A. CALL TO ORDER – Deputy Mayor Randy McKibbin called the special meeting to order in the main conference room of Suite 200 in the Justice & Municipal Center. In addition to Deputy Mayor McKibbin, elected officials attending were Councilmember Terry Carter, Councilmember Justin Evans, Councilmember Michelle Surdez, Councilmember Dan Swatman and Councilmember Tom Watson. Councilmember James Rackley was absent due to illness. Staff members in attendance were City Administrator Don Morrison, and Administrative Services Director/City Clerk Harwood Edvalson.

B. DISCUSSION: Utility operations, revenues, expenditures, and projects.

The City Council began with a discussion of the utility revenues and the impact of the 12% increase in water rates authorized over the past two years. Councilmember Swatman said he would like to see stabilization in the rates and questioned the impact of the recent rate increase triggered by the increase in the Consumer Price Index (CPI). Councilmember Watson said recent financial data shows the water utility expenditures have been exceeding revenues. He suggested increases are needed now to reduce the need for greater future increases. Councilmember Surdez added long-term solutions are needed. Councilmember Watson observed that the current revenue problems were created years ago by delaying rate increases in the water utility. He proposed a reduction in sewer rates to moderate the overall impacts to the utility customer of an increase in the water rates. The Council briefly discussed this proposal. City Administrator Morrison pointed out that balancing rate impacts between sewer and water is what got the water utility in its current state. Deputy Mayor McKibbin said the Council simply looked at the bottom line to the consumer the last time they made rate decisions and didn’t consider the separate impacts on the individual utilities.

Councilmember Evans asked if the Council has the authority to set the rates where they feel they should be. City Administrator Morrison said the Council has the obligation to have a well-run and maintained water system. He pointed out that the Council spent money to hire the FCS Group and RH2 to establish the rates needed to support the City’s utilities. Councilmember Surdez said the variables are the capital projects the City needs to do and their timing. City Administrator Morrison said if the rates could be increased to get the utility out of the negative cash flow, then the City could get back with its consultants and really look again at the capital projects.

Councilmember Surdez asked if the City had taken a close look at the utilities’ operations. Deputy Mayor Swatman said the Council could more closely scrutinize the utility operations, but he felt there are not great sums of money to be recovered there. Councilmember Evans noted that operational expenses had increased almost $1.4 million between 2016 and 2017. City Administrator Morrison said the increase correlates with the increase in bond payments which fall in this category of operational expense. Councilmember Carter said the utility rates should be able to pay for the product provided. Councilmember Surdez said the utility rates need to be established with solid justification and asked if the rates are reviewed annually rather than relying on a CPI adjustment. Councilmember Swatman and City Administrator Morrison said an increase based on the CPI is reasonable to cover actual changes in the marketplace for the cost of goods, services and labor. Both Councilmember Surdez and Deputy Mayor McKibbin observed that compared to other parts of the United States, the water rates in Bonney Lake are very reasonable.

City Administrator Morrison announced the Mayor is intending to hold an open house, perhaps on Saturday, March 3rd to include a historical perspective of the City’s utilities from RH2 Engineering and an explanation of the rate study produced by the FCS Group, followed by a question and answer period with the participants. Deputy Mayor McKibbin said it sounded like a good educational opportunity for the customers.

Councilmember Watson said the Council knows what needs to be done based on the current rate study. City Administrator Morrison said the State Department of Health is closely watching the City’s actions in funding the utilities. There is the potential that without proper funding the City’s system will be flagged as out of compliance, and eventually taken over and rates imposed to bring the utility back into a state of proper operation and fiscal funding. Councilmember Surdez said the Council needs to look rationally at the water utility and not make decisions based on scare tactics. Deputy Mayor Swatman suggested the utility operations may include some industry best practices that are not truly necessary and have increased expenses. City Administrator Morrison proposed checking with the consultants to see if a cost of service study could be done quickly and without major expense. Councilmember Surdez suggested this be done before taking action on another rate increase.

The City Council concluded to ask the administration to investigate the time required and cost associated with a cost of service study. They asked that results of that investigation be presented at the February 20th Council workshop along with the Chief Financial Officer providing more detailed projections for 2018 to include the impacts of the 3% CPI increase implemented in January 2018. Councilmembers Surdez and Watson applauded the Mayor’s proposed workshop and suggested the customers need more education regarding the utilities’ summer rates before the rates go into effect. City Administrator Morrison said the Executive Department is working on those communication pieces.

