City Clerk Newsletter

• Ms. Benitez and Mr. Barber and Mr. Nichols are preparing the January/February 2020 Issue of the newsletter for publication. Ms. Benitez is always looking for new material. Please share with her any new ideas and thoughts for the newsletter.

Events:

• Mr. Barber and Ms. Benitez prepared for Halloween 2019 making a total of 600 candy bags. The City was sorry that due to predicted weather the event had to be cancelled. We notified the public that Halloween Goodie Bags were available at the City Municipal Center while supplies last..

• Mr. Barber has scheduled the Annual Shredding Day Event for Saturday, November 16, 2019, from 9:00 a.m. until 12:00 Noon. The event will take place at Beckett Field.

• Mr. Barber, Mr. Nichols, and Ms. Benitez are once again planning our Spring Festival. Save the Date for Saturday, April 4, 2020, from 10:00 a.m. until 3:00 p.m.

• Mr. Barber and Mr. Nichols have updated the Holiday Decorating Contest Application. The 2019 Holiday Decorating Contest Application has been placed in our current newsletter as well as on all our social media platforms.

Elections:

• Mr. Barber has been meeting with the Board of Elections regarding the 2020 Election scheduled to be held on Monday, May 4, 2020. Mr. Barber along with the Board are reviewing the election process and hopes to increase voter turn-out for the 2020 Election.

We identified several candidates for the Public Works Director vacancy, and will begin interviewing candidates in the upcoming weeks. Health & Wellness Our first Health & Wellness Week was a huge success, and the Wellness Fair was well attended. Thank you to everyone who participated and met with our vendors, received a flu vaccination, health screenings, completed a health assessment, or indulged in massages and acupuncture. The drawing for individuals who received a wellness screening and completed a health assessment will be held at our Annual Holiday Party on December 13th. Prizes include $50 Visa gift cards, $100 Visa gift cards, and the grand prize is a Massage Seat plus a $200 Visa gift card. On Friday, November 15th, Connect Care 3 is hosting a Heart Health Seminar for employees. Attendees will learn about health conditions such as high blood pressure, high cholesterol, heart attack, and stroke, as well as lifestyle changes to prevent conditions that affect the heart.

Ordinance 20-06 Budget Amendment Reconciliation No. Three:

To Amend Ordinance 19-17 Current Expense Budget for FY 2020

AN ORDINANCE OF THE CITY COUNCIL OF NEW CARROLLTON AMENDING THE ADOPTED BUDGET FOR THE FISCAL YEAR BEGINNING JULY 1, 2019 AND ENDING JUNE 30, 2020 AS EMBODIED IN ORDINANCE 19-17 TO REFLECT MONEY BROUGHT INTO THE BUDGET FROM CITY RESTRICTED/DESIGNATED FUNDS, AND TO ADD A PARKING ENFORCEMENT OFFICER AND A GROUNDS MAINTENANCE SUPERVISOR. WHEREAS, the City Council of New Carrollton (the “City Council”), a body politic and corporate of the State of Maryland is authorized to adopt a fiscal year budget, pursuant to City Charter, §C-14 “Budget and Finance”; and WHEREAS, the City Council adopted a budget for FY 2020 via Ordinance No. 19-17; and WHEREAS, the City of New Carrollton FY2020 Adopted Budget document, page 105, provides for one Parking Enforcement Officer. Given issues stated by residents at the City’s recent Town Hall Meeting on parking issues, the City Council desires to increase the number of Parking Enforcement Officers to two and to amend the budget to provide for the additional employee; and WHEREAS, the City of New Carrollton FY2020 Adopted Budget document, page 137, sets for the number of employees in Public Works – Ground Maintenance. The Department would like to add a position entitled Grounds Maintenance Supervisor, and the City Council concurs; and WHEREAS, certain expenses reflected in the City budget will exceed their appropriated amount and require an adjustment in the FY 2020 Budget to reflect additional money being appropriated to these items; and WHEREAS, in order to provide for the additional expenses outlined above, money must be brought into the FY2020 Budget from City Restricted/Designated Funds; and WHEREAS, the City Council wishes to amend the FY 2020 Budget to account for new revenues and expenditures since the enactment of the Budget and to add a Parking Enforcement Officer and a Grounds Maintenance Supervisor . Section 1. NOW THEREFORE, BE IT ENACTED AND ORDAINED by the City Council of New Carrollton, with the approval of at least a four-fifths vote of the total Council, that Ordinance 19-17, Current Expense Budget for the City of New Carrollton, Maryland for Fiscal Year 2020, under the heading of “City of New Carrollton FY 2020 Adopted Budget” be and hereby is amended as follows:

