Issues Before the Commission:

Consider extension of the Emergency Declaration related to COVID-19 to July 6, 2020

Informational Summary:

On March 16, 2020 your Board declared an emergency in response to COVID-19 through May 1, 2020; on April 22, 2020 the declaration was extended to May 31, 2020. Staff is requesting your Board approve a third extension to July 6, 2020, which conforms with the Governor’s declaration.

The emergency declaration measures available to the County include the prohibition or limitation of mass gatherings; contract for mutual aid; suspension of completive bid requirements; redirection of County funds for emergency use; and all other measures to assist in the response.

The declaration does not impose restrictions on the community; but allows the administrative flexibility to respond as conditions merit. Covid-19 remains a significant public health concern that will require extensive staff and resource commitments for the foreseeable future.

Options to Consider:

1. Adopt the Resolution extending the Emergency Declaration through July 6, 2020. 2. Do not act on the Resolution and allow the Emergency Declaration to expire on

May 31, 2020.

RESOLUTION AND ORDER

WHEREAS, the Clatsop County Board of Commissioners declared an emergency on March 16,

2020, and on April 22, 2020, extended the emergency declaration to May 31, 2020;

WHEREAS, the emergency declaration extension is necessary because COVID-19 continues to

be a significant public health concern that requires extensive staff and resource commitments;

WHEREAS, the County desires to extend the declaration to July 6, 2020 in order to protect the

health and safety of the citizens of Clatsop County; and

NOW, THEREFORE, the Clatsop County Board of Commissioners enacts the following:

Section 1. The emergency declaration is extended to July 6, 2020.

Issues Before the Commission:

Consider approval of Emergency Order #2 – approving plan to gradually reopen lodging, camping and short-term rentals.

Informational Summary:

On March 22, 2020 your Board approved Emergency Order #1 which effectively restricted camping and lodging in Clatsop County due to COVID-19. This order was amended twice to extend the effective date through April 30, 2020 and May 31, 2020, respectively.

Based on the County’s Plan to Implement Governor’s Reopening Oregon Framework, the County was approved for Phase 1 reopening by the Governor effective May 15, 2020. The Governor’s Framework and the County Plan are founded on a measured and phased approach to reopening the economy with regular assessment of the seven prerequisite criteria.

The cities of Gearhart, Warrenton, and Astoria joined Clatsop County in a coordinated plan to gradually reintroduce lodging and camping beginning on June 5, 2020. This date was selected as it is 21 days from entering Phase 1 (May 15) and coincides with the Governor designated monitoring period between phases.

The cities and County are committed to manage local decisions within the Governor’s Framework. The lifting of travel restrictions is a key consideration for the local easing of lodging and camping restrictions. Emergency Order #2 eases restrictions on lodging and camping in a two-step process. Step 1 allows 60% of total capacity for a minimum of 21 days. If the prerequisite criteria are trending positively, the County will move to Step 2 and lodging and camping may resume at 100% capacity.

The County reserves the right to adjust the % of total capacity approved for occupancy and the timeframe between steps based on the ongoing evaluation of the prerequisite criteria.

If adopted, Emergency Order #2 goes into effect immediately and incorporates the continuation of Emergency Order #1.

RESOLUTION AND ORDER

WHEREAS, in response to the COVID-19 pandemic, the Oregon Governor ordered Oregonians

to “Stay Home, Save Lives,” directing individuals to stay home to the greatest extent possible,

ordering the closure of specified retail businesses, banned on-site consumption of food and drink

at food establishments, and requiring physical distancing measures for other public and private

facilities;

WHEREAS, on March 22, 2020, the County enacted Emergency Order #1, setting forth

additional health measures to stop community spreading and to mitigate individual and

community impacts. Order #1 prohibited local lodging, camping and short-term rental

restrictions except for existing residential long-term use and employment-related lodging.

