I. INTRODUCTION The City of Forest Park, hereinafter referred to as the “City” , is seeking to provide through this “Request for Proposal” hereinafter referred to as “ RFP” process, qualified sanitation companies hereinafter referred to as „Contractor “ to provide the services below to the City at the most favorable cost consistent with efficient operations. Requested services include:

1. Collection of Residential Solid Waste; and/or

2. Collection of Residential Recyclables; and/or

3. Collection of Commercial Waste; and/or

4. Collection of Commercial Recyclables

The City is seeking Proposal from interested and qualified Bidders for the provision of residential solid waste and/or residential recycling and/or commercial solid waste and/or commercial recyclables. Services specifically include the collection and disposal from residential, Multi- Family and businesses within the City‟s limits.

The City will follow a formal RFP process. All technical requirements, unless otherwise

specified, must be met, or be capable of being met by each Bidder or its RFP will be disqualified as being non-responsive. Bidders whose Proposal are not accepted due to incompleteness of technical requirements will be promptly notified that they are no longer being considered.

Additional copies of this RFP package are available by visiting the City Clerk, City Hall

745 Forest Parkway, Forest Park Georgia 30297 on/or after February 10, 2012. Proposals must be made in accordance with all aspects of the RFP.

The City reserves the right to reject any or all proposals, to waive technical or legal

deficiencies, and to accept any bid that it may deem to be in the best interest of the City. All interested Bidders need to submit their Proposal to the City of Forest Park City Hall, by deadline date of March 16, 2012 at 2:00 pm., Eastern Daylight Savings Time.

Late proposals will not be accepted.

Faxed or emailed proposals will not be accepted. The City is not responsible for submissions not properly identified.

Further, the City reserves the absolute right, in its sole, exclusive and absolute

discretion, to reject any bids or all bids for any reason. The City is under no obligation to award and/or enter into a Contract for these services.

II. DEFINITIONS

1. Bags – Plastic or paper sacks designed to refuse with sufficient wall strength to maintain

physical integrity when lifted by top. Total weight of a bag and its contents shall not exceed 50 lbs.

2. Bidder - Business submitting a response to the RFP.

3. Bidder Disclosure Form - The form attached to the RFP as Attachment requesting specific information about officers, directors and employees of the Bidder.

4. Bulky Waste – Stoves, certified CFC free refrigerators, CFC free air conditioning units, hot water tanks, washing machines, furniture, and other waste materials other than Construction Debris, Hazardous Waste, Dead Animals, or Auto Parts with weights or volumes greater than those allowed for Carts or Bags.

5. Business Identification Form - The form attached to the RFP as Attachment D, requesting specific information about each Bidder.

6. Backdoor Service – Service provide at no additional charge to persons with a disability and no able-bodied person in the household. Retro paid backdoor service prior to 1998.

7. Cart – A 95 and or 65 gallon roller receptacle, with wheels and lid, designed for the purpose of curbside collection of refuse and/or recycling.

8. City – City of Forest Park, Georgia

9. Commercial and Industrial Refuse – All Garbage and Rubbish generated by a Producer at a Commercial and Industrial Unit, but in all cases to exclude Hazardous Waste.

10. Commercial and Industrial Unit – All premises, locations or entities, public or private requiring Refuse collection within the Service Area for which Refuse Collection using Carts is deemed to be appropriate, other than a Residential Unit.

11. Construction Debris – Waste building materials resulting from construction, remodeling, repair or demolition operations.

12. Contract Documents – The Request for Proposals, Instructions to Proposers, Definitions, Contractor‟s Proposal, the Contract(s), the Contract(s) Performance Bond and any addenda or changes to the foregoing documents agreed to by the City and the Contractor.

13. Contractor – The person, corporation or partnership performing refuse collection and

disposal, under contract with the city.

14. Control - The possession, directly/ indirectly, of the power to direct or cause the direction of the management and policies of a person or entity, whether through ownership of voting securities, by entreat, or otherwise.

15. Disposal Site – A Refuse depository including but not limited to sanitary landfills, transfer

stations and waste processing separation centers licensed, permitted or approved by all governmental bodies and agencies having jurisdiction and requiring such licenses, permits or approvals to receive refuse for processing or final disposal.

