ITEM BACKGROUND:Clayton Harlow has submitted an application for a Special Exception for a barber shop operation to belocated in a residential structure at 20 Peters St. The proposed location is zoned R-2 (Single and TwoFamily Residential) which by Bristol Virginia City Code does not allow business uses by right. Theapplicant plans to also reside in the residence. Due to this, the applicant considered only obtaining ahome occupation permit rather than applying for a special exception, however, he determined that thismight limit his business plans. The property is owned by Edward Harlow who also signed theapplication form. Bristol City Code (BCC) does allow a property owner or applicant to request aSpecial Exception to allow a “use of the property which would not otherwise be permitted†(Section 50-39 of BCC). This is not a rezoning request. The special exception process allows for aspecific use to occur without changing the zoning district. It is a normal component of a local zoningordinance to allow flexibility. So far this year, there have been three special exception permitsapproved by the City Council. In 2018, there were no special exception applications processed. Overthe last six years, there have been an average of two special exceptions granted each year. (Forcomparison, Bristol, TN typically has three or four special uses approved per year). City Code Section50-39 provides for a process to consider and approve special exceptions to the zoning ordinance. Aspecial exception is defined as “a use of the property which would not otherwise be permitted in thezone in which the property is situated.†The process must follow state code requirements for a publichearing and a recommendation from the Planning Commission prior to approval by the City Council.Attached is the staff report describing the application, existing conditions, and a preliminary staffanalysis of the application.

8) Request:

9) Background and Existing Conditions:

The subject property is 7,500 square feet (sf) in size (0.2 acres) and in three small parcels that are under the same ownership. The structure was built in the early 1940’s and takes up approximately 1,500 sf footprint on the property. The property is at the corner of Peters Street and Kings Mountain Alley with a frontage of fifty (50) feet on Peters Street. The building is currently vacant but is being renovated by the applicant.

The zoning of the remainder of the block and immediately across the street is R-2. The lot immediately to the north is vacant. The block to the south between Kings Mountain Alley and W. State Street is zoned B-3 (Intermediate Business). Immediately across the alley is an auto parts store and an auto repair shop.Across Peters Street from that commercial property is a furniture store with a large parking lot.

The property has no driveway and only street parking in front. The applicant proposes to create three parking spots in the rear of the structure accessed off the alley. The alley is approximately ten feet wide. There is a wood fence in the rear yard which would have to be removed to create the parking lot. There is also a dilapidated out building on the southwest corner of the tract. The applicant will need to construct a handicapped accessible walkway from the parking lot to the front door of the business.

10) Project Description

The proposed activity will be the establishment of a barber shop on the first floor of the structure. The applicant who is a state-licensed barber proposes to convert a portion of the former living space into space for customers for hair cutting and other related services. A conceptual site plan for the property submitted by the applicant shows three angled parking spaces in the back yard of the property. The applicant plans to be able to hire additional employees as his business grows so may need to expand the parking spaces in the future.

11) Previous Planning Commission Actions: There have been no previous Planning Commission actions related to this request.

12) Authority to Act:

Virginia Code §15.2-2286 (A) (3) provides the authority to City Council to grant special exceptions “under suitable regulations and safeguards.” The process for granting an exception is largely left to the local ordinance or code to define. City Code §50-39 stipulates that a special exception may be granted following due consideration of eight (8) particular questions regarding the impact of the proposed use and the availability of local services for the planned use. A complete application is required along with the applicable fee. The Planning Commission is required to provide a positive or negative recommendation to the City Council following a joint public hearing. The City Council, after hearing comments from the public, shall decide to grant or deny the request based on the facts and evidence presented by the staff, the Planning Commission and the public. Conditions may be attached to the granting of a special exception to address impacts of the proposed use.

13) City and State Code Requirements:

City Code §50-39 stipulates that a special exception may be granted following due consideration of eight (8) particular questions regarding the impact of the proposed use and the availability of local services for the planned use. The Planning Department has circulated the application materials and solicited responses from the various departments responsible for providing services and received the following responses:

1. The sufficiency of streets and public ways to accommodate increased traffic flow, the considered opinion of the City Engineer and of any certified traffic engineer being given particular weight by the council.Staff Response: The city transportation planner states that the public street system can support the establishment of a barber shop at this location. The Engineering Department has requested that the parking spots off the alley be perpendicular rather than angled as the alley carries two-way traffic.

