Our Convention is just around the corner! This year will be bigger and bet-

ter then ever! Our vendor Hall is completely sold out and our seminars are the best yet.

Not only will this years’ Con-vention be educational, it will be fun! You will have many opportu-nities to network with fellow pawn-brokers, industry vendors and your volunteer leadership.

We will provide you with a fed-eral update as to what Washington D.C. has done and what the future may hold for our industry.

One of many highlights will be our Gold Buyer/Law Enforcement Panel with our own attorney Jon Webster. This will give you an op-portunity to hear what you can do in your own cities to combat this prob-lem along with what CLSDA is doing to help protect its members.

Other sessions will include: What to expect from the new 1099 reporting requirements, fabulous sessions on how to make your own business more successful, how to stay away from human resource management problems and how to effectively communicate with your customers and employees. These are only a few examples of what we have in store for you.

The Convention we put on for you every year is the best way to become educated on what is happening in our Industry. Knowledge is “POWER”. Don’t miss out.

Again we’ve planned a fantastic fishing trip. It does not matter if you have fished before or not, you are in for a great time, and all gear is sup-plied for you. Or you can choose our very special southern CA pawn shop tour. It is always educational to see how other people run their shops. You may even learn something that you can use in your own shop! And you get lunch!

For all of you “Vegas” fans, we will be having a Casino Night follow-ing our Welcome reception on Friday. I hope to see all of you at the Univer-

sal Hilton for what is sure to be our best Convention ever!

I would also like to invite you to our Board of Directors Meeting on Thursday, October 21, 2010 starting at 9 a.m. at the Hilton. Here you will see how our Board works on your behalf to plan not only the direction for next year but we also work on ways to pro-tect our industry.

At this meeting we will be dis-cussing: • Our legislative agenda for next

year. Moving forward on a “fix-it” bill to help correct inconsistencies in current law that can and has hurt our members.

• What a public relations firm can do for us in California.

• Exploring the concept of “Continu-ing Education” with guest speaker Craig Rabiner from Ohio.

These are only a few of the topics that will be discussed. There is nothing more important that you can do then be informed and proactive. Please RSVP to the office ([email protected]) so that we can plan for space and food.

As we have seen our industry is no

longer under the radar. Gold has hit all time highs, Pawn Stars

and other TV shows have come into existence. We receive many, many calls a week from people wanting to become pawnbrokers. We must stay focused and become more involved in local, state, and national issues.

CLSDA SpecificMarc LeForestier with the Depart-

ment of Justice, assures me that our request for federal funds to implement a statewide and uniform database is one of their priorities. Obviously the Attorney General himself is “otherwise occupied” at the moment. I believe af-ter November 2nd all parties will have more time to do their jobs.

AB 1810 failed passage August 30th, was granted reconsideration and the bill failed again on August 31st.

If enacted, Assembly Bill 1810 would have required registration of rifles and shotguns in the same way handguns are now registered in California. Under current law, the information collected at the time of purchase of a rifle or shotgun (se-rial number, make, and model) is de-stroyed after the background check is completed. AB 1810 would have required that the make, model, and serial number of the firearm, as well as the identifying information of the purchaser, be recorded and kept on file by the California Department of Justice.

The bill was moved to the inac-tive file and died when session was adjourned. It will likely be re-intro-duced in January. Perhaps CLSDA would like to offer suggestions to im-prove the idea.

General NewsAt Midnight on August 31, 2010,

the moment the State Constitution mandates that the 2-year Legislative session must come to an end, I was in the hallway outside the State Sen-ate listening to Member after Mem-ber congratulate themselves on all of their fine work over the past two years. They were thanking everyone for all the sacrifice, extra effort, and long hours put in over the past two years. Then they proceeded to leave town without a budget, as if it was the most natural thing that could happen. Our CLSDA members should know that it is not natural, it is not normal, in fact it is a violation of their sworn oaths upon taking public office. It is the Legislature’s duty to deliverer a budget (by June 15 for July 1).

