Cases: ZBA 2020-01; ZBA 2020-02Notice is given that two (2) public hearings are scheduled before the Huron County Zoning Board of Appeals on Wednesday, September 9, 2020 at 7:00 p.m. at the Huron County Expo Center, 170 W. Soper Road, Bad Axe, Michigan 48413. The purpose of this meeting is to receive public comment and consider the following zoning variance requests:ZBA 2020-01, David and Linda Wineman, 567 Brunswick St, Sebewaing, Michigan, 48759, are requesting a dimensional zoning variance for approval to construct a 16 foot x 32 foot (512 square feet) rustic log cabin with 8 foot x 32 foot covered front porch, on a parcel on land in Section 21 of Fairhaven Township, located on North Island. Fairhaven Township Parcel Number 3208-137-001-10 is zoned Residential (R-1) and contains approximately 23.86 acres. The Huron County Zoning Ordinance Article IX, Section 9.01 Schedule of Regulations, requires all dwellings located on each parcel of land in the R-1 zoning district to be a minimum size of 900 square feet. The proposed 512 square foot rustic log cabin does not comply with the minimum dwelling size requirement. The owners have also requested a dimensional variance for reduced side yard setbacks that does not comply with Section 9.01 Schedule of Regulations minimum 10 foot side yard setback per each side. The proposed front and rear zoning setbacks are compliant with minimum ordinance requirements. Pursuant to the Huron County Zoning Ordinance, Section 19.05(c), the Board of Appeals shall have the power to authorize, upon an appeal, specific variances from such requirements as lot area and width regulations, building height and bulk regulations, yard and depth regulations, and off-street parking and loading space requirements. ZBA 2020-02, Berne Enterprises, 7190 Berne Road, McKinley Township, Pigeon, Michigan, 48755, requesting a dimensional zoning variance for approval to construct a 36 foot x 180 foot building addition, which is proposed to enclose an existing cooling production conveyor line currently operating outside the existing foundry building. The proposed addition is located in Section 35 of McKinley Township, Huron County, Michigan. Parcel number 3215-035-019-55 is zoned Industrial (IND) district and contains approximately 3.9715 acres. The Huron County Zoning Ordinance, Article IX, Section 9.01, Schedule of Regulations, requires a main building side yard setback of 20ft. minimum. The Huron County Zoning Ordinance, Article IX, Section 9.02(n) also states “No building shall be located closer than sixty (60) feet to the outer perimeter (property line) of such district when said property line abuts any R-1, AGR, or RM-1 district.” The proposed 6,480 square foot building addition is proposed with a reduced side yard setback of 2 feet to the east side property line (ordinance requires a minimum of 20ft) and the Industrial IND parcel also abuts a R-1 zoned district on both side yard property lines; therefore the property owner is requesting a dimensional variance to reduce the side yard setback requirement from 20 feet to 2 feet. Along with a sixty (60) foot easement on the adjacent east neighbors parcel. Pursuant to the Huron County Zoning Ordinance, Section 19.05(c), the Board of Appeals shall have the power to authorize, upon an appeal, specific variances from such requirements as lot area and width regulations, building height and bulk regulations, yard and depth regulations, and off-street parking and loading space requirements.Persons interested in commenting on the requests may appear in person at the public hearings or, if unable to attend the hearings, may submit written comments to the Huron County Building & Zoning Office, Room 102 of the County Building, 250 E.