16. Dumpster – Metal receptacles designed to be lifted and emptied mechanically for use

primarily for Commercial and Industrial Refuse and have a well-fitted lid.

17. Drop-Off Carts – Containers to be placed at Multi-Family and Condominium Units for collecting Recyclable Materials from Producers therein.

18. Evaluation Committee - A group of selected City employees designated to review and rate

submission packets and interview selected Bidders.

19. Garbage – Every accumulation of waste (animal, vegetable and/or other matter) that results from the preparation, processing, consumption, dealing in, handling, packing, canning, storage, transportation, decay or decomposition of meats, fish, fowl, birds, fruits, grains or other animal or vegetable matter (including, but not by way of limitation, used tin cans and other food containers; or easily decomposable animal of vegetable waste matter which is likely to attract flies or rodents); except (in all cases) any matter included in the definition of Construction Debris, Hazardous Waste, Yard Trimmings, or Rubbish.

20. Hazardous Waste – Waste, in any amount, which is defined, characterized or designated

as hazardous by the United States Environmental Protection Agency or appropriate State agency by or pursuant to Federal or State law, or waste, in any amount, which is regulated under Federal or State law. For purposes of this Contract(s), the term Hazardous Waste shall also include motor oil, gasoline, paint, paint cans and items containing Freon or chlorofluorocarbons.

21. Multi-Family Unit - Individual residential units in a multi-family structure (i.e. apartment

building) which units are not separately owned by are owned by one common entity, for which Refuse Collection using Dumpsters and Recycling using Drop-off carts, is deemed appropriate.

22. Price Matrix Form - The form attached to the RFP as Attachment C, requesting specific

information about prices for various types of services.

23. Producer – An occupant of a Residential Unit or Commercial and/or Industrial Unit who generates Refuse and/or Recyclable Refuse.

24. Residential Unit – (a) Residential Unit – (a) A free standing constructed for use as a

residence by a person or group of persons comprising a family, or (b) a residential unit within a muti-family structure for which Refuse Collection using Carts (or bags) is deemed

appropriate. A Residential Unit shall be deemed occupied when either water or domestic light and power services are being supplied thereto.

25. Recyclable Material(s) – Corrugated cardboard, chipboard, office paper, computer paper, colored paper, newsprint, magazines, aluminum and bi-metal cans; HDPE clear plastic milk jugs and PET plastic soft drink containers and used motor oil; or any other Commodity agreed upon in writing by the City and Contractor.

26. Recycling Waste Cart – A receptacle with a capacity of 65 gallons or 95 gallons made of

plastic and designed for the purpose of curbside collection of Recyclable Materials.

27. Refuse – All Garbage and/or Rubbish and/or Bulky Waste and/or Yard Waste generated by customer.

28. Rubbish – All chips, shavings, sawdust, printer matter, paper, pasteboard, rags, straw,

used and discarded clothing, shoes and boots, combustible waste pulp and other products such as are used for packaging, or wrapping crockery and glass, ashes, cinders, floor sweepings, glass, mineral or metallic substances, and any and all other similar waste materials not included in the definition of Construction Debris, Garbage, or Hazardous Waste.

29. Service Area – The entire geographic area within the corporate limits of the City, unless

otherwise agreed to by the parties in writing.

30. Submission Packet - The Bidders response to the RFP filed with the City according to the guidelines set forth herein.

31. Yard Waste – All tree trimmings, dead plants, weeds, leaves, and dead tree debris not exceeding four feet (4‟) in length, four inches (4”) in diameter or forty pounds (40 Lbs.), and

III. SUBMISSION PACKET REQUIREMENTS

a. Submission Packet rules:

1. All Submission Packets must be bound on 81/2-inch by 11-inch, no larger than a 12 pt.

font. Please provide an original and five (5) copies. 2. Submission Packets must be responsive to all aspects or for sections such as:

residential services and/or residential recycling and/or commercial services and/or commercial recycling of this RFP. The delivery of the Submission Packets to the City by the time and date stated in the Introduction paragraph above is solely and strictly the responsibility of the Bidder. The City will in no way be responsible for delays caused by the United States Postal Service, Federal Express or other couriers or for delays caused by any other occurrence.

