Approval of Hiring Christopher Campbell as Finance Manager and authorizing the City Administrator to negotiate the pay and benefits package. If unsuccessful with Mr. Campbell, approval of hiring Jason Lawrence as Finance Manager and authorizing the City Administrator to negotiate the pay and benefits package.
Item 4e: Approval of Hazard Mitigation Projects and authorize City staff to execute all necessary documents to apply for grant funding for said projects.
Item 4c Synopsis: Evaluation Committee for RFP # 2017‐01 Land Development Re‐Write On January 26, 2017, staff began the process of soliciting proposals for the Land Development Re‐Write. Proposals are due on Wednesday, February 22, 2017 at 3:30pm and packets will be available on Thursday, February 23, 2017. The RFP is available on the City Website and DemandStar. Pending this approval from the City Commission the Evaluation Committee will be comprised of PLDRC Chairman Joseph Hammett, City Administrator Jason Yarborough and City Clerk Becky Witte. The Committee plans to review responses on Wednesday, March 1, 2017 at 8:30am at City Hall. The Committee will use the evaluation criteria set forth in RFP # 2017‐01 to rank the proposals and bring forth to the City Commission in March. Item 4d Synopsis: Michael Wright announced his goal to retire at the end of February 2017. After advertising and interviewing candidates, the City Administrator and staff recommends hiring Christopher Campbell (resume attached). The approval of this consent agenda item would include hiring of Mr. Campbell and authorizing the City Administrator to negotiate the pay and benefits package. If negotiations are not successful, the City Commission authorizes the hiring of Jason Lawrence (resume available upon request) and authorizing the City Administrator to negotiate the pay and benefits package. Item 4e Synopsis: Florida Department of Emergency Management has said they expect the Notice of Funding Availability (NOFA) for HMGP Hurricane Matthew funding to be released in February. Once it is released, we will have 90 days to submit our priority list for Volusia County applications and each jurisdiction to submit the applications. Staff has worked to have three items placed on the Local Mitigation Priority list. Tier 3 funding will be available from Hurricane Hermine. Volusia County will receive Tier 1 & Tier 2 funding for Hurricane Matthew. The consent agenda approval will include support of the Hazard Mitigation projects list and direct staff to continue efforts on securing funding for these three projects.

City Administrator Jason Yarborough discussed the Facility Policy to be put onto the February meeting, introduced Ben Cashman who is interning with the City from Stetson University, discussed the circus planned for February 17, 2017 as well as the retirement of Michael Wright (Finance Manager). Mr. Yarborough discussed the Historic Board request regarding a Fence Contractor, City of DeLand request for participation with Homeless Program at the Neighborhood Center, State Budget Appropriations Process request for Virginia Drive, as well as the upcoming Strategic Planning Session on February 3, 2017. Consensus to send letter to Dave’s Fence. Consensus to approve $1,500 request to City of DeLand for participation with Homeless Program at the Neighborhood Center. Mayor Buddy Snowden opened the Public Hearing Consultant Greg Beliveau discussed the process, noted the advertisement in the Beacon Newspaper, as well as the sign in sheet. Linda Garrett (Prevatt Ave) discussed the Commercial Support Intersections on Prevatt Avenue. MOTION Commissioner Michael Woods to retain the Commercial Support Intersection at Macy and Ohio but to remove the Commercial Support Intersections on Lemon and Prevatt as well as Ohio and Prevatt. Mayor passed the Gavel to Commissioner Tom Wilson. SECOND by Mayor Buddy Snowden. Discussion MOTION CARRIED UNANIMOUSLY. MOTION by Commissioner Tom Wilson to remove retail use in the GED land use. MOTION by Commissioner Tom Wilson to approve the First Reading of Ordinance 2017‐02 Annexation of 970 McKenzie Road (Zook) and waive the mailing and placard notice provisions with regard to voluntary annexations. SECOND by Commissioner Jim Connell. Discussion MOTION CARRIED UNANIMOUSLY. Item 8: COMMISSION CONSIDERATION: Item 8a: Consideration of COA for Renovations at 261 N Lakeview Drive Discussion with input from City Administrator Jason Yarborough. MOTION by Commissioner Tom Wilson to grant the Certificate of Appropriateness for COA for Renovations at 261 N Lakeview Drive. SECOND by Commissioner Jim Connell. MOTION CARRIED UNANIMOUSLY. Budget Analysis:
As of the end of January we are 33.3% into the fiscal year.
Revenue is exceeding expenses in all funds. In the case of the Café, most the
revenue reported is the result of recognizing revenue that was previously
unearned, i.e. amounts held as deposits.
Utility Fund. While revenue is exceeding expenses in the utility fund, actual
revenue (22.6%) is below budgeted revenue (33.3%). Contributing factors
include: New water meter installation, meter readings in December occurred
earlier (Dec. 12th vs. Dec 15th), less outdoor water usage due to higher rainfall
amounts, and customer conservation due to higher utility rates. Higher water
usage later in the year should improve actual vs. budgeted revenue.
Legal. No invoices received yet during this fiscal year.
Unrecorded Expenditures. Due to the date in which this report must be
produced, there are expenditures that occurred in this month’s reporting period
that are not yet available for this report, because we have not yet received all of
the month’s invoices. The cash disbursements report does reflect, however, all
payments of cash that occurred during the month.