I. CALL TO ORDER – Mayor Neil Johnson, Jr. called the workshop to order at 6:00 p.m.

ROLL CALL: Administrative Services Director/City Clerk Harwood Edvalson called the roll. In addition to Mayor Johnson, elected officials attending were Deputy Mayor Randy McKibbin, Councilmember Terry Carter, Councilmember Justin Evans, Councilmember James Rackley, Councilmember Michelle Surdez, Councilmember Dan Swatman, and Councilmember Tom Watson. Planning Commissioners in attendance were Vice Chair David Baus, Commissioner Brad Doll, Commissioner L. Winona Jacobsen, Commissioner Dennis Poulsen, and Commissioner Debbie Strous-Boyd. Planning Commission Chair Grant Sulham and Commissioner Craig Sarver were absent.

Staff members in attendance were City Administrator Don Morrison, Administrative Services Director/City Clerk Harwood Edvalson, Chief Financial Officer Cherie Gibson, Police Chief Dana Powers, Public Services Director John Vodopich, City Attorney Kathleen Haggard, Deputy City Clerk Susan Haigh, Public Works Superintendent Ryan Johnstone, and Planning & Building Supervisor Jason Sullivan.

II. AGENDA ITEMS:

A. Planning/Council Discussion: AB18-04 – Resolution 2629 – A Resolution of the City of Bonney Lake, Pierce County, Washington Adopting the Planning Commission Work Plan for 2018-2019.

Planning & Building Supervisor Jason Sullivan reviewed the draft plan and explained the revised format. The proposed work plan includes: a review of permit fees; pre-zoning of potential annexation areas (Country Highlands and an area between 112th and S Prairie Rd); school district property annexations; Future Land Use Designation implementation; review of Code Enforcement and Public Nuisance regulations; updates to zoning regulations; watershed planning; updates to landscaping and clearing codes; an update to the Critical Areas code; the Shoreline Master Program update; small cell facilities regulations; the Puget Sound Regional Council’s ‘VISION 2050’ region plan; and updates to the sewer system plan.

Councilmembers and Commissioners discussed the process for review and approval of proposed updates and future ordinances. Several Councilmembers said they preferred reviewing Comprehensive Plan updates and other complex items as individual discussion items throughout the year rather than as a single year-end action item.

Commissioner Strous-Boyd said it is important to involve the Design Commission in review of design-related code updates and suggested the Planning Commission hold a joint meeting with the Design Commission. Commissioner Baus suggested the City consider increasing the size and detail on notice signs at commercial development sites; he said they are small compared to other city’s signage. Mr. Sullivan said this could be included in review of the fee schedule. Councilmembers thanked staff for the improved format of the work plan. Planning Commissioners provided feedback and other suggestions.

B. Planning/Council Presentation: Stormwater Basin Plan – Parametrix. (No Advance Materials.)

Mr. Sullivan introduced Paul Fendt from Parametrix, who explained that the City received grant funds to complete the Stormwater Basin Plan. He summarized the study to develop the plan, basin-specific stormwater requirements, and the capital projects and implementation plan. He said Bonney Lake is considered a ‘Phase 2’ community under the National Pollutant Discharge Elimination System (NPDES) permit. He said the City will need to address ‘retrofitting’ planning in its next NPDES permit and provided recommendations on how to address this requirement based on the stormwater study. Moving forward, the City needs to adopt the basin plan, obtain approval from the Department of Ecology, adopt basin-specific standards, and adopt low-impact development feasibility standards.

Mr. Sullivan said a lot of the study for this plan can be used in the City’s upcoming NPDES permit process. He said he plans to have the draft plan ready for a Planning Commission public hearing in April. After this it will be forwarded to the Council for adoption, and then for approval by the Department of Ecology. Councilmembers requested a copy of the draft plan for review.

Mayor Johnson thanked the Planning Commissioners for participating in the joint meeting with Councilmembers.

At 6:58 p.m. the Special Joint City Council/Planning Commission Meeting was adjourned, followed immediately by the regular Council Workshop.

C. Review of Draft Minutes: January 2, 2018 Workshop, January 9, 2018 Meeting, January 20, 2018 Council Retreat, and January 23, 2018 Meeting.

The minutes were forwarded to the February 13, 2018 Meeting for approval with minor corrections.

Abandoned Vehicle: Councilmember Watson asked about a car that was dumped at the creek. Director Vodopich said staff responded to the report and will need to get a tow truck to remove it.

Water Rates: Councilmember Watson said he spoke with a resident in another community about outreach and communication provided to customers about proposed utility rate adjustments. He said customers feel better about the process when they have good communication.

