CHURCHILL GARDENS ESTATE
THE CITY OF WESTMINSTER (ESTATE PARKING) (ON-STREET) ORDER 201*
1. NOTICE IS HEREBY GIVEN that Westminster City Council proposes to make theabove Order under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to theRoad Traffic Regulation Act 1984, as amended.
2. The general effect of the Order would be to facilitate the civil enforcement of all on-street parking places and waiting restrictions on the roads within the Churchill GardensEstate under the provisions of the Traffic Management Act 2004. This would enable theCouncil’s Civil Enforcement Officers to issue Penalty Charge Notices when parkingcontraventions occur.
3. The Order would provide that the roads on the estate would form the ChurchillGardens Controlled Parking Zone (CPZ) within which parking would be restricted to thosevehicles displaying valid parking permits for the estate.
4. The following types of on-street parking places would be formally designated on theestate:
· Unassigned residents’ parking bays – for use by any vehicle displaying avalid residents’ permit, contractors’ permit or multi-registration permit;
· Residents’ parking bays assigned to specific residents – for use by thevehicle displaying the numbered permit relating to that bay;
· Visitor / contractor parking bays (located underneath the overhang ofNos. 135 to 137 Lupus Street) – for use by any vehicle displaying a validresidents’ visitor permit or contractors’ permit;
· Shared-use parking bays (to replace all existing residents’ parking bays onChurchill Gardens Road) – for use by any vehicle displaying a valid residents’permit, visitor permit, contractors’ permit or multi-registration permit; and
· Motorcycle parking bays (to be introduced outside and opposite Elgar House,at the northern end of the echelon parking opposite Wilkins House, and outsidethe play area near Shelley House).
5. The following types of permit would be available:
· Residents’ permit for unassigned baysThe charge for a residents’ permit would remain as follows:· £4.13 per week for a tenant / lessee of the estate;· £17.31 per week for a City of Westminster resident who does not live on
the estate; and· £51.90 per week for any other person;
· Resident’s permit for bays assigned to specific residents – no charge;
· Residents’ visitor permit (in the form of a scratch card)The charge for a visitor permit would be £1.00 for 2 hours of parking (up to 10scratch cards could be purchased within any single calendar month);
· Contractors’ permit (for use by approved City Council staff and contractorsworking on the estate) – no charge; and
· Multi-registration permit (for use by carers of certain residents) – no charge.
6. All existing permit holders would be issued with replacement permits. Residents withassigned bays would be issued with uniquely numbered replacement permits specific totheir existing dedicated parking bays.
7. New permits would be issued by the City Council provided that the applicant meetsthe relevant criteria and that parking bays are available.
8. Vehicles must be parked within the limits of a parking bay and display the relevantpermit for that type of parking bay.
9. The parking bays and waiting restrictions would apply “at any time”.
10. Engine idling by waiting vehicles would be prohibited, with certain exceptions.
11. The proposed Order and other documents giving more detailed particulars of theproposals are available for inspection until six weeks have elapsed from the date on whicheither the Order is made or the Council decides not to make the Order between 9 a.m. and5 p.m. on Mondays to Fridays inclusive at the Estate Office, 137 Lupus Street, SW1V 3HEand at WSP, Portland House, Bressenden Place, London, SW1E 5RS.
12. General queries about the proposed introduction of civil enforcement on housingestates or queries about existing permits and parking arrangements should be directed tothe City Council’s Parking Consultation Team on 0800 358 3783. Further informationregarding the consultation process or the proposed Order should be directed to theCouncil’s agents, WSP, on (020) 3057 2156. Details are also available athttp://westminstertransportationservices.co.uk/estateparking.
13. Any objections or other representations about the proposals should be sent inwriting to the Council’s agents, WSP, Portland House, Bressenden Place, London,SW1E 5RS, or by email to [email protected] quoting reference 7382/PJ, by23rd April 2019. All objections must specify the grounds on which they are made.

Statement of Reasons
Churchill Gardens is the first estate to be included within the City Council’s parkingenforcement remit.
Historically, the City Council’s housing estate land has not been included within theparking enforcement arrangements that apply elsewhere across the City’s on-streetparking zones, and has been effectively treated as private land. Until May 2016, parkingon the estates was controlled instead by a contractor through the issue of non-statutory“parking notices” with charges attached, which the DVLA supported by providingregistered keeper details to help secure payment.
However, in May 2016, the DVLA stopped providing these details, meaning that non-statutory parking notices ceased to be an effective method of parking enforcement, ascharges could no longer be recovered successfully.
Therefore, to control unauthorised parking within the City Council’s housing estates it willbe necessary to make Traffic Management Orders which will allow the City Council’s civilenforcement officers to issue Penalty Charge Notices (PCNs) for non-compliant parkingunder the existing relevant stautory legislation.
The benefits of bringing the housing estates within the City Council’s existing parkingenforcement regime are three-fold:
· to prevent and deter vehicles from obstructing access for emergency servicesor service vehicles;
· to enable the City Council’s civil enforcement officers to relocate or removeobstructive or incorrectly parked vehicles where necessary; and
· to ensure that residents, visitors and tradespersons who are permitted to parkon estate land are not deprived of those places by unauthorised vehicles.