RFP # 2017‐01 REQUEST FOR PROPOSALS FOR
Rewrite of City of Lake Helen’s Land Development Code (LDC) DUE: Wednesday, February 22, 2017 AT 3:30 PM
INTRODUCTION The City of Lake Helen, Florida, whose City Hall is located at 327 South Lakeview Drive, Post Office Box 39, Lake Helen, Florida 32744, is inviting Proposals for the Rewrite of City of Lake Helen’s Land Development Code (LDC). The purpose for this Request for Proposals (RFP) is to solicit competitive sealed bids from qualified firms to provide a rewrite of City of Lake Helen’s Land Development Code (LDC) consistent with the Comprehensive Plan. The approach shall be meant to create a zoning ordinance and supersede the entire local land development regulations that apply to the City. The City is most interested in preserving the existing quality of life that is afforded to its residents and visitors; preserving its small town charm; honoring and building upon its historical heritage; preserving its existing residential and rural character; and promoting economic vitality. PRIMARY WORK PRODUCT This contract will result in a rewrite of the City’s Land Development Code (LDC) consistent with the Comprehensive Plan. The approach shall be a proposal, meant to create a zoning ordinance and supersede the entire local land development regulations that apply to the City. The City is most interested in preserving the existing quality of life that is afforded to its residents and visitors; preserving its small town charm; honoring and building upon its historical heritage; preserving its existing residential and rural character; and promoting economic vitality. The City of Lake Helen hopes to begin work on this project in April or May (2017) but it could be delayed up to six (6) months depending on responses, comments and notes regarding the updated City Comprehensive Plan (transmitted in January 2017). The City of Lake Helen is an Equal Employment Opportunity Employer. Submittals consisting of 10 complete, signed original sets or 1 original and 9 high quality, legible, copies must be received. 1 CD of the Complete Submittal must also be included. After the closing time, Proposals will be opened for the sole purpose of recording the names of the respondents submitting their written Proposals and to deliver all timely received Proposals to the review committee. After the review committee has reviewed the proposals, the top candidates will be presented to the City Commission. The City Commission may select any number of respondents to interview or determine not to conduct interviews. Following the interviews, if any are held, the City Commission will select the respondent to engage and will authorize the City Administrator to negotiate and execute a contract with the selected respondent. The successful respondent shall prove by his/her/its qualifications, experience, and plan for the work that it will best serve the overall needs of the City. The selection of the successful respondent shall be at the City of Lake Helen’s discretion after receipt and evaluation of all responses. The City of Lake Helen shall be the sole judge of its own best interests, the proposals and the resulting agreement. Any respondent requiring special accommodations due to a disability or physical impairment at any of the public meetings regarding this RFP should contact the City Clerk at least 3 working days prior to any meeting. Any Proposals received after the specified time and date shall not be considered; additionally, any Proposals submitted orally, telephonically, e‐mailed, faxed, or modified shall not be accepted. All Proposals may only be submitted in person or by mail/courier service to the specified address by the specified deadline. The City cautions respondents to ensure actual delivery of mailed or hand delivered proposals prior to the deadline set for receiving proposals. PURPOSE/SCOPE OF WORK The City of Lake Helen, Florida, in conformance with the policies and procedures of the City of Lake Helen (City), is soliciting proposals from applicants that are interested in providing specific services to the City of Lake Helen. Specific services include the following: INTRODUCTION The purpose for this Request for Proposals (RFP) is to solicit competitive sealed bids from qualified firms to provide a rewrite of City of Lake Helen’s Land Development Code (LDC) consistent with the Comprehensive Plan. The approach shall be meant to create a zoning ordinance and supersede the entire local land development regulations that apply to the City. The City is most interested in preserving the existing quality of life that is afforded to its residents and visitors; preserving its small town charm; honoring and building upon its historical heritage; preserving its existing residential and rural character; and promoting economic vitality. PRIMARY WORK PRODUCT The result will be a rewrite of the City’s Land Development Code (LDC) consistent with the Comprehensive Plan. BACKGROUND a. INITIAL REVIEW AND ANALYSIS
1. Interviews. The Consultant will interview appropriate stakeholders involved with the project. These interviews will include, but are not limited to, groups and individuals including elected officials, property owners, and municipal staff.
2. Site Analysis. The Consultant will become familiar with the physical layout of the City and its historic patterns of development and architecture. Existing geographic information will also be provided to assist the Consultant with this analysis.
3. Initial Outcome. The Consultant shall make a recommendation based on the interviews and site analysis as to what approach will be taken to rewrite the LDC to accomplish its goals and implement the Comprehensive Plan.
b. PUBLIC AWARENESS 1. The Consultant shall plan to attend approximately ten (10) Public Meetings including Planning and
Land Development Regulation Commission and City Commission Board meetings DRAFTING THE LAND DEVELOPMENT CODE a. The Consultant shall provide a matrix that shows how the LDC and the Comprehensive plan are
linked, and focus on producing code that entirely replaces the LDC. The consultant shall review the

