OtiNTY NOTICE OF PUBLIC MEETING A public meeting has been scheduled on Tuesday, January 16, 2018 at Grauwyler Recreation Center, located at 7780 Harry Hines Boulevard, Dallas, TX 75235 beginning at 6:30p.m. regarding an application from FBM BAV LLC ("Applicant") for a Municipal Setting Designation ("MSD") ordinance for property located at 8231 John Carpenter Freeway and adjacent street rights-of-way ("Designated Property"), Dallas, Texas in and adjacent to City Block 44/7940. The purpose of an MSD ordinance is to restrict access to and prohibit the use of the groundwater directly below the Designated Property and to protect public health and welfare where the groundwater quality may present an actual or potential threat to human health. You are receiving this notice because you have been identified as the owner of a state registered water well located within five miles of the Designated Property. State Law requires MSD applicants to provide notice to all such registered well owners. This notice imposes no legal obligation upon you. If you have no interest in this matter, please feel comfortable in discarding this notice and we apologize for any inconvenience we have caused you. A property is eligible for an MSD if: (1) it is within the corporate limits or extraterritorial jurisdiction of a municipality authorized by statute; and (2) a public drinking water supply system exists that satisfies the requirements of Texas Health and Safety Code Chapter 341 and that supplies or is capable of supplying drinking water to the property for which the MSD is sought and property within one-half mile of the property for which the MSD is sought. The Designated Property meets these criteria. The City of Dallas drinking water originates from area lakes and after treatment is distributed through a distribution system consisting of ground storage reservoirs and elevated tanks. Based on information provided by the Applicant, the Designated Property is underlain by a perched shallow aquifer that is encountered at approximately 12 - 15 feet below ground surface (bgs) and extends to approximately 55 feet bgs at the top of the underlying Eagle Ford Group. The Eagle Ford Group is considered a regional aquitard that is composed primarily of shale, sandstone, and limestone and has an estimated thickness of approximately 200 to 300 feet in the area. The anticipated direction of groundwater flow beneath the Designated Property is to the south-southeast. A portion of this shallow groundwater has been affected by trichloroethene (TCE), arsenic, chromium, and lead at concentrations above groundwater ingestion standards. NOTICE OF PUBLIC MEETING

removed from the ground in 1998. The anticipated source for arsenic, chromium, and lead is from naturally occurring metals in the suspended sediment in the groundwater sample collected from a temporary monitor well. The anticipated source for TCE is from offsite facilities to the northwest of the Designated Property where TCE has been identified. Currently the Designated Property is used for office space and warehouse storage by Foundation Building Materials . The anticipated future use of the Designated Property will remain commercial and light industrial.

The public meeting will address MSDs generally, allow the applicant to explain the application, allow citizens to comment, and provide the approximate date of the City Council public hearing. A copy of the complete application is available for review in the reference section at the Grauwyler Park Branch Library located 2146 Gilford Street, Dallas, TX 75235.

If approved by the Dallas City Council , the MSD ordinance will prohib it the use of designated groundwater beneath the Designated Property as potable water and other inappropriate uses of and contact with the groundwater at the Designated Property and will support issuance of an MSD by the Texas Commission on Environmental Quality ("TCEQ"). The Applicant will then file a separate application with the TCEQ for an MSD certificate pursuant to Texas Health and Safety Code, Chapter 361, Subchapter W. You may file comments (not later than the 60th day after the date of receipt of this notice) to: Alayna Goetsch, Remediation Division , Texas Commission on Environmental Quality, P .0. Box 13087, MC-221 , Austin, Texas 78711 . The Executive Director of the TCEQ will certify or deny the application filed with the TCEQ or request additional information from the Applicant not later than 90 days after receiving such application .

AVISO DE ASAMBLEA PUBLICA ~

Se ha programado una asamblea publica que se llevara a cabo el martes 16 de enero de 2018 en el Centro de Recreaci6n Grauwyler, ubicado en 7780 Harry Hines Boulevard, Dallas, Texas 75235 a partir de las 6:30 p.m., relativa a una solicitud de FBM BAV, LLC (el "Solicitante") para Ia expedici6n de una ordenanza de Designaci6n de Entorno Municipal (Municipal Setting Designation, "MSD") para una propiedad ubicada en 8231 John Carpenter Freeway y los derechos de paso de las calles adyacentes ("Propiedad Designada"), Dallas, Texas, en Ia cuadra municipal 44/7940 y adyacente a esta.

El objetivo de una ordenanza de MSD es restringir el acceso y prohibir el usc de agua subterranea directamente debajo de Ia Propiedad Designada y proteger Ia salud y el bienestar publicos donde Ia calidad del agua subterranea pueda llegar a representar una amenaza real o potencial a Ia salud humana.

