AN ORDINANCE OF THE CITY COUN-CIL OF THE CITY OF CLAREMONT,

AMENDING AND UPDATING VARIOUSCHAPTERS AND SECTIONS OF THE

CLAREMONT MUNICIPAL CODE.Summary of Ordinance

The Ordinance amends the Claremont MunicipalCode as follows: • Chapter 1.14 is revised to create a second type ofadministrative citation. The City’s existing Ad-ministrative Citation will remain, and continue tobe issued by code enforcement officers. Such Ad-ministrative Citations will primarily be related tobuilding code violations or other “correctable” vi-olations. The second type of citation will be calleda Police Citation and will be issued exclusively byClaremont Police Officers. Police Citations will behandled similar to parking citations. Persons chal-lenging Police Citations will seek initial reviewfrom a Claremont Police Department Watch Com-mander and, should further review be requested, anadministrative hearing will be held similar to park-ing citations. Recipients of Police Citations willhave 21 days to pay the fine (same as parking cita-tions) or request review, and fines will be subjectto late fees if not paid on time. The fine paymentdeadlines and administrative hearing procedures forAdministrative Citations remain unchanged. TheCity may pursue recovery of costs for all adminis-trative hearings on both citations, and recipients ofthe citations will be allowed to challenge the finalruling of the hearing officer by filing a petition tothe superior court.• Chapter 1.16 is revised to incorporate the provi-sions of the Government Claims Act (Gov. Code §900 et seq.) and include the following: (1) estab-lishes requirements for contents of claims; (2) es-tablishes the procedure for filing late claims; (3)specifies tax refunds as requiring claims, rather thanrequiring claims to be filed for all types of refunds;(4) corrects the time limits for presenting claimsand for filing lawsuits after claims have been re-jected; (5) establishes the time period for the City toact on a claim; (6) requires any “class action” claimto be verified by each member of that “class”; (7)requires claims to be presented to the City Clerk;(8) authorizes the City Manager (or his/her de-signee) to review all claims for sufficiency and no-tify claimants of any insufficiencies in their claims;and (9) authorizes the City Manager to reject, set-tle, compromise or allow claims up to $2,500.• Section 2.040.020 is revised to eliminate the fol-lowing existing language regarding the City Man-ager: “At the time of his or her appointment, he orshe need not be a resident of the city or state, butduring his or her tenure of office he or she shall re-side within the city.”• Section 2.04.050 is revised to allow the City Man-ager to designate a qualified administrative officeby letter and/or by email filed with the City Clerk.• Section 2.04.060 is revised to add the position ofFinance Director to the list of Department Head po-sitions under the City Manager’s supervision.• Section 2.08.020 is revised to add the exceptionthat the City Manager may, with the Mayor’s ap-proval, determine that a different location is neces-sary or better suited for the purpose of the meeting.• Section 2.12.040 is revised to add to the existinglanguage to allow for reserve police officers to becompensated when: (1) working “special events”paid for by third parties; (2) responding to a sub-poena related to a reserve police officer’s duties;and (3) when authorized by the City Manager forseasonal events. The proposed language will alsoadd that reserve police officers are to be reimbursedfor personnel expenses as a monthly per diem ap-proved by the City Manager.• Section 2.12.050 is revised to add that a reservepolice officer may also have the same power andauthority of a regular police officer when he/she hassatisfied the requirements of a Level I reserve offi-cer as defined by the Peace Officer Standards andTraining (POST) requirements.• Section 2.16.010 is revised to establish a boundaryfor the residence of the one approved commissionerof up to one quarter mile outside the City limits.• Section 3.29.200 is revised to remove the separatepublic hearing requirement for the Utility Users Tax(UUT) and include review of the UUT in two publichearings held for development of the annual budget.• Section 4.16.120 is revised to remove “dumps,”and will add mobile disc jockeys (“Mobile DJs”)to Tax Category XII.• Section 4.18.120 is revised to replace “dumps”with mobile disc jockeys (“Mobile DJs”) in TaxCategory XII. The proposed changes will also setthe business tax rate for Mobile DJs as $75 for thefirst day and $32.50 for each additional day. Theserates are equal to the existing rates for concerts anddances. The new languagealso replaces the term “blind person” with “a per-son with a disability” and removes language re-quiring proof of certification from “a recognizeddog training institution.” • Section 6.12.080 is revised to add specific re-quirements for service animals, using the same lan-guage as provided in the ADA. The new languagefollows the ADA requirement for a service animalto have a harness, leash or other tether and be underthe control of its handler. Under specific circum-stances, a service animal may be off leash in pub-lic, but must still be under its handler’s control. Theproposed changes also exempt police service dogsfrom the leashing requirement when they are en-gaged in law enforcement activities. • Chapter 8.04 is revised to add language regardingmobile food vendors and vending vehicles to allowfor and regulate food trucks within the City. Thechanges include a requirement for all food trucksto obtain mobile food vendor permits from theCommunity Development Director. The new lan-guage also exempts food trucks from the City’s so-licitation regulations. The new language furtherexempts any publicly owned vending vehicles;food trucks operating for private events; and foodtrucks operating for special events in public areas(e.g., block parties, parades, etc.). The proposedchanges also require written permission from apublic school for a food truck to operate within 300feet of the school. Finally, the changes provide op-erating regulations, limiting the location of foodtrucks with reference to businesses, intersections,and bus stops.• Sections 8.08.255(B), 8.16.020(B.4), 16.087.030,16.142.010, 17.168.020(B) and Chapter 12.26 arerevised to change the language from “Director ofCommunity and Human Services” to “Director ofCommunity Services.” • Chapter 8.20 is revised to delete the Chapter fromthe Municipal Code due to it being nearly identicalto the language in subdivisions G and H of Section12.26.090. • Chapter 9.80 is revised to add language to morespecifically identify the prohibited conduct andclarify the exceptions for such conduct to allow forlegitimate free movement in public. The proposedchanges also add language that clarifies the actionsto be taken by police officers in enforcing these reg-ulations.