entire LDC to ensure consistency throughout the LDC. The goal is to develop an LDC that is clear, concise, and predictable as to the form of development.
b. Additional consultant task: Provide regulatory diagrams as part of the rewrite and provide a clear presentation of what the code requirements are and or what they seek to achieve.
DESIGN PARAMETERS FOR THE CODE a. Incorporating the Comprehensive Plan. The new code shall be consistent with the City
Comprehensive Plan. b. Simplified Development Process. Simplification to the greatest extent possible by which
development is reviewed and approved. The simplification of the development standards shall encourage quality development in the City. The development process must be fair, open and understandable for all users.
c. Include Innovative Planning Principals. The City seeks the incorporation of innovative planning concepts to the new regulation. The goal of the new land development regulations is to make the City of Lake Helen a better community by improving the basic policies and rules that govern land development activities in the city. The focus should be on outlining a land development regulation that will result in a sustainable, high quality environment.
d. User‐Friendly Format. The City seeks a concise, well‐written, and easy to use tool. Developers, consultants and the public should be able to easily navigate the new regulations without referring to a variety of separate ordinances.
e. Legal and Fair Document. The regulations must be fair but highly defensible rules for land development in the City of Lake Helen. The regulations Constitution principals, recent court rulings and other applicable case law. It must also be framed in accordance with Florida statutory authority as it pertains to community planning and land development, with such issues as vested rights, appeal processes and rezoning.
REFINING THE CODE a. Presentation of First Draft. The Consultant will present the first draft of the new code for the purpose
of gathering comments. Copies of the first draft will need to be in hardcopy and digital form and posted on the website. The presentation may be made to a special audience of neighborhood residents or stakeholders, or may be presented before a joint gathering of municipal boards and committees, as determined by the City.
b. Presentation of the Second Draft. After making revisions in response to comments on the first draft, the Consultant will present the second draft of the new code at another meeting convened by the City.
c. Meetings with Stakeholders. The Consultant will attend and participate in up to five (5) additional meetings with key stakeholders and/or staff to explain the details of the new code and obtain further input and comments. At least one meeting will be a training session with the City staff that will be implementing the code.