3. Timeline:

This schedule is for information purposes only and may be adjusted as needed. Bidders submitting Proposal are encouraged to reserve flexibility.

RFP Release Date: Date February 10, 2012 RFP Submission Deadline: Date March 16, 2012

4. Five (5) copies [One copy is to be marked “Original”] of the Submission Packets are to

be submitted by 2:00 p.m. (EST) on March 16, 2012 to the address listed below. Proposal submitted after this date and time, will not be considered.

5. Contact person: (Mike Gippert, Director or Public Works Department) Any questions or suggestions regarding this RFP shall be submitted in writing to Mike Gippert, Director of Public Works Department, at 5230 Jones Road, Forest Park, GA 30297 not less than seven (7) calendar days before Submission Packets are due. b. Contents:

All Submission Packets must contain the following information, using the tab letters A-I

specified below.

1. Bidder‟s Disclosure Form and Questionnaire (Attachment A);

2. Scope of Work (Attachment B); 3. Pricing Matrix (Attachment C); 4. Business Identification Form (Attachment D); 5. Organization Chart showing anticipated team members names and roles/titles, responsibilities and reporting relationships. 6. Four (4) references for the Bidder representing work performed within

the last three (3) years in Georgia of comparable size and nature to the City of Forest Park.

7. Information of financial capacity, including but not limited to: (1) at

least two-bank reference for Bidder with contact name, address and

telephone number; (2) a copy of Bidder‟s operating budget for the past two years; and (3) the Bidder‟s most recent audited financial statement.

8. Information of prior liability, including but not limited to: (1) state

whether the Bidder, or any prior parent company, subsidiary or owner of the Bidder, has ever filed a petition in bankruptcy, taken any actions with respect to insolvency, reorganization receivership, moratorium, or assignment for the benefit of creditors, or otherwise sought relief from creditors and, if so, explain the circumstances; (2) state whether the Bidder has had a contract terminated due to the quality of its work and, if so, explain the circumstances; and (3) state whether the Bidder ever been cited by any governmental agency and, if so, state the date of citation, reason for citation and the amount of any fine paid.

9. Cost Qualification showing the total cost for anticipated services provided to the City using the figures from the Pricing Matrix.

c. Rules governing RFP process.

1. All Submittal Packets and supporting documentation

received by the City shall become the property of the City, and will not be returned.

2. The City reserves the right to reject any and all submittals received in response to this RFP. The City is under no obligation to award and/or enter into a Contract for these services and the selection schedule may be revised at the City‟s discretion.

3. All costs associated with the preparation and submission of the Submission Packet shall be borne solely at the expense of the Bidder. The City shall not, under any circumstances, be responsible for any costs or expense incurred by the Bidder.

4. This RFP and the interview selection processes shall in no way be deemed to create a cartding contract of any kind between the City and the Bidder.

5. The City reserves the right in its sole discretion to waive informalities in the RFP process.

6. To be considered, a Bidder must submit a complete response to this RFP as indicated. The format that is provided in this document is not negotiable. Failure to adhere to the instructions contained within this document will void the submission of any bids.

7. Submission Packets will not be considered from any Bidder for which the City has a claim against outstanding debts or a financial dispute.

8. Each Bidder must comply with the applicable laws, ordinances and resolutions of the City, Clayton County, the State of Georgia and the federal government, including but not limited to all environmental laws regulating the disposal of municipal solid waste. Bidders must also exhibit the financial ability to furnish the necessary insurance as specified by this RFP.

9. The selected Bidder is expected to enter into a Contract with the City and to abide by its terms and conditions.

10. The price or prices for the services requested in this RFP include all taxes, licenses and permits that the Bidder is or may be required to complete this work.

11. The City reserves the right to award a Contract to a Bidder other than the lowest cost Bidder if the interests of the City are best served.