Usted recibi6 este aviso porque fue identificado como propietario de un pozo de agua estatal registrado ubicado a una distancia maxima de cinco millas de Ia Propiedad Designada. La ley estatal exige que los solicitantes de MSD notifiquen a todos los duenos de pozos registrados de este tipo. El presente aviso no le impone ninguna obligaci6n legal a usted. Si no tiene interes alguno en este asunto, sientase en libertad de desechar este aviso, y nos disculpamos per cualquier inconveniente que pudieramos haber causado.

Una propiedad es admisible para una designaci6n MSD si (1) esta situ ada dentro de los limites corporativos o de Ia jurisdicci6n extraterritorial de un municipio autorizado per ley; y (2) existe un sistema publico de suministro de agua potable que cumpla con los requisites del Capitulo 341 del C6digo de Salud y Seguridad de Texas, y que abastezca o tenga Ia capacidad de abastecer agua potable a Ia propiedad para Ia cual se ha solicitado Ia designaci6n MSD y Ia propiedad esta dentro de media milia de Ia propiedad para Ia cual se ha solicitado Ia designaci6n MSD. La Propiedad Designada cumple con estes criterios. El agua potable de Ia Ciudad de Dallas tiene su origen en lagos de Ia zona y, una vez tratada, se distribuye a traves de un sistema de distribuci6n que consiste en embalses de acumulaci6n en tierra y tanques elevados.

Sobre Ia base de Ia informacion proporcionada per el Solicitante, debajo de Ia Propiedad Designada subyace un acuffero a poca profundidad que se encuentra a aproximadamente entre 12 y 15 pies per debajo de Ia superficie del suelo (bgs) y se extiende hasta aproximadamente los 55 pies bgs, donde se encuentra el esquisto Eagle Ford Group. Se considera que Eagle Ford Group es un acuitardo regional compuesto principalmente per esquisto, arenisca y piedra caliza, cuyo espesor estimado en Ia zona es de 200 a 300 pies. Propiedad Designada se desplaza en una direccion prevista sur sureste. Una parte de esta agua subterranea poco profunda se ha vista afectada por tricloroetileno (TCE), arsenico, cromo y plomo en concentraciones superiores a las normas de ingesta de agua subterranea. Las posibles fuentes en el predio identificadas en Ia Propiedad Designada incluyen un antiguo separador de agua y aceite, un antiguo desarenador, tres tanques de almacenamiento subterraneo (UST) de 1 0,000 galones que no se ha utilizado desde 2005 y un antiguo UST para aceite usado de 500 galones que se extrajo de Ia tierra en 1998. La fuente prevista de arsenico, cromo y plomo consiste en los metales que se presentan naturalmente en el sedimento suspendido de Ia muestra de agua subterranea recolectada de un pozo de monitoreo temporal. La fuente prevista de TCE se halla fuera del predio, hacia el noroeste de Ia Propiedad Designada, donde se ha identificado TCE. Actualmente, Foundation Building Materials usa Ia Propiedad Designada como espacio de oficina y almacen. El usa futuro anticipado de Ia Propiedad Designada continuara siendo comercial y para Ia industria liviana.

En Ia asamblea publica se trataran las designaciones MSD en general, se permitira al solicitante explicar su solicitud , se permitira a los ciudadanos comentar y se comunicara Ia fecha aproximada de Ia audiencia publica del Consejo Municipal. Se encuentra a su disposici6n para su revision una copia de Ia solicitud completa en Ia Sucursal Grauwyler Park de Ia Biblioteca, ubicada en 2146 Gilford Street, Dallas, Texas 75235.

En case de que el Consejo Municipal de Ia Ciudad de Dallas lo apruebe, Ia ordenanza de Ia designaci6n MSD prohibira el usa del agua subterranea designada que se encuentra debajo de Ia Propiedad Designada como agua potable y otros uses inadecuados del agua subterranea , y el contacto con el agua subterranea en Ia Propiedad Designada, y respaldara Ia expedicion de una designacion MSD por Ia Comision de Calidad Ambiental de Texas ("TCEQ"). Posteriormente, el Solicitante presentara una solicitud por separado ante Ia TCEQ para Ia obtencion de un certificado de MSD segun lo dispuesto en el C6digo de Salud y Seguridad de Texas, Capitulo 361 , Subcapftulo W. Usted podra presentar comentarios (a mas tardar a los 60 dias de haber recibido e/ presente aviso) a: Alayna Goetsch, Remediation Division , Texas Commission on Environmental Qual ity, P.O. Box 13087, MC-221 , Austin , Texas 78711 . El Director Ejecutivo de Ia TCEQ certificara o denegara Ia solicitud presentada ante Ia TCEQ o le solicitara informacion adicional al solicitante a mas tardar a los 90 dfas despues de que haya recibido dicha solicitud .