2. The sufficiency of electrical, sewer and water services for the proposed project, the considered opinion of the general manager of the utility board being given particular weight by the council.Staff Response: BVU has reviewed the project and has identified no issues. Electrical power, water, and sewer are on site.

3. The sufficiency of fire, police, garbage, and other services of the City to meet the needs of the proposed project, the opinion of the department head of each department providing such City service being given particular weight.Staff Response: The Bristol, VA fire and police department has reviewed the proposed request and have identified no issues in terms of providing fire protection and law enforcement services. The building will have to meet all applicable fire and building codes, as well as appropriate and safe standards for solid waste disposal. There is a fire hydrant within 500 feet of the structure.

4. The adequacy of protection to adjoining properties and to the air and water of the commonwealth from noise, odor, pollution and health hazards, the opinion of the state health department, state air pollution control board, state water quality control board, being given particular weight by the council.Staff Response: The proposed use of the property is not anticipated to generate any noise, pollution, or health hazards.

5. The impact of the proposed project upon the property values of contiguous property owners as evidenced by the testimony or written opinion of the city's Economic Development Committee Director, a certified property appraiser, or opinion of a realtor licensed by the Commonwealth and regularly listing and selling properties within the City.Staff Response: The proposed use is not expected by city staff to have a negative impact on property values of contiguous properties.

6. Whether the natural topography, natural screening or proposed screening to be put in place by the applicant is sufficient to promote the health, safety and general welfare of the community, to protect and conserve the value of contiguous properties and to encourage the most appropriate use of contiguous properties.Staff Response: Due to the proximity to existing business uses and the lack of residential structures immediately adjacent to the subject property, it is unlikely that buffering will be needed.

7. Any other factor materially affecting the health, safety and general welfare of other citizens.Staff Response: All applicable building and fire code standards will have to be met for life safety issues dealing with fire protection and other concerns.

8. If the project is to construct a parking garage or a parking lot as a primary use of a property in the B-2 district, certain additional requirements must be met, as defined in section 50-108(c)(1) and (2).Staff Response: Not Applicable.

14) Staff Analysis:

Staff has reviewed the circumstances surrounding the application for special exception #05-2019 at 20 Gate Peters Street and has the following analysis:

Consistency with the Comprehensive Plan: One of the major visions expressed in the 2017 City Comprehensive Plan (updated 2019) was making Bristol “the economic hub of the Tri-Cites” and to ensure job growth. A major objective to reach that goal is the revitalization and repositioning of the city’s aging commercial corridors including West State Street. The subject property, although developed originally for residential use, is just beyond one block from West State Street.

The Future Land Use map which is part of the Comprehensive Plan indicates most of the corridor of W. State Street at this location to be “Local Commercial” (which includes retail facilities that provide goods and services for local customers as opposed to interstate-oriented businesses). Although this specific property is shown as Residential, the existing residential structure will be retained and the business activity will not impact the residential uses nearby. Additionally, the close proximity to several businesses to the immediate south and the small size of the property limit its attractiveness for continued residential use.

Compatibility with Surrounding Uses: The conversion of the former residence to business use, especially for personal services such as a barber shop, is compatible with surrounding uses. The property is immediately adjacent to business buildings and there is a vacant lot on the other side of the property.

15) Conclusion:

The staff recommends that the Planning Commission move the application forward to the City Council for a joint public hearing. A final staff report will be presented to the Planning Commission following the public hearing. Conditions could be recommended for the Special Exception permit, if needed.

A Resolution Recognizing Small Business Saturday

Whereas, the Cities of Bristol, Tennessee and Bristol, Virginia celebrate our local small businesses and the contributions they make to our local economy and community; according to the United States Small Business Administration, there are currently more 30 million small businesses in the United States, they represent 99.7 percent of all businesses with employees in the United States, are responsible for 64 percent of net new jobs created over the past 20 years, and

Whereas, small businesses employ over 49.2 percent of all businesses in the private sector

in the United States; and

Whereas, on average, 33 percent of consumers’ holiday shopping will be done at small, independently-owned retailers and restaurants; and

Whereas, 70 percent of adult U.S. consumers are aware of Small Business Saturday; and

Whereas, 42 percent of consumers who reportedly shopped at small, independently-owned businesses on Small Business Saturday did so with friends or family, and 83 percent reported encouraging others to also shop or dine small; and

Whereas, among consumers who said they participated on the day, 41 percent reported that they shopped small online on Small Business Saturday; and

Whereas, among companies that were planning promotions on Small Business Saturday, 92 percent said the day helps their business stand out during the busy holiday shopping season; and

Whereas, the Cities of Bristol, Tennessee and Virginia support our local businesses that create jobs, boost our local economy, and preserve our neighborhoods; and

Whereas, advocacy groups as well as public and private organizations across the country have endorsed the Saturday after Thanksgiving as Small Business Saturday.