IV. BIDDER PROPOSAL a. A Bidder must be experienced in performing commercial and/or residential and/or

recycling sanitation services. The Bidder must possess a minimum of seven years commercial, residential and recycling sanitation hauling experience to be considered by the City.

b. A Bidder shall supply and maintain proof of certifications and licenses required by State and local governments.

c. A Bidder shall ensure that sufficient personnel are maintained, employed by the

company, and available to perform commercial sanitation hauling services required by the scope of the Contract.

V. EVALUATION PROCESS

a. Scoring of Submission Packets.

The Submission Packets will be evaluated using the selection criteria provided below. The Evaluation Committee will make a thorough investigation into each the Bidder‟s Proposal, experience, references, and past performance on similar projects. Factors such as the Bidder‟s service, employment practices, experience, reputation, past performance, and pricing, among others, will be considered in the award decision. The decision for selecting a firm shall be made by the Evaluation Committee.

This criterion measures the overall organization infrastructure of the Bidder, including but not limited to successful incorporation of the role of subcontractors and a well thought-out approach in undertaking the required scope of work. Experience of the individuals proposed to lead and manage this project as well as the experience and resources of the Bidder will be carefully considered. Key factors to be considered are experience in providing these types of services for projects similar in scope and size, professional credentials and project leadership, reputation in the industry and the references provided or obtained and must possess enough landfill space for distribution of MSN over a 10 year period within the state of Georgia.

2. Experience (20 Points) Characterize the Bidder‟s understanding of the project‟s principle requirements and describe the Bidder‟s and team member‟s expertise and experience. Provide a detailed resume. Define the project and key project performance criteria to ensure a successful project and discuss your approach to managing and implementing these criteria.

Furnish written information about your experience. State all locations, and dates of operation; the types and size of events; if appropriate, the numbers and kinds of employees involved; and any other relevant details, which would indicate the Bidder‟s capability to perform such operations.

Detail key risk areas that are to be mitigated to facilitate project success. Outline the Bidder‟s approach towards successful mitigation.

3. Quality Of Technical Approach (20 points)

Submittal Packets will be judged on the completeness and overall quality of the technical approach for collection services, improvement of service, customer service plan and cost saving measures.

4. Performance Capabilities (20 Points)

Bidders will be evaluated on their competence to provide the services at the desired quality level in a timely fashion. The evaluation will include the quality and timeliness of the Bidder's past performance of previous contracts of similar size and scope within the state of Georgia.

5. Financial Condition (20 Points) Bidders will be evaluated on the strength of the financial information submitted.

b. Selection Process

Each member of the Evaluation Committee will read, review, evaluate and score each Submission Packet based on the items contained in Sec. V(a). Written notification of the Evaluation Committee‟s intent to interview will be sent to the three highest ranked Bidders. The notice will provide the day, time and location of the interview. The Evaluation Committee will rank each Bidder interviewed utilizing a numbering system. The Bidder possessing the highest total point score resulting from the scores of the Submission Packets and interviews will be selected for Contract consideration. If the City is unable to successfully negotiate and enter into a Contract with the top scoring Bidder, then the first selected Bidder will be excused and the second place Bidder will be contacted. If this step is unsuccessful, then the third place Bidder will be contacted. If this step fails, then a new bidding procedure will commence. VI. REQUIRED CONTRACT TERMS

a. Pricing

All prices, costs and conditions outlined in the Submission Packet shall remain fixed and valid for acceptance by the City for 60 calendar days starting on the due date of the bid.

Prices will remain firm for the duration of the initial Contract term, which shall be for a maximum period of two (2) years.

The price quoted shall include all labor, materials, equipment, and other costs necessary to complete the Scope of Services set forth in the Submission Packet.

b. Equal Employment Opportunity The Bidder shall not discriminate against any employee or applicant for employment because of race, color, religion, sex, national origin, or handicap. The Bidder will take affirmative action to ensure applicants are employed, and that employees are treated fairly during employment without regard to their race, color, religion, sex, national origin, or handicap. Such action shall include, but not be limited to, (1) employment, (2) upgrading, (3) demotion, (4) transfer, (5) recruitment or recruitment advertising, (6) layoff or termination, (7) pay rates or other forms of compensation and (8) selection for training, including

apprenticeship. The City of Forest Park fully encourages the participation of qualified minority business firms with respect to the project.