It is unclear just how long Cali-fornia can go without a budget. Many guess it will be at least until Novem-ber 2nd. Many Republicans believe

that if Meg Whitman is elected Gov-ernor, she would be much tougher than Arnold. Many Democrats be-lieve that there is still a slim chance that the ballot proposition allowing a budget to be passed by a simple majority and not a 2/3rds vote might pass. Heaven help us if Proposition 25 does pass. As badly as things are going now with the Legislature’s in-ability to say no to spending, can you imagine what spending would be if they were unrestrained by the 2/3rds vote requirement? ■

I had 2 or 3 different outfits regularly coming to Fresno to buy coins and gold. I got a meeting with Chief of

Police and Fresno Pawn Detail officers. The buyers were licensed. I challenged the FPD with the fact they hold off site and (even out of state). The PD is still allowing them to buy at hotels.

So this is what I do:Every time I see an ad for out of

town “road-shows” in my area I im-mediately (next day) run three straight half page ads in the paper myself (one per day). The ads say in large letters

"GOLD We Pay MORE than the traveling road-shows". We have a few paragraphs about how we are a local business. Sup-port the local economy. Pay local taxes. Employ local people. A picture of our 20 + person staff. We mention how we give money to local charities.

We say "we know that times are

tough and that you deserve to get the most for your gold". We say "we are not saying that you have to sell to us, but you owe it to yourself to check with a local business before giving it to some-one in the mail or at a hotel."

The response by customers has been great. We do an excellent business on the days these guys come to town. Customers have thanked us for remind-ing them to support a local business. It is common sense but people forget. These out of town ads are very compel-ling and hook people especially seniors. Do not let these guys come to your town unopposed or you will be seeing them every other week. You must fight fire with fire. If you get punched in the nose, punch back to the nose and then give them one to the gut too.

You might be thinking that you can-not afford the ads. How do they afford the ads? I think you cannot afford to do

nothing. You can beat these guys as long as

you pay good prices, give great service, and remind people to frequent local businesses instead of out-of-towners. We can also mention that we loan or buy. Please try this unless you like your new neighbor. These guys do not come to Fresno nearly as much as they used to. I guess the pickings are easier some-where else. I will be happy to share a copy of my ad later.

MOTIVATING YOUR STAFF

1. High fives and compliments when you find team members doing something right (even small things)

2. Constant recognition. As an ex-ample, we do a “Star Performer of the Month” award. The winner gets a nice framed certificate to put on the wall and $100 in cash. We also make a big deal of it via company email. Star Performer awards are based not only on outstanding sales, loaning and gold buying, but also team spirit, attitude and going beyond ex-pectations in performance of re-sponsibilities.

3. Short duration contests with immediate rewards are good, too. As an example, for the month of August, any team

member who suc-cessfully converted a loan pick up into a loan renewal plus a minimum $100 sale instead for that cus-tomer got $20 cash that day.

4. Every month the team member who buys the most gold (highest number of transactions) in each store gets rec-ognition and $100 cash as well. If two or more team mem-bers tie for the highest number of transactions, then the one with the highest dollar amount in purchases wins.

5. Our managers hold “morning huddles” before opening, and while putting out jewelry. Most “morning huddles”, the manag-ers cover features and benefits

on different pieces of jewelry (thanks to Brad Huiskens train-ing).6. We hold pe-riodic companywide breakfast meetings at 7:30 or 8 am before store openings. We had a great company-wide meeting in Au-gust where we gave an overview of our company’s growth, recognized Star Per-formers, and had each manager give a

short story about his or her team members and the positive things they were doing. We played a couple of especially good record-ings of team member phone con-versations with customers, and afterwards we asked anyone that wished to point out the positive aspects of the phone selling. We then showed a PowerPoint with pictures of each team member starting with baby pictures, then clips of them at work and pic-tures of various company social functions to the background mu-sic of “We are Family”.