WHEREAS, the County extended Emergency Order #1 and it is set to expire on May 31, 2020;

WHEREAS, the Oregon Governor adopted the Framework for Reopening a Safe and Strong

Oregon. The Framework provides a statewide phased reopening process, requiring the

Governor’s approval for counties to enter into Phase I after meeting all prerequisites;

WHEREAS, Clatsop County submitted a reopening plan to the Governor and was approved to

start Phase I on May 15, 2020;

WHEREAS, the Governor’s lifting of state-wide travel restrictions is necessary for easing local

lodging, camping and short-term rental restrictions for non-essential use. The Governor’s

Framework restricts non-essential travel until Phase II and is projected to begin on June 5, 2020;

WHEREAS, the County desires to enact a second emergency order, to reflect the incremental

and stepped approach adopted by the Governor and other communities utilizing best practices;

and

WHEREAS, key federal and state partners are working collaboratively with Clatsop County to

coordinate the reopening of park amenities with the easing of travel, lodging and camping

restrictions. The cities of Gearhart, Warrenton, Astoria (the “cities”) and Clatsop County agree to

a coordinated and structured plan to continue the regulations in Emergency Order #1 and to ease

restrictions on lodging, camping and short-term rentals;

WHEREAS, the cities and the County desire to allow up to 60% occupancy of the lodging,

camping and short-term rentals on June 5, 2020, to coordinate with Phase II of the Governor’s

Framework. The cities and the County desire to allow up to 100% occupancy of the lodging,

camping and short-term rentals on June 26, 2020;

WHEREAS, Clatsop County reserves the right to modify the % of allowable occupancy

(capacity) and the timeline for progressing towards 100% based on the ongoing assessment of

the Governor’s seven prerequisite criteria;

WHEREAS, the COVID-19 virus continues to present a risk to public health and the County

desires to strongly encourage residents and visitors to comply with the guidance from the Centers

for Disease Control (CDC), Oregon Health Authority (OHA) and Clatsop County Public Health.

Mitigation guidelines include physical distancing, proper hygiene, face coverings and restrictions

on mass gatherings;

NOW, THEREFORE, the Clatsop County Board of Commissioners enacts the following:

Section 1. This emergency order is effective immediately.

Section 2. Except as provided in Section 3 of this Order for the phased reopening, the

restrictions on lodging, camping and short-term rentals in Emergency Order #1 and as modified

by the County Manager, are continued.

Section 3. The plan for reopening lodging, camping and short-term rentals and the health and

safety guidelines as set forth in the attached Exhibit A is hereby adopted and incorporated herein.

This Order may be modified, rescinded or extended by the authority of the County Manager, in

consultation with the Board of Commissioners.

LODGING, CAMPING AND SHORT-TERM RENTALS

1. Underlying principles

a) The Governor’s Reopening Oregon Framework and Clatsop County’s

Implementing Plan are based on an incremental and stepped approach to

easing restrictions;

b) The COVID-19 virus continues to present a risk to public health. Residents

and visitors are strongly encouraged to comply with the guidance from the

Centers for Disease Control (CDC), Oregon Health Authority (OHA) and

Clatsop County Public Health. Mitigation guidelines include physical

distancing, proper hygiene, face coverings and restrictions on mass

gatherings. Vulnerable populations should continue to self-isolate and limit

non-essential travel and outings;

c) The cities of Gearhart, Warrenton, Astoria and Clatsop County agree to a

coordinated and structured plan to ease restrictions on lodging, camping and

short-term rentals;

d) The Governor’s Reopening Oregon Framework restricts non-essential travel.

The lifting of travel restrictions is a key consideration for easing local

lodging, camping and short-term rental restrictions;

e) Key federal and state partners are working collaboratively with Clatsop

County to coordinate the reopening of park amenities with the easing of

travel, lodging and camping restrictions; and

f) Adjustments to this Plan will be informed by the regular monitoring of the

Governors seven prerequisite criteria. Depending on the situation, the cities

and County may adjust the % of allowable occupancy and/or timeline as part

of a broader strategy to respond to emerging public health considerations.

2. Lodging, Camping and Short-term Rental

a) Hotel/Motel Restrictions

1. Step 1 – 60% of total room capacity may be occupied daily from June

5, 2020 through June 25, 2020

c) Short-term Rental, Home Stay and Bed & Breakfast Restrictions

1. Step 1 – 60% of maximum occupancy capacity (rounded up) may be

occupied daily from June 5, 2020 through June 25, 2020.

o Example 1: If a rental home has a maximum capacity of 8

occupants; during step 1 maximum daily occupancy is 5

(8*0.6=4.8, rounded up to 5).

o Example 2: If a homestay rental has a capacity of 2; during

step 1 maximum daily occupancy is 2 (2*.06=1.2, rounded up

to 2)