APPROVAL PROCESS a. Public Hearing Presentations. The Consultant will make formal presentations to the City Planning
and Land Development Regulation Commission and the City Commission during the adoption hearing stage.
b. Additional Revisions. The Consultant will be responsible for three (3) rounds of revisions that may become necessary between presentations. City staff will be responsible for collecting comments, questions, and suggestions for these refinements from various sources and consolidating them into a series of action items for revision or responses.
c. Final Work Product. The final work product shall be provided in Microsoft Word 2007 and Adobe Acrobat formats.
PRICE PROPOSAL Interested firms are asked to provide a "Not to Exceed" amount for this project with a breakdown of the overall cost into its constituent parts and the price for each one. In addition, please include the hourly rates (inclusive of overhead and profit) for personnel or personnel categories. Information about the City of Lake Helen can be found at our website, www.lakehelen.com. Proposals will be publicly opened and read aloud in the City Hall Conference Room on the above appointed date (2/22/2017) at 3:30p.m., local time, or as soon thereafter as possible. The City Commission shall be the final authority in the selection of any and all proposals (undetermined date). Respondents will be given proper notice for interviews before the City Commission. CLARIFICATION OF DOCUMENTATION Respondents requiring clarification or having a dispute with these documents must advise the City Clerk on the nature of the required clarification or basis of the dispute, in writing, no later than Thursday, February 9, 2017. If no written contact has been made by this specified date, the Respondent waives the right to any future consideration and accepts the documents as published and/or revised by the City. FLORIDA PUBLIC RECORDS LAW Submittal information shall be subject to Chapter 119, Florida Statutes, generally known as the "Florida Public Records Law." The City cannot regard any document, information or data as proprietary or confidential unless so exempted by Florida Statutes. Documents received with proprietary or confidential information may be resealed and returned without further consideration or obligation. EXPARTE COMMUNICATION Please note that to insure the proper and fair evaluation of a submittal, the City of Lake Helen prohibits exparte communication (i.e., unsolicited) initiated by the Respondent to the City Official or Employee evaluating or considering the submittals prior to the time a proposal decision has been made. Communication between Respondent and the City will be initiated by the appropriate City Official or Employee in order to obtain information or clarification needed to develop a proper and accurate evaluation of the proposal. Exparte communication may be grounds for disqualifying the offending Respondent from consideration or award of the proposal then in evaluation or any future proposal.

INDEMNIFICATION AGREEMENT The Respondent agrees to indemnify and hold harmless the City of Lake Helen in complete accordance with the attached requirements. This agreement shall be signed, notarized and returned with the qualification package. Failure to provide the Hold Harmless Indemnification Agreement may be cause for disqualification as nonresponsive to the qualifications requirements. PUBLIC ENTITY CRIME STATEMENT All invitations to bid, as defined by Section 287.012 (11), Florida Statutes, requests for proposals, as defined by Section 2387.012(16), Florida Statutes, and any contract document described by Section 287.028, Florida Statutes, shall contain a statement informing persons of the provisions of paragraph (2)(a) of Section 287.133, Florida Statutes which reads as follows:

a) Loss Deductible Clause: The City shall be exempt from, and in no way liable for, any sums of money that may represent a deductible in any insurance policy. The payment of such deductible shall be the sole responsibility of the Respondent and/or sub consultant providing such insurance.
b) Workers' Compensation Insurance: The Respondent shall obtain during the life of this Agreement, Worker's Compensation Insurance with Employer's Liability Limits of $500,000/$500,000/$500,000 for all the Contractor's employees connected with the work of this project and, in the event any work is sublet, the Respondent shall require the sub consultant similarly to provide Workers' Compensation Insurance for all of the employees unless such employees are covered by the protection afforded by the Respondent. Such insurance shall comply fully with the Florida Workers' Compensation Law. In case any class of employees engaged in hazardous work under this contract for the City is not protected under the Workers' Compensation statute, the Respondent shall provide, and cause each sub consultant to provide adequate insurance, satisfactory to the City, for the protection of the Respondents employees not otherwise protected.
c) Contractor's Public Liability and Property Damage Insurance: The Respondent shall obtain during the life of this agreement Commercial Automobile coverage, this policy should name the City of Lake Helen as an additional insured, and shall protect the Respondent and the City from claims for damage for personal injury, including accidental death, as well as claims for property damages which may arise from operations under this Agreement whether such operations be by the Respondent or by anyone directly or indirectly employed by the Respondent. 1) Automobile Bodily Injury Liability & Property Damage Liability

