office of the City Clerk)AN ORDINANCE OF THE CITY COUNCILOF THE CITY OF CLAREMONT, AMEND-ING AND UPDATING VARIOUS CHAP-TERS AND SECTIONS OF THECLAREMONT MUNICIPAL CODE.
Summary of Ordinance The Ordinance amends the Claremont MunicipalCode as follows: • Chapter 1.14 is revised to create a second typeof administrative citation. The City’s existingAdministrative Citation will remain, and continueto be issued by code enforcement officers. SuchAdministrative Citations will primarily be relatedto building code violations or other “correctable”violations. The second type of citation will becalled a Police Citation and will be issued exclu-sively by Claremont Police Officers. Police Ci-tations will be handled similar to parkingcitations. Persons challenging Police Citationswill seek initial review from a Claremont PoliceDepartment Watch Commander and, should fur-ther review be requested, an administrative hear-ing will be held similar to parking citations.Recipients of Police Citations will have 21 daysto pay the fine (same as parking citations) or re-quest review, and fines will be subject to late feesif not paid on time. The fine payment deadlinesand administrative hearing procedures for Ad-ministrative Citations remain unchanged. TheCity may pursue recovery of costs for all admin-istrative hearings on both citations, and recipientsof the citations will be allowed to challenge thefinal ruling of the hearing officer by filing a peti-tion to the superior court.• Chapter 1.16 is revised to incorporate the pro-visions of the Government Claims Act (Gov.Code § 900 et seq.) and include the following: (1)establishes requirements for contents of claims;(2) establishes the procedure for filing late claims;(3) specifies tax refunds as requiring claims,rather than requiring claims to be filed for alltypes of refunds; (4) corrects the time limits forpresenting claims and for filing lawsuits afterclaims have been rejected; (5) establishes the timeperiod for the City to act on a claim; (6) requiresany “class action” claim to be verified by eachmember of that “class”; (7) requires claims to bepresented to the City Clerk; (8) authorizes theCity Manager (or his/her designee) to review allclaims for sufficiency and notify claimants of anyinsufficiencies in their claims; and (9) authorizesthe City Manager to reject, settle, compromise orallow claims up to $2,500.• Section 2.040.020 is revised to eliminate the fol-lowing existing language regarding the City Man-ager: “At the time of his or her appointment, he orshe need not be a resident of the city or state, butduring his or her tenure of office he or she shallreside within the city.”• Section 2.04.050 is revised to allow the CityManager to designate a qualified administrativeoffice by letter and/or by email filed with the CityClerk.• Section 2.04.060 is revised to add the position ofFinance Director to the list of Department Headpositions under the City Manager’s supervision.• Section 2.08.020 is revised to add the exceptionthat the City Manager may, with the Mayor’s ap-proval, determine that a different location is nec-essary or better suited for the purpose of themeeting.• Section 2.12.040 is revised to add to the exist-
ing language to allow for reserve police officersto be compensated when: (1) working “specialevents” paid for by third parties; (2) responding toa subpoena related to a reserve police officer’sduties; and (3) when authorized by the City Man-ager for seasonal events. The proposed languagewill also add that reserve police officers are to bereimbursed for personnel expenses as a monthlyper diem approved by the City Manager.• Section 2.12.050 is revised to add that a reservepolice officer may also have the same power andauthority of a regular police officer when he/shehas satisfied the requirements of a Level I reserveofficer as defined by the Peace Officer Standardsand Training (POST) requirements.• Section 2.16.010 is revised to establish a bound-ary for the residence of the one approved com-missioner of up to one quarter mile outside theCity limits.• Section 3.29.200 is revised to remove the sepa-rate public hearing requirement for the UtilityUsers Tax (UUT) and include review of the UUTin two public hearings held for development ofthe annual budget.• Section 4.16.120 is revised to remove “dumps,”and will add mobile disc jockeys (“Mobile DJs”)to Tax Category XII.• Section 4.18.120 is revised to replace “dumps”with mobile disc jockeys (“Mobile DJs”) in TaxCategory XII. The proposed changes will also setthe business tax rate for Mobile DJs as $75 forthe first day and $32.50 for each additional day.These rates are equal to the existing rates for con-certs and dances. The proposed changes will alsoadd a definition of “theatrical performances.”• Chapter 5.03 is revised to remove the 1986 or-dinance language and will add additional lan-guage from the Digital Infrastructure and VideoCompetition Act of 2006 (DIVCA) regarding en-croachment permits and payment of late fees bystate video franchise holders.• Chapter 5.28 is revised to delete the chapter,given it is now regulated by Chapter 5.40 (Solic-itation), adopted in 2008.• Chapter 5.38 is revised to add language ad-dressing the purposes of the chapter, includinglanguage to reduce the risk of fraud and larceny.The proposed changes also clarify the permit re-quirements for fortunetelling businesses to re-quire both a business license and a fortunetellingpermit. The proposed changes also clarify the re-ligious exemptions for any potential Constitu-tional issues.• Section 5.40.010.F is revised to delete the lan-guage referencing leaflets and flyers because itconflicts with case law by the State SupremeCourt and U.S. Supreme Court.• Section 5.40.140 is revised to require personsselling food from vehicles to comply with theprovisions of Chapter 8.04, which regulates mo-bile food vendors (“food trucks”). Chapter 8.04requires mobile food vendors to display their per-mits and a City business tax certificate.• Section 6.12.010 is revised to add new subsec-tion “D” to Section 6.12.010 to define “serviceanimal,” using the same language as provided inthe Americans with Disabilities Act (ADA). Theproposed language distinguishes a “service ani-mal” from an animal that provides “emotionalsupport, well-being, comfort or companionship.”• Section 6.12.030 is revised to specify the ex-emption is for the licensing fees and adds policeservice dogs to the above exemption. The newlanguage also replaces the term “blind person”with “a person with a disability” and removes lan-guage requiring proof of certification from “a rec-ognized dog training institution.” • Section 6.12.080 is revised to add specific re-quirements for service animals, using the samelanguage as provided in the ADA. The new lan-guage follows the ADA requirement for a serviceanimal to have a harness, leash or other tether andbe under the control of its handler. Under spe-cific circumstances, a service animal may be off