RE: Proposed Amendments to the City of New Carrollton Charter and City

Code Relating to Election Issues

Dear Chair Nembhard:

On behalf of the City of New Carrollton Board of Elections, I am writing to request that the City

Council consider amendments to the City Charter and the City Code that the Board of Elections

believes would assist it in fulfilling its duties with respect to the conduct of City elections. The

Board of Elections reviewed the City’s Election Handbook, forms used by the Board of Elections

and the City Charter and Code, and has concluded that there are some changes to the City Charter

and the City Code that would be in the best interest of City elections.

Set forth below are the changes proposed to the City Charter and Code.

City Charter

The Board requests that the City Council amend the City Charter as follows:

1. City Charter, §C-3 “Government of the City” Section (B) Vacancies provides that if a vacancy

occurs in the office of Councilmember more than one hundred twenty (120) days before a

general election, a special election shall be scheduled within sixty (60) day of the date of such

vacancy to fill the position of Councilmember. It further states that if such vacancy occurs one

hundred twenty (120) or less before the next general election, the Councilmember shall not be

replaced until the next general election. As we witnessed in 2019, the City not only held its

General Election, but due to the death of a sitting Councilmember and the timing thereof, the

City held a Special Election six weeks prior to the General Election. The Board recommends

the Council adopt a process whereby if a vacancy occurs in the office of a Councilmember less

than 120 days before a general election, the City Board of Elections will seek nominations for

the vacant position, review the nominations to ensure that each individual nominated meets the

requirements for the office and then forward those names that meet the requirements to the

City Council for an interview and an appointment to the vacant position

2. City Charter, §C-5 “Board of Elections” establishes that the Board of Elections shall consist

of three (3) members who shall be appointed by the Mayor with the City Council approval.

The Board requests the addition of two members to the current Board. This change will allow

the Board to always have a quorum for meetings conducted during the City election cycle

and allow for additional outreach efforts regarding City elections.

City Code

3. Poll Watchers

City Code, §50-36 “Vote Count” allows “any candidate and the duly accredited watchers

within the polling place” to be present when the Board of Elections canvasses the voting

machines or other voting system and counts any paper ballots to determine the vote cast for

each candidate and/or any questions on the ballot. City Code, §50-37 establishes the rights of

the challengers and watchers, but does not include the right to be present in the room when

votes are tallied. The Board of Elections would like to amend City Code, §50-37 to add that

poll watchers are to be allowed in the room while the Board tallies the official votes.

However, the Board would like to ensure that candidates are not allowed in the room when

votes are tallied. These will be changes to the City Election Code, which is Chapter 50. The

changes would ensure that only certified poll watchers are in the room with the Board as they

tally the official election results. Candidates will have to wait in an alternate location. Poll

watchers will not be allowed to interrupt the election process during the official tally.

4. Update to Candidate Book

Candidates’ Set-Up at Early Voting Sites and on Election Day. The 2020 Candidate Book

will express to all potential candidates the need to be aware of their surroundings given that

the voting location (whether for early voting or on Election Day) is at the City Municipal

Center, which is an open City facility that operates a fully functional Police Station in the

building. We are reminding candidates of this and asking that, for their safety and that of the

voters, candidates not stand in the drive aisles when speaking to voters. We also want to

request that all candidates have adequate space to campaign. Therefore, candidates’ official

set-ups shall only consist of election related materials, a small table and a chair(s).

Candidates must provide their own table/tent/chairs.

5. Schedule for Early Voting Additional Times and Locations

The current Charter and Code allows for the City to have alternate voting locations as long

as they are vetted and approved by resolution of the Council and executive order of the

Mayor. The Board is suggesting the City conduct two early voting sessions for the

upcoming 2020 election.
