Writing a Will ensures that your wishes are carried out after you’re gone
The main reason why people write a Will is to ensure that their possessions are gifted
to who they choose. Remember, if you are unmarried then your partner Will not receive
anything from you after you’re gone. You can also decide to make gifts to those that
meant the most to you in your life, or perhaps gift some money to a charity.
More importantly for many, it also allows you to appoint guardians for your children.
Without a Will, a Court could ultimately decide who cares for your children.
Similarly it also allows you to decide who would look after your estate for your children.
This means you have the most suitable people ensuring the well-being of your children,
should you not be around to care for them any longer.
A person who is appointed as an executor will deal with the
administration of your estate. These administrative duties include
paying off all of your debts, completing forms and distributing your
estate to the people that you have chosen to benefit under your Will.
Should you have young children they will also look after any part
of the estate that you have left to your children, and ensure that
your guardians are financially able to care for your children. When
your children are old enough, the executors will gift the remainder
of their inheritance to them in full.
This can be a burdensome role, and only people that can handle
the duties stated above should be appointed to this position. Many

by you to take on a potentially challenging role.

that you think hard about who is best suited to care for your children should you not be around.
These are some of the questions you should ask yourself before making your mind up;
� Who is most able to take on the responsibility of caring for your children?
� Do your children already know and feel comfortable with this person?
� Do they share a similar parenting style to you?
� Are they physically up to the role?
Once decided, this person must be fully ready to act as a replacement parent, and provide a
loving and caring home for your children. Should they act, they will have to make decisions
about all aspects of your children's lives. Educational and health decisions will be made by your
guardians, but they may also impart religious views and other values upon your children.
Your estate will be held in a children’s trust for their benefit, and your executors will use parts
of this to help the guardians maintain your children. If you feel the value of your estate is a little
low for this, then consider the financial stability of the guardians you are appointing.

In your Will you choose where your estate goes when you die. Should
you fail to write a Will, the government decides this for you…
In this modern age many choose to live unmarried. If this is you, then
your partner will receive nothing from your estate. This may even
result in them being forced from their home. Even if you are married,
or in a civil partnership you cannot ensure that your spouse or civil
partner will receive what you intended them to receive without writing

Worryingly, those that are separated from their spouse or civil partner