leash in public, but must still be under its han-dler’s control. The proposed changes also exemptpolice service dogs from the leashing requirementwhen they are engaged in law enforcement activ-ities. • Chapter 8.04 is revised to add language regard-ing mobile food vendors and vending vehicles toallow for and regulate food trucks within the City.The changes include a requirement for all foodtrucks to obtain mobile food vendor permits fromthe Community Development Director. The newlanguage also exempts food trucks from theCity’s solicitation regulations. The new languagefurther exempts any publicly owned vending ve-hicles; food trucks operating for private events;and food trucks operating for special events inpublic areas (e.g., block parties, parades, etc.).The proposed changes also require written per-mission from a public school for a food truck tooperate within 300 feet of the school. Finally, thechanges provide operating regulations, limitingthe location of food trucks with reference to busi-nesses, intersections, and bus stops.• Sections 8.08.255(B), 8.16.020(B.4),16.087.030, 16.142.010, 17.168.020(B) andChapter 12.26 are revised to change the languagefrom “Director of Community and Human Serv-ices” to “Director of Community Services.” • Chapter 8.20 is revised to delete the Chapterfrom the Municipal Code due to it being nearlyidentical to the language in subdivisions G and Hof Section 12.26.090. • Chapter 9.80 is revised to add language to morespecifically identify the prohibited conduct andclarify the exceptions for such conduct to allowfor legitimate free movement in public. The pro-posed changes also add language that clarifies theactions to be taken by police officers in enforc-ing these regulations. The proposed changes alsoinclude a severability clause so that if any part ofthe ordinance is challenged and found to be un-enforceable, the remainder will be valid and en-forceable.• Section 9.92.010 and 11.02.030 are revised toincorporate paintball and airsoft guns into the listof prohibited weapons. Although these twoweapons are generally prohibited under the cur-rent code language, they are not specificallynamed in the code.• Section 10.08.050 is revised to eliminate the ap-pointment by the City Manager and designatesthe City Engineer to serve as the City Traffic En-gineer. The proposed language also states that allreferences to “City Traffic Engineer” shall meanthe City Engineer.• Section 10.32.025 is a new section that author-izes the City Engineer to restrict parking on resi-dential streets on days scheduled for streetsweeping and/or collection of trash and recycla-ble materials. Under this new section, the CityEngineer may place signs or markings on resi-dential streets to restrict parking for street sweep-ing and/or trash and recyclable materialscollection.• Section 10.32.210 is revised to update the sec-tion to include utilizing the City’s online“Overnight Parking” (ONP) exemption system,available through the City’s website, as a methodfor requesting an exemption. The proposed lan-guage also clarifies that an exemption is “per ve-hicle” and that the Police Chief makes thedetermination as to whether a request for an ex-emption of longer than three nights has demon-strated good cause.• Chapter 10.60 is revised to eliminate the licens-ing provisions for bicycles and retains the exist-ing sections regulating bicycle ways and bicycleparking zones.• Section 10.69.090 is revised to clarify that vio-lations listed in this section pertain to residentparking permits. Also, the new language adds aviolation for selling, loaning or otherwise trans-ferring a valid Wilderness Park/Thompson CreekTrail residential parking permit to a third party.
The proposed new language will also identify thespecific penalty for violations of this chapter.• Title 11 and Chapter 12.42 are revised tochange the language from “Director of Com-munity and Human Services” to “Director ofHuman Services.” • Section 11.02.040 is revised to separate the sec-tion into two subsections. The first subsectioncontains the existing prohibition regarding “mis-siles.” The new second subsection prohibits op-erating a model rocket within any public park oron any public highway.• Section 11.02.070 is revised to exempt from re-strictions any maintenance personnel, law en-forcement personnel, or persons responding to anemergency situation that requires vehicular ac-cess in a City park.• Section 11.02.120 is revised to add exemptionsfor: (1) service animals that are accompanied bytheir handlers and following the City’s leashingrequirements, and (2) for police service dogs en-gaged in law enforcement duties in public parks. • Section 11.10.070 is revised to incorporatepaintball and airsoft guns and compound bowsinto the list of prohibited weapons. Althoughthese weapons are generally prohibited under thecurrent code language, they are not specificallynamed in the existing section.• Section 11.10.120 is revised to add an exemp-tion for police service dogs engaged in law en-forcement duties is the Claremont HillsidesWilderness Park. The proposed language willalso require persons with horses and exotic pets inthe park to clean up after their animals.• Section 12.04.090 is revised to add a referenceto the existing appeal procedures in Chapter16.321 for appealing any denial of an excavationpermit.• Title 14 is revised to delete the title as the mu-nicipal solar utility has never been implemented.
