A timeline of the necessary steps in the process, beginning with action taken in 2017, is included below. Annexation is a highly prescribed process governed by state law. The detailed requirements for annexation are contained in the Indiana Code at IC 36- 4-3 et seq. Because of the complexity of the process and the particular proposals being brought forward, the city has retained financial consultant Reedy Financial Group P.C. to assist with the preparation of required fiscal plans and retained outside legal counsel, Bose McKinney & Evans (with Steve Unger playing lead role), to advise the City during its pursuit of these annexations.

REMONSTRANCE PROCESS

Jan. 1, 2024 Current effective date - Approved annexations take effect Annexation Ordinances and Amendments After the required public hearing (which concluded on August 11), the Council may adopt the annexation ordinances not earlier than thirty (30) days or not later than sixty (60) days. Final action on the ordinances is currently scheduled for September 15, 2021, subject to change by the Council. The annexation ordinances may be changed up until the final vote, with a few caveats. Please be aware that new areas or new property cannot be added to the proposals. The area remaining after any changes or reductions must still meet all applicable statutory requirements, including contiguity requirements. Also, depending on the scope of a proposed change, there may be significant work involved in updating any affected fiscal plans, maps, and legal descriptions. For this reason, and to leave enough time to update these materials ahead of a final vote on the ordinances, the Council has scheduled a Special Session on August 31 to consider and take final action on prepared amendments. Included herein are five prepared amendments to Ordinance 17-09 (one amendment) and Ordinance 17-12 (four amendments). Two amendments have been prepared by administration staff (in search of a council sponsor) and would add impoundment funds and related advisory boards to the South-West A Annexation Area (Area 1A) and South-East Annexation Area (Area 2) respectively. Such impoundment funds are required under certain circumstances and have been included for each of the other six proposed annexation areas. Staff believes such impoundment funds may also be required for Areas 1A and 2. Even if not required, the administration believes it would be advisable to create such funds and advisory boards. If adopted, these amendments would insert new sections into Ordinances 17-09 and 17-12 to create impoundment funds for a period of three years after the effective date of the annexations. Any municipal property taxes collected from the annexation areas but not spent would be maintained in the fund and used to provide additional services to the respective annexation area. The amendments would also establish advisory boards charged with advising the City Council regarding the expenditure of the impounded funds. Three amendments have been prepared by councilmembers to remove certain parcels of property, all within the South-East Annexation Area (Area 2). Each amendment includes a

The amendments provide that all other parcels necessary to effect the depicted changes shall be removed, including any parcels not listed in the amendment that must necessarily be removed as a result of the amendment. If the previously-approved fiscal plans require updates as a result of adopted amendments, the Council will be asked to consider additional resolutions approving of those updated fiscal plans ahead of a final vote on the ordinances.

Proposed Amendment: To add an impoundment fund to South-West A Bloomington

Annexation Area (Area 1A)

1. Ordinance 17-09 shall be amended to add new Sections 8 and 9, as recorded below, and all

subsequent Sections of the Ordinance shall be renumbered accordingly.

SECTION 8. There is hereby created a special fund titled the “South-West A Bloomington

Annexation Impoundment Fund” (“Impoundment Fund”). For a period of three (3) years

following the effective date of this annexation, all municipal property taxes imposed in the

Annexation Territory after the annexation takes effect that are not used to meet the basic non-

capital and capital services set forth in the fiscal plan shall be impounded in the Impoundment

Fund. The impounded property taxes in the Fund shall be used to provide additional services that

were not specified in the fiscal plan, and shall be expended not later than five (5) years after the

annexation becomes effective.

SECTION 9. There is hereby created an advisory board titled the “South-West A Bloomington

Annexation Advisory Board” (“Advisory Board”). The Advisory Board is governed by I.C. § 36-

4-3-8.1, and shall advise the City on the provision of services to the Annexation Territory that are

paid for with the municipal property taxes impounded in the Impoundment Fund. The Advisory

Board shall be appointed not later than ninety (90) days after the annexation becomes effective,

and shall consist of the following seven (7) members:

(1) The township trustee of the township with the largest number of residents living

within the Annexation Territory;

(2) One (1) member of the County Council representing the district with the largest

number of residents living within the Annexation Territory;

(3) One (1) member who is the City engineer (or, a licensed professional engineer

appointed by the Mayor if the City does not have a municipal engineer);

(4) Two (2) citizen members, appointed by the Mayor, who own real property and

reside within the Annexation Territory;

(5) Two (2) citizen members, appointed by the County Commissioners, who own real

property and reside within the Annexation Territory.

Synopsis

This Amendment adds an impoundment fund to South-West A Bloomington Annexation Area,

commonly referred to as Area 1A, so that, for a period of three years after the effective date of the

annexation, any municipal property taxes collected from the annexation area but not expended are

maintained in a special fund and used to provide additional services to the annexation area. The

Amendment also establishes an advisory board charged with advising the City Council regarding

the expenditure of the impounded funds.

Proposed Amendment: To add an impoundment fund to South-East Bloomington

Annexation Area (Area 2)

1. Ordinance 17-12 shall be amended to add new Sections 8 and 9, as recorded below, and all

subsequent Sections of the Ordinance shall be renumbered accordingly.

SECTION 8. There is hereby created a special fund titled the “South-East Bloomington

Annexation Impoundment Fund” (“Impoundment Fund”). For a period of three (3) years

following the effective date of this annexation, all municipal property taxes imposed in the

Annexation Territory after the annexation takes effect that are not used to meet the basic non-

capital and capital services set forth in the fiscal plan shall be impounded in the Impoundment

Fund. The impounded property taxes in the Fund shall be used to provide additional services that

were not specified in the fiscal plan, and shall be expended not later than five (5) years after the

annexation becomes effective.

SECTION 9. There is hereby created an advisory board titled the “South-East Bloomington

Annexation Advisory Board” (“Advisory Board”). The Advisory Board is governed by I.C. § 36-

4-3-8.1, and shall advise the City on the provision of services to the Annexation Territory that are

paid for with the municipal property taxes impounded in the Impoundment Fund. The Advisory

Board shall be appointed not later than ninety (90) days after the annexation becomes effective,

and shall consist of the following seven (7) members:

(1) The township trustee of the township with the largest number of residents living

within the Annexation Territory;

(2) One (1) member of the County Council representing the district with the largest

number of residents living within the Annexation Territory;

(3) One (1) member who is the City engineer (or, a licensed professional engineer

appointed by the Mayor if the City does not have a municipal engineer);

(4) Two (2) citizen members, appointed by the Mayor, who own real property and

reside within the Annexation Territory;

(5) Two (2) citizen members, appointed by the County Commissioners, who own real

property and reside within the Annexation Territory.

Synopsis

This Amendment adds an impoundment fund to South-East Bloomington Annexation Area,

commonly referred to as Area 2, so that, for a period of three years after the effective date of the

annexation, any municipal property taxes collected from the annexation area but not expended are

maintained in a special fund and used to provide additional services to the annexation area. The

Amendment also establishes an advisory board charged with advising the City Council regarding

the expenditure of the impounded funds.