Now, Therefore, we, Margaret Feierabend and Neal Osborne, the mayors of Bristol, Tennessee and Virginia do hereby proclaim, November 30, 2019 as Small Business Saturday and encourage the residents of our community, and communities across the country, to support small businesses and merchants on Small Business Saturday and throughout the year.

70th Anniversary

WHEREAS, the young people of Bristol, Virginia are tomorrow’s leaders; and

WHEREAS, many young people need professional youth services to help them achieve their full potential; and

WHEREAS, the Boys & Girls Club of the Mountain Empire has served our youth for 70 years now, beginning in 1949; and

WHEREAS, Boys & Girls Clubs instill young people with the self-confidence to believe they can succeed at anything they put their mind to, and stand at the forefront of efforts in the areas of academic success, healthy lifestyles and good character and citizenship and

Proclamation of Adoption Awareness Month November 2019

WHEREAS, the health and safety of all Virginians is important to the happiness, prosperity, and well-being of our Commonwealth’s families and communities; and

WHEREAS, every child in Virginia, regardless of physical, medical or emotional challenges, age or race, needs love, support, security and a place to call home; and

WHEREAS, children thrive and reach their full potential when given a firm foundation and love from a family with a desire to parent a child who would otherwise not have permanency in their lives; and

WHEREAS, in addition to adoption from foster care, it is appropriate to recognize those who have chosen other adoption options to build a family; and

WHEREAS, it is important for every child who cannot be raised by a birth parent to find a permanent home because children have better outcomes when they are raised in families; and

WHEREAS, there are more than 5,000 children in Virginia’s foster care program and more than 600 children have the goal of adoption and are available for placement in an adoptive home; and

WHEREAS, not all children waiting to be adopted are newborns; many older youth who live in foster care desire to be adopted, just as many siblings who are separated in foster care long to be adopted by the same family, and all of these children want a sense of belonging that adoptive parents can provide; and

WHEREAS, Virginia Heart Galleries have been created throughout the Commonwealth to provide much needed exposure of the faces of our waiting children, and these endeavors can continue their unprecedented successes in finding loving and permanent homes;

NOW, THEREFORE, I, Neal Osborne, do hereby recognize November 2019 as ADOPTION AWARENESS MONTH in the City of Bristol, Virginia, and call this observance to the attention of all our citizens.

AGENDA ITEM WORDING:Resolution of support for Virginia's Great Valley Lewis & Clark Eastern Legacy Trail

ITEM BACKGROUND:In 2015, the General Assembly passed HJ Resolution #566 that designated Virginia's Great ValleyLewis & Clark Eastern Legacy Trail. The trail is 258 miles long and passes through 10 counties andthirteen cities/towns including Bristol. There are 20 historic sites connected to Lewis & Clark'sexpeditions that have been documented, including one at Walnut Grove in Bristol (Lee Highway acrossfrom Home Depot). A sign has been erected at this location to identify and commemorate this history.The all-volunteer organization that has been working on this effort is now seeking funding from the2020 General Assembly for funds to hire an Executive Director. Office space at no cost has beenoffered at the Natural Bridge State Park headquarters. Catherine Brillhart has been serving as arepresentative from Bristol to the organization. She has provided our Department with somebackground information and a draft resolution of support for the City Council to consider. Other Lewis& Clark commemorative sites in the US have reaped substantial tourism tax dollars to those areas. Thedraft resolution supports proposed state funding for staff and support for the "continued development,implementation, and promotion" of Virginia's Great Valley Lewis & Clark Eastern Legacy Trail and itsrelated historic sites.

A REGULAR MEETING OF THE BRISTOL, VIRGINIA, CITY COUNCIL WAS HELD ON MARCH 26, 2019 AT 300 LEE STREET, BRISTOL, VIRGINIA WITH MAYOR KEVIN MUMPOWER PRESIDING. COUNCIL MEMBERS PRESENT WERE VICE MAYOR KEVIN WINGARD, ANTHONY FARNUM, WILLIAM HARTLEY, AND NEAL OSBORNE.CITY MANAGER/INTERIM CITY ATTORNEY, RANDALL EADS, AND CHIEF FINANCIAL OFFICER TAMRYA SPRADLIN WERE ALSO PRESENT.

