NOTICE IS HEREBY GIVEN, that thePlanning Commission will hold a public hear-ing to consider amendments to the ClaremontMunicipal Code (CMC) banning the retailsale, cultivation, and mobile delivery of med-

ical marijuana in the City of Claremont. Thehearing will be held on Tuesday, December15, 2015, at 7 p.m.,  in the City CouncilChamber, 225 W. Second Street, at whichtime all interested persons are invited to ap-pear and be heard.Currently, Section 9.72.010 of the CMC bansthe sale or distribution of a medical marijuanaon any property or in any building or struc-ture in any zone throughout the City, with theexception of residential zones, unless the per-son or entity selling or distributing the con-trolled substance has all applicable State andFederal pharmaceutical licenses. While exist-ing City regulations address medical mari- juana dispensarie s, cultivation and mobiledelivery of medical marijuana are left unad-dressed. The California Legislature recentlypassed a series of bills that together comprisethe Medical Marijuana Regulation and SafetyAct (MMRSA) establishing a comprehensiveregulatory framework for California’s med-ical marijuana industry. Under MMRSA, mu-nicipalities can either ban or regulatecultivation, manufacturing, dispensaries, dis-

tribution and transporters of medical mari- juana, confirming what the courts have heldregarding local municipalities’ power to reg-ulate or ban activities related to the sale anddistribution of medical marijuana. Should acity fail to adopt land use regulations or ordi-nances that prohibit medical marijuana dis-pensaries, the cultivation of medicalmarijuana and/or the mobile delivery of med-

ical marijuana prior to March 1, 2016,MMRSA regulations, standards, and require-ments, which are less restrictive than thosefound in CMC Section 9.72.010, shall be-come applicable. Under MMRSA, city landuse regulations pertaining to medical mari- juana uses m ay be stricter than what is m an-dated by State law. The proposed ordinanceto amend CMC Chapter 9.72 prior to March16, 2016, would enact and enforce a ban onall cannabis dispensaries, cannabis manufac-turers, cultivation, and cannabis deliveryoriginating or terminating within the Citylimits. The City intends to further study landuse issues pertaining to medical marijuana in2016 and to craft a new ordinance that willbe brought forward for consideration later inthe year.NOTICE IS FURTHER GIVEN, the Direc-tor of Community Development has deter-mined that this matter is not subject toCalifornia Environmental Quality Act(CEQA) pursuant to CEQA Guidelines Sec-tions 15060(c)(3) because this activity is nota project as defined by Section 15378 of the

CEQA Guidelines, California Code of Regu-lations, Title 14, Chapter 3, and pursuant toCEQA Guidelines Section 15061(b)(3) be-cause it can be seen with certainty that it willnot have a significant effect or physicalchange to the environment.
