 PUBLIC HEARING/REGULA R SESSION SUMMARY MINUTES City Of Hiram Council Meeting Tuesday, July 7, 2015 1 The Public Hearing for July 7, 2015 of the City of Hiram was called to order at 7:00 pm  by Mayor Doris A. Devey in t he Hiram Communi ty Center. Meeting attendees: Mayor Doris Devey, Mayor Pro Tem Kathy Bookout, Councilperson Derric k Battle, Councilperson Kathy Carter, Councilperson Teresa Philyaw, Councilperson Pep Rollins, Robbie Rokovitz, Kelly Hundley, Cynthia Geyer, Jody Palmer, Jason James, Chief VandeZande , Doug Munnell, Helene Fitzgerald, Cathy Helms, Nancy Hollingshed, Bob Bookout, Rich Erdman, Deborah Turner. Concetta Sellers, Audra Hembry, Anita Eberly, Carmen Rollins, Jackie Jordan, Bob Tressel, Charles Stock, Allen Bell, Parks, Huff, Adam, Caracci, Glen Cox, Amy Cox  The City of Hiram held a Public Hearing to consider an application (2015-02-V_COH) by RACETRAC PETROLEUM for a variance to reduce the rear (north) setback requirement from 15 (fifteen) feet to 0 (zero) foot for an existing building and a proposed freezer. Property is approximately 1.11 acres located in Land Lot 610; District 2, Section 3; on the northwest corner of US 278 (aka Jimmy Lee Smith Parkway) and Lake Road. (4597 Jimmy Lee Smith Parkway).  Parks Huff, Attorney for the Racetrac Corporation, spoke in favor of the Variance application.  No Public Comment was made in opposition to the Variance application.  The City of Hiram, Georgia held a Public Hearing to consider Text amendme nts to the City of Hiram Zoning Ordinance, Article VI II, Section M, (2) perta ining to “pac kage store for alc oholic  beverages” and el imination as a p ermissible use in the B-1 (General Business District), PSC (Planned Shopping Center District), and B-2 (Highway Business District); Article X Section B establishin g a requirement for a Special Use Permit to operate a Retail Package Liquor Store; and Article III, Section B (144) new definitions regarding package liquor store. This is the second public hearing for this amendment to the Zoning Ordinanc e.  Mr. Kelly Hundley presented Staff comments  No public comment was made for or against the Zoning Ordinance amendment.  Public Hearing was adjourned.  Mayor Devey called the Regular Session to order.  The May 5 2015 Regular Session; May 16 2015 Work Session; May 26 2015 Work Session; June 2 2015 Regular Session; June 23 2015 Work Session/Special Session minutes were approved.  Ms. Kim Fonseca requested authorization to hold a Youth Summer Basketball Program at Ben Hill Strickland Sr. Memorial Park.   Adopted City of Hir am Ordinanc e 2015-04, amendi ng the City of Hiram Z oning Ordinance,  Article VII I, Section M, (2) pertai ning to package st ore for alcohol ic beverages.   Adopted City of Hir am Ordinance 2015-05, approving the a pplication (2015-0 2-V_COH) submitted by RACETRAC PETROLEUM for a variance to reduce the rear (north) setback requirement from 15 (fifteen) feet to 0 (zero) foot for an existing building and a proposed freezer at Jimmy Lee Smith Parkway) and Lake Road.   Approved Ms. Ki m Fonseca ’s request to hold a Youth Summer Basketball Program at Ben Hill Strickland Sr. Memorial Park with the condition that Release of Liability forms would be completed by all participants.   Awarded the En gineering Study for the South Forty Pass S ubdivision stormwater draina ge to Stevenson & Palmer as outlined in the proposal provided to Mayor and Council.  Untabled the agenda item from June 2 2015 for the Main Street Improvements project as presented in the Stevenson & Palmer Engineering Award.

    Awarded the contract for the Main Street Improvements project as presented in the Stevenson & Palmer Engineering Award Notice to Georgia Development Partners, LLC in the amount of $1,343,061.55 ($1,173,448.17 Base Bid + $169,613.38 Additive Alternate) using SPLOST and Capital Reserves with an amendment to modify/widen the intersection at North Street, Main Street and Powder Springs Street and to move the sidewalks to the south side of Main Street.

    Authorized the City Manager to facilitate the reinvestment of the City of Hiram, General Fund Certificates of Deposit that are maturing at Bank of North Georgia in July 2015: 1) $231,039.44 matures on 7/16/15; 2) $621,313.75 matures on 7/31/15; and 3) $558,615.93 maturing on 7/31/2015 based on the most competitive market rates.

    Authorized the City Manager to cash CD which is maturing at Bank of North Georgia on July 16, 2015 with a current balance of $397,459.47. These funds will be deposited into the Reserves Money Market Account and held specifically for the purpose of general operations as adopted in the FY16 Budget.

    No Visitor business.

    Adjourned the Regular Session.