Preference shall be given to businesses with drug‐free workplace programs. Whenever two or more proposals, which are equal with respect to price, quality, and service, are received by the State or by any political subdivision for the procurement of commodities or contractual services, a bid received from a business that certifies that it has implemented a drug‐free workplace program shall be given preference in the award process. Established procedures for processing tie bids will be followed if none of the tied vendors have a drug‐free workplace program. The guide has been reviewed and supported by the Historic Preservation Board (November and December 2016), the Planning and Land Development Regulation Commission (November 14, 2016), and local architect and historical preservation expert Jerry Mills (see attached letter dated January 24, 2017). The proposed ordinance will add the following language to Article 15:
The Gateway Corridor Historical Style Guide dated ______________ is hereby adopted as a reference guide for developers in preparing architectural elevations and to the City in reviewing architectural elevations for approval. The Gateway Corridor Historical Style Guide is only a guide and does not require strict compliance nor dictate the only acceptable architectural style or design. Prior to final approval of a building permit for a new structure or modification of an existing structure which changes the architectural design within the Gateway Corridor, the plans and renditions shall be presented to both the Historic Preservation Board and the City Commission for the opportunity of public review and comment. Final approval for the issuance of a permit shall remain with the City Administrator.

WHEREAS, the City Commission recognized a need for clarification and guidance of Article 15, Gateway Corridor Architectural styles; and
WHEREAS, in effort to provide clarification of the architectural styles listed in the Land Development Code, the guide was created by staff utilizing valuable input, discussions and assistance from Historic Preservation Board members, Planning and Land Development Regulation Commissioners, the Historic Preservation Society, local historians and community members, the National Register of Historic Places Survey (created by Sidney Johnson in the early 1990’s), guidelines and recommendation by the City’s Planning Consultant and Architectural Historians (GAI Planning Consultants) as well as depictions, descriptions and pictures of buildings within Lake Helen and surrounding and similar areas; and
WHEREAS, the goal of the guide is to have a user friendly translation of the Architectural styles listed with the City’s Land Development Code specific to the uniqueness of Lake Helen which is compatible with the structures and the aesthetics of the City of Lake Helen; and
WHEREAS, the Gateway Corridor Historical Style Guide has been reviewed and supported by the Historic Preservation Board, the Planning and Land Development Regulation Commission as well a letter of support and backing from Jerry Mills, local architect and historian; and
WHEREAS, the goal is to utilize as a guide and reference for the public, staff and city boards with the ability for staff to update, modify and add additional depictions and themes as needed.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF LAKE HELEN, FLORIDA:
SECTION 1. LEGISLATIVE FINDINGS. The City Commission of the City of Lake Helen hereby adopts the recitals set forth in the preamble to this Ordinance (whereas clauses) as legislative findings.
SECTION 2. The City Commission of the City of Lake Helen hereby amends Article 15.06.06 of the City of Lake Helen Code of Ordinances to create 15.06.06 (A)(1)(e) to read as follows:

If any provision of this Ordinance or the application thereof to any person or circumstances is held invalid, the invalidity shall not affect other provisions or applications of this Ordinance which can be given effect without the invalid provision or application and to this end the provisions of this Ordinance are declared severable.
SECTION 5. CODIFICATION. Specific authority is hereby granted to codify and incorporate this Ordinance in the existing Code of Ordinances of the City of Lake Helen.
SECTION 6. EFFECTIVE DATE. This Ordinance shall become effective immediately upon adoption.