Mayor Mumpower thanked the citizens in attendance. Mr. Hartley commented on the new documentary featuring Bristol that was screened at the Paramount.

Ginger Fleenor spoke about issues involving the school system. Jack Johnson spoke about trash collection and rate increases.

Mayor Mumpower spoke about financial issues at the landfill. Mr. Wingard spoke about trash collection issues and said that the City should be picking up more construction waste at the rates being charged.

Michael Pollard spoke about collection issues as he was involved in writing the modern trash ordinance.

Mr. Wingard made a motion to table item #2 until the next meeting. Mr. Hartley seconded the motion, which carried by the following votes:

1. Consider Resolution Granting Final Plat Approval for Plat #03-2019 for The Falls -Phase 3.

City Planner Sally Morgan said that the new plat for The Falls Phase 3 includes seven lots and eleven acres. Mr. Farnum asked if anyone on the Planning Commission had concerns; Mr. Wingard responded that they did not. City Manager Randall Eads read the resolution:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRISTOL, VIRGINIA APPROVING THE FINAL PLAT #03-2019 FOR THE FALLS – PHASE 3 SUBDIVISION

The City Council finds that:

WHEREAS, the subdivision plat for The Falls – Phase 3 subdivision has been properly submitted to the City and reviewed by City staff, and

WHEREAS, the Planning Commission met on March 18, 2019 and approved the preliminary plat and the final plat, and

WHEREAS, Section 50-270 requires that the final plat of a subdivision be approved and certified by City Council before it can be recorded.

NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF BRISTOL, VIRGINIA:

The Council approves and certifies the final plat (Plat #03-2019) for The Falls – Phase 3 subdivision as attached in Exhibit A, including the vacation of +/- 0.156 acres of city right-of-way along Lee Highway (Route 11) as shown on the plat.

PASSED AND ADOPTED by the City Council of the City of Bristol, Virginia, at a regularly scheduled meeting of said Council on March 26, 2019.

City Manager Randall Eads said that the presented lease would move the golf cart replacement cycle to three years instead of four, which was in line with the current life span of the golf carts. Mr. Farnum made a motion to approve the lease which was seconded by Mr. Mumpower. Mr. Wingard asked about the batteries used in the golf carts and said he felt the lifespan could be increased with better maintenance. The motion carried by the following votes:

3. Resolution authorizing lease-purchase of trash collection truck.

City Manager Randall Eads said that the trash collection truck had been included in the FY20 budget. Mr. Mumpower made a motion to approve the lease-purchase which was seconded by Mr. Farnum. Mr. Eads read the resolution by caption only:

4. Resolution approving the sale of Clear Creek lot E-23.

Multi-year funding for nonprofits that impact both communities were discussed, including the Birthplace of Country Music Museum, Paramount Theatre, Discover Bristol, and Believe in Bristol. City Managers Randall Eads and Bill Sorah agreed to come up with possible options.

2. Discussion of Bristol Tennessee – Virginia Joint Planning Commission

Discussion of starting the Joint Planning Commission was supported by both bodies who agreed to further discuss the makeup of the commission.

3. Historic Preservation and Historic Zoning Presentation

Bristol, Tennessee staff presented on a grant award that would support the creation of downtown historic zoning guidelines.

A follow up meeting was planned for January 2020, to be hosted in Bristol Virginia.

1. Proclamation recognizing Adverse Childhood Experiences Awareness Month.

City Manager Randall Eads read the proclamation:

Whereas, Bristol TN/VA recognizes that a strong community depends on supporting the development of strong brain architecture and supporting the health and well-being of our children to create a foundation for lifelong health and responsible citizenship; and

Whereas, Adverse Childhood Experiences, or ACEs, are stressful or traumatic experiences, including abuse, neglect, family dysfunction, and community violence which can disrupt the safe, stable, nurturing environments children need to thrive; and

Whereas, ACEs can cause toxic stress, which can affect brain development and lead to a lifetime of physical, mental, economic, educational, and social challenges and have been linked to public health problems such as obesity, addiction, heart disease and hypertension; and

Whereas, the economic burden of ACEs in Tennessee and Virginia is seen in direct medical costs and lost employee productivity, and Bristol’s continued prosperity relies on our current action to prevent these adverse experiences whenever possible and to mitigate their impact when they cannot be prevented; and

Whereas, trauma-informed care is not a therapy or intervention, but a principle-driven, culture change process aimed at shifting a community’s mental model to be more empathetic and resiliency-focused; and