Park Board: Councilmember Swatman said another Park Commissioner has resigned. He said the Council needs to consider how to deal with park-related issues. Mayor Johnson said he has been thinking about this in relation with the pool interest group. He said a combined plan for Midtown Park and a pool may be more than the City can handle on its own. He said one option would be for the aquatics interest group to form a pool district, while the City worked separately on a parks plan. Councilmember Swatman said there is value in an aquatics center, but it needs to be fiscally responsible. He said the School District is not interested in managing an aquatics center and the interest group needs to work on a plan. Councilmember Watson said the various groups need to keep connected if they want to move forward in an intentional way, not work separately. CFO Gibson and Mr. Sullivan provided background from their experience at another city (Des Moines) which set up a Metropolitan Parks District (MPD) including both a pool and parks. They warned that setting up a MPD specifically for a pool might cut off the option to include parks in a future MPD.

Deputy McKibbin said now may be a good time to start working on a MPD proposal and facilitating conversations with the aquatics program group. Councilmember Evans and Mayor Johnson noted that issues related to parks and pools are very different and could negatively impact each other. Mayor Johnson said a plan with benchmarks and targets is needed so people don’t waste their time and not make progress. Mayor Johnson said he could set up a meeting between Councilmembers, citizens, and others interested in working on the process to meet and form a plan to move forward.

Councilmembers briefly discussed the status of the Park Commission, noting they currently do not have enough members to have a quorum for meetings.

Building key card system: Councilmember Evans said he attended the last Finance Committee meeting which included discussion of the electronic key-card system for the Justice & Municipal Center building. He said the proposed project costs $35,000 and he feels the funds could be better spent elsewhere. He said the system will not include all the doors and it is not a pressing issue.

Pierce Transit: Mayor Johnson said he recently met with Pierce Transit representatives and they discussed future system planning and needs for transit on the plateau. He said he has previously suggested an ‘on-demand’ transportation

option for the plateau area. Councilmembers briefly discussed use of the Sound Transit shuttle to the Sumner train station.

III. EXECUTIVE/CLOSED SESSION:

Pursuant to RCW 42.30.110(1)(i), the Council adjourned to an Executive Session with the City Attorney at 7:20 p.m. for 15 minutes to discuss potential litigation. The Council returned to chambers at 7:32 p.m. No action was taken.

IV. ADJOURNMENT:

At 7:33 p.m. the Workshop was adjourned by common consent of the Council.

When enacted, the intention of this code was to be an infraction that would not affect the driver's Department of Licensing (DOL) driving abstract. ORDINANCE NO. D18-24 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BONNEY LAKE, PIERCE COUNTY, WASHINGTON, AMENDING CHAPTER 10.04.026 OF THE BONNEY LAKE MUNICIPAL CODE AND ORDINANCE NO. 1360 RELATING TO INATTENTIVE DRIVING.

WHEREAS, per Bonney Lake Municipal Code (BLMC) 10.04.026 it is unlawful for any person to operate a motor vehicle within the City of Bonney Lake in an inattentive manner; and

WHEREAS, due to a Department of Licensing (DOL) change, an amendment is needed to ensure the Bonney Lake Municipal Code retains its original purpose;

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF BONNEY

LAKE, WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. BLMC Section 10.04.026 and Ordinance No. 1360 § 1 are hereby amended to read as follows:

10.04.026 Inattentive driving. It is unlawful for any person to operate a motor vehicle within the city in an inattentive manner. For the purposes of this section, “inattentive manner” means the operation of a motor vehicle in a manner that evidences a lack of degree of attentiveness required to safely operate the vehicle under the prevailing conditions, including, but not limited to, the nature and condition of the roadway, presence of other traffic, presence of pedestrians, and weather conditions. The offense of operating a motor vehicle in an inattentive manner shall be considered to be a lesser offense than, but included in, the offense of operating a motor vehicle in a negligent manner. Unless otherwise set out in applicable law or court rule, any person who violates the provisions of this section shall be guilty of a traffic civil infraction punishable by a monetary value not more than $250.00, plus assessments. Section 2. This Ordinance shall take effect and be in force five (5) days from

and after its passage, approval and publication, as required by law.

Background Summary: The Police Department has had a full time funded Department Assistant position for 16 years. The incumbent occupying the position requested to work on a part time basis, a request was approved for many years. The City has been engaged in contract negotiations with the Bonney Lake Police Guild since early fall and there has been discussion regarding the need for a Confidential Administrative Assistant position that can assist with a variety of duties that would be considered non-union work. Although the negotiation of the expired Guild contract has been on hold awaiting mediation, the City has continued discussions with the Guild regarding this position. The Guild recently notified the City that they have no objection to filling the position as non-represented. The incumbent retired in January and as such, the change in duties and position will not have an effect on a current employee. It is anticipated that this change would not add a position to the department; however, a title change to the position authorization table in the budget will need to be included in the 2019/20 budget. This position will be placed on the Non-Represented Grade Matrix at a grade 10, the matrix will be adjusted accordingly in the future. This motion will authorize the position as a replacement to the Department Assistant and placement of the Confidential Administrative Assistant on the Non-Represented Grade Matrix.