There are huge rewards in hav-ing a happy, well-motivated staff. When they have a good attitude, it shows in their customer service. They are more apt to listen to and respect management, they want to work for you for a long time and bring other potential good employ-ees in for interviews.

We are fortunate to have a sales trainer that is a skilled public speaker. His name is Stephan Swanson, and he will be speaking at the CLSDA Convention in October. If you are interested in improving employee performance, then you don’t want to miss his seminar.

Dr. Hernandez spoke of how important it is to be represented in Sacramento and calls us the “most regulated profes-sion in the country.” He joked how the most dangerous time for a pawnbroker is when the State Legislature is in session, since one law could potentially put us out of business. As an Optometrist in predominantly a low-income com-

munity, Dr. Hernandez understands how pawnbrokers help the

“unbanked” sector of society.

This was CLSDA’s second event for Assemblyman Her-nandez, who is now running for State Senate. Four years ago CLSDA was the first industry to hold an event for him and he has never forgotten us. I’m sure that a lot of you are thinking that it’s been a very quiet year, legis-

latively speaking. You may be wondering, what’s going on, why aren’t we doing any-thing? Illegal gold buyers are running amok and stealing our business. Why aren’t we doing anything?!

Let me assure you, just because we haven’t run any bills in Sacramento doesn’t mean that your Legislative Committee and the CLSDA Board of Directors has not been very busy on several fronts. Here’s what we have been working on -

Our major focus this year has been split between two issues that have the potential to greatly impact our industry

now and in the foreseeable future. The first and most pressing was the federal leg-islation to include the pawn industry in the oversight of the Consumer Financial Pro-tection Bureau. We worked nonstop in conjunction with the NPA to protect our busi-nesses from the intrusion of

more governmental oversight and regulation. At this time, the jury is still out on whether or not we have com-pletely dodged that bullet, but it appears that for the immediate future we are going to be able to continue to conduct business as usual.

At the state level, we passed SCR 63, our Senate Concurrent Resolu-tion to bring to fruition a statewide

database for the reporting of all sec-ondhand tangible personal property transactions that occur across all juris-dictions. We identified federal funding to build the database, and are working with the Attorney General’s office to make it a reality. While it may not be readily apparent, this is a step in the process of giving law enforcement an important tool to enforce current law, i.e. go after these guys that are stealing our business and not operating under the laws of our state.

One of our biggest efforts has been preparing a bill that we intend to run in the next legislative session that we have nicknamed our “Fix-It Bill”. It has been almost a year in the making, and is now being prepared for presentation to the full CLSDA Board. With this legislation we will attempt to correct many of the am-biguities that are in the code sec-tions that regulate our industry. We will attempt to further the protec-tions for the pawnbroker and codify industry practices for the benefit of all. While this may not have the “sex appeal” of the Matricula Bill or a rev-enue enhancement bill, it will greatly improve business conditions for the pawn industry.

There is also a good chance that we will “go back to the well” to go after the third piece of our revenue bill. That is, collapsing the stair-step rates in the fourth and subsequent months of a pawn transaction and making it a flat 2 ½%. This too would result in enhancing the revenue stream for pawnbrokers.

As you can see, the CLSDA Legisla-tive Committee never sleeps!

As we move forward, it is critical that you, the members of CLSDA, con-tinue to support and contribute to our legislative agenda. It is only with your support, both through your efforts and monetary donations, that we will be able to achieve our goals.

On One Hand We Litigate While on the Other We Educate

Since the last legal update, your CLSDA attorney has been busy litigating your rights in federal

court while at the same time prepar-ing and presenting an educational seminar for central California law enforcement personnel.

On the Litigation Front:As authorized by the CLSDA

Board of Directors, a federal lawsuit was filed in the United States Dis-trict Court for the Northern District of San Francisco against the City of San Francisco entitled, Chait v. City of San Francisco, USDC No. CV10-2194-WHA.