c. Breach by Bidder

In the event there should occur any breach of the Contract or default in the performance of

any of the conditions contained therein by Bidder that has not been remedied within 30 days

after receipt of written notice from the City specifying such breach or default, the City may, if

such breach or default is continuing: (i) terminate the Contract upon written notice to the

Bidder; (ii) cure the breach or default at the expense of the Bidder; and/or (iii) have

recourse to any other right or remedy to which it may be entitled by law, including but not

limited to, the right for all damage or loss suffered as a result of a termination. In the event

the City waives default by the Bidder, such waiver shall not be construed or determined to

be a continuing waiver of the same or any subsequent breach or default. d. Insurance Bidder shall at all times during the Contract maintain in full force and effect Employer's Liability, Workmen's Compensation, Public Liability, Automobile and Property Damage Insurance. All insurance shall be by insurers, or a self-insurance plan, acceptable to the City and before commencement of work hereunder. Bidder agrees to furnish the City certificates of insurance or other evidence satisfactory to the City to the effect that such insurance has been procured and is in force. The certificates shall contain the following express obligations:

"This is to certify that the policies of insurance described herein have been issued to the insured for whom this certificate is executed and are in force at this time. In the event of cancellation or material change in a policy affecting the certificate holder, thirty (30) days prior written notice will be given to the certificate holder."

The certificates shall also name the City as an additional insured.

For the purpose of the Contract, Bidder shall carry the following types of insurance in at least the limits specified below:

Employer's Liability $1,000,000 each occurrence

Commercial General Liability $1,000,000 each occurrence

Automobile Bodily Injury Liability $500,000 per person $1,000,000 each occurrence

Automobile Property Damage Liability $1,000,000 each occurrence

Excess Umbrella Liability $3,000,000 each occurrence

The Bidder shall procure and keep in full force and effect throughout the term of this Agreement all of the insurance policies specified in, and required by, the Contract Documents. Failure to keep in full force and effect the insurance policies set forth above

constitutes a material breach of the Contract by the Bidder. If any of the above coverage(s) expire during the term of this contract, the “Successful Bidder” shall deliver renewal certificates and/or policies to Clayton County, GA at least ten-days prior to the expiration date.

The Bidder shall require Certificates of Insurance from subcontractors. Subcontractors will carry limits of insurance equal to or greater than those carried by the Bidder. These certificates shall evidence waivers of subrogation in favor of the Bidder and the City, and shall be made available to the City upon request.

The Bidder‟s selected insurers must be authorized to conduct and transact insurance contracts by the Insurance Commissioner, State of Georgia, furthermore; all bid, performance aid payment bonds must be a U.S. Treasury Circular 570 listed company. If the issuing company does not meet these minimum requirements, or for any other reason shall be or become unsatisfactory to the City, written notification shall be mailed by the City to the Bidder who shall promptly obtain a new policy or bond issued by an insurer acceptable to the city, and shall submit evidence of the same to the City as required herein. e. Indemnification Obligation. Bidder shall indemnify and save harmless the City, its officers, agents, servants, and employees from, and against, any and all claims, demands, actions, suits, and any type of proceeding by others, and against all liability to others, arising from any and all allegations of negligence or willful misconduct of Bidder, its officers, agents, servants, and employees, related in any way to the performance of the Contract, including, but not limited to, any liability for damages by reason of or arising out of any failure of Bidder to secure proper licenses, bonds, and insurance coverage for Bidder and the City or the like, and against any loss, cost, expense, and damages resulting therefrom. Bidder expressly agrees that this duty of indemnification includes providing a complete defense to the City and paying the City‟s reasonable attorney's fees and expenses. Nothing contained herein shall be deemed to constitute a waiver by the City of its governmental immunity.

f. Performance bond.

Bidder will be required to furnish for each year of the Contract a corporate surety bond as security for the performance of the Contract (the “Performance Bond”) as specified by the City. Said surety bond must be in an amount equal to 100% of the annual revenues to Bidder under the Contract and shall be provided annually at the beginning of each contract year.

The premium for the Performance Bond described above shall be paid by the Bidder. A certificate from the surety showing that the bond premiums are paid in full shall accompany the Performance Bond.

