AMERICAN MUSIC AWARDS PERMIT NO. 20091557 -CLAIM: FOR REFUND NO. 104150 FOR OVERPAYMENT OF SPECIAL EVENT FEES

RECOMMENDATION:

l. Authorize the Bureau of Street Services (Bureau) and the Office of Accounting, subject to the approval of the City Council, to process the Claim for Refund Over $5,000 No. 104150, to refund Dick Clark Productions (American Music Awards), overpaid special event fees in the amount of $68,219.53 at the time the refund is approved by the City Council.

2. Forward this report to the City Council with recommendation that the Claim for Refund Over $5,000 No. 104150 be approved, and that Dick Clark Productions (American Music Awards) be refunded the amount overpaid at the time the refund is approved by the City Council.

TRANSMITTALS:

1. Statement for Permit No. 20091557 2. Claim for Refund. No. 104150

RECITAL:

On November 19,. 2009, the City issued a permit to Dick Clark Productions for the American Music Awards on November 22, 2009, at the Staples Center!LA Live area. The fees for the permit were based on estimates obtained from various City departments.

After the event, all City departments are required to reconcile actual costs with estimates and provide that information to the Special Events One Stop Section of the Bureau of Street Services. In this case, two departments provided final costs less than original estimates.

The Department of Transportation (DOT) submitted an estimate for sign posting for $266.70; the actual cost was $126.00. The DOT estimate for traffic control was $1,276.87; the actual cost was $1,152.03. The most significant portion of the refund is related to the Los Angeles Police Department (LAPD) estimate of$76,840.00; actual cost was $8,886.01.

The applicant was advised of the refund, and a claim was filed requesting a refund of $68,265.99. The applicant paid a total of$79,211.81 to obtain the permit. After all final costs were received, and further investigation, we determined a refund of $68,219.53 is warranted.

CONCLUSION:

Based on the above, it is recommended that Dick Clark Productions Claim for Refund No.l04150 be approved and that Dick Clark Productions be refunded the amount at the time the refund is approved by the City Council.