Whereas, adopting innovative, collaborative trauma informed approaches in workplaces, schools, communities and governments can prevent or mitigate mental, emotional, physical, and/or social issues among those impacted by toxic stress; and

Whereas, numerous professionals in the Bristol TN/VA area have received trauma informed care training and in 2019 through Bristol’s Promise launched a Trauma Informed Care Community as best practice following recommendations to do so by the Substance Abuse Mental Health Services Administration (SAMHSA); and

Now, therefore, be it resolved, that Margaret Feierabend, Mayor of Bristol, Tennessee, and Neal Osborne, Mayor of Bristol Virginia, do hereby recognize the month of October 2019 as ADVERSE CHILDHOOD EXPERIENCES AWARENESS MONTH

In Bristol to raise awareness and encourage all residents to become informed about the impacts of ACEs and Toxic Stress, learning about trauma informed approaches that promote prevention, healing and resiliency in children, adults and communities to build a stronger and healthier Bristol.

The Bristol Tennessee and Virginia City Council Members along with partners the Bristol’s Promise Trauma Informed Care Community, Tennessee Department of Children’s Services, Ballad Health, Tennessee Commission on Children and Youth, United Way of Bristol Tennessee/Virginia and others, encourage community leaders, business owners, pastors, educators, coaches, and the public to participate in upcoming educational opportunities by attending the events and trainings during the Month of October for ACEs Awareness Month. Together as City Leaders and community partners, this Proclamation indicates our commitment to exploring ways to make Bristol a resilient community for all its citizens.

WHEREAS, The City Council of Bristol, Virginia recognizes that Goodpasture Motor Company has been a customer-oriented organization since its founding by Frank Goodpasture Sr. and his Father-In-Law, S.T. Copenhaver, Sr. in August of 1919 in Bristol, VA, and;

WHEREAS, In the five-state region surrounding the Tri-Cities, Goodpasture has been synonymous with Trucks, Truck Parts and Truck Service, with a customer list that reads like a who's who in the southern Appalachians spanning the greater part of the twentieth century, and;

WHEREAS, When Goodpasture Motor Company started business truck transportation was just getting established; paved roads were the exception and it was not until 1926 that a fully loaded two-ton truck was driven from New York to San Francisco; and Goodpasture had been in business meeting the transportation needs of the area for many years already, and;

WHEREAS, the owners of Goodpasture Motor Company, past and present, have been deeply involved with service to the City of Bristol, Virginia, through participation in boards, committees, and the Chamber of Commerce, and;

THEREFORE, be it RESOLVED that Neal Osborne, Mayor, and the City Council of the City of Bristol, Virginia do hereby recognize the contributions of Goodpasture Motor Company to our community and congratulate them for their 100th YEAR IN BUSINESS IN THE CITY OF BRISTOL, VIRGINIA.

4. Public hearing regarding three scheduled residential demolitions

Mayor Osborne opened the hearing. City Manager Randall Eads said that the three properties had been deemed hazardous by the building inspector. Mayor Osborne closed the public hearing with no comments made.

5. Public hearing on the issuance of general obligation notes for the purchase of real property.

Mayor Osborne opened the hearing. City Manager Randall Eads said that the public hearing was required in order to finance the purchase of a building for the Department of Social Services. Michael Pollard asked about interest rates. Mayor Osborne closed the hearing.

6. Resolution Authorizing the Issuance and Sale of General Obligation Notes of the City of Bristol, Virginia.

City Manager Randall Eads said the resolution would authorize the financing for the DSS building purchase. Vice-mayor Hartley made a motion to read the resolution by caption only which was seconded by Mr. Farnum. The motion carried by the following votes:

Mr. Wingard said he did not support financing the building purchase. Vice-mayor Hartley said he felt the city needs to have cash on hand to address needs that may come up during the year that are not budgeted which Mr. Farnum and Mayor Osborne agreed with.

7. Release from Performance Agreement. Contractual Obligations for Studio Brew.

City Manager Randall Eads said that Studio Brew requested a release from their performance agreement with the city having met most of the requirements since opening for business. Mr. Farnum made a motion to release Studio Brew from their performance agreement with contractual obligations as amended. Vice-mayor Hartley seconded the motion. Mr. Eads mentioned that the agreement did require a repayment to the city should Studio Brew close or sell the business prior to the original end date from the performance agreement.

AYES: Farnum, Hartley, Osborne.

NO: Wingard.