The surety on the bond shall be a duly authorized corporate surety company authorized to do business in the State of Georgia.

Surety companies executing bonds must appear on the Treasury Department‟s most current list (Circular 570, as amended) and be authorized to transact business in the State of Georgia.

Power of Attorney: Attorneys-in-fact who sign performance bonds or contract bonds must

file with each bond a certified and effectively dated copy of their power of attorney.

1. SCOPE OF WORK

A. General

1. The Contractor shall produce and distribute educational materials, brochures, advertisements, and other materials to City residents, specifying acceptable and unacceptable materials for collection and otherwise educating the residents as to the Collection Services to be provided by the Contractor.

2. Hauling – All Refuse hauled by the Contractor shall be so contained, tied or enclosed so that leaking, spilling or blowing is prevented.

3. Disposal – All Refuse collected for disposal by the Contractor shall be hauled to such sanitary landfill, as the Contractor shall determine (the Disposal Site”).

4. Rates – The City shall pay the Contractor on a monthly basis amounts calculated on Proposal for Residential Solid Waste and Commercial Waste Collection.

5. Customer Service – The Contractor shall provide information on handling all aspects of customer service.

6. Billing Services – The Contractor shall provide information of the billing services they can offer to the City or City Customers should the City decide to change its current in-house billing policies.

7. The Contractor shall furnish all labor, supervision, collection vehicles, collection containers, other equipment, materials, supplies, and all other items and services necessary to perform its obligations.

8. Routes of Collection – Collection Routes shall be proposed by the Contractor and coordinated with the City. In general, the City seeks routes and hours, which provide the least conflict to traffic and general mobility in the City.

9. Exclusive Contract(s) – The Contractor(s) shall have the sole and exclusive franchise, license and privilege to provide Residential Solid Waste and/or Residential Recyclables and/or Commercial Waste Collection and/or Commercial Recyclables, and/or Roll-off services within the corporate limits of the City.

10. The work under this Contract shall consist of the items contained in the RFP, including all the supervision, materials, equipment, labor, and all other items necessary to complete said work in accordance with the Contract Documents.

B. Residential Solid Waste Collection and Disposal; In addition to the forgoing Sections, I thru VI as outlined herein and the General Section above, the following information is specific to the proposal for Residential Solid Waste Collection.

1. The City estimates that the number of residential units to be initially serviced for weekly Residential Solid Waste Collection is 5,043 less (8) percent annual vacancies. Unit price computations for Residential Units shall be based upon this estimate

2. Containers; The Contractor shall provide one (1) 95 Gallon Cart for Garbage for each Residential Unit. The Contractor will replace (or, at its option, repair) Carts which require replacement or repair as a result of normal wear and tear, and not as a result of misuse by the Producer.

3. Location of Carts for Collection; The term “Curbside” as used in this agreement refers to that portion of right-of-way adjacent to paved or traveled City roadways. Carts shall be placed as close to the roadway as practicable without interfering with or endangering the movement of vehicles or pedestrians. When construction work is being performed in the right-of-way, Carts shall be placed as close as practicable to an access point for the collection vehicle. The Contractor may decline to collect any Cart not so placed, unless the resident Unit is on back door service. The Contractor shall record all “not-outs” and shall provide a weekly listing to the City.

4. Commencing the Effective Date, the Contractor shall collect and dispose of in a workman like manner one (1) time per week Residential Refuse, Residential Yard Waste and Residential Bulk Waste placed, at curbside at each Residential Unit located within Service Area. The Contractor shall collect Yard Waste and Bulk Items separate from all other Residential Refuse with such collection to occur on Wednesdays. The Contractor shall not be required to collect more than one (1) Cart and four (4) Bags per Residential Unit per week of Residential Refuse. Additionally, the Contractor shall not be required to collect Yard Waste more than once per week per Residential Unit where such Yard Waste shall be placed by the occupant(s) on the curb, in recyclable yard debris bags for collection.