In Chait, San Francisco police placed two separate 90-day statuto-ry holds on four Rolex watches pur-chased by CLSDA member Joseph W. Chait (Provident Loan Assn.). The

holds were placed on the watches shortly after their purchase in June and July 2009. In October, a San Francisco Police Department detec-tive came into Mr. Chait’s business and advised him that the watches were needed for criminal prosecu-tion of the seller from whom the watches were purchased. Mr. Chait provided the watches as required by the code.

In January 2010, Mr. Chait learned that criminal proceedings against the seller of the watches had concluded. He asked the SFPD to return the watches to him consis-tent with Business and Professions Code Section 21647 and the Ninth Circuit Court of Appeal decision in G&G Jewelry v. City of Oakland, 989 F.2d 1093, (9th Cr 1993). The SFPD refused. Claiming that they had the power to determine ownership of the Rolex watches, a police lieuten-ant (who is also an attorney!) wrote Mr. Chait and advised him that an-

other person had claimed the Rolex watches and that the SFPD had de-termined that this person was the “rightful owner” of the watches. (Sound familiar?)

Wisely, Mr. Chait notified CLSDA and sought the assistance of coun-sel. Correspondence between the CLSDA attorney and SFPD failed to convince the City of San Francisco of the error of its position and the federal Civil Rights lawsuit was filed. In its answer, the City of San Francisco claimed it could elect to use the 90-Day hold statute and then “seize” the Rolex watches under the California Financial Code and deter-mine who was, in its sole opinion, “the rightful owner.” CLSDA’s posi-tion is that a hold means just what it says, a hold over the property until such time as it is no longer needed in a criminal proceeding at which time it will be returned to the pawnbroker from whom it was taken.

for San Francisco notified CLSDA’s attorney that the Ro-lex watches were “inadvertently” determined to be stolen property when, in actuality, they were never stolen. Con-sequently, Mr. Chait was able to recover possession of the watches. Interestingly, in the federal court on September 3, 2010, the merchant who sold the Rolex watches to the person who then resold them to Mr. Chait appeared. She admitted selling the watches in exchange for what turned out to be a bad check. However, she demanded the federal judge order the watches be given back to her on the ba-sis, among other things, that she has a February 2010 letter from SFPD advising her that they had determined she was the rightful owner!

While the trial will not be until Fall of 2011, this should prove to be a valuable learning lesson for law enforcement. Two important teaching points can be gleaned: (1) The 90-Day statutory hold provisions under California Business and Professions Code Section 21647 mean that once the property placed on hold is no longer needed as evidence, it must be returned to the pawnbroker; and (2) Merchants who accept bad checks can pass clear title of the goods sold. Here, Mr. Chait is a bonafide purchaser for value of the Rolex watches. As such, he now holds title to the watches even if the seller passed a bad check to acquire them.

On the Education Front:In August, CLSDA member Steve Diamond, having

worked diligently with his local law enforcement agencies for several years, financially sponsored a joint training event attended by numerous state and local law enforce-ment agencies. In the six hour presentation, the CLSDA attorney presented a two-hour block on enforcement of secondhand dealer and pawnbroker laws with an empha-sis on controlling the spread of unlicensed “gold buyers.” Participants were provided with booklets outlining the rel-evant laws and cases. Positive feedback was obtained, and numerous officers expressed their appreciation for the ed-ucational and training opportunity Steve Diamond permit-ted them to receive. Several officers had no idea that gold buyers had to be licensed, had to comply with the holding requirements and had to transmit the requisite DOJ form JUS123s.

Summary:Unregulated gold buying continues to be a severe and

pervasive issue throughout California. Consumers and legitimate businesses alike are hurt. CLSDA continues to aggressively orchestrate advertising and educational cam-paigns to stop this menace. Anything you can think of as individual members to aid in this campaign would be most appreciated. ■
