk where it is in easy view of the library staff.The tapes are kept for 30 days.

I feel it is necessary to have a policy in place regarding the security cameras at West Branchand have attached one for Bee approval, Because an outcome of the camera lise may involverawenforcement, you may want the County Attorney to review the policy before it goes to theBCC for consideration.

Policy Regarding Security Cameras at the West Branch of theColumbia County Public Library

The Columbia County Public Library reasonably strives to maintain a sate and secureenvironment for its staff. patrons and facilities. In pursuit of this objedive, selected areas of theWest Branch Library premises are equipped with video cameras that are recording at all times.Signage will be posted at the library entrance disclosing this activity. The library's video securitysystem shall be used only for the protection and safety of customers, employees. assets,property. and assist lawenforcement. While it is recognized that the use of security cameras willnot prevent all incidents, its potential deterrent effect and resource as a means of identifying andprosecuting offenders is considered worthwhile.

Video monitoring of public areas will be limited to uses that do not violate the reasonableexpectation of privacy as defined by law. Information obtained from the cameras would be usedexclusively for law and/or policy enforcement. When an incident occurs in the library, theserecords may be used by library staff and/or law enforcement agencies in accordance withapplicable state and federal laws to maintain a safe and secure environment. Any persons whotamper with or destroy video security equipment will be subjed to criminal proceedings.

Only the director or employees designated by the director are authorized to operate the videosecurity system. Access to video records shall be limited to authorized employees, who shall onlyaccess such records during the course of their regular duties. Library employees are to reviewand comply with this policy.

Use/Disclosure of Video Records:

• Video records may be used to identify the person or persons responsible for librarypolicy violations, criminal activity. or actions considered disruptive to normal libraryoperations.

• Video records may be used to assist law enforcement agencies in accordance withapplicable state and federal laws upon receipt of a subpoena. The requirement of asubpoena may, however, be waived by the director or authorized employees 'lJhenappropriate. Video records of incidents can be retained and reviewed as long asconsidered necessary by the director.

• Video records may be shared with authorized employees when appropriate or, uponapproval by the director. other library staff to identify person(s) suspended fromlibrary property and to maintain a safe. secure and policy-compliant environment.

• Video records rnay be used, upon authorization by the (Jirector, as otherwise allowedbylaw.

Only the director and employees designated as Persons In Charge shall be authorized torelease any video record to law enforcement.

Requesting Full Funding of Amendment I OffsetFor Fiscally Constrained Counties

Whereas, the Florida Legislature defines a county as Fiscally Constrained if it is locatedwithin a rural area of critical economic concern pursuant to s. 288.0656 or if the value ofI mill of ad valorem taxation within the county will raise no more than $5 million inrevenue; and,

Whereas" during Special Legislative Session held in October of 2007'\ the FloridaLegislature passed Senate Bill 4D stating that "beginning in the 2008-2009 fiscal year.the Legislature shall appropriate moneys to offset the reductions in ad valorem taxrevenue experienced by fiscally constrained counties, as defined in s. 218.67( 1), FloridaStatutes, which occur as a direct result of the implementation of the revision of ArticleVH of the State Constitution approved in a special election held on January 29" 2008;and..

Whereas, on January 29, 2008 the voters of the State of Florida passed ConstitutionalAmendment I which resulted in revisions to Ad Valorem Taxation; and,

Whereas, on January 31, 2008. Governor Crist announced his budget proposal forconsideration by the Florida Legislature which included the following statement - "InFiscal Year 2009-10, Governor Crist will recommend $26.2 million in recurringfundsto offset the impact that Amendment I will have to the property taxes collected byfiscally constrained county governments. Senate BiI14-D, which implements theconstitutional amendment, directs that this revenue loss be offset beginning wit" localgovemmentstfiscal year, which runs/rom October 2008 to September 2009. "; and

Whereas, during the 2008 Regular legislative Session, the Florida Legislatureappropriated $10,000,000 to partially offset the impact of Amendment 1 in the FiscallyConstrained counties and passed SB L588 further outlining procedures for distribution ofthe appropriation to the eligible counties through the Department of Revenue; and,

Whereas, based on actual tax roll information the impact of Amendment I in the FiscallyConstrained counties has been determined to be $24,,613,127 leaving the unfundedportion of the Amendment I offset to the Fiscally Constrained counties tor FY 2008­200Q at $14, 6l3,l27; and,

Whereas, the Columbia County Board of County Commissioners finds that ColumbiaCounty meets the statutory definition of Fiscally Constrained County; estimates the totalimpact of Amendment I in Columbia County in FY 2008-2009 to be $1 ~ 926,683; and..estimates that Columbia County will receive approximately $782.. 787 from the$10.000,000 appropriated by the Legislature leaving an unfunded arnount of $1 ~ 14JJ~96

from the Amendment I impact in Columbia County in FY 2008-2009.

Now Therefore Be It ResoJved that the Columbia County Board of CountyCommissioners requests that Governor Crist request and the Florida Legislatureappropriate an additional $14,,61 J. 125 for the unfunded impact of Amendment I for FY2008-2009 providing an additional $1.. 143,896 to Columbia County to fund the unfundedportion of the Amendment I Offset in 2008-2009.

Be It Further Resolved that Governor Crist included a request to provide $24.6 million tofund the anticipated impact of Amendment 1 in Fiscally Constrained counties in FY2009-2010.

The Columbia County Board of County Commissioners met in a special meetingat the School Board Administration Office. The meeting came to order at 7 p.m.

There was a moment of silence in memory of those who lost their lives onSeptember 11, 2001 due to an attack by terrorists. Chairman Weaver offered a prayerand the Pledge of Allegiance to the Flag of the United States of America followed.