5. Rate Modifications/Additional Services:

a. Additional Residential Units. As new Residential Units are constructed and occupied in the Service Area, the Contractor shall, after notification from the Resident and confirmed by the City, provide Collection Services as required by this Agreement. The Contractor will provide service for up to fifty additional units within three (3) working days after notification by the City, and will provide Collection Services of the frequency and quality otherwise required of

the Contractor to all other Residential Units within the Service Area. For additional units required for over fifty Residential customers, as may be the case due to annexation, the City will provide two (2) weeks advance written notice to the Contractor to enable the purchase of new containers for Collection Services. The Contractor at the contracted rate shall provide additional residential service.

b. The contractor shall keep on hand at least two percent (2%) over the total number of roll carts currently in use to be available immediately for new Residential Units added. Additional Residential Units in excess of this two percent (2%) shall be provided roll carts within two (2) weeks of notification by the City.

6. Hours of Operation: Carts, Bags, Yard Waste, and Bulk Items shall be placed at curbside by 7:00 a.m. on the designated collection day. The Contractor may decline to collect any Residential Refuse not contained in Carts and Bags.

7. Side/ Back Door Cart Service; The Contractor will provide back door service to accommodate the special medical and or physical needs of individuals in the City that have no able-bodied person in the household, at no extra charge to the City or Resident. The City will provide the Contractor with the names and addresses of those Residential Units requiring this service and may amend such listing in writing.

C. Residential Recycling Collection and Disposal: In addition to the forgoing Sections, I thru VI as outlined herein and the General Section above, the following information is specific to the proposal for Residential Recycling Collection.

1. The City estimates that the number of residential units initially serviced for weekly or biweekly Residential Recycling Collection is 5,043 less (8) percent annual vacancies. Unit price computations for Residential Units shall be based upon this estimate

2. Recycle Pickup; The Contractor shall be responsible for weekly recycling collection and disposal.

3. Recycling Rewards Program; Contractor, to provide the City with incentive-based recycling program(s).

4. Customer Support; Contractor will provide the City with sufficient information about the Recycling Incentive Offered. The City will have support such as, by Phone and/or Internet online services.

5. Recycle Containers or carts; The Contractor shall provide one (1) 65 or 95 Gallon cart or Recycling Container for Recycling for each Residential Unit. 10. Side/ Back Door Recycle Containers or Carts Service: The Contractor will provide back door service to accommodate the special medical and or physical needs of individuals in the City that have no able-bodied person in the household, at no extra charge to the City or Resident. The City will provide the Contractor with the names and addresses of those Residential Units requiring this service and may amend such listing in writing.

11. Contractor shall provide annual collection of Christmas trees for three (3) weeks following Christmas day, December 25

th at no additional charge.

Residents will be required to place the trees curbside for collection. Trees must be free of ornaments; garland; tinsel and flocking; and stands must be removed. Contractor will be required to collect trees up to six feet in length. Trees may be cut in half to meet the six (6) foot requirement.

D. Commercial Waste Collection and Disposal: In addition to the forgoing Sections I thru VI as outlined herein and the General Section above, the following information is specific to the proposal for Commercial Waste Collection.

1. Commencing on the Effective Date, the Contractor shall provide solid waste collection and disposal services to Commercial Units for Commercial Refuse placed in the Contractor‟s containers (such services referred to as the “Commercial Waste Collection Services”). Carts shall be placed at a curbside or designated location by 7:00 a.m. on the designated collection day. Larger containers shall be serviced on the scheduled pick up days as per arrangement with the City and the Contractor. The approximate number of commercial businesses is 750.

2. Additional Commercial and Industrial Units. The Contractor will, within three (3) working days after written notification by the City, provide Collection Services of the same quality, frequency and at the same rate as otherwise required of the Contractor to other Commercial and Industrial Units within the Service Area. The City‟s notification shall set forth the number and size of the containers required and the frequency of service to be provided.