With nine "styles" of residential Architecture described, anyone deciding to build a single family residence within the City's boundaries, would certainly have the information available for their Architect to easily emulate the period or style of architecture common to and compatible with the existing architectural language of the community. Continuity of design for the City appears to be an essential need for the residents, to maintain the eclectic mix of architecture represented throughout the area. Only a few constructive comments are offered herein, as the material is well organized, laid out and easily read and understood: 1. Some examples described by addresses in the description/ definition of some of the styles are not followed by specific direction to find an associated photo, such as: (see below) or (as shown on page xx, should the document ultimately be paginated) 2. I believe it would be useful to identify resources and references through a bibliography. Should an Architect for a proposed residence wish to identify additional elements, materials, proportions and details that define a specific style, they would have an easier opportunity to find the published information. 3. Many of the styles represented within the nine provided in the document actually blend many similar elements, materials and details. This is not a criticism of the document, simply an observation of reality. 4. Additional comments were penciled in the copy of the document provided to this reviewer. That copy will temporarily returned to Ms. Witte for her consideration. They will be discussed, personally, in a meeting on Tuesday, Jan. 23. There are many current residents in the City that clearly care deeply for the quality of life and the Architecture in which they reside and enjoy. It is the opinion of this reviewer, therefore, that the "Guides" should be finalized and accompanied by a City ordinance to protect the architectural lifestyle they treasure, for the current population and for the future of Lake Helen. Meeting Date: February 9, 2016 Subject: Consideration of Improvements at Creative Arts Cafe Synopsis: The Creative Arts Café has a septic tank system permitted by Volusia Department of Health for 26 full service (reusable plates) customers or 35 “paper plate” customers. It was explained at the mandatory pre‐proposal meeting, that if the winning vendor for the food service agreement wanted something better than what was currently allowed by permit, then the vendor would be responsible for any necessary improvements to the septic system and permit changes. Based on staff research, it has been determined that upgrading the septic tank system and permit to allow for a full service dining experience is going to be more expensive than originally thought. Staff has discussed the improvement issue with the vendor and they are not able to fund the upfront cost of the improvements. However, they did express a willingness to amend the agreement regarding the extra contribution of 1% of sales. Currently the 1% contribution cap on gross sales is $500.00 per month. They are willing to remove that cap for this improvement. Option #1 – Require Vendor to make the necessary Septic upgrades

Dixie Septic has given a written quote of $42,250 which includes a discount from them because they recognize the value of the project and were the original tank installers. We have gotten a verbal quote from Big Dog, Inc. for $55,000. As a result of Dixie Septic’s knowledge of the existing system and their quote being below the City engineer’s estimate and another vendor quote, staff is recommending waving the purchasing procedure and awarding the project to Dixie Septic. Additional funds will be needed to pay for electrical, site restoration and plumbing work. The total project cost is anticipated to not to exceed $50,000. Consideration of Security System for City Hall
Meeting Date: February 9, 2016 Subject: Consideration of the expenditure of $1,500 for installation of a CCTV System at City Hall. Synopsis: The City Commission discussed and authorized the City Administrator to research the cost and options for a security system at City Hall. The cost will be $1,500 for installation of a CCTV System with J&J Security. Three companies were contacted and two quotes were received (J&J Security $1,500 and Signal21 Security $1,745). At the January meeting staff was asked to inquire about the monitoring and maintenance fee on the J&J Security quote. Chief Walker contacted the company and verified that the City would not be charged a monthly monitoring or maintenance fee but it is an optional service they could provide. The funds for this expense will be extracted from the contingency line item. Recommendation: Consideration of the expenditure of $1,500 for installation of a CCTV System at City Hall. Meeting Date: February 9, 2017 Subject: Discussion of the City Commission Business Forum on February 28, 2017 Synopsis: The City Commission Business Forum is set for held at 10:00 am at Hopkins Hall on Tuesday, February 28, 2017. Invitations have been sent by mail on January 25, 2017 and Commissioner Wilson has visited many local businesses to extend a personal invitation. Staff has received good feedback and several confirmations of attendance. Set-Up of Hopkins Hall: Chairs aligned in the main hall in a “U” shape with the Commissioners seated at a Head Table in front of the stage. Eye to eye with the audience. Brunch set up in the Library. Suggested Agenda:
9:30 AM: Doors open (brunch buffet available) 10:00 AM: Open Social, Meet and Greet 10:15 AM: Welcome and Introductions (Mayor Snowden)
Goal: to create a dialogue, a conversation so to speak. Discussion of opportunities now and in the future. Feedback to the City.