Commissioners in Attendance:

Dewey Weaver, Stephen Bailey, Ronald Williams, and George Skinner.The position of District 5 County Commissioner remains vacant at this time.

Others in Attendance:

County Manager Dale Williams, Attorney Marlin Feagle,Deputy Clerk Sandy Markham, and BCC Secretary Carolyn Baker.

FY 2008-2009 Non-Ad Valorem Assessments Final RatesThe County Manager explained that the foregoing hearings were originally

scheduled for September 04. 2008. but were not heard due to advertising omission.The omission was not based on the legal requirement as per statute, but the hearingwas not placed on the agenda September 04th and did not make the county web page.Therefore, a decision was made to postpone the public hearings.

The foregoing hearings qualify as a special and/or emergency hearing. Thehearings meet the requirements of a special meeting per the Columbia County Charter,and have been advertised accordingly. The hearings qualify as an emergency hearingbecause the rates must be certified to the Tax Collector by September 15, 2008.

PUBLIC HEARING(s):

(1) Fire Protection Services. There;s no increase reflected from the 07-08 fiscalyear. The public hearing opened.

Citizen Stewart Lilker said that the way the county charges for acreage after thehomestead is simply wrong. He said the citizens who own more than six acres, but lessthan or equal to 160 acres, are penalized and forced to subsidize the larger landownersshare of the assessment.

Mr. Lilker used as a comparison that he owns 17.5 acres and CommissionerBailey owns a 160 acre parcel of land. He asked for the Board to explain how it is fairthat he pays $70 in assessments and Commissioner Bailey's assessment is $69.58.Healso asked what the assessment is for land over 640 acres.

The County Manager recalled that Krystal Kerri, the attorney handling theassessments for the county, explained at last year's meeting how the 160 acredetermination was made. According to historical response, it takes approximately thesame amount of man power and equipment to respond to a fire of 150 acres as it doesto 14 acres. Beyond that, up to the 640 acres, a different level of response is generallyneeded in terms of manpower and equipment. If one exceeds the 640 acres, theproperty is considered contiguous property, has a separate identification number, and ischarged at the rate of .35 cents per acre.

Mr. Lilker was steadfast that the county's method is not fair. He said thatAlachua County, as well as many other counties, charges a certain amount per acre foranything over what is homestead. He asked the Board to change to something similarto that of Alachua County.

There being no others to address the Board, the public hearing closed.

Attorney Feagle read Resolution 2008R-29.

MOTION by Commissioner Bailey to approve the resolution. Second byCommissioner Skinner. The motion carried unanimously.

(2) Solid Waste Collection and Disposal Services. Last year's rate was $201 perresidence. The proposal was to adopt the same rate of $201 per residence.

The public hearing opened.

Citizen Melanie Roberts said that she cannot afford to pay this assessment onher rental property. She does not feel it would be right to include the rate in the rent,since the tenants are already delinquent in their monthly rent and cannot afford to takeon this additional amount. She said that the citizens in general need some relief.

The Board replied that the tenant's situation is unfortunate. Nonetheless, it doescost to dispose of the waste, and other citizens cannot be expected to pay anothercitizen's rate for them.

Citizen Stewart Lilker asked regarding the public hearings at hand, if the meetingof September 04 was advertised. The response was affirmative. Mr. Lilker asked toreview the publisher's Proof of Adverlisement. Mr. Lilker said that if the legalrequirements for publishing were met that there was no reason, including failure to postto the website, not to hold the public hearings. Mr. Lilker asked when a decision wasmade to not hold the puoltc hearings.

The County Manager concurred that the public hearing could have been held ifproperly advertised, but explained that at the onset of the meeting that the Board did nothave proof of publication and could not be certain that advertising requirements hadbeen met. As a result, the Chairman made the decision to reschedule the hearings,which was announced at the September 04th meeting.

Regarding waste, Mr. Lilker asked if the county had ever gotten a correct countof the number of houses being served, and if so, he asked how far off the original count

was and why Waste Pro never knew the count was off. The Chairman responded thatthe county finished the count in April, but that the number is constantly being updated.There are a number of reasons Waste Pro did not know the correct house count. Onereason is that there were miscalculations due to property classifications. The CountyManager added that when the service was bid out and the contract changed, a newhousing count was done. The new housing count showed a substantial number ofadditional homes over and beyond that that being paid to the previous carrier (WasteManagement). A second housing count was done when it was discovered that therewas no differentiation between commercial and residential. Even after the second countthe county wound up with a number of housing units above and beyond what the countybelieved there was, but did not have any evidence to dispute the number. The numberswere based on a route housing count in a joint effort between the county and theprovider. When those who had previously been excluded from the roll came in to havetheir bill adjusted, a field person was sent out for verification purposes. Once the rollwas nearly complete, it was determined that the housing count was up from what WasteManagement had previously been billing, but considerably lower than Waste Pro'snumber. The budget is based on what the county believes the housing count to be, notwhat was previously billed. The only issue remaining is that the county paid Waste Proon the basis of the housing count for a year, and there are excess units included in that.Legal council will have to advise if there is money the county can recoup.

Mr. Lilker asked if the two "white good" pickups would be scheduled this year,and stated he received no schedule of the pickups. The Board replied that there is noschedule for the white pickups. Each household is allotted a maximum of two whitepickups per year and it is up to the individual to call Waste Pro at any time during theyear to make the request for their pickups. Mr. Lilker said it should be the county'sresponsibility to make the residents aware of what it is they receive for their money, andalso when pickup schedules change.

(3) Rolling Oaks Municipal Service Benefit Unit - This is an assessment that theresidents have imposed on themselves in order to provide road improvements.