3. As part of the consideration of this Agreement, the City will receive commercial waste service at no additional expense, as provided below, at each of the following locations:

a. Fire Station #1– one four (4) cubic yard Dumpster with pick-up at least twice per week.

b. Fire Station #2– one four (4) cubic yard Dumpster with pick-up at least twice per week

c. Fire Station FT Gillem– one two (2) cubic yard Dumpster with pick-up at least twice per week

d. Fleet Services - one three (3) cubic yard Dumpster with pick-up at least twice per week.

e. Mini Golf - one eight (8) cubic yard Dumpster with pick-up at least twice per week.

f. Police Department - one four (4) cubic yard Dumpster with pick-up at least twice per week.

g. Parks and Recreation - one four (4) cubic yard Dumpster with pick-up at least twice per week.

h. Signs & Signal Division - four (4) cubic yard Dumpster with pick-up at least once per week.

i. Athletic Association - two four (4) cubic yard Dumpster with pick-up at least once per week.

j. Any other City buildings that the City may add within the contract time period.

E. Commercial Recycle Collection and Disposal: In addition to the forgoing Sections, I thru VI as outlined herein and the General Section above, the following information is specific to the proposal for Residential Recycling Collection.

1. The City estimates that the number of Commercial units initially serviced for weekly or bi-weekly Commercial Recycling Collection is 233. Unit price computations for Commercial Units shall be based upon this estimate

2. Recycle Pickup; The Contractor shall be responsible for weekly recycling collection and disposal.

3. Recycling Rewards Program; Contractor, to provide the City with an incentive-based recycling program.

4. Customer Support: Contractor will provide the City with sufficient information about the Recycling Incentive Offered. The City will have support such as, by Phone and/or Internet online services.

F. Multi-Family Service: Multi-Family customers include any residential premises, other than single-family residences, used for residential purposes, which have centralized solid waste and recyclable material collection service for all units in the building and are billed as one address.

1. Multi-Family Services shall include services comparable to residential single-family units such as apartments;

2. The City estimates that the number of Commercial units initially serviced for weekly or bi-weekly Multi-Family Solid-Waste and Recycling Collection is 13. Multi-Family Complexes price computations for Multi-Family Units shall be based upon this estimate. Duplexes and Quadplexes total approximately 80 units billed individually.

3. Solid-Waste and Recycle Pickup; The Contractor shall be responsible for weekly or bi-weekly collection and disposal.

4. Customer Support; Contractor will provide the City with sufficient information about the Recycling Incentive Offered. The City will have support such as, by Phone and/or Internet online services.

5. Location of Solid Waste and/or Recycle Containers or Carts for Collection; The Contractor, Multi-Family Unit and the City will decide on the best locations for the Commercial Units.

6. Commencing the Effective Date, the Contractor shall collect and dispose of in a worker like manner one (1) time per week Multi-Family Solid Waste and/or Recycling or bi-weekly if Recycle Containers are used. The Contractor shall collect Recyclables separate from all other Commercial Refuse. The Contractor shall not be required to collect more than one (1) Recycle Containers or Cart per Commercial Unit per week or bi-weekly of Commercial Recycled Items.

7. Rate Modifications/Additional Services.

a. Additional Multi-Family Units. As new Multi-Family Units are constructed and occupied in the Service Area, the Contractor shall, after written notification from the City, provide Collection Services as required by this Agreement. The

Contractor will provide service for up to one additional unit within three (3) working days after notification by the City, and will provide Collection Services of the frequency and quality otherwise required of the Contractor to all other Multi-Family Units within the Service Area.

b. The contractor shall keep on hand at least one percent (1%) over the total number of Containers and/or Carts currently in use to be available immediately for new Multi-Family Units added. Additional Multi-Family Units in excess of this one percent (1%) shall be provided Solid-Waste and/or Recycle Containers or Carts within two (2) weeks of notification by the City.

8. Hours of Operation: Solid-Waste and/or Recycle Containers or Carts shall be serviced as agreed between the Contractor, Multi-Family Unit and City.

G. Special Provisions: The Work under this Contract consists of collecting, hauling, recycling and disposing of garbage, refuse, large articles, and bulky items for all sanitation needs in the City, Commercial and Residential.

1. All aspects of the Sanitation services bid Proposal are to be submitted in its entirety or individually such as; Residential Sanitation, Commercial Sanitation, Residential Recycling or Commercial Recycling.

2. Recycling services consists of collection, delivery, and the selling of the recycling materials with rebates or incentives back to the City.

3. All other submittals to encourage recycling maybe considered.
