On January 5th, Colorado Springs UtilityCompany employees gave a surprise
welcome back party for Navy Chief ChrisOrtiz, on this return from Iraq after a yearsdeployment. Approximately 70 employees ofthe company welcomed him home, withballoons, food, hugs, and many welcomehome signs. The companys president, Mr.Jerry Forte, personally thanked Chris Ortizand particularly his wife, Christie, for thesignificant role she played in keeping thehome fires burning during his longdeployment. Hustedt spoke on behalf of ESGR, and alongwith Colonel USA (Ret) Mary Miller, theythanked the many company employees fortheir strong support for our Guard andReserve members, as well the ColoradoSprings Utilities for their above and beyondsupport for their Guard and Reserveemployees. The company employs 1800personnel, of which about 100 are Guard andReserve members.

Our guest speaker will be Admiral James A. Winnefeld, Jr., Vice Chairman of the JoChiefs of Staff.

Admiral James A. Winnefeld, Jr., serves as the ninth ViceChairman of the Joint Chiefs of Staff. In this capacity, he is amember of the Joint Chiefs of Staff and the Nations secondhighest-ranking military officer.
Admiral Winnefeld graduated from the Georgia Institute of
Technology and received his commission from the NavyReserve Officer Training Corps program. He subsequentlyserved with three fighter squadrons flying the F-14 Tomcat andas an instructor at the Navy Fighter Weapons School.
Admiral Winnefelds unit commands at sea include FighterSquadron 211, USS Cleveland (LPD 7), and USS Enterprise(CVN 65). He led Big E through her 18th deployment, whichincluded combat operations in Afghanistan in support ofOperation Enduring Freedom immediately after the terrorist actsof Sept. 11, 2001. As Commander, Carrier Strike Group TWO/Theodore Roosevelt Carrier Strike Group, he led Task Forces
50, 152, and 58 in support of Operation Iraqi Freedom and maritime interception operations in theArabian Gulf. He also served as Commander, United States SIXTH Fleet, Commander NATOAllied Joint Command Lisbon, and Commander Striking and Support Forces NATO.His shore tours include service in the Joint Staff Operations Directorate (J-3), as Senior Aide tothe Chairman of the Joint Chiefs of Staff, and as Executive Assistant to the Vice Chief of NavalOperations. As a flag officer he served ashore as director, Warfare Programs andTransformational Concepts, United States Fleet Forces Command, as Director of Joint Innovationand Experimentation at United States Joint Forces Command, and as the Director for StrategicPlans and Policy (J-5) on the Joint Staff. He most recently served as the Commander of North
American Aerospace Defense Command (NORAD) and U.S. Northern Command(USNORTHCOM).Admiral Winnefelds awards include the Defense Distinguished Service Medal, DistinguishedService Medal, Defense Superior Service Medal, the Legion of Merit, the Bronze Star, theDefense Meritorious Service Medal, the Meritorious Service Medal, the Air Medal, and five BattleEfficiency awards.

Part 1002Regulations under the Uniformed Services Employment And Reemployment Rights Act Of 1994
1. Can employers make Service Members use regularly scheduled days off to make up time missebecause of military duty?
A. No. The preamble to the Code of Federal Regulation 20 Section 1002 specifically states the mandatoscheduling of Service Members to make up time spent on military duty during regularly scheduled time off prohibited. Generally, time off in a normal 40 hour work week is considered a benefit of employment antherefore cannot be restricted based on military service. (See 1002.236).
The final comments regarding section 1002.153seeks guidance on a situation in which an employer switches aemployees days off so that they coincide with the employees obligation to participate in a regular, monthly twoday military drill or similar military obligation. This may be a hardship to the employee because he or she will losleisure time as a result of having to perform service obligations during the scheduled time off. Because this comment does not concern the use of accrued leave, it does not require modification of section 1002.153. Howeve
the Department of Labor notes that such a scenario may constitute a violation of USERRAs antidiscriminatioprovisions if the employee successfully establishes the elements of a discrimination case set forth in section1002.22 and 1002.23. USERRA prohibits the denial of any benefit of employment on the basis of militaservice obligations, see section 1002.18, and it bears emphasis in response to this inquiry that USERRA includean employees opportunity to select work hours as a benefit of employment, see 38 U.S.C. 4303(2); sectio1002.5(b).
2. Are Ombudsmen required to have a written or verbal response to populate the service member cotacted box within the Inquiry case Management System (ICMS) after leaving a phone message osending an initial email to the Service Member on an assigned case?
A. No. Once phone or email contact has been attempted (message was left asking for a return call) to a ServicMember that has opened a case in ICMS, the Service member contacted on button should reflect contaestablished within ICMS. This complies with the ESGR operating rule to contact the Service Member with
two business days. The only field in the Case Management tab that requires an affirmative response from thService Member to complete is the Permission to Speak with Employer Field.
3. If no comparable position exists at the time of reemployment, employers are required to displacpersonnel hired to backfill for the Service Member from that position when the Service Membereturns from duty. Where is that fact found in the Code of Federal Regulations 20?
A. CFR 20 Section 1002.139(a)... The employer may not, however to refuse to reemploy the employee on thbasis that another employee was hired to fill the reemployment position during the employees absence, eveif reemployment might require the termination of that replacement employee.
4. If a Service Member does NOT elect medical coverage to continue while on military duty is there written portion in USERRA that states the employer should stop it?
A. There is no written provision in USERRA stating that an employee must take affirmative action to sto
coverage when leaving for military duty. The Department of Labor has stated that since there is affirmativaction required to retain medical coverage, its position is that there is a presumption that coverage should stowhen a Service Member fails to indicate a preference for the disposition of medical coverage during militarduty. The exception would be if the employer continues medical coverage at no cost to the Service MembeBoth DOL and the ESGR Ombudsman Directorate have seen cases in which employers have asked returninService Members to pay medical premiums when no continuation of medical coverage was requested. these cases, DOL has advised employers that could not hold the Service Member accountable for thoverdue premiums as long as the medical care benefit was not exercised by Service Member or famimember while the Service Member was way.
